"Tesis ini membahas program penjaminan polis asuransi berdasarkan peraturan perundang-undangan perasuransian dan Undang-Undang No. 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan (“UU P2SK”) yang telah memberikan fungsi baru untuk melakukan penjaminan polis nasabah asuransi, yang harus dilaksanakan oleh Lembaga Penjamin Simpanan dalam jangka waktu 5 (lima) tahun sejak diundangkan. Permasalahan yang dibahas dalam Tesis ini adalah bagaimana pengaturan program penjaminan polis asuransi dalam peraturan perundang-undangan perasuransian dan UU P2SK serta bagaimana kesiapan Lembaga Penjamin Simpanan untuk melaksanakan fungsi program penjaminan polis asuransi. Metode penelitian yang digunakan adalah yuridis-normatif dengan bahan hukum primer dan sekunder, dengan teknik pengumpulan data melalui studi kepustakaan dan wawancara dengan analisis data secara kualitatif. Berdasarkan hasil penelitian, diperoleh kesimpulan bahwa sebelum diterbitkannya UU P2SK, pengaturan terkait program penjaminan polis hanya diatur secara singkat berdasarkan Undang-Undang No. 40 Tahun 2014 tentang Perasuransian dalam Pasal 53 ayat (1) sampai ayat (4), namun semenjak diundangkannya UU P2SK, pengaturan program penjaminan polis menjadi semakin lengkap. Kesimpulan lain adalah Lembaga Penjamin Simpanan telah melaksanakan persiapan program penjaminan polis yaitu menyusun roadmap yang memuat hal-hal yang harus dilaksanakan dengan target pelaksanaan dibagi per-tahun; melakukan beanchmark atau studi banding ke negara- negara lain yang telah memiliki lembaga penjamin polisnya sendiri; merancang RPP Program Penjaminan Polis, RPLPS tentang Pelaporan Perusahaan Asuransi, RPLPS tentang Penjaminan Polis Asuransi, dan RPLPS tentang Likuidasi Perusahaan Asuransi untuk selanjutnya akan diterbitkan di awal tahun 2024; melakukan pembentukan grup untuk menangani pelaksanaan program penjaminan polis; melakukan penyesuaian susunan dewan komisioner; dan melakukan program rekrutmen pegawai yang terdiri atas penerimaan lulusan baru dan penerimaan pegawai yang telah memiliki pengalaman kerja minimal 5 (lima) tahun. Saran yang dapat diberikan dalam penelitian ini adalah agar partisipasi dari ahli-ahli di bidang perasuransian dapat ditingkatkan dalam internal Lembaga Penjamin Simpanan melalui pelaksanaan rekrutmen terbuka agar pelaksanaan program penjaminan polis ditangani oleh individu-individu yang berpengetahuan baik di bidang perasuransian. Saran lainnya yakni agar persiapan yang dilaksanakan oleh Lembaga Penjamin Simpanan diawasi dengan baik oleh Otoritas Jasa Keuangan selaku lembaga yang mempunyai fungsi, tugas, dan wewenang pengawasan terhadap lembaga- lembaga keuangan termasuk perasuransian.
This thesis discusses the insurance policy guarantee program based on insurance laws and regulations and Law no. 4 of 2023 concerning the Development and Strengthening of the Financial Sector ("P2SK Law") which has provided a new function for underwriting insurance customer policies, which must be implemented by the Deposit Insurance Corporation within a period of 5 (five) years from its promulgation. The problems discussed in this thesis are how the insurance policy guarantee program is regulated in insurance laws and regulations and the P2SK Law and how prepared the Deposit Insurance Agency is to carry out the function of the insurance policy guarantee program as regulated in the P2SK Law. The research method used is juridical-normative using primary and secondary legal materials, with data collection techniques through literature study and interviews with qualitative data analysis. Based on the research results, it was concluded that before the issuance of the P2SK Law, regulations related to policy guarantee programs were only briefly regulated based on Law no. 40 of 2014 concerning Insurance in Article 53 paragraph (1) to paragraph (4), but since the promulgation of the P2SK Law, the regulation of policy guarantee programs has become more complete. Another conclusion is that the Deposit Insurance Corporation has carried out preparations for a policy guarantee program, namely preparing a roadmap containing things that must be implemented with implementation targets divided per year; carry out benchmarking or comparative studies to other countries that have their own policy insurance institutions; draft RPP Policy Guarantee Program, RPLPS concerning Insurance Company Reporting, RPLPS concerning Insurance Policy Guarantee, and RPLPS concerning Liquidation of Insurance Companies to be subsequently issued in early 2024; establishing a group to handle the implementation of the policy guarantee program; make adjustments to the composition of the board of commissioners; and carrying out an employee recruitment program consisting of accepting new graduates and recruiting employees who have a minimum of 5 (five) years of work experience. Suggestions that can be given in this research are that the participation of experts in the insurance sector can be increased internally at the Deposit Insurance Agency through open recruitment so that the implementation of the policy guarantee program is handled by individuals who have good knowledge in the insurance sector. Another suggestion is that the preparations carried out by the Deposit Insurance Agency be properly supervised by the Financial Services Authority as an institution that has functions, duties and supervisory authority over financial institutions including insurance."

"Tesis ini membahas mengenai penyelenggaraan program penjaminan polis asuransi setelah berlakunya Undang-Undang Pengembangan dan Penguatan Sektor Keuangan. Pokok permasalahan yang dibahas dalam tesis ini meliputi bagaimana pengaturan program penjaminan polis asuransi setelah berlakunya Undang-Undang Pengembangan dan Penguatan Sektor Keuangan. Selain itu juga akan membandingkan program penjaminan polis asuransi yang ada di Indonesia dengan yang ada di Korea Selatan dan Jerman. Metode penelitian yang digunakan oleh Penulis dalam tesis ini adalah yuridis normatif. Penelitian hukum ini menggunakan jenis data sekunder yang diperoleh dari bahan pustaka. Hasil penelitian ini adalah dalam Undang-Undang Pengembangan dan Penguatan Sektor Keuangan telah mengatur peraturan dasar terkait program penjaminan polis asuransi, namun memang dibutuhkan peraturan pelaksananya agar penyelenggaraan program penjaminan polis ini dapat dilakukan secara menyeluruh dan jelas. Beberapa pengaturan serta mekanisme yang ada di Korea Selatan dan Jerman juga ada yang dapat diterapkan di Indonesia agar program penjaminan polis asuransi ini dapat berjalan dengan maksimal. Undang-Undang Pengembangan dan Penguatan Sektor Keuangan memberikan amanat kepada Lembaga Penjamin Simpanan untuk menjalankan program penjaminan polis, sehingga Lembaga Penjamin Simpanan harus memperhatikan agar perannya untuk menjamin dana perbankan juga tidak terganggu.
This thesis discusses the implementation of the insurance policy guarantee program after the enactment of the Development and Strengthening of the Financial Sector Law. The main issues addressed in this thesis include the regulation of the insurance policy guarantee program after the enactment of the Development and Strengthening of the Financial Sector Law. Additionally, a comparison will be made between the insurance policy guarantee programs in Indonesia, South Korea, and Germany. The author uses normative juridical research methodology with secondary data obtained from literature. The research result shows that the Development and Strengthening of the Financial Sector Law has established fundamental regulations regarding the insurance policy guarantee program. However, implementing regulations are necessary to ensure the comprehensive and clear implementation of this program. Some regulations and mechanisms from South Korea and Germany can also be applied in Indonesia to enhance the effectiveness of the insurance policy guarantee program. The Development and Strengthening of the Financial Sector Law mandates the Deposit Insurance Corporation to execute the insurance guarantee program, and therefore, the Deposit Insurance Corporation must ensure that its role in guaranteeing banking funds remains undisturbed."

Penelitian ini merupakan penelitian hukum doktrinal. Sumber data yang digunakan untuk menganalisis permasalahan dalam penelitian ini berupa sumber data sekunder yang diperoleh melalui hasil penelaahan kepustakaan dan/atau bahan literatur lainnya yang berkaitan dengan topik penelitian. Hasil dari penelitian ini adalah dalam upaya memberikan pelindungan kepada para pemegang polis, skema penjaminan polis oleh LPS menggunakan metode resolusi Refund Premium dan Payment Claims, Run-off, Likuidasi, dan Bridge Institution terhadap perusaahaan asuransi dan asuransi syariah yang dicabut izin usahanya oleh Otoritas Jasa Keuangan. This thesis discusses the insurance guarantee scheme programs in Indonesia based on Law number 4 of 2023 concerning the Development and Strengthening of the Financial Sector (“P2SK Law”) which provides a new mandate for Indonesia Insurance Deposit Corporation (“LPS”) as a Indonesia Insurance Guarantee Schemes in order to organize a insurance guarantee schemes program. This research will explore several aspects related to the insurance guarantee schemes program as an effort to provide legal protection for the policy holders which will be effective in 2028, by comparing with the implementation of insurance guarantee scheme in Malaysia and Singapore. This thesis uses doctrinal legal research methods. The data sources which used to analyze the problems in this research are secondary data sources obtained through literature reviews and/or other literature materials that necesarry. The results of this research are that in an effort to provide protection to policy holders, the insurance guarantee scheme by LPS uses resolution methods such as: Refund Premium and Payment Claims, Run-off, Liquidation and Bridge Institution for insurers and Sharia insurers that its license have been revoked by the Indonesia Financial Services Authority. The insurance guarantee scheme in Indonesia could take inspiration from any nearby countries such as Malaysia and Singapore regarding institutional funding by annual and periodic levies, the calcuation premium rates based on risk, coverage of insurance guarantee scheme, maximum aggregate value of guarantees, and etc."

"Penelitian ini membahas mengenai pengaruh program penjaminan simpanan (deposit insurance) oleh LPS terhadap disiplin pasar dengan menggunakan data time series dari 120 bank umum selama kurun waktu Januari 2003 sampai dengan Desember 2013. Dengan menggunakan empat variasi yang menjadi variabel terikat berupa tingkat suku bunga deposito 1 bulan/TD, tingkat suku bunga deposito 3 bulan/TD3, tingkat suku bunga deposito rata-rata 1 dan 3 bulan/MRATE, dan Interbank Call Money, serta dengan variabel bebas berupa : (i) variabel risiko bank yang terdiri dari : NPL, LDR, BOPO, ROA, dan CAR; (ii) variabel kontrol yang terdiri dari Growth GDP dan Inflasi; dan (iii) variabel dummy, diperoleh hasil penelitian Kebijakan program penjaminan simpanan LPS yang di-proxy oleh dummy, efektif menekan tingkat bunga pada lag 4 periode. Dengan kata lain, kebijakan LPS pada saat ini membutuhkan masa tenggang waktu yang relatif lama yaitu 4 triwulan untuk dapat berpengaruh pada kedisplinan pasar.
This research explain about The Impact Analysis of Deposit Insurance Program by The Indonesia Deposit Insurance Corporation to Market Dicipline using the time series data from 120 banks from January 2003 to December 2013. I use Ordinary Least Squares/OLS method with four variations of dependent variables (time deposit rate 1 month, 3 months, average rate in 1 month and 3 months, and interbank call money), as well as the independent variable such as: (i) the bank's risk variables consisting of: NPL, LDR, ROA, ROA, and the CAR Ratios; (ii) the control variables consisting of GDP Growth and Inflation; and (iii) a dummy variable, the result of this research is deposit insurance program by IDIC with proxy by dummy, effectively reduces the interest rate on the lag 4 period. In other words, the policy of IDIC during the grace period requires a relatively long time, that is 4 quarters, to be able to influence the market discipline."

"Tulisan ini menganalisis mengenai perkembangan pengaturan tindak lanjut pengawasan dan penanganan Bank dalam Resolusi pasca berlakunya Undang-Undang Nomor 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan (UU PPSK) serta bagaimana perkembangan ini mempengaruhi pengambilan keputusan penyelamatan BPR sebagai Bank dalam Resolusi oleh Lembaga Penjamin Simpanan (LPS). Tulisan ini disusun menggunakan metode doktrinal. Berlakunya UU PPSK mengubah status pengawasan dan tindak lanjut pengawasan Bank oleh LPS dan Otoritas Jasa Keuangan (OJK). Salah satu implikasi berlakunya UU PPSK terhadap penanganan Bank dalam Resolusi adalah dengan memperluas peran LPS sebagai pengurang risiko (risk minimizer) krisis Perbankan yang memungkinkan LPS menerapkan metode keterlibatan dini Bank dalam Resolusi. LPS kini dapat menentukan berbagai metode termasuk penjajakan kepada investor untuk memperbaiki kondisi finansial Bank sebelum menentukan opsi resolusi yang diatur dalam Undang-Undang. Hal ini memungkinkan LPS untuk menerapkan konversi pinjaman pemegang saham menjadi modal inti tambahan sebagai bentuk penyehatan kembali Bank sebagaimana diterapkan pada kasus BPR X.
This paper analyzes the development of supervision and banks in resolutions management after the enactment of Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector (UU PPSK) and how these developments influence decision making to save BPRs as banks in resolutions by the Deposit Insurance Authority (LPS). This paper was written using doctrinal research method. The enactment of the PPSK Law changes the status of supervision and follow-up to bank supervision by LPS and the Financial Services Authority (OJK). One of the implications of the enactment of the PPSK Law on Banks in Resolution management is the expansion of LPS’ role as a risk minimizer for banking crises, which allows LPS to implement methods of early involvement in Banks in Resolution. LPS can now determine various methods including seeking investors to aid a Bank’s financial condition before determining the resolution options regulated in the Law. This allows LPS to implement the conversion of shareholder loans into additional core capital as a form of bank restructuring as applied in the case of BPR X."

"Special Purpose Vehicle atau entitas yang didirikan dengan tujuan khusus dianggap sebagai salah satu konsep yang biasa digunakan oleh para pelaku usaha di Indonesia. Sifat fleksibilitas dari konsep tersebut menyebabkan penggunaannya dapat ditemukan di berbagai sektor perekonomian. Meski demikian, hukum Indonesia masih belum memiliki pengaturan spesifik dan khusus terkait konsep Special Purpose Vehicle sehingga perkembangannya masih terbatas. Maka sebagai upaya untuk memberdayakan penggunaan Special Purpose Vehicle, pemerintah kemudian menyusun strategi Penguatan Skema Alternatif Penerapan Special Purpose Vehicle yang tertuang dalam Strategi Nasional Pengembangan dan Pendalaman Pasar Keuangan 2018-2024. Strategi tersebut diwujudkan oleh pemerintah dengan mengesahkan Undang-Undang Nomor 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan. Melalui penelitian yang menggunakan metode doktrinal dan bentuk penelitian deskriptif analitis dengan pendekatan kualitatif, Penulis berusaha untuk menganalisis strategi tersebut lebih mendalam. Dalam rangkaian strategi tersebut, pemerintah secara khusus hanya berfokus pada Special Purpose Vehicle dalam rangka penyelenggaraan sekuritisasi aset, dan bukan pada Special Purpose Vehicle dalam lingkup luas. Hal ini karena sekuritisasi aset merupakan salah satu sumber pembiayaan baru yang dianggap dapat meningkatkan kegiatan investasi untuk mendorong pertumbuhan perekonomian Indonesia. Melalui undang-undang tersebut, maka pemerintah kemudian memperkenalkan konsep baru, yakni Badan Pengelola Instrumen Keuangan yang merupakan salah satu bentuk dari Special Purpose Vehicle dalam rangka sekuritisasi aset di Indonesia. Pengenalan konsep Badan Pengelola Instrumen Keuangan diharapkan dapat meningkatkan penggunaan Special Purpose Vehicle untuk kegiatan sekuritisasi aset di Indonesia karena konsep ini dianggap memiliki karakteristik yang paling menyerupai bentuk murni dari suatu Special Purpose Vehicle.
Special Purpose Vehicles or entities established with a special purpose are considered as one of the concepts commonly used by business actors in Indonesia. The flexibility of the concept causes its use to be found in various economic sectors. However, Indonesian law still does not have a specific and special arrangement related to the Special Purpose Vehicle concept so that its development is still considered limited. Therefore as an effort to empower the use of Special Purpose Vehicles, the government developed a strategy called Strengthening Alternative Schemes for the Application of Special Purpose Vehicles as stated in the 2018- 2024 National Strategy for Financial Market Development and Strengthening. The strategy was then realized by the government by the passing of Law Number 4 of 2023 on Financial Sector Development and Strengthening. Through research that uses doctrinal methods and a form of analytical descriptive research with a qualitative approach, the Author seeks to analyze said strategy more thoroughly. In that series of strategies, the government chooses to specifically focus only on Special Purpose Vehicles in the context of asset securitization, and not on Special Purpose Vehicles in a broad scope. This is because asset securitization is known as one of the new sources of financing that is considered to increase investment activities that could boost Indonesia's economic growth. Through said provision, the government then introduced a new concept, which is called Badan Pengelola Instrumen Keuangan, which is a form of Special Purpose Vehicle in the context of asset securitization in Indonesia. The introduction of the Badan Pengelola Instrumen Keuangan concept is expected to increase the use of Special Purpose Vehicles for asset securitization activities in Indonesia due to its resemblance on the characteristics of the pure form of a Special Purpose Vehicle."

"Otoritas Jasa Keuangan sebagai lembaga negara yang independen diharapkan dapat menjadi salah satu penopang dalam menciptakan sistem keuangan yang stabil dan berkelanjutan melalui pengawasan terhadap industri perasuransian untuk membentuk industri perasuransian yang sehat, berdaya saing, dan memperoleh kepercayaan masyarakat melalui perlindungan terhadap konsumen. Sebagai salah satu instrumen dari pengawasan, Otoritas Jasa keuangan memiliki kewenangan penegakan hukum baik secara administratif, perdata maupun pidana. Penegakan hukum yang dilakukan tidak hanya berfokus pada tujuan hukum berupa kepastian hukum dan keadilan, namun juga kemanfaatan. Undang-Undang Nomor 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan telah memberikan transformasi penegakan hukum di bidang perasuransian dengan adanya ketentuan mengenai penyelesaian pelanggaran peraturan perundang-undangan melalui pemberian ganti rugi kepada pihak yang dirugikan. Selain itu, juga terdapat ketentuan mengenai pidana tambahan berupa pengganti kerugian yang diderita oleh korban tindak pidana. Pembayaran ganti rugi merupakan upaya pemulihan bagi konsumen bidang perasuransian yang menjadi korban sebagai implementasi dari pemenuhan tujuan hukum berupa kemanfaatan. Penegakan hukum demikian akan efektif dengan adanya koordinasi yang dilakukan oleh pihak-pihak yang melakukan penyidikan bidang perasuransian. Koordinasi dilakukan bukan hanya semata oleh Otoritas Jasa Keuangan dengan Kepolisian Republik Indonesia dalam rangka integrated criminal justice system, namun juga oleh Kepolisian Republik Indonesia dengan Otoritas Jasa Keuangan dalam rangka mendapatkan gambaran atas tindakan pengawasan yang komprehensif dengan penegakan hukum. Oleh karenaya diperlukan peraturan perundang-undangan yang mengatur mengenai koordinasi antar lembaga yang memiliki kewenangan penyidikan di bidang perasuransian dan sektor jasa keuangan secara umum.
The Indonesian Financial Services Authority (Otoritas Jasa Keuangan, OJK) is an independent body intended to oversee the stability and sustainability of financial systems operating domestically. Its monitoring function over insurance companies is designed to shape an insurance ecosystem that is healthy, competitive, and trustworthy to protect customer’s interest. As part of its monitoring function, OJK has law enforcement authorities in the field of administrative, civil, and criminal proceedings to ensure the enactment of justice and the protection of parties’ interests. Law no. 4/2024 on the “Development and Reinforcement of the Financial Sector” has transformed law enforcement in the insurance sector with provisions regarding the resolution of violations of laws and regulations by providing compensation to the injured party. Furthermore, it also regulates provisions regarding additional penalties in the form of compensation for losses suffered by victims of criminal acts. Compensation payments are an effort to restore the rights of disadvantaged insurance consumers as an implementation of fulfilling the legal objective in the form of benefits. Such practices should be done electively, with coordination between parties involved in the investigation of the relevant Insurance entities. The coordination is done not only by OJK, but also by the National Police under the integrated criminal justice system to paint a holistic picture based on the findings collected by the bodies, thus ensuring a comprehensive monitoring function and a strict law enforcement. With this need in mind, it is necessary for the government to enact laws and regulations governing coordination between institutions that have investigative authority in the insurance sector and the financial services sector in general."

"Penelitian ini dilakukan untuk mengetahui pengaruh dari penerapan sistem deposit insurance sebagai salah satu opsi financial safety net yang dilakukan pemerintah terhadap tingkat stabilitas perbankan yang diukur dengan menggunakan pengambilan risiko bank. Dengan menggunakan 48 sampel bank yang berada di negara ASEAN-5 (Indonesia, Malaysia, Thailand, Filipina, dan Singapura), penulis menemukan bahwa adanya sistem deposit insurance menurunkan tingkat pengambilan risiko yang diambil oleh bank dan meningkatkan tingkat pengambilan risiko bank pada saat terjadi krisis.
The purpose of this study is to know the effect on deposit insurance system implementation, as one of the financial safety net option by government, to the banking stability which measured by the level of bank risk taking. Using 48 bank sample in ASEAN-5 (Indonesia, Malaysia, Thailand, Philippine, and Singapore), researcher find evidence that the deposit insurance system implementation decreased the level of bank risk taking and increased the level of bank risk taking in crisis period."

Krisis ekonomi global pada tahun 2008 mengharuskan LPS meningkatkan Nilai Penjamin Simpanan. Penelitian ini bertujuan untuk mengetahui alasan LPS meningkatkan Nilai Penjamin Simpanan berdasarkan Undang-Undang Nomor 24 Tahun 2004 Tentang Lembaga Penjamin Simpanan sebagaimana telah diubah dengan Undang-Undang No. 7 Tahun 2009 dan peraturan perundang-undangan yang berlaku, menganalisis kemungkinan penurunan Nilai Penjamin Simpanan LPS serta hubungannya dengan penerapan risk-based premium di Indonesia untuk menjaga stabilitas sistem keuangan Indonesia. Penelitian ini merupakan penelitian kepustakaan yang bersifat yuridis-normatif. Data yang dikumpulkan dengan studi kepustakaan. Hasil dari penelitian ini adalah berdasarkan Pasal 11 UU LPS dimungkinkan terjadi penurunan terhadap Nilai Penjamin Simpanan LPS. Berdasarkan alasan peningkatan Nilai Penjamin Simpanan pada tahun 2008, yaitu adanya ancaman krisis ekonomi, UU LPS mengatur apabila alasan tersebut telah teratasi maka besaran Nilai Penjamin Simpanan dapat disesuaikan kembali. Maka berdasarkan hal ini, dimungkinkan untuk menurunkan Nilai Penjamin Simpanan LPS.
As one of the important elements in the financial safety net, especially in banking system, Indonesia Deposit Insurance Corporation (IDIC) has a big role to keep the stability of Indonesia?s financial system. The global economic crisis in 2008 requires IDIC increase the Deposit Insurance Coverage. This studies aims to determine the reaseon IDIC increase the coverage based on Law No. 24 of 2004 on the Indonesia Deposit Insurance Corporation (IDIC) as amended by Act No. 7 of 2009, to analyze the possibility to decrease the deposit insurance coverage and its relation to the risk-based premium in Indonesia in order to maintan the stability of the financial system. This research is a normative juridical research. The data were collected by literature study. The results for this study are based Article 11 of IDIC Act, there is a posibility to adjust the Deposit Insurance Coverage. IDIC increased the coverage in 2008 because there is a threat of an economic crisis.
