Penerapan asas nailed down dalam KK dalam perkembangannya tidak selamanya bersifat baku, dan dilakukan penyesuaian sesuai dengan situasi dan kondisi serta berdasarkan itikad baik dan kesepakatan kedua belah pihak. Hal ini juga didasari dengan ketentuan dalam KK yang mengatur bahwa pelaksanaan KK diatur, tunduk kepada dan ditafsirkan sesuai dengan hukum Republik Indonesia Berkaitan dengan penerapan otonomi daerah, pendelegasian wewenang dari Pemerintah Pusat kepada Pemerintah Daerah secara tidak langsung akan membuat ketidakpastian pihak investor akan jaminan kontraknya (security of title), sehingga semua pelaksanaan kewenangan oleh Pemerintah Daerah harus mengacu pada ketentuan baku dalam azas berkontrak berdasarkan kesepakatan kedua belah pihak dan tidak bertentangan dengan peraturan perundangan di bidang mineral, batubara dan panas bumi.
