"Skripsi ini membahas wasiat wajibah sebagai pengganti hak kewarisan bagi istri beda agama (non-muslim) menurut hukum Islam. Pokok permasalahannya adalah apakah pemberian wasiat wajibah kepada istri beda agama dibolehkan menurut hukum Islam, dan apakah Putusan Mahkamah Agung R.I Nomor: 16 K/AG/2010 telah sesuai dengan hukum Islam. Penelitian ini merupakan penelitian yuridisnormatif dengan menggunakan metode deskriptif-analitis. Dapat disimpulkan bahwa istri beda agama tidak boleh menerima wasiat wajibah karena tidak termasuk orang yang wajib diberikan wasiat dengan berdasarkan Q.S. Al-Baqarah [2]: 180 dan 240, dan lebih banyak mudaratnya. Putusan Mahkamah Agung Nomor: 16 K/AG/2010, ada yang belum sesuai dengan hukum Islam, yaitu memberikan wasiat wajibah kepada istri beda agama, bagian wasiat wajibah tidak dikeluarkan terlebih dahulu dibandingkan bagian warisan, dan menyatakan adanya harta bersama padahal perkawinan beda agama keduanya tidak sah.
This thesis discusses the obligatory bequest (wasiat wajibah) as substitute of inheritance rights for wife of different religions (non-Muslims) according to Islamic law. The problems are whether giving of obligatory bequest (wasiat wajibah) to wife of different religions is allowed under Islamic law, and whether the Supreme Court Decision No.: 16 K/AG/2010 in accordance with Islamic law. This research is a juridicial-normative by using descriptive-analytical method. It can be concluded that the wife of different religions can not accept obligatory bequest (wasiat wajibah) because she is not included in the group of people that must be given a testament according to Q.S. Al-Baqarah [2]: 180 and 240, and more harm. The Supreme Court of R.I. Decision No. 16 K/AG/2010, there are matter that is not in accordance with Islamic law, that is gives the obligatory bequest (wasiat wajibah) to wife of different religions, obligatory bequest (wasiat wajibah) has not been given first, and declare the joint property of parties whereas the interfaith marriage are invalid."

ABSTRAKSuicide attacks are a recurrent feature of many conflicts. Whereas warfare heroism and martyrdom are allowed in certain circumstances in times of war, a suicide bomber might be committing at least five crimes according to Islamic law, namely killing civilians, mutilating their bodies, violating the trust of enemy soldiers and civilians, committing suicide and destroying civilian objects or properties. The author examines such attacks from an Islamic jus in bello perspective."
