Abstrak :
Penelitian ini bertujuan untuk menganalisis efektivitas pelaksanaan pasal 61 Undang-Undang no. 6 Tahun 2011 tentang Keimigrasian yang secara khusus telah memberikan peluang bagi warga negara asing yang menikah dengan warga negara Indonesia beserta anak hasil perkawinannya untuk dapat tinggal dan melakukan pekerjaan atau usaha di Indonesia. Metode penelitian ini menggunakan deskriptif yang memberikan gambaran mengenai kondisi atau hubungan yang ada, pendapat yang berkembang, proses yang sedang berlangsung, akibat atau efek yang terjadi, dan tentang kecendrungan yang tengah berlangsung. Diperlukan responden-responden yang dianggap mampu dan mempunyai kompetensi untuk memberikan informasi tentang masalah penelitian ini. Dari hasil penelitian dapat disimpulkan bahwa pelaksanaan undang-undang tersebut belum sepenuhnya berjalan efektif karena masih disharmonis dengan aturan yang ada di bidang ketenagakerjaan. Ketidakpastian hukum yang dirasakan para subjek perkawinan campuran di Indonesia menjadi kendala serius sebagai akibat terjadinya disharmonisasi peraturan tersebut. Atas dasar hal tersebut, pemerintah Indonesia semestinya harus segera mengatasi permasalahan disharmonisasi peraturan tersebut. ......This research is to analyze the effectiveness of the implementation of article 61 of the Act No. 6 year 2011 concerning Immigration, which has provided opportunity for any foreigners who are married to an Indonesian, also for any children  born to this marriage, to live and to work or to have business in Indonesia. The research utilized a descriptive method which provides description of condition or relations, developed ideas, undergoing processes, results or effects, and also of continuing trends in the matter. The respondents needed to this research are those who considered to be qualified in  having competencies to give information regarding the object of the research. The research  has concluded in a conclusion that the implementation of the said law has not yet been effective, as there were still disharmony between those law and manpower regulations. The legal uncertainty, felt by those who are the subject of mix-marriage in Indonesia, still becomes  serious challenges that resulted from the disharmony. Therefore, the research  recommends the Government of Indonesia to immediately resolve the disharmony between those law and manpower regulations.
