"Indonesia has probably the fastest changing legal system in the Muslim world. This ethnographic account of legal pluralism in the post-conflict and disaster situation in Aceh addresses changes in both the national legal system and the regional legal structure in the province. Focusing on the encounter between diverse patterns of legal reasoning advocated by multiple actors and by different institutions (local, national and international; official and unofficial; judicial, political and social cultural) it considers the vast array of issues arising in the wake of the December 2004 earthquake and tsunami in Aceh.It investigates disputes about rights to land and other forms of property, power relations, the conflict of rules, gender relationships, the right to make decisions, and prevailing norms. These disputes are presented on multiple levels and in various forums, either through negotiation or adjudication, regardless of whether they are settled or not. The cases involve various actors from villages, the courts, the provincial government and the legislature, the national Supreme Court and the central government of Indonesia. "Tesis ini akan membahas persoalan mengenai kedudukan Hukum Perdata Islam dalam Tata Hukum Indonesia serta mengenai berbagai peluang dan tantangan masuknya Hukum Perdata Islam dalam Tata Hukum Indonesia.Adapun methodologi yang penulis pergunakan adalah diskriptif analitik, dengan menggunakan janis data normatif-kualitatif. Sedang metode pengumpulan datanya adalah studi kepustakaan.Kesimpuian yang berhasil penulis lakukan dari pembahasan ini adalah hahwa kedudukan hukum Islam dapal dibagi menjadi dua periode, antara lain: Periode penerimaan hukum Islam sepenuhnva dan periode penerimaan hukum Islam oleh hukum adat. Hukum Perdata Islam yang telah berhasil menjadi tam hukum Indonesia antara lain adalah UU Pernikahan kompilasi Hukum Islam dan lainnya.Peluang masuknya hukum Islam ke dalam berbagai peraturan perundang-undangan di Indonesia masih sangat terbuka sakali: factor-faktor yang mengindikasikan kearah itu antara lain adalah faktor historis, sosiologis, yuridis dan filosofis.Tantangan Hukum Perdata Islam di Indonesia yang dihadapi cukup banyak. antara lain adalah dualisme pendidikan hukum, kurangnya sumber daya manusia andal yang mencukupi, tidak adanya buku-buku rujukan utama dalam bahasa nasional dan buku-buku teks yang dapat digunakan di perguruan tinggi, dan last but not least, sistem politik dan hukum yang belum jelas arah tujuannya.This Thesis will study the problem of concerning history and legal status of Islamic Law in Indonesia Law and also hit various opportunities entry of Islamic Law in Indonesia Law.

A success conclusion that the writer takes away from this solution is that history and the Islamic Law tradition in Indonesia that has been very old taken place and executed.

The Legal status of Islamic Law can be separated into two periods, they are: The full acceptance period of Islamic Law and the acceptance Islamic Law by customary law.
