Penelitian ini mengambil permasalahan pertanggungjawaban pidana korporasi di bidang informasi dan transaksi elektronik terkait e-commerce pada  saat ini, tata cara penanganan perkara tindak pidana korporasi di bidang informasi dan transaksi elektronik terkait  e-commerce serta pertanggungjawaban pidana korporasi di bidang  informasi dan transaksi elektronik terkait  e-commerce pada masa  yang akan datang. Metode pendekatan yang digunakan dalam penelitian ini menggunakan metode penelitian yuridis normatif yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder sebagai bahan dasar untuk diteliti dengan cara mengadakan penelusuran terhadap peraturan peraturan dan literatur-literatur yang berkaitan dengan permasalahan yang diteliti.  Dalam Penelitian masalah hukum dengan pendekatan normatif, maka peneliti harus melakukan pengamatan dengan mempelajari dan menjelaskan data sekunder, yang disebut dengan metode studi kepustakaan sebagai patokan untuk mencari data dan gejala atau peristiwayang menjadi objek penelitian  Dari penelitian yang telah dilakukan ditemukan pertanggungjawaban pidana korporasi dalam bidang  informasi dan transaksi elektronik terkait e-commerce saat ini  baik KUHP, Undang-Undang  Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen, dan Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik masih memiliki kekurangan mengenai pengaturan korporasi sebagai subjek hukum, kapan korporasi melakukan tindak pidana siapa yang dapat dipertangggungjawabkan, bagaimana pertanggungjawabannya serta tata cara penanganan perkara tindak pidana korporasi di bidang informasi dan transaksi elektronik terkait  e-commerce. Oleh karena itu kebijakan formulasi pertanggungjawaban pidana korporasi untuk masa yang akan datang perlu dilakukan perubahan dan memperhatikan beberapa hal dalam penyempurnaannya untuk mewujudkan tujuan hukum dalam mencapai keadilan, kepastian dan kemafaatan.


This study takes the issue of corporate criminal liability in the field of information and electronic transactions related to e-commerce at present, procedures for handling corporate criminal acts in the field of information and electronic transactions related to e-commerce and  as well as corporate criminal liability in the field of information and electronic transactions related to e -commerce in the future. The method of approach used in this study uses normative juridical research methods, namely legal research conducted by examining library materials or conducting a search of regulations and literature relating to the problem. In researching legal issues with a normative juridical, the researcher must conduct research by studying and explaining secondary data, as a guide for finding data and events that are the object of research. From the research that has been found, corporate criminal liability in the field of information and electronic transactions related to e-commerce today are KUHP, Undang-Undang  Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen, dan Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik still has deficiency regarding the regulation of the corporation as a legal subject, who can be accounted when the corporation commits a crime, and how corpotarate criminal liability responsibility and procedures for handling corporate criminal acts. Therefore, the policy on the formulation of corporate criminal liability for the future needs to be changed and pay attention to several things to realize the legal goals in achieving justice, certainty and morality

"Konsep Joint Criminal Enterprise pertama kali diperkenalkan oleh Pengadilan Pidana Internasional untuk bekas wilayah Yugoslavia di dalam kasus Tadic pada tahun 1999. Setelah kasus Tadic, konsep Joint Criminal Enterprise diterapkan di berbagai pengadilan pidana internasional dan pengadilan hybrid supranasional untuk kasus kejahatan internasional. Di Indonesia, Kitab Undang-undang Hukum Pidana memuat konsep penyertaan, sebuah konsep yang menyerupai Joint Criminal Enterprise.
Tulisan ini membahas pengertian dan perkembangan konsep Joint Criminal Enterprise, penerapan Joint Criminal Enterprise di dalam pengadilan pidana internasional dan pengadilan hybrid supranasional, serta analisis kesamaan konsep Joint Criminal Enterprise dengan konsep penyertaan menurut hukum Indonesia dan apakah konsep Joint Criminal Enterprise dapat diterapkan di dalam Pengadilan HAM di Indonesia.

The concept of Joint Criminal Enterprise was first introduced by the International Criminal Tribunal for the Former Yugoslavia in the 1999 Tadic case. The concept was then applied in various international criminal tribunals and hybrid criminal courts for cases of international crimes. In Indonesia, the criminal code prescribes the concept of joint perpetration, a concept that is similar to the concept of Joint Criminal Enterprise.
This thesis discuses the definition and development of the concept of Joint Criminal Enterprise, the application of Joint Criminal Enterprise in various international criminal tribunals and hybrid criminal courts, as well as the concept of Joint Criminal Enterprise and its association with the concept of joint perpetration under Indonesian law. Finally, this thesis discusses whether Joint Criminal Enterprise can be applied in the Human Rights Court in Indonesia.
