"Skripsi ini membahas mengenai tinjauan yuridis mengenai pengaturan syarat, tatacara pengalihan, serta tahapan-tahapan dan proses dari perjanjian pengalihan hak atas rumah negara pada lingkungan institusi TNI berdasarkan peraturan perundang-undangan di Indonesia. Selain itu, dalam skripsi ini juga akan dibahas mengenai keabsahan hukum atas pengalihan hak atas rumah negara pada lingkungan institusi TNI, apabila dalam proses pengalihannya tersebut tidak berdasarkan kepada ketentuan peraturan perundang-undangan yang berlaku. Metode penelitian dalam kegiatan penelitian ini adalah penelitian yang bersifat yuridis-normatif, artinya kegiatan penelitian ini dilaksanakan melalui penelitian kepustakaan hukum dan norma hukum tertulis yang berasal dari peraturan perundang-undangan untuk menjelaskan mengenai peristiwa hukum yang diteliti dalam penelitian ini. Penelitian ini menunjukan bahwa pengalihan hak atas rumah negara di lingkungan institusi TNI mempunya syarat-syarat yang harus dipenuhi oleh subjek maupun objek hukumnya, dan mempunyai tatacara dan tahapan perjanjian pengalihan yang menggunakan perjanjian sewa-beli dan mempunyai akibat hukum. Serta pengalihan hak atas rumah negara di lingkungan institusi TNI yang dilakukan tidak sesuai dengan peraturan perundang-undangan merupakan suatu tindakan penyimpangan hukum dan dapat menimbulkan sanksi terhadap subjek hukum yang melakukannya.

This thesis discusses the judicial review of requirements and procedures for the transfer arrangement, the stages and processes of the agreement on transfer of the ownership to the state house in military institutional (Indonesian National Armed Forces) based on the laws in Indonesia. Moreover, in this thesis will also discuss about the legal validity on the transfer of ownership to the state house in military institution, if the transfer process is not based on the provisions of the legislation in force. The research method in this research is a juridical-normative study, which the research activities carried out by the research literature and written legal norms derived from legislation to explain the legal events examined in this study. This study shows that the transfer of ownership to the state house in the military institution possessed requirements must be met by the subject and object of the law, and it has procedures and stages of the transfer agreement which uses a lease-purchase agreement and a legal effect. Then, the transfer of ownership to the state house in the military institution which do not comply with the legislation is an act that could lead to violations of the law and legal sanctions against subjects who did it."
