"ABSTRACTNegara Indonesia adalah  Negara yang menganut bentuk Negara Kesatuan (Unitary) berdasarkan UUD 1945. Undang-undang Nomor 23 Tahun 2014 Tentang Pemerintahan Daerah memberikan keweenangan pemerintah pusat mengawasi Peraturan Daerah secara Executive Review melalui pembatalan Peraturan Daerah tersebut. Seteleah terbitnya putusan MK No. 137/PUU-XIII/2015 dan  Putusan MK No. 56/PUU-XIV/2016, kewenangan tersebut dianggap Inkonstitusional. Bentuk dari penelitian ini adalah yuridis-normatif, penelitian ini dilakukan dengan cara meneliti asas-asas, baik yang tertulis maupun tidak tertulis. Peneltian ini membahas kedudukan peraturan daerah dalam penyelenggaraan pemerintahan daerah, bentuk pengawasan pemerintah pusat  terhadap proses pembentukan dan jalanya peraturan daerah serta kewenangan pemerintah pusat terhadap pengawasan peraturan daerah  setelah adanya putusan Mahkamah Konstitusi Nomor 56/PUU-XIV/2016. Kedudukan Peraturan Daerah terhadap pengaturannya di daerah yaitu peraturan yang dapat dibentuk oleh daerah yang mengatur urusan pemerintahan konkuren sebagaimana ditentukan undang-undang yang mencakup terhadap wilayah daerahnya tersebut. Kewenangan Pemerintah Pusat Untuk Mengawasi Proses Pembentukan dan Jalanya Peraturan Daerah adalah secara pengawasan preventif dan pengawasan represif. Kewenangan Pemerintah Pusat Terhadap Peraturan Daerah Setelah Adanya Putusan MK No. 137/PUU-XIII/2015 dan Putusan MK No.56/PUU-XIV/2016 dibatasi menjadi hanya kewenangan Executive Preview dimana pemerintah hanya memiliki kewenangan pengawasan secara preventif.

ABSTRACTThe State of Indonesia is a State that adheres to the form of a Unitary State based on the 1945 Constitution. Law Number 23 Year 2014 concerning Regional Government gives the central government the responsibility to oversee Local Regulations in an Executive Review through the cancellation of the Local Regulation. After the issuance of the decision of the Constitutional Court No. 137 / PUU-XIII / 2015 and Court Decision No. 56 / PUU-XIV / 2016, the afore-mentioned authority is considered unconstitutional. The form of this research is juridical-normative, this research is carried out by examining the principles, both written and unwritten. This research discusses the position of local regulations in the implementation of regional government, forms of central government oversight of the process of forming and implementation of local regulations and central government authority on supervision of local regulations after the decision of the Constitutional Court No. 137 / PUU-XIII / 2015 and Constitutional Court No 56 / PUU-XIV / 2016. The position of the Local Regulation on its regulation in that specific region is a regulation that can be established by the region that regulates concurrent government affairs as stipulated by the law which covers the area of the region. The authority of the Central Government to Supervise the Process of Establishing and Spending Regional Regulations is in the form of preventive and repressive supervision. The authority of the Central Government against Regional Regulations after the decision of the Constitutional Court No. 137 / PUU-XIII / 2015 and the Decision of the Constitutional Court No.56 / PUU-XIV / 2016 was became limited to only the authority of Executive Preview where the government only has the authority to preventive supervision."
