"In compliance with government regulations, mining companies in Indonesia are obliged to reclaim and return a post-mined area into its pre-mining condition. Revegetation, as part of reclamation activity, performs a significant role in the rehabilitation of degraded post-mined areas to restore their productive land uses. Hence, this study aimed to assess tree growth on the reclamation sites across four mining companies in East Kalimantan, South Sulawesi, South Sumatra, and West Java in Indonesia and to evaluate whether the companies have met the legal requirements set for site revegetation. The success parameters were based on the applicable regulations of the Ministry of Environment and Forestry (MOEF) P.60/Menhut-II/2009 and tree growth parameters (stem diameter, total height and basal area). The parameters set by MOEF included revegetation realization, survival rate, tree density, tree health, species composition and rotation length. The four mining companies applied the two-phase planting method that included the planting of Enterolobium cyclocarpum for the first phase; and in the second phase, the slow growing native species, such as Intsia palembanica, Sycygium polyanthum, Shorea spp. and Elmerrillia tsiampaca. The tree growth parameters showed different performances over species and reclaimed sites. An extremely high growth of stem basal area of 57.6 m2/ha in 11 years, was recorded in the E. tyclocarpum stand of the Mining Company in South Sulawesi. All four mining companies strived to comply with the regulation with scores of revegetation success ranging from 15 to 25 out of 25 possible points. However, these favorable results may not be representative of all the mining companies, as the ones assessed were only those voluntarily supporting this research. Moreover, each of the four companies made some distinct efforts in implementing post-mining revegetation, such as by establishing plots of Melaleuca cajuputi trees producing cajuput oil and polycultures of native species."

"Penelitian ini membahas hak ulayat atau beschikkingsrecht serta kaitannya dengan kewenangan Kepala Adat atau Hukum Tua Adat dalam urusan pertanahan. Diketahui bahwa Hukum Tua Adat Desa Tontalete diputuskan bersalah karena tindak pidana pemalsuan surat keterangan kepemilikan tanah berdasarkan Putusan Mahkamah Agung Nomor 847 K/PID/2017. Penelitian ini dilakukan untuk menjawab dua permasalahan penelitian yakni: a) Bagaimana aturan pendaftaran dan peralihan tanah komunal serta aturan hak pengelolaannya; b) Bagaimana tanggung jawab dan kewenangan kepala adat di Minahasa serta perlindungan hukum terhadap pihak ketiga yang dirugikan karena penyalahgunaan wewenang adat yang mengakibatkan peralihan status tanah ulayat ditinjau dari hukum pertanahan dan; c) Bagaimana akibat hukum Putusan Mahkamah Agung Nomor 847 K/Pid/2017 terhadap kepala adat yang melakukan pemalsuan surat keterangan kepemilikan tanah. Metode yang digunakan dalam menjawab permasalahan penelitian ini adalah metode kualitatif, dengan pendekatan Yuridis Empiris. Hasil penelitian ini menemukan bahwa kewenangan Hukum Tua Adat dalam Masyarakat Hukum Adat yang berkenaan dengan perkara pertanahan adalah membuat surat keterangan tentang tanah beserta riwayat status dan kepemilikan tanah tersebut; serta bahwa akibat hukum yang terjadi terhadap Kepala Adat yang melakukan pemalsuan surat keterangan kepemilikan tanah dalam putusan tersebut adalah a) Vonis hukuman penjara selama 6 bulan karena terbukti melanggar Pasal 263 ayat (1) KUHP jo. Pasal 55 ayat (1) ke-1 KUHP tentang Pemalsuan Surat; b) Tidak sahnya jual-beli yang dilakukan oleh Saksi Elsje Maria Pantouw dan; c) Kembalinya hak-hak PT. Aman Liman Jaya selaku penguasa tanah yang sah yang didukung dengan dokumen HGB atas sebagian besar tanah yang sempat dijual- belikan oleh Saksi Elsje Maria Pantouw.

This research discusses about communal title or beschikkingsrecht in accordance with the authority of Custom Head on land affairs. It is known that the custom head of Tontalete village of Kema Sub-district, North Minahasa is found guilty of Land Ownership Information Letter Forgery based on Supereme Couort decision Number 847 K/PID/2017. This research is conducted to answer two research questions, which are: a) What are the rules for registration and transfer of communal land and the rules for managing rights?; b) How is Custom Head responsible in composing land ownership information letter, land ownership status transfer process and protection against the disadvantaged third party because of the authority abuse that causes communal land status transfer according to the agrarian law and; c) What are the legal effect of the Supereme Court decision number 847 K/Pid/2017 on the Custom Head that have done the land ownership information letter forgery. The method used to anser the research problems is qualitative metod with juridicial and empirical approach. The result of this research finds that the authority of custom head in customary law society regarding land affairs is to compose land information letter along with the status and ownership history; and the legal effects against the custom head that have forged the land information ownership letter are: a) Prison sentence of 6 months for proven to have violated artile number 263 (1) KUHP jo. article number 55 (1) the first KUHP about official letter forgery; b) The transaction done by the witness Elsje Maria Pantouw becomes invalid and; c) Return of rights for PT. Aman Liman Jaya as the legal land authority, supported by the HGB document on most of the land that ever transacted by the witness Elsje Maria Pantouw."

"Daerah panas bumi Limbong, Kabupaten Luwu Utara, Provinsi Sulawesi Selatan merupakan salah satu lapangan panas bumi yang belum dilakukan eksplorasi. Tujuan dari penelitian ini adalah untuk merekomendasikan wilayah prospek panas bumi guna dilakukan kegiatan eksplorasi. Metode analisis penginderaan jauh dan geokimia air digunakan untuk mencapai tujuan tersebut. Terdapat 12 manifestasi air panas bumi yang dianalisis, terdiri dari 11 air panas dan 1 air dingin. Analisis penginderaan jauh menunjukkan pola kelurusan pada daerah penelitian berorientasi utara – selatan dan timurlaut – baratdaya, dengan tingkat densitas kelurusan dari sangat rendah hingga sangat tinggi. Pola dan densitas kelurusan tersebut diinterpretasikan sebagai zona permeabel yang mengontrol kemunculan manifestasi panas bumi. Selain pola kelurusan, analisis penginderaan jauh juga menunjukkan tingkat kerapatan vegetasi di daerah penelitian tersebar dari vegetasi tinggi hingga tidak bervegetasi, dengan suhu permukaan berkisar antara 12˚C hingga 26˚C. Berdasarkan analisis geokimia air, tipe air panas bumi pada daerah penelitian adalah klorida – bikarbonat. Sumber air panas bumi dari satu reservoir dengan kondisi full equilibrium dan immature waters yang telah mengalami pengenceran oleh air meteorik. Analisis geoindikator menunjukkan zona outflow dari daerah penelitian berada pada mata air APKD-5. Berdasarkan analisis data penginderaan jauh dan geokimia air, dapat direkomendasikan dua area prospek panas bumi di daerah penelitian. Area rekomendasi prospek panas bumi A terletak pada daerah Kanan Dede dengan luas sekitar 6.9 km2 di koordinat 120.012132, -2.557325 dan 120.045600, -2.573257. Area rekomendasi prospek panas bumi B terletak pada daerah Salu Rassasisi dengan luas sekitar 6.8 km2 di koordinat 119.964534, -2.552284 dan 120.000229, -2.567610.

The Limbong geothermal area, North Luwu Regency, South Sulawesi Province is one of the geothermal fields that has yet to be explored. The purpose of this study is to recommend geothermal prospect areas for further exploration activities. Remote sensing and geochemical methods were used to gain this purpose. There are 12 geothermal water manifestations analyzed, consisting of 11 hot springs and 1 spring. The results of remote sensing analysis show a lineament in the study area with an N-S and NE-SE orientation, with lineament density levels from very low to very high. The lineament orientation and density are interpreted as a permeable zone that controls the appearance of geothermal manifestations. Remote sensing analysis also shows the level of vegetation density in the study area is spread from high to non-vegetated vegetation index with surface temperatures ranging from 12˚C to 26˚C. Based on Ternary Diagram, shows that the water manifestations in this area were classified as chloride – bicarbonate water types. The water source for the geothermal systems from a reservoir with full equilibrium and immature water conditions. Geoindicator analysis shows outflow zone from the research area is in the APKD-5 hot spring. Based on the remote sensing data analysis and water geochemistry, two geothermal prospect areas can be recommended. The recommended area for geothermal prospect A is around Kanan Dede with an area covers 6.9 km2 at coordinates 120.012132, -2.557325 and 120.045600, -2.573257. The recommended area for geothermal prospect B is around Salu Rassasisi area with an area covers 6.8 km2 at coordinates 119.964534, -2.552284 and 120.000229, -2.567610."
