"Perkawinan bertujuan untuk membentuk suatu keluarga yang bahagia. Namun, seringkali tujuan ini tidak tercapai dan perceraian pun terjadi. Perceraian tidak melepaskan tanggung jawab kedua orang tua untuk melaksanakan pemeliharaan kehidupan anak-anak yang dihasilkan dari perkawinan tersebut. Dalam memenuhi kewajiban ini, negara dapat ikut campur dengan pembuatan pengaturan yang menjamin terpenuhinya kesejahteraan anak pasca perceraian. Menggunakan metode yuridis normatif, penelitian ini melaksanakan perbandingan antara hak alimentasi anak di Indonesia dengan tunjangan anak di Selandia Baru. Hasil penelitian ini menunjukan bahwa Indonesia memiliki pengaturan hak alimentasi anak yang sporadik dan tidak mengatur hak alimentasi anak untuk seluruh masyarakat secara komprehensif dan spesifik. Sebagian besar penentuan jumlah hak alimentasi anak hanya didasarkan pada kebijaksanaan hakim dan/atau yurisprudensi. Berbeda dengan Selandia Baru yang telah memiliki pengaturan tertulis yang terpusat dan komprehensif mengenai tunjangan anak. Hal ini pun telah memberikan kepastian hukum bagi masyarakat di Selandia Baru. Maka, dapat disimpulkan bahwa Indonesia masih tertinggal dalam pengaturan hak alimentasi anak. Dengan demikian, pengaturan di Indoensia dapat diperjelas demi tercapainya kepastian hukum bagi masyarakat Indonesia. Dalam melaksankan hal tersebut, pemerintah Indonesia dapat menggunakan pengaturan di Selandia Baru sebagai acuan agar kesejahteraan anak di Indonesia dapat dilindungi dan terjaga dengan lebih baik lagi.
A marriage has a purpose to build a happy family. However, often times, this purpose is failed to be achieved, resulted in a divorce. A divorce does not remove the responsibilities of both parents to maintain and ensure their children’s livelihood. In fulfilling this obligation, the state can interfere by making regulations to ensure the fulfilment of children's welfare after a divorce. Using a judicial-normative method, this study conducted a comparison between the child alimony rights in Indonesia and child support in New Zealand. The results of this study indicates that Indonesia has a sporadic regulation and there is no specific nor comprehensive regulation about child alimony rights. Therefore, the determination of the amount of child alimony rights mostly based on a judge’s discretion and/or jurisprudence. In contrast to New Zealand that already has a centralized and comprehensive written law regarding child support. As a result, it has provided legal certainty for the people in New Zealand. It is concluded that Indonesia is still left behind in terms of child alimony rights regulation. Thus, the regulations in Indonesia can still be improved in order to achieve legal certainty. In implementing this, the Indonesia government could use the regulations in New Zealand as a reference so that the welfare of children in Indonesia can be better protected and maintained."
