Namun, belum ada harmoni antara kewajiban internasional Indonesia dengan hukum nasionalnya dan implementasi yang ada di masyarakat. Peraturan perundang-undangan dan kebijakan yang ada masih bersifat diskriminatif dan menghilangkan esensi dari hak tersebut. Kasus kekerasan terhadap jemaah Ahmadiyah dan tumpang tindihnya peran negara dalam perkawinan lintas agama dan kepercayaan adalah cerminan bahwa hak atas kebebasan beragama dan berkeyakinan di Indonesia belum dilindungi sepenuhnya.

Freedom of religion and beliefs is protected by Article 18 of the International Covenant on Civil and Political Rights which Indonesia has ratified. It creates international obligation for Indonesia to put the Covenant into effect. However, there is inconsistency between Indonesia international obligation with its national law and the implementation in society. It can be reflected by many discriminative national laws that degrading the essence of the right to freedom of religion and beliefs. Violence towards Ahmadiyah people and mixed administration in interfaith marriage demonstrated that the right to freedom of religion and beliefs has not yet been fully protected in Indonesia."

"Penelitian ini mengeksplorasi mengapa Perancis membatasi freedom to manifest religion perempuan minoritas Muslim dengan burqa dan niqab pada 2010, padahal itu bertentangan dengan norma-norma Hak Asasi Manusia internasional, dapat melanggengkan subordinasi minoritas Muslim, serta dapat menghalangi penggunanya untuk keluar ke ranah publik. Penelitian ini menggunakan metode studi kasus dengan cara analisis interpretif, menggunakan konsep freedom to manifest religion dan asimilasi sebagai kerangka pikir utama. Hasil penelitian menunjukkan bahwa pembatasan freedom to manifest religion dimungkinkan karena kebebasan ini tidak bersifat absolut. Perancis menjustifikasi burqa dan niqab tidak sesuai dengan nilai Liberté, karena tidak menghargai hak perempuan dan lekat dengan fundamentalisme agama yang dapat menghambat proses asimilasi. Larangan ini mencerminkan kembalinya negara koersif dalam politik internasional kontemporer, dengan Perancis yang menegaskan kembali kesatuan identitasnya di tengah kemunduran ekonomi, imigrasi massal, dan globalisasi.

This research explores why France restricts the freedom to manifest religion of Muslim minority women by banning the burqa and niqab in 2010, despite its contradiction with international norms of human rights, its potential to perpetuate the subordination of Muslim minority, and its possibility to curb the wearer to be in public sphere. This is a case study research with interpretive method of analysis, using the concept of freedom to manifest religion and assimilation as the main framework of thinking. The research shows that the restriction is possible due to the non-absolutist nature of freedom to manifest religion. France justifies burqa and niqab incompatible with the value of Liberté, for they are oppressing women?s rights and related to religious fundamentalism which will hinder the assimilation process. The ban reflects ?the return of coercive state? in contemporary international politics, with France recalling its indivisible identity in the midst of economic downturn, mass immigration, and globalization."
