"Sejak awal penciptaan karya Fan-art dan kegiatan komersialisasi Fanmerchandise, berbagai pertanyaan mengenai status serta perlindungan hukum hak cipta yang diberikan kepada pencipta karya Fan-art atau Fan-artist terus dipertanyakan. Hal ini dikarenakan penciptaan karya tersebut dibuat tanpa ada izin dari pencipta dan/atau pemilik hak cipta. Dalam penelitian ini menunjukkan bahwa karya Fan-art dan Fanmerchandise merupakan karya turunan yang tidak memiliki izin sehingga tidak mendapatkan perlindungan hak cipta dan merupakan pelanggaran hak moral dan/atau hak ekonomi pencipta dan/atau pemilik hak cipta. Namun, dengan menggunakan doktrin Fair Use, karya Fan-art dan Fanmerchandise memiliki kemungkinan untuk mendapat perlindungan. Apabila karya Fan-art dan Fanmerchandise dimodifikasi sehingga memiliki kesamaan substansial yang minim dari karya aslinya, maka akan menghasilkan Karya Transformatif yang akan dilindungi oleh hak cipta. Karya Fan-art dan Fanmerchandise tersebut juga secara tidak langsung mempromosikan atau memberikan fasilitas iklan gratis kepada pencipta dan/atau pemilik hak cipta dalam sebuah penggunaan internet disebut dengan Participative Web, sehingga memiliki kemungkinan untuk tidak mengganggu lalu lintas pasar pencipta dan/atau pemilik hak cipta.

Since the beginning of the creation of Fan-art and the commercialization of Fan-merchandise, various questions regarding the status and legal protection of copyright given to the creators of Fan-art works or Fan-artists have continued to be questioned. This is because the creation of the Fan-art work was made without permission from the creator and/or copyright owner of the original work. In this study, normative legal research methods and literature are used to show that Fan-art and Fanmerchandise works are derivative works that do not have permission so that they do not obtain a copyright protection and constitute a violation of the moral rights and/or economic rights of the creator and/or copyright owner of the original work. However, by using the Fair Use doctrine, Fan-art and Fanmerchandise works have the possibility of gaining protection. If Fan-art and Fanmerchandise works are made in such a way that they have minimal substantive similarities to the original works, they will produce Transformative Works which will be protected by copyright. The Fan-art and Fanmerchandise works also indirectly promote or provide free advertising facilities to creators and/or copyright owners of the original works in an internet use called Participative Web. so that it has the possibility not to interfere with the market traffic of creators and/or copyright owners of the original works."

"Penelitian ini akan menganalisis perubahan-perubahan yang terdapat dalam pengadaptasian sosok Youkai pada karya budaya populer. Analisis akan dilakukan dengan membandingkan dua karya budaya populer yang menggunakan Youkai sebagai tema utamanya. Hasil dari artikel ini akan menyatakan dampak atau pengaruh dari perubahan imaji Youkai dalam budaya populer terhadap citra Youkai yang sebelumnya diketahui melalui folklore Jepang.

This research will analize the differences that exist within folklore's Youkai adaptation into pop culture works. Analizying the works will be done by comparing both pop culture works which use Youkai as its main theme. The results of this journal will explain the impact of Youkai's pop culture image changes towards Youkai's image that was previously known from Japanese's folklore."
