Abstrak :
Skripsi ini membahas tentang penerapan Herfindahl-Hirschmann Index (HHI) oleh KPPU dalam pendapatnya untuk menilai, apakah suatu proses merger maupun akuisisi berpotensi untuk menimbulkan pasar monopoli ataupun persaingan usaha tidak sehat. Penelitian dilakukan dengan menganalisis beberapa pendapat KPPU atas beberapa proses akuisisi. Penelitian dilaksanakan guna memastikan kesesuaian penggunaan HHI dalam pendapat KPPU dengan peraturan perundang – undangan terkait persaingan usaha yang berlaku, serta menggambarkan keberagaman penentuan pasar bersangkutan oleh KPPU guna menghitung tingkat persaingan. Bentuk penelitian skripsi ini adalah penelitian yuridis-normatif yang dilakukan melalui studi kepustakaan. ......This skripsi discusses the implementation of the Herfindahl-Hirschmann Index (HHI) by KPPU in its opinion to assess, either a merger or acquisition process has the potential to create a monopoly market or unfair business competition or not both. The research was conducted by analysing several opinions of KPPU on several acquisitions process. The research is carried out to ensure the suitability of the use of HHI in the opinion of KPPU with the prevailing laws and regulations related to business competition, as well as describing the diversity in determining the relevant market by KPPU in order to calculate the level of competition. The form of this skripsi’s research is juridical-normative research conducted through literature research.
