"This collection addresses all of the areas of international law that the International Court of Justice has addressed with depth and nuance. The topics considered include general principles of law, sources of law, treaty interpretation, substantive issues such as the law of the sea, state sovereignty, and state responsibility, questions of jurisdiction and competence, and questions of the Court's procedure. Since 1989, the author, a former Principal Legal Secretary to the International Court of Justice, contributed frequent articles on this subject to the British Yearbook of International Law continuing the work begun by Sir Gerald Fitzmaurice in 1950. This work brings together these articles in one place for the first time, with extensive cross-references, and a thorough index and tables, making it more accessible than eve"

Dalam Legal Consequences of the Separation of the Chagos Archipelago from Mauritius in 1965, terdapat isu dekolonialisasi yang belum terselesaikan karena terdapat pemisahan paksa antara Kepulauan Chagos dengan Mauritius.

The advisory function is one of the functions upheld by the International Court of Justice (ICJ) as one of the principle organs of the United Nations (UN). There is a trend to discuss legal questions related to pending disputes through the advisory function despite having contentious characteristics, where the two functions share different significance of the principle of state consent. The pro state consent view emphasizes its relation to the principles of international obligation, compliance, and judicial principles such as res judicata and lis pendens. The opposing view refers to the mandate of UN to maintain international peace and a previous ICJ opinion which points out that state consent is not required in the advisory jurisdiction. It can be concluded that advisory opinion on pending disputes must be seen on a case-by-case basis; from the formulation of the questions, its relation to international peace, as well as the state membership to the UN, to determine the role of state consent. In the Legal Consequences of the Separation of the Chagos Archipelago from Mauritius in 1965, there is an unresolved issue of decolonialism due to the forced separation between the Chagos Islands and Mauritius. In addition, Mauritius and the United Kingdom are members of the UN, which means they have given their foundational state consent to the jurisdiction of the ICJ. The recommendation that can be given is the need for more detailed provisions for the implementation of the advisory opinion function, especially related to a pending dispute.

Devaney, James Gerard
"Fact-Finding before the International Court of Justice examines a number of significant recent criticisms of the way in which the ICJ deals with facts. The book takes the position that such criticisms are warranted and that the ICJ's current approach to fact-finding falls short of adequacy, both in cases involving abundant, particularly complex or technical facts, and in those involving a scarcity of facts. The author skilfully examines how other courts such as the WTO and inter-State arbitrations conduct fact-finding and makes a number of select proposals for reform, enabling the ICJ to address some of the current weaknesses in its approach. The proposals includes, but are not limited to, the development of a power to compel the disclosure of information, greater use of provisional measures, and a clear strategy for the use of expert evidence."
