This second edition of International Environmental Law, Policy, and Ethics revises and expands this groundbreaking study into the question of why the environment is protected in the international arena. This question is rarely asked because it is assumed that each member of the international community wants to achieve the same ends. However, in his innovative study of international environmental ethics, Alexander Gillespie explodes this myth. He shows how nations, like individuals, create environmental laws and policies which are continually inviting failure, as such laws can often be riddled with inconsistencies, and be ultimately contradictory in purpose. Specifically, he seeks a nexus between the reasons why nations protect the environment, how these reasons are reflected in law and policy, and what complications arise from these choices.

Natural resource conservation programs like reforestation, terracing, the construction of small scale water reservoirs and alley cropping can be offered to communities living along river watershed areas to protect the environment. The community?s response and willingness to pay (WTP) varies. Related to the environmental conservation programs above, this research was carried out in the Citarum River Basin in West Java, covering the upstream area in Bandung District, the middle stream area in Cianjur District and the downstream area in Karawang Sub-District. The Contingent Valuation Method (CVM) was employed to analyze WTP by communities in the Citarum River Basin for the various programs on offer and the factors that influence WTP in order to obtain recommendations and policy implications for program implementation. The research showed that communities were quite willing to pay for conservation programs; downstream communities were even ready to participate in preventing environmental degradation in upstream areas as this negatively impacts their own communities.

Merbau (Intsia bijuga) has high economic value as a source of timber, and its bark and leaves are used in traditional medicines. The survival of this species is threatened in its natural habitat. So, action has been undertaken to support its survival and to upgrade its conservation status by ex situ propagation of seedlings, and by re-planting seedlings in their natural habitat. Nevertheless, the conservation status of merbau is still threarened.

Abstrak :
Psophocarpus scandens (Endl.0 Verdc. is a member of a small genus of leguminous plants that includes the vegetable crop, winged bean. Some plants of P. scandens, an endemic of tropical Africa, were recently found growing uncultivated in site XIX.P within Bogor Botanic Gardens. It is possible these plants are descendants from experements carried out iin the Gardens in the 1970s, or even possible from original plants recorded in Bogor as early as 1842. This plants has trifoliate leaves and attractive blue butterfly-like flowers, smaller in size that the domesticated winged bean. Its small winged pods are a popular bush food in Africa, but unlike the domesticated winged bean, P. scandens has the potential to be weedy. At times, it has been used as a leguminous cover crop in the plantation industry.

The management of natural resources is authorized with local regulations when dealing with forest community and legal law including some parties from outside of particular forest area. The two contrasts between the local and national regulations have frequently taken place as result of conflict of interest. Therefore some questions arise: how is the development of such conservation areas meet with the local regulation or adat? Is the activity to make use of the resources by the community remains possible? To response to the question the writer would like to argue that assessment of how a national park management interact with local regulations and hak ulayat or communal rights, one should aware of the contexts of their interaction as well as the following aspects: historical, adat law, economical, institutional and the dynamic of local politics. These have to be emphasized since the national park policy in Indonesia can be seen as the manifestation of state territorialization which results in the marginalization of adat community. All parties' interests in natural resources are consider as national citizen and legally authorized to manage or exploit the resources inside the country's territory. Cases from the four national parks observed concluded that even when they live in around the parkas indigenous, they are not automatically awarded their traditional rights or access to make use of the parks.

Tesis ini secara umum mengeksplorasi bagaimana sistem tenurial lahan dan sumber daya alam yang dijalankan oleh masyarakat matrilineal. Secara khusus tesis ini menelusuri posisi perempuan dalam sistem tenurial lahan dan sumber daya alam di masyarakat matrilineal tersebut. Penelitian ini merupakan penelitian kualitatif berperspektif feminis dengan menggali secara mendalam sejarah dan pengalaman hidup perempuan. Tekhnik pengumpulan data dilakukan dengan penelusuran sejarah suku, silsilah keluarga, sejarah kehidupan perempuan, wawancara mendalam, diskusi terfokus dan observasi terlibat. Teori yang digunakan adalah ekologi politik feminis Feminist Political Ecology . Hasil penelitian menunjukkan bahwa perempuan memiliki peran penting dalam sejarah pembukaan dan pengolahan lahan dan sumber daya alam. Perempuan berperan sama dengan laki-laki ketika membuka lahan, berladang kemudian mengolahnya menjadi kebun. Perempuan juga berperan dalam sejarah berkembangnya sebuah perkampungan. Perkebunan dan tanah yang telah diolah kemudian dimiliki oleh perempuan. Perempuan juga secara aktif terlibat dalam pembangunan desa yakni dengan memberikan sebagian tanahnya kepada suku lain yang memerlukan pemukiman. Di tingkat keluarga inti dan keluarga saparuik sumber daya dan lahan matrilineal dikelola oleh perempuan meliputi kebun karet, ladang, tanah dan rumah. Tradisi matrilineal dalam sistem tenurial lahan dan sumberdaya alam masih berlangsung hingga kini. Namun demikian, sumber daya matrilineal mengalami tekanan yang dipengaruhi oleh nilai, ekologi dan politik. Walau perempuan merupakan subyek utama dalam tradisi waris sumberdaya matrilineal, namun perempuan bukan pemegang otoritas atas tata kuasa lahan dan sumberdaya matrilineal. Kepemilikan hak perempuan atas tanah hanya klaim de-facto . Ini berarti bahwa meskipun perempuan adalah subjek utama dalam tradisi pewarisan, namun perempuan tidak memiliki otoritas untuk klaim de-jure di tingkat yang lebih tinggi, baik pada tingkat suku dan nagari. Selain itu, perempuan tidak terwakili dalam struktur suku dan kelembagaan adat di masyarakat matrilineal di Gajah Bertalut. Lebih jauh, kepemimpinan adat oleh perempuan tidak pernah terjadi di dalam suku maupun nagari. Perubahan sistem tenurial lahan dan sumber daya alam mulai terjadi melalui pengambilan keputusan oleh laki-laki datuk selaku pemimpin adat, yakni sebagai pemegang kekuasaan di tingkat suku dan nagari, serta melalui berkembangnya konsep kepemilikan individu atas nama laki-laki. Program-program yang dikembangkan pemerintah dan LSM menempatkan laki-laki sebagai Kepala Keluarga dan pemimpin di tingkat keluarga inti/rumah tangga. Hal ini menyebabkan kerancuan dalam keberlangsungan sistem tenurial lahan dan sumber daya alam di masyarakat matrilineal. Kata Kunci: posisi perempuan, matrilineal, tenurial lahan, sumber daya alam. ...... This thesis explored how land tenure and natural resources systems are run by the matrilineal community. It is also the thesis talked particularly in how the position of women in land tenure and natural resources systems especially in the matrilineal society. The research was a qualitative research and used feminist perspective by deeply explore herstory and life experience of women. Data collection techniques were conducted by tracing the herstory of tribes, family pedigrees, women 39 s life herstory, in depth interview, focused group discussions and observation. The data was analyzed by using the Feminist Political Ecology theory. The results of the research showed that since the village established, the women has the same role as men in land clearing, farming and rubber planting. The plantation and its land were then owned by the women. Women also actively involved a role in the herstory of the development of the village by giving part of her land to other clan as necessary. Women is manager of land and resources matrilineal in the core and extended family level, including rubber plantations, fields, land and houses. The matrilineal tradition in land and natural resource tenure systems has been run for long time ago and it still prevail until now . However, matrilineal resources are under pressure that is influenced by value, ecology and politics. The women ownership right on the land is only ldquo de facto claim rdquo . It means that although the women are the main subject in the tradition of inheritance, however the women do not have an authority for ldquo de jury claim rdquo on high level clan and nagari structure. In addition, women are not represented in tribal and institutional structures of adat in matrilineal societies in Gajah Bertalut Village. Furthermore, indigenous leadership by women has never occurred in tribes or nagari. Changes in land tenure and natural resources systems began through decision making by datuk as adat leader, as well as through the development of the concept of individual ownership in land the name of men. Programs developed by government and NGOs had placed the men as heads of the households and leaders at the core family household level thus these led to obscure the sustainability of land tenure and natural resources systems in the matrilineal community.
