The australian support mobilized many people and lasted until august 1999, when the popular consultation was held in east timor following the decision to make it happen by indonesian president habibie, who had replaced suharto to the previous year. "Tesis ini menganalisis tentang studi kasus aneksasi Timor Timur dan jejaring advokasi transnasional, the East Timor and Indonesia Action Network (ETAN dengan menggunakan konsep pola bumerang (Keck dan Sikkink, 1998) dan siklus hidup norma (Finnemore dan Sikkink, 1998). Tesis ini menyimpulkan bahwa norma yang diinternalisasi tidak dapat berjalan dikarenakan adanya benturan antara norma internasional dan struktur domestik. Benturan ini terjadi ketika norma internasional yang menghendaki hak untuk menentukan nasib sendiri ditantang pada kepentingan negara untuk menjaga kedaulatan. Oleh sebab itu, aktor transnasional membutuhkan kemampuan non-material yakni, kekuatan diskursus untuk melawan nilai dan norma yang dianggap tidak sejalan dengan kesepakatan internasional. Selain itu, juga dibutuhkan satu mekanisme yang simultan antara aktor domestik dan transnasional untuk menekan dan mempengaruhi kebijakan maupun perilaku negara.
This thesis analyzes the study case of East Timor annexation and transnational advocacy network, the East Timor and Indonesia Action Network (ETAN) by using the concept of boomerang pattern (Keck and Sikkink, 1998) and norm lifecycle (Finnemore and Sikkink, 1998). This thesis concluded that internalized or cascading norms may eventually fail to reach because of the clash between international and domestic structure. These norms clash occur when the right of self-determination is challenged by the norm of state sovereignty. Hence, transnational actors need the immaterial capability as power in discourse to counter the existing logic of appropriatness and also by creating a simultaneous mechanism between domestic and transnational actors to pressure and influence on policy change and state behavior."

"This study focuses on the prohibition of sexual violence in armed conflict based on the provision of various international treaties and the sanctions that imposed on perpetrators of sexual violence according to the Rome Statute of International Criminal Court. The analysis on the provision of the Rome Statute of International Criminal Statute and its application in some cases of sexual violence in the Democratic Republic of the Congo. This study is based on the results of literature study with normative juridical method. Based on the result of this study, the provisions of the prohibition of sexual violence has not been properly applied in some cases that occur in armed conflict in the Democratic Republic of the Congo. Therefore, in addition to the provision of regulation, it is also necessary to establish the system of evidence that could facilitate the implementation of the sanctions to the perpetrators of sexual violence in armed conflicts.
Skripsi ini membahas mengenai larangan dilakukannya kekerasan seksual dalam konflik bersenjata berdasarkan perumusan dalam berbagai perjanjian internasional dan sanksi yang diberikan kepada pelaku kekerasan seksual berdasarkan statuta peradilan internasional. Analisa mengenai perumusan kekerasan seksual didasari pada ketentuan dalam Rome Statute of International Criminal Court dan penerapannya dalam kasus kekerasan seksual yang terjadi di Democratic Republic of the Congo. Penelitian ini disusun berdasarkan studi kepustakaan dengan metode yuridis normatif. Berdasarkan hasil penelitian, perumusan mengenai larangan kekerasan seksual belum dapat diterapkan secara baik dalam beberapa kasus yang terjadi pada konflik bersenjata di Democratic Republic of the Congo. Oleh karena itu, selain rumusan pengaturan, diperlukan pula sistem pembuktian yang dapat mempermudah dilakukannya penerapan saksi bagi pelaku kekerasan seksual dalam konflik bersenjata."
