"Tulisan ini menganalisis bagaimana pengaturan mengenai tindak pidana perkosaan terhadap laki-laki di Indonesia, khususnya pengaturan tindak pidana perkosaan pada KUHP Lama dan KUHP Baru. Tulisan ini disusun dengan menggunakan metode penelitian doktrinal. Saat ini, ketentuan tindak pidana perkosaan pada Pasal 285 KUHP Lama tidak mengatur tentang perkosaan terhadap laki-laki karena pada ketentuan pasal tersebut hanya mengenal perempuan sebagai korban perkosaan. Namun, seiring berkembangnya gerakan hak asasi manusia, perkosaan terhadap laki-laki mulai diakui. Hal ini terlihat dari banyaknya negara yang telah melakukan pembaruan hukum terhadap tindak pidana perkosaan, termasuk Inggris dan Belanda. Pembaruan tersebut tidak hanya pada menaikkan hukuman tindak pidana perkosaan namun juga memasukkan laki-laki sebagai objek dalam tindak pidana perkosaan. Dengan disahkannya KUHP Baru, ketentuan tindak pidana perkosaan sudah berubah. Tindak pidana perkosaan pada Pasal 473 KUHP Baru bukan sekadar terbatas pada korban perempuan, tetapi termasuk korban laki-laki. Diaturnya perkosaan terhadap laki-laki juga menjadi cerminan dari perlindungan dan pemenuhan hak asasi manusia. Perkosaan terhadap laki-laki harus diyakini sebagai pelanggaran hak atas integritas tubuh dan hak untuk terbebas dari segala bentuk penyiksaan.

This paper analyzes how the regulation of male rape in Indonesia, especially the regulation of male rape in the Indonesia’s Old Criminal Code and the Indonesia’s New Criminal Code. This paper employs doctrinal legal research. Currently, the provisions of rape in Article 285 of the Indonesia’s Old Criminal Code do not regulate male rape because the provisions of the article only recognize women as victims. However, along with the development of the human rights movement, male rape began to be recognized. This can be seen from the number of countries that have reformed and revised their rape laws, including UK and Netherlands. The reform is not only on increasing the punishment but dropping the restriction that perpetrators must be male and victims female, it then became legally possible for a man as victims. With the enactment of the Indonesia’s New Criminal Code, the provisions of rape have changed. Rape in Article 473 of the Indonesia’s New Criminal Code is not only limited to female victims, but also male victims. The regulation of male rape is also a reflection of the protection and fulfillment of human rights. Male rape must be seen as a violation of a person’s right to bodily integrity and freedom of torture."
