"There are several substantial problems remain on intellectual property rights in the focal society of Indonesia. The needed for the protection of intellectual property did not come from the civil society itself but from the pressure of external factor. Intellectual Properly Regime is also known as capitalistic regime and that is the problem. The protection is given to the one who own the right, not for the real author. The characteristic of intellectual property is to protect individually. In the other hand, the background of local society of Indonesia, V which consists of many tribes, lived based on communalistic, The opposite of concept did not avoid Indonesia for taking a step into ratification of international instruments of intellectual property rights protection. The reason behind is the position of Indonesia as a developing country which has powerless bargaining position put side by side with developed countries. This article attempts to offer another point of view to find out what is the real matter, the root of the problems, why intellectual property regime can not be implemented well in Indonesia."

"The conception of Intellectual Property Right (IPR) is generally misunderstood by among common people. In order to obtain a more comprehensive understanding of IPR, we may as well start with the most dominant point of view, namely that from the perspective of the State and Government.This point of view is dominant because the State and Government are the institutions which havethe authority to make law, to implement law and to interpret the law in the various forms of itsimplementation. A study of IPR can be taken from wider view, as cultural perspectivetake the approach of looking at various events related to the implementation of the laws concerned. It also provide various situations to analyze related to the implementation of Copyright Law in various regions all over Indonesia.Within current situation, after Indonesia has ratified the WTO/TRIPs, the consequence now is binding, politically, legally and economically, although we may freely provide the needs of our people, in this case : IPR protection system. There are of course many other things in the spirit of the Constitution and the Indonesian nation that can be explored further and applied in the IPR protection system. In the end, IPR as the part of the culture can be developed further by taking into consideration and looking into possibility that much suitable to the needs of Indonesian respective communities."

"Cerpen ldquo;Kaki Malaikat rdquo; dan ldquo;Topeng Malaikat rdquo; merupakan dua cerpen yang mengangkat tema kebudayaan. Dalam dua cerpen tersebut, terdapat mitos-mitos yang dipercaya oleh masyarakat. Mitos-mitos tersebut merupakan hasil dari pemikiran manusia di dalam suatu masyarakat atas gejala-gejala yang muncul dalam kehidupan. Penelitian ini bertujuan menjelaskan mitos-mitos apa saja yang muncul dalam cerpen KM dan TM serta bagaimana kepercayaan masyarakat terhadap mitos-mitos tersebut.Penelitian ini dilakukan dengan metode kualitatif deskriptif yang melalui tahapan pengumpulan data, seleksi data, analisis data, dan menarik simpulan.Pendekatan yang digunakan adalah pendekatan struktural untuk mengkaji struktur cerpen dan tinjauan sosiologis dengan teori mitos Barthes dan Zeffry untuk mengkaji kepercayaan masyarakat terhadap mitos. Analisis data dilakukan dengan menganalisis relevansi latar, alur, dan penokohan dengan unsur cerita yang lain lalu analisis tersebut menjadi pijakan untuk menganalisis mitos yang ada dalam masyarakat.Hasil penelitian menunjukkan bahwa bentuk-bentuk mitos dalam dua cerpen meliputi benda keramat, wisik, tumbal dan sesaji, serta firasat dan tanda-tanda lainnya. Mitos-mitos tersebut hanya berlaku dalam masyarakat sampai dibuktikan ketidakbenarannya.

ldquo Kaki Malaikat rdquo and ldquo Topeng Malaikat rdquo are two short stories that have a cultural theme. In those two short stories, there are myths that are believed by the society. These myths are the result of human thinking in a certain society over the phenomena that arise in life. This study aims to explain the myths that appear in KM and TM short stories, and how the society believe in these myths.This research is conducted by qualitative descriptive method through the stages of data collection, data selection, data analysis, and conclusion.The approaches used are structural approaches to assess the structure of short stories and sociologicalreviews with the myth theory of Barthes dand Zeffry to examine the society believe in myths. The data analysis is done by analyzing the relevance of background, plot, and characterization with other elements of the story. Then the data analysis becomes the base to analyze the existing myths in the society.The results show that the forms of myth in two short stories include sacred objects, wisik, sacrifices and offerings, premonition and other signs. These myths only apply in the society until they are proved not true."
