"ABSTRAKDewasa ini jasa kecantikan bedah plastik kosmetik sangat populer dan mengalami perkembangan pesat karena digemari oleh masyarakat dan merupakan bisnis yang menjanjikan sehingga banyak pihak ikut mengambil peluang dari bisnis tersebut. Mulai dari dokter sampai oknum non dokter yang tidak mempunyai kompetensi ikut melakukannya sehingga mengakibatkan korban. Hal tersebut dikarenakan belum jelasnya pengaturan pihak yang berwenang untuk melakukan bedah plastik kosmetik. Permasalahan dalam skripsi ini adalah pengaturan mengenai bedah plastik kosmetik di Indonesia, pihak yang berwenang melakukan bedah plastik kosmetik, dan analisa Putusan No. 944/Pid.Sus./2015/Jkt.Sel. berdasarkan hukum kesehatan. Metode penelitian yang digunakan adalah penelitian kepustakaan. Data yang digunakan adalah data sekunder dari buku-buku, jurnal, kamus, peraturan perundang-undangan dan tulisan-tulisan lain yang mendukung penelitian ini. Penelitian lapangan juga dilakukan dengan mewawancarai dokter yang terkait dengan objek penelitian. Kesimpulan yang dicapai yaitu pengaturan bedah plastik kosmetik belum diatur secara jelas dan lengkap dalam peraturan perundang-undangan di Indonesia, bedah plastik kosmetik harus dilakukan oleh pihak yang memiliki kewenangan dan kompetensi serta memiliki izin praktik untuk melakukan tindakan tersebut, dan permasalahan hukum dalam analisa Putusan No. 944/Pid.Sus./2015/Jkt.Sel. yaitu pihak yang seharusnya berwenang melakukan bedah plastik kosmetik yang dilakukan oleh JS, sarana yang digunakan JS tidak memenuhi standar kesehatan, tanggung jawab hukum supplier obat, putusan hakim, dan kesalahan penulisan dalam putusan. Adapun saran yang disampaikan yaitu perlu adanya peraturan pelaksana yang mengatur secara jelas dan lengkap mengenai bedah plastik kosmetik dan adanya sosialisasi dan penyuluhan dari pemerintah untuk meningkatkan kesadaran dan campur tangan masyarakat dalam memilih jasa kecantikan bedah plastik kosmetik yang aman.

ABSTRACTNowadays, cosmetic surgery popularity seems to be rapidly growing in society and one of a promising business so that many people want to take the opportunity from it. Cosmetic plastic surgery must be performed by competent doctors who have the competence to do so, but in reality those treatments are performed by Doctors and non doctors without the relevant and required competence join in the act, resulting in a number of casualties. The issues discussed in this thesis are the regulation of cosmetic plastic surgery in Indonesia, the authorized party to do so and the extent of its authority. And also an analysis of District court decision Number 944 Pid,Sus. 2015 PN.Jkt.Sel. from health law perspective. The research method used in this thesis is literature review. The datas used are secondary data from journals, dictionary, legislations and other relsted literatures. Furthermore, the datas also conducted by interviewing the related beauty physicians. The conclusion of this research is that the regulation itself does not explicitly and completely express about the cosmetic plastic surgery. Nevertheless the cosmetic plastic surgery must be performed by competent and licensed doctors. In addition, the issues in the analysis of district court decision Number 944 Pid,Sus. 2015 PN.Jkt.Sel. is namely the party who should have the authority to perform cosmetic surgery conducted by JS, the tools used by JS does not meet the health standard, the legal responsibility of the medical supplier, judges rsquo decision, and the judge 39 s legal error. The recommendation is that there should be a complete and clearer regulation of cosmetic surgery and also for the government, socialization and counseling are needed to raise awareness so that people will choose cosmetic surgery wisely."

"Bedah kosmetik estetika merupakan fenomena sosial dan gaya hidup yang sudah tidak asing lagi dilakukan di Korea Selatan. Berdasarkan data statistik The International Society of Plastic Surgery (ISAPS) tahun 2015, sebanyak 1.156.234 tindakan bedah kosmetik estetika dilakukan di Korea. Bedah kosmetik estetika yang dilakukan untuk kepuasan diri memiliki persamaan dengan nilai budaya chemyeon. Budaya chemyeon yang merupakan bagian dari nilai Konfusianisme memiliki dua unsur dasar, yaitu kebutuhan untuk pemenuhan diri dan kebutuhan untuk pencapaian sosial. Tujuan penelitian ini adalah untuk menganalisis perilaku bedah kosmetik estetika di Korea dan kaitannya dengan nilai-nilai budaya chemyeon. Penelitian ini menggunakan metode kualitatif deskriptif melalui analisis dengan berdasarkan sumber data sekunder seperti buku, jurnal penelitian, dan sumber daring. Hasil penelitian ini menunjukkan bahwa unsur dasar dan nilai-nilai budaya chemyeon terdapat dalam perilaku bedah kosmetik estetika di Korea. Melalui bedah kosmetik estetika, masyarakat dapat menunjukkan kemampuan individu serta menjaga kehormatan dan martabatnya dalam lingkungan sosial. Keinginan masyarakat Korea untuk menjaga chemyeon mendorong individu untuk melakukan bedah kosmetik estetika.

Cosmetic surgery is a social and lifestyle phenomenon that is already familiar in South Korea. Based on the statistical data of The International Society of Plastic Surgery (ISAPS) in 2015, a total of 1,156,234 aesthetic cosmetic surgical measures were performed in Korea. Cosmetic surgery done to self-satisfaction has similarities to the value of chemyeon culture. The chemyeon culture that is part of Confucian value has two basic elements, the need for self-fulfillment and the need for social achievement. The purpose of this research is to analyse cosmetic surgery behaviour in Korea and its relation to chemyeon cultural values. This research uses qualitative methods of descriptive through analysis based on secondary data sources such as books, research journals, and online sources. The results of this study show that the basic elements and values of chemyeon culture are reflected in the conduct of cosmetic surgery in Korea. Through cosmetic surgery, the public can demonstrate individual ability, maintain honor and dignity in the social environment. Korean People's desire to maintain honor (chemyeon) encourages individuals to do cosmetic surgery."
