Abstrak :
Tesis ini membahas kekuatan pembuktian sertifikat dan bukti Letter C, cara memperoleh kedua bukti tersebut agar menjadi hak milik masing - masing pihak dan putusan hakim masing - masing peradilan. Penelitian ini bersifat deskriptif analitis, berbentuk preskriptif dan bertujuan explanation atau penjelasan yang berfokus pada masalah dengan ilmu monodisipliner yaitu ilmu hukum. Hasil Penelitian menyarankan perlunya sosialisasi kepada masyarakat agar melakukan proses pendaftaran hak atas tanah, dan pentingnya melakukan transaksi jual beli tanah harus sesuai dengan Hukum Pertanahan Nasional, serta dalam kasus tersebut hakim perlu penggalian hukum yang lebih luas agar putusan yang dihasilkan tegas dan adil bagi para pihak yang bersengketa.

The focus of this study is the proof of title power between building rights title and Letter C, how to grant each of the title by parties and the decisions of judge discretion on each level of court. This research is descriptive analytical with problem focused research and law as the science to answer all the problems on this study. This study suggest the need for socialization of land registration process to the public, and the importance of land sells transaction in according with National Land Law, as well as in this case the Judges need more exploration about the law to result a firm and fair decisions to the parties.
