Negara Indonesia melindungi dan menjamin hak asasi manusia setiap warga negaranya sebagaimana yang telah tertulis pada Pasal 28A sampai dengan 28I UUD 1945. Dengan adanya jaminan dari negara atas hak-hak tersebut, bukan berarti negara telah membuka pintu seluas-luasnya kepada warganya untuk melakukan segala macam perbuatan tanpa batas, sebagaimana yang ada pada Pasal 28J UUD 1945. Lesbian Gay Bisexual and Transgender merupakan sebuah penyimpangan dalam perilaku seksual.Beberapa kelompok di negara-negara eropa membungkus bentuk penyimpangan tersebut dengan sebuah “bungkus” yang bernama hak asasi manusia guna justifikasi terhadap prilaku homoseksual dan legalisasi perkawinan sejenis. Dalam penelitian ini mempunyai dua rumusan masalah yaitu; I) Bagaimana pandangan Hak asasi manusia di Indonesia terhadap perkawinan sesama jenis dan perbuatan homoseksual? II) Bagaimana norma hukum yang berlaku di Indonesia dalam menyikapi fenomena perkawinan sejenis dan perbuatan homoseksual kaum  LGBT dengan mempertimbangkan Hak Asasi Manusia? Penelitian ini merupakan penelitan normatif dengan sumber data sekunder. Menggunakan teknik pengumpulan data dengan studi pustaka dan wawancara. Sedangkan analisis data mengunakan analisis kualitatif sehingga bentuk penelitian ini merupakan penelitian evaluatif. Pendekatan yang dilakukan adalah pendekatan konsep, pendekatan perundang-undangan dan pendekatan sejarah. Pada akhirnya penelitan ini menyimpulkan I) berdasarkan cara pandang theosentris perkawinan sejenis dan prilaku homoseksual bukan merupakan hak asasi manusia, sedangkan berdasarkan cara pandang antroposentris, sebaliknya. II) Indonesia adalah negara yang menganut teori hukum alam irasional dengan pandangan theorisentris, sehingga prilaku homoseksual dan perkawinan sejenis sejatinya telah bertentangan dengan Pancasila dan norma hukum yang berlaku. Penelitian ini menyarankan agar Pemerintah Indonesia merumuskan adanya norma hukum yang melarang prilaku homoseksual dan perkawinan sejenis.


The Indonesian state protects and guarantees the human rights of every citizen. Protection of these rights is written in Articles 28A through 28I of the 1945 Constitution of the Republic of Indonesia. With the guarantee from the state of the rights possessed by each citizen, it does not mean that the state has opened the widest possible door for its citizens to do all kinds of actions according to their own personal desires without clear boundaries. In Article 28J of the 1945 Constitution, according to Article 28J paragraph (2) of the 1945 Constitution Lesbian Bisexual and Transgender Gay is a deviation in sexual behavior. Some groups in European countries wrap the form of deviation with a "wrapper" called human rights for justification of homosexual behavior and the legalization of similar marriage. In this study there are two formulation of the problem, namely; I) What is the view of human rights in Indonesia towards same-sex marriage and homosexual behavior of LGBT people? II) What are the legal norms in force in addressing the phenomenon of similar marriages and homosexual behavior of LGBT people by considering human rights? This research is normative research with secondary data sources consisting of primary legal materials, secondary legal materials, and tertiary legal materials. Using data collection techniques with literature studies and interviews. While the data analysis uses qualitative analysis so that the form of this research is evaluative research. The approach taken is the conceptual approach, legislative approach and historical approach. The purpose of this study is I) The purpose of writing this paper is to explain more about the human rights perspective in Indonesia in addressing homosexual behavior of LGBT people and same-sex marriage. II) to explain the legal norms in Indonesia in responding to homosexual behavior of LGBT people and same-sex marriage based on consideration of the concept of human rights in Indonesia In the end, this research concludes I) that based on irrational natural law theory with theorocentric views will see homosexual and marital behavior of a kind not part of human rights, but based on rational natural law theory with an anthropocentric view will see this as part of human rights. II) Indonesia is a country that adheres to irrational natural law theory with a theoretic view, so that homosexual and marital behaviors of a kind have actually contradicted Pancasila, Law Number 1 of 1974 concerning Marriage and Law Number 39 of 1999 concerning Human Rights Suggestions from this study suggest that the Indonesian Government formulate legal norms that prohibit similar homosexual and marital behavior.

"ABSTRAK
Tesis ini menganalisis mengenai perkembangan Lesbian, Gay, Bisex, dan Transgender di
wilayah Jakarta Selatan. Permasalahan yang berkembang dimasyarakat bahwa salah satu badan
PBB yakni United Nations Development Programme (UNDP) akan mengucurkan dana untuk
mendukung dan membesarkan komunitas Lesbian, Gay, Biseksual, dan Transgender (LGBT) di
Indonesia. Dalam menganalisis permasalahan tersebut, penulis menggunakan teori Etika
Imperatif Kategoris Immanuel Kant dan Etika Situasi menurut Joseph Fletcher, Teori Sosiologi
tentang Perubahan Sosial menurut Parsudi Suparlan, Teori Penyimpangan Seksual menurut Tb.
Ronny Nitibaskara, Teori Hak Asasi Manusia menurut Koesparmono Irsan, Teori Hiperrealitas
dalam Media Massa menurut Jean Baudrillard, dan konsep Pemolisian Masyarakat (Community
Policing). Penulis menggunakan teori tersebut sebagai pisau analisis untuk mengupas teori dan
dikaitkan dengan fakta yang ada. Analisis yang penulis tuangkan pada tesis ini akan dikaitkan
antara teori dan fakta yang ada, tiap teori dihubungkan dengan fakta-fakta yang ada. Fakta
menunjukkan bahwa kelompok LGBT diperlukan pendekatan secara persuasif oleh anggota
Kepolisian Negara Republik Indonesia dalam merangkul mereka sebagai kelompok masyarakat.
Solusi yang dapat dilakukan oleh anggota Kepolisian Negara Republik Indonesia dalam
medekatkan diri kepada kelompok LGBT yakni menonjolkan sifat kasih sayang pada mereka dan
menjalankan tugas pokoknya sebagai anggota Kepolisian Negara Republik Indonesia dengan
penuh rasa tanggung jawab secara moral dengan kata lain demi kewajiban. Kesimpulan yang
dapat penulis ambil dari tesis ini bahwa kelompok LGBT bukan kelompok yang dijauhi karena
mereka memiliki hak yang sama dan sebagai anggota Kepolisian Negara Republik Indonesia
wajib memberikan pendekatan kepada mereka. Selain itu, dalam bertindak anggota Kepolisian
Negara Republik Indonesia senantiasa menjunjung tinggi Hak Asasi Manusia (HAM) termasuk
dalam memberikan arahan dan pendekatan kepada kelompok LGBT

ABSTRACT
This thesis analyses the phenomenon of Lesbian, Gay, Bisexual, and Transgender
in South Jakarta. Rumour has shown that United Nations Development Program
(UNDP) will donate their movement in Indonesia. Within the context of analysis,
there are several theories and one concept will be put to use, such as categorical
imperative theory by Immanuel Kant, situation ethic by Joseph Fletcher,
sociological theory of social change by Parsudi Suparlan, sexual deviance theory
by Tb. Ronny Nitibaskara, human rights theory by Koesparmono Irsan, hyperreality
theory in mass media by Jean Baudrillard, and community policing
concept. In terms of police duty, Lesbian, Gay, Bisexual, and Transgender need to
care with persuasive approach as a part of society. Indonesian National Police
(INP) must get closer to them in order to fulfil their social responsibilities. As a
conclusion, Lesbian, Gay, Bisex, and Transgender isn?t prohibited group in
society because they are equal in society. Indonesian National Police needs to
uphold human rights value in every way. In terms of police duty, Lesbian,Gay,
Bisexual, and Transgender need to care with the persuasive approach as a part of
society. Indonesian National Police must use persuasive approach to encourage
them as a social group. They need to treat them carefully by using their
consciousness (moral value) as a human. Indonesian National Police must closer
to them in order to fulfil their social responsibilities. As a conclusion, LGBT
aren?t prohibited group in society because they are equal in society. Indonesian
National Police needs to uphold human rights value in every way"

"ABSTRAK
Perilaku konsumen adalah hal yang terus menarik dibahas dalam bisnis. Jika tidak
ada konsumen, sudah tentu bisnis tidak akan berjalan. Persaingan yang ketat di era
globalisasi membuat perusahaan harus terus menjaga kredibilitas merek dan loyalitas
konsumen. Penelitian Alam et al (2012) menyatakan bahwa agama menjadi aspek
penting dalam proses pembelian. Konsumen cenderung akan membeli produk dari
merek yang sesuai dengan ajaran agama konsumen (Alam et al : 2012). Berdasarkan
penelitian tersebut, penelitian ini bertujuan untuk menganalisis apakah terdapat
pengaruh antara brand credibility terhadap customer loyalty. Serta apakah variabel
religious orientation menjadi variabel moderator antara brand credibility dan
customer loyalty di Universitas Indonesia pasca dukungan Kafe Kopi terhadap
komunitas LGBT (Lesbian, Gay, Bisexual dan Trangender). Penelitian ini
menggunakan pendekatan kuantitatif. Pengambilan sampel dalam penelitian ini
dilakukan dengan menggunakan sampel penelitian sebanyak 100 orang mahasiswa/i
di Universitas Indonesia. Instrumen penelitian ini menggunakan kuesioner dan
dianalisis menggunakan linier regression dan moderated regression analysis. Hasil
dalam penelitian menemukan bahwa kredibilitas merek menjadi aspek yang lebih
berpengaruh daripada aspek agama terhadap customer loyalty. Hasil penelitian ini
menunjukkan bahwa terdapat pengaruh antara brand credibility terhadap customer
loyalty serta variabel religious orientation tidak menjadi variabel moderator antara
antara brand credibility terhadap customer loyalty pada Kafe Kopi di Universitas
Indonesia.

ABSTRACT
Consumer behavior is something that continues to attract discussion in the business.
Consider reversing, business will not run without consumers. Intense competition in
the era of globalization makes companies have to continue to maintain the credibility
of the brand and customer loyalty. Alam et al (2012) stated that religion became one
of important aspect of the purchasing process. Consumers tend to buy products from
brands that conform to religious teachings consumers (Alam et al : 2012). Based on
these studies, this study aimed to analyze whether there is influence between brand
credibility of the customer loyalty and whether the variable religious orientation
become a moderator variable between brand credibility and customer loyalty in the
University of Indonesia after the support Kafe Kopi against the LGBT (Lesbian, Gay,
Bisexual and transgender). This study uses a quantitative approach. The samples in
this study conducted using sample of 100 students at the University of Indonesia. The
research using questionnaires and analyzed using linear regression and moderated
regression analysis. Results of the study found that the credibility of the brand
become more influential aspects than the religious aspects of the customer loyalty.
The results of this study indicate that there is influence between the brand and
customer loyalty as well as the credibility of the religious variable orientation did not
become a moderator variable between the brand credibility of the customer loyalty at
Kafe Kopi at the University of Indonesia"

"ABSTRAK
Penelitian ini membahas tentang upaya representasi self appointed yang dilakukan oleh kelompok lesbian, gay, biseksual, transgender/transeksual, dan interseks (LGBTI) sebagai komisioner Komisi Nasional Hak Asasi Manusia (Komnas HAM) Periode 2012-2017. Dengan metode kualitatif dan jenis penelitian eksplanatif, penelitian ini menggambarkan upaya reprentasi self appointed kelompok LGBTI sebagai komisioner Komnas HAM. Mami Yuli dan Dede Oetomo adalah wakil dari kelompok LGBTI yang maju sebagai calon komisioner Komnas HAM. Melalui analisis menggunakan teori representasi self appointed, the politics of presence, subaltern counterpublics, dan gerakan sosial baru, hasil penelitian memperlihatkan bahwa adanya hambatan eksternal dan internal dari perjuangan representasi self appointed Mami Yuli dan Dede Oetomo. Hambatan eksternal dipahami berasal dari masyarakat dan DPR, sedangkan hambatan internal berasal dari gerakan LGBTI. Penelitian ini berkesimpulan bahwa upaya representasi self appointed kelompok LGBTI belum berhasil sebagai komisioner Komnas HAM. Hal ini dapat dipahami bahwa LGBTI belum mendapatkan pengakuan dari masyarakat dan negara.

ABSTRACT
This thesis describe about lesbian, gay, bisexual, transgender/transexual,and intersex (LGBTI) group in their self appointed representation effort as commisioner(s) in The National Commision of Human Rights (Komnas HAM) on 2012-2017 period. Using qualitative method and explanative type of research, this study describe self appointed representation effort of LGBTI group to become commisioner(s) in Komnas HAM. Mami Yuli and Dede Oetomo are the candidates that represent the LGBTI group itself. Through analysis using theories of selfappointed representation,the politics of presence, subaltern counterpublics, and the new social movements, this study findings show several obstacles, both external and internal, on Mami Yuli and Dede Utomo's struggle on doing their self appointed representation effort. The external obstacles have been realized come from the society and the council, while the internal obstacles come from LGBTI movements. In summary, this study shows that self appointed representation effort on LGBTI group has not earned a success as commisioner(s) in Komnas HAM. It could be understood that LGBTI has not gained any recognition from the society and the government."

"Penelitian ini bertujuan untuk mengkaji ujaran kebencian dalam pernyataan-pernyataan pejabat negara yang dikutip dalam pemberitaan media daring Kompas selama tahun 2016. Teori yang digunakan dalam penelitian ini adalah Queering Criminology. Dalam kaitannya dengan hubungan LGBT dengan negara, seringkali timbul pertanyaan mengenai siapa yang memiliki kekuasaan dan bagaimana orang-orang kuat yang paling politis berpengaruh.Metode yang digunakan dalam penelitian ini adalah analisis wacana kritis.
Temuan data dalam penelitian ini berupa 20 berita dengan kutipan pernyataan pejabat negara terkait LGBT. Temuan data menunjukkan adanya 18 berita yang merupakan ujaran kebencian karena mengandung pernyataan diskriminatif, mengandung stereotipe, antagonis, dan merendahkan martabat, sementara 2 lainnya tidak mengandung ujaran kebencian. Pejabat negara dan media telah sama-sama menjadi agen pembentuk wacana kebencian. Hal tersebut berdasarkan pandangan kritis dapat disebut sebagai kejahatan.

Title Hate Speech by the Ruler against Lesbian, Gay, Bisexual, and Transgender in Media as Crime An Analysis of State Official 39 s Statement in Kompas Media Online News 2016 This study aims to examine hate speech in the statements of officials who are in the media coverage online Kompas during 2016. The theory used in this study is Queering Criminology. In his relationship between LGBT with the state, appear the question about who has power and a very moderate political person. The method used in this research is critical discourse analysis.
The data finding in this research is 20 news with quotation of opinion of LGBT related official. The findings of the data indicate 18 news which are hate speech because they contain discriminatory assumptions, containing stereotypes, antagonists, and degrading, while the other two are not contained by hate speech. State officials and the media have become equally hate shaping agents. Based on critical perspective, it can be called a crime.
