"This book addresses the social experiences of juvenile offenders in the correctional machinery and the career effects these experiences have on offenders. It follows offenders from apprehension through detention, court appearance, probation and institutionalization, showing how the organizations operate, the role definitions of the people who man them, and the views of the correctional organizations held by members of the public. It is a valuable supplement to courses in deviance, criminology, social problems and organizational analysis. The book begins with the delinquent population and endeavours to identify the major characteristics of juvenile lawbreaking. It separates youths who most often remain as "hidden" delinquents from those who are observed and apprehended. The text then moves through the major parts of the correctional machinery in much the same way as offenders are processed through it. Information on each topic is marshalled in accordance with five dimensions; the nature of the organization; the perspectives of the consumer (the public); the perspective of the employees; the perspectives of the offenders; and the impact of the agency upon offenders. Thus, a major focus of the book is an organizational analysis, a basic feature of the current sociological perspective. This work, on first publication in 1970, was one of the first to tackle the growing skepticism as to the beneficial aspects correctional institutions may have on the young offenders, and the analysis of those benefits. The readings attempt to show something of the impact of correctional experiences on juvenile delinquents, and suggest that the overall effect is to drive deviants further into deviant activities rather than attaining the desired goal of rehabilitation."

"Sejak tahun 1970 kejahatan mutilasi sudah terjadi di Indonesia. Namun pola kejahatan tersebut mengalami peningkatan pada tahun 1990-2010 dengan total 36 kasus terjadi di Indonesia. Diketahui bahwa terdapat kondisi tertentu yang menyebabkan pelaku melakukan mutilasi pada korbannya. Oleh karena itu perlu dilihat kondisi dan aspek apa saja yang mempengaruhi pelaku dalam melakukan mutilasi.
Rational Choice Theory (RCT) sebagai sebuah teori kejahatan, digunakan untuk membantu menjelaskan fenomena tersebut dan mencari faktor apa saja yang mempengaruhi pelaku dalam dilakukannya mutilasi, ditambah dengan Routine Activity Theory (RAT) dengan segitiga permasalahan dilakukannya kejahatan, diharapkan dapat mempertajam hasil analisa dari fenomena mutilasi tersebut sehingga dapat diketahui kondisi dan faktor apa saja yang dapat mempengaruhi individu berbuat kejahatan.
Teknik pengumpulan data yang dilakukan adalah melalui wawancara mendalam terhadap para pelaku, penyidik yang menangani serta para orang orang dekat pelaku. Wawancara dilakukan beberapa kali sampai data yang dikumpulkan oleh peneliti dirasa cukup, guna menjawab pertanyaan penelitian. Observasi juga dilakukan guna melengkapi data, selain menelaah hasil dari BAP para pelaku.
Dalam menjelaskan mutilasi, muncul temuan bahwa faktor sosiodemografi diinterpretasikan juga memiliki hubungan erat dengan dilakukannya mutilasi, dimana ditemukan bahwa pelaku mutilasi memiliki kesamaan faktor dalam aspek sosio-demografi yaitu; (1) Pelaku adalah kaum urban, (2) Pelaku memiliki pendidikan yang rendah, dan (3) Pelaku berasal dari keluarga yang tidak harmonis. Meskipun ditemukan motif yang berbeda-beda namun ternyata terdapat kesamaan diantara para pelaku mutilasi ini yaitu; (1) antara pelaku dan korban memiliki hubungan yang dekat, (2) pola pemikiran yang sederhana dari pelaku dalam memutuskan dilakukannya mutilasi, (3) pengambilan keputusan yang didasarkan pada terbatasnya informasi atau keterbatasan individu dalam menelaah informasi.
Selain faktor pencetus dan pendorong terdapat faktor lain yaitu dinamika yang terjadi ketika mayat tersebut hadir sebagai bentuk benda yang seharusnya tidak ada dan harus disingkirkan. Keterbatasan rasional pelaku dalam menganalisa permasalahan yang ada membuat tindakan yang diambilnya (memutilasi) adalah hasil pengambilan keputusan sesaat, tanpa mempertimbangkan lagi kemungkinan lain.

Crime with mutilation has been reported in Indonesia since 1970s. However, this crime pattern showed an increasing number of incidences between 1990 until 2010, with a total of 36 cases from across Indonesia. It is known that certain condition can cause perpetrators to perform mutilation on their victims. Thus, what conditions and aspects that influence the perpetrators? behavior when committing the mutilation.
Rational Choice Theory (RCT) as a theory on crime with its triangle of criminal causes is used to explain the phenomenon and to find attributing factors to perpetrators? behaviors to perform mutilation, in addition to the Routine Activity Theory. The use of both RCT and RAT is expected to be able to sharpen the result of analysis of this mutilation phenomenon so that it can lead to the disclosure of the conditions and factors influencing the perpetrators.
Data collection techniques are done through in-depth interviews of the perpetrators, investigators and the person who handles the near perpetrators. Interviews were conducted several times until the data collected by the researchers considered, in order to answer questions with research. Observations were also carried out in order to complete the data, in addition to reviewing the results of the investigation report (BAP) actors.
In explaining mutilation, findings are gathered from the study that sociodemographic factor is interpreted to have close tie to the act of mutilation and mutilation perpetrators share similar factors in socio-demographic aspects, namely; (1) Perpetrators are immigrants, (2) Perpetrators are of low education background, and (3) Perpetrators come from disharmonious families. Despite different motives, similarities are discovered among perpetrators, they are; (1) close relationship between the perpetrators and the victims, (2) perpetrators? simple way of thinking to decide mutilation, (3) decision-making is based on limited information or the limited ability of perpetrators to understand the information.
In addition to precipitating factors and other factors that are driving the dynamics that occur when the body was present as a form of object that should not exist and should be eliminated. Limitations of rational actors in analyzing the existing problems make this action (mutilated) is the result of decision-making moment, without due regard to other possibilities."

Dalam kurun waktu lima tahun terakhir Indonesia dikejutkan oleh maraknya kasus kejahatan seksual terhadap anak, beberapa kasus menimbulkan puluhan korban dari satu pelaku. Menyikapi hal ini, pihak perumus kebijakan memfokuskan perhatiannya kepada upaya pemberatan hukuman semata, pemerintah menganggap bahwa sanksi yang ringan merupakan penyebab kasus terus bertambah. Padahal jika kita mencermati secara lebih luas, terdapat beberapa tipe pelaku kejahatan seksual, salah satunya pengidap pedofilia. Pedofilia dalam ilmu psikologi dikenal sebagai suatu gangguan seksual yang membutuhkan treatment bukan penghukuman. Penelitian ini bertujuan untuk mencari tahu apakah kebijakan pidana tertentu perlu diterapkan bagi pelaku kejahatan seksual yang mengidap pedofilia. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatan perundang-undangan, perbandingan dan pendekatan kasus. Penelitian ini bersifat eksploratoris dengan menelusuri landasan teori pidana dan pemidanaan. Berdasarkan hasil penelitian, dapat disimpulkan bahwa pemidanaan pada sistem peradilan pidana modern tidak hanya memandang perbuatan namun juga pelaku. Perkembangan pemidanaan ini melahirkan ide rehabilitasi dan individualisasi pidana. Konsep rehabiltasi dan individualisasi pidana ini pun sejalan dengan Pasal 10(4) Konvensi Hak Sipil dan Politik dan UU No 12 tahun 1995 tentang Pemasyarakatan yang menjelaskan bahwa pemidanaa bertujuan merehabilitasi dan mengembalikan pelaku kepada masyarakat, sehingga kebijakan khusus bagi pelaku yang mengidap pedofilia diperlukan untuk merehabilitasi dan mengembalikan pelaku kepada masyarakat.

ABSTRACT
Over the past five years, people around Indonesia watched in fear and heartbreak as the number of sexual offences against children has risen. The several cases cause more than one victims from each perpetrator. Legislators and executives zealously react this problem by tightening laws to regulate the heavier sentence. They contend that the insufficient punishment has significant role in the increasing number of sexual offense. In fact, if we see in a wider perspective, sexual offence against children is not merely about criminal act. Sex offenders are classificated into four types, one of them is pedophilic offender. In psychology, Pedophile is known as an abnormal attraction which requires treatment, not punishment. This research aims to investigate whether the distinctive criminal law policy should be regulated for pedophilic offender. This research is a normative juridical, with an approach in legislation, comparison and approaches in cases (case approach), also explores several number of theories of sentencing. Based on this research, it can be concluded that under the modern criminal justice system, both offense conduct and offender characteristic have significant role in sentencing decisionmaking. This concept formulated individualized tailoring of sentences and rehabilitative model which confirming to the concept of correctional board under Law No 12/1995 and rehabilitative model Article 10(4) ICCPR. Therefore, the distinctive criminal law policy for pedophilic offender should be regulated in order to rehabilitate and to resocialize the offenders.;"
