Hasil dari penelitian ini adalah bahwa Surat Keterangan oleh Camat sebagai alas hak atas tanah sejatinya bukan merupakan objek yang dapat dijaminkan dengan Hak Tanggungan. Lebih lanjut lagi, cover note Notaris tidak dapat dipergunakan sebagai dasar dari pencairan kredit oleh karena sifatnya hanya berupa surat keterangan atas pekerjaan, dan bukan merupakan bentuk janji dari Notaris atas penyelesaian pekerjaan pensertifikatan atas Surat Keterangan oleh Camat tersebut.
This study is aimed to describe and to analyse the use of Sub-District Head’s Certificate on Land
as collateral in a Credit Agreement, and the problematic situation that follows with that practice. This study also discusses the practice of the utilization of Notary’s cover note as the basis of credit disbursement in which the collateral is a Sub-District Head’s Certificate on Land that is still in progress of certification. In this study, will also discuss Bank’s implementation of prudential banking principlein facing these practices. The research method used in this study is a normative juridical type, in which this study will explore the regulation related with these practices based on literature study. The result of this study is that Sub-District Head’s Certificate on Land is not an object in which a mortgagecan be placed upon them. Furthermore, Notary’s cover note cannot be used as the basis of credit disbursement, as it is only a letter of statement of the work that is currently in progress, and not a form of promise from the Notary for the completion of that particular work."
