"Fokus penelitian tesis ini adalah berupaya menjelaskan bagaimana pemahaman kesadaran bela negara di lingkungan organisasi kemasyarakatan pemuda (OKP) Pengurus Besar (PB) Himpunan Mahasiswa Islam (HMI) periode 2013-2015 serta bagaimana strategi pembinaan kesadaran bela negara di lingkungan OKP PB HMI tersebut. Tujuan penelitian ini adalah mengetahui bagaimana pemahaman kesadaran bela negara di lingkungan OKP PB HMI periode 2013-2015 serta bagaimana strategi pembinaan kesadaran bela negara di lingkungan OKP PB HMI.Penelitian tesis ini menggunakan metode deskriptif kualitatif analitis dengan tujuan membuat gambaran secara sistematis mengenai fakta-fakta faktual yang selama ini terjadi terhadap kesadaran bela negara pada generasi muda dengan didukung teori civil defense dan civil society serta wawancara mendalam sebanyak 12 informan yang terdiri dari informan ahli yaitu pihak kementerian pertahanan dan akademisi serta 10 informan selaku aktivis OKP HMI dari beberapa wilayah di Indonesia.Temuan penting hasil penelitian tesis ini adalah diketahui bahwa adanya kesamaan pemahaman dari para aktivis OKP HMI tentang pemahaman kesadaran bela negara yang melingkupi seluruh aspek kehidupan serta kesamaan tentang strategi pembinaan yang dilakukan di lingkungan OKP PB HMI dengan menerapkan jenjang formal kaderisasi LK1, LK2, LK3 dengan training-training maupun diskusi rutin non formal.

The focus of this thesis is an attempt to explain how the understanding of environmental awareness to defend the state in the social organization of youth (OKP) Executive Board (PB) Islamic Students Association (HMI) in the period from 2013 to 2015 and how the coaching strategy to defend the state in environmental awareness OKP the HMI. The purpose of this study was to determine how the understanding of environmental awareness to defend the country in the period 2013-2015 OKP HMI development strategies as well as how to defend the state in environmental awareness OKP HMI.The thesis research this uses the method descriptive qualitative analytical with the purpose of making a picture in systematic factual concerning the facts which have so far happens to of the sense of state-defense for the young generation by the support the theory of civil defense and civil society and in-depth interviews as many as 12 informants consisting of informants expert namely the ministry of defense and academics as well as 10 informants as activists OKP HMI from several areas in Indonesia.An important finding of this research thesis is known that the common understanding of the activists OKP HMI awareness to defend state of understanding covering all aspects of life as well as the similarity of development strategies undertaken in OKP HMI environment by implementing a formal level regeneration LK1, LK2, LK3 with trainings and non routine formal discussion."

"Dalil Exceptio Non Adimpleti Contractus merupakan dalil pembelaan debitur yang didalilkan wanprestasi oleh kreditur dengan dasar kreditur juga dianggap telah lalai menjalankan kewajibannya. Skripsi ini membahas dan menjelaskan bagaimana sejarah hukum dari dalil tersebut dan perbandingan peraturannya antara negara Indonesia dan negara Belanda serta penerapannya saat ini di Indonesia. Penelitian ini merupakan penelitian yuridis-normatif menggunakan data sekunder.Hasil penelitian menunjukkan bahwa dalil tersebut ditemukan oleh Romawi dan dikembangkan oleh Canonist, serta pada zaman Hukum Perancis dan Hukum Belanda dalil ini sudah diatur didalam aturan yang berlaku saat itu. Dalam penerapannya saat ini, Indonesia masih menerapkan dalil tersebut sebagai suatu dasar hukum berupa yurisprudensi, namun tidak diatur lebih jelas selain diatur di dalam Pasal 1478 KUHPerdata.

Exceptio Non Adimpleti Contractus is a defense argument that argued by the debtor who is declared by the creditor that they have breach the contract, assuming that the creditor is also absentminded. This thesis discuss about the legal history of the defense argument, its regulation comparison between Indonesia and Netherland and its current application in Indonesia. This research method is the normative-juridical using secondary data.

The results shows that the argument was discovered by the Romans and developed by the Canonists, in the days of French and Dutch law this argument has been applied in their regulations. In practice today, the argument is still applicable in Indonesia as a legal basis in the form of jurisprudence, but it is only regulated in the Article 1478 of the Civil Code."

"Terorisme merupakan issue keamanan yang mencuat sejak peristiwa 11 September 2001. Namun, Indonesia baru menyadari ancaman terorrisme terhadap keamanan setelah peristiwa bom Bali I pada 12 oktober 2002. Dalam kebijakan pemerintah yang pertama terkait dengan terorisme , kerjasama yang dibangun lebih difokuskan pada Kepolisian dan Intelejen. Hal ini seolah mengkuak konsep yang salah kaprah tentang keamanan. Artikel ini menjelaskan posisi pertahanan dalam pemberantasan issue terorisme dan kebijakan pertahanan yang seharusnya dibentuk oleh Pemerintah Indonesia. Artikel ini menggunakan teori sekuratisasi sebagai pisau analisis. Melalui teori ini, konsep keamanan dan proses pengamanan suatu objek dari ancaman yang tidak hanya dilakukan oleh aparat kepolisian dan intelejen, tetapi juga pertahanan, digambarkan dengan jelas. Selain itu, artikel ini juga menjelaskan bahwa pertahanan inmiliter mempunyai peranan yang sangat besar dalam upaya pemeberantasan terorisme. Hal ini disebabkan oleh permasalahan utama dalam pemberantasan terorisme adalah manipulasi ajaran agama yang mampu menarik perhatian generasi muda hingga bergabung dalam jaringan teroris."

"Skripsi ini membahas dan menganalisa keabsahan pengerahan pasukan multi nasional (MNJTF) oleh African Union Peace and Security Council di Nigeria sebagai tanggapan atas serangan bersenjata (armed attack) yang dilakukan oleh Boko Haram. Dengan mengingat pengerahan MNJTF didasarkan pada doktrin right of selfdefense, khususnya collective self-defense, maka akan dilakukan pembahasan tentang sejarah, pengaturan, dan perkembangan daripada doktrin right of self-defense dan collective self-defense. Pembahasan dasar pengaturan yang dimaksud mengacu pada Piagam Perserikatan Bangsa-Bangsa, terutama Pasal 51 piagam tersebut. Status Boko haram sebagai suatu aktor bukan negara (non-state actor) menimbulkan pertanyaan, apakah terhadapnya dapat diterapkan doktrin collective self-defense. Oleh karena itu, dalam penelitian ini akan dibahas pula perkembangan dan syaratsyarat penerapan self-defense terhadap non-state actor.

This thesis discusses and analyzes the legality of the authorization and deployment of a multi national joint task force (MNJTF) by the African Union Peace and Security Council in Nigeria. The aforementioned deployment was conducted in response to armed attack mounted by Boko Haram. Considering that said deployment was justified under the doctrine of right of self-defense, in particular collective self-defense, it is necessary to discuss the history, regulation, and development of right of self-defense and collective self-defense. The analysis will be based on the Charter of the United Nations, in particular Article 51 of the Charter.Boko Haram?s status as a non-state actor necessitates the discussion about the applicability of collective self-defense as a justification in this case. Thus, this thesis will also include discussion about the conditions upon which self-defense could be applied to armed attacks conducted by non-state actors."

" ABSTRAK Pada masa modern, pembangunan pangkalan militer di luar wilayah negaranya masih dilakukan oleh beberapa negara. Hal itu dilakukan sebagai bentuk perwujudan kerjasama pertahanan yang dilakukan antar negara ataupun organisasi internasional. Permasalahan yang kerap timbul ialah tentang penegakkan yurisdiksi kepada personel militer yang bertugas di pangkalan militer tersebut. Untuk mengatasi masalah tersebut, dibentuklah perjanjian bilateral antara negara pihak yang salah satunya berfungsi untuk menentukan yurisdiksi yang berlaku terhadap suatu pelanggaran hukum. Namun demikian, tidak setaranya posisi negara saat pembentukan perjanjian tersebut mempengaruhi proses pemberlakuan yurisdiksi. Hal ini terjadi karena tidak adanya kesepakatan internasional mengenai perjanjian bilateral yang harus mengatur yurisdiksi tersebut. Oleh karenanya, perlu dibentuk model perjanjian bilateral tentang status personel yang disepakati secara internasional untuk memastikan keadilan dan kesamarataan posisi antara negara-negara yang terlibat dalam pembangunan pangkalan militer asing di suatu negara.

ABSTRACT In the modern era, the establishment of foreign military bases outside the of its teritory is still practiced by some states. The establishment itself is seen as a form of the embodiment of mutual defense that is being done between states or international organizations. The intermittent issue related to it is about the enforcement of jurisdiction toward the on duty military personnels in military bases. In order to cope with the issue, bilateral agreement between states is formed to determine the applicable jurisdiction when violation of the law happens. However, the unequal position between the states when the agreement is formed affects the practices of the enforcement of jurisdiction. The issue arises since there is no international apperception about which party that is able to assign the jurisdiction. Thereupon, the condition shows that it is required to form an internationally accepted model of bilateral agreement about the status of forces to ensure the equity and equality position between states involving in establishment of foreign military bases in one state.
