"Jakarta is one of the areas with high urbanization number and its impacts, so it requires Local Government to control the urbanization to minimize its negative impacts. On the other hand, the rights to freedom of movement and residence throughout the territory of Indonesia are guaranteed by the Law. So, this study becomes important to know how the efforts of Jakarta Provincial Government to control the urbanization as seen in human rights perspective. This study uses a qualitative approach and descriptive method. This paper argues that the urbanization control by Jakarta Local Government with orderly administration approach is not effective to control the urbanization and only created constraints of people movement and this policy violates the right to freedom movement and residence. It further sug¬gests that the orderly administration approach should be replaced by the human rights approach in controlling the urbanization in Jakarta if it is to seek better policy."

"Cosmopolitanism, as an intellectual and political project, has failed. The portrayal of human rights, especially European, as evidence of cosmopolitanism in practice is misguided. Cosmopolitan theorists point to the rise of claims-making to the European Court of Human Rights (ECtHR) among Europe's Muslims to protect their right to religious freedom, mainly concerning the hijab, as evidence of cosmopolitan justice. However, the outcomes of such claims-making show that far from signifying a cosmopolitan moment, European human rights law has failed Europe's Muslims. Human Rights, Islam and the Failure of Cosmopolitanism provides an empirical examination of claims-making and government policy in Western Europe focusing mainly on developments in the UK, Germany, France, Italy and the Netherlands. A consideration of public debates and European law of conduct in the public sphere shows that cosmopolitan optimism has misjudged the magnitude of the impact claims-making among Europe's Muslims. To overcome this cul-de-sac, European Muslims should turn to a new 'politics of rights' to pursue their right to religious expression. Against this backdrop, legal scholars and human rights advocates have encouraged integration of human rights into the discourse of counterterrorism as the best way to counter such repression and violence. This book challenges that received wisdom by showing the ambiguous effects of such converged discourse on developing countries. "Having articulated numerous human rights norms and standards in international treaties, the pressing challenge today is their realisation in States' parties around the world. Domestic implementation has proven a difficult task for national authorities as well as international supervisory bodies. This book examines the traditional State-centric and legalistic approach to implementation, critiquing its limited efficacy in practice and failure to connect with local cultures. The book therefore explores the permissibility of other measures of implementation, and advocates more culturally sensitive approaches involving social institutions. Through an interdisciplinary case study of Islam in Indonesia, the book demonstrates the power of social institutions like religion to promote rights compliant positions and behaviours. Like the preamble of the 1948 Universal Declaration of Human Rights, the book reiterates the role not just of the State but indeed 'every organ of society' in realising rights."
