"ABSTRACT
On May 24, 2017, the world was impressed by the decision made by the justices of the constitutional court in Taiwan regarding the constitutionality of the legal ban on same sex marriages. both the opposing opinions in such debate have assumed that social activities view these two paths, the legislative and the court, as contradictory to each other. This paper thus argue that the marriage equality movement in Taiwan viewed these strategies, both legislation and litigation, as parallel, rather than mutually exclusive, paths to achive its goal."

"Skripsi ini membahas tentang perdamaian di luar pengadilan yang dilakukan oleh para pihak dalam bentuk akta otentik yang dibuat di hadapan Notaris setelah adanya putusan Banding yang telah berkekuatan hukum tetap (inkracht). Perdamaian sebagaimana dimaksud dibuat dalam bentuk akta perdamaian, yang mana secara hukum memiliki sifat mengikat dan terakhir (final and binding). Dalam penelitian ini, penulis melakukan peninjauan terhadap Putusan No. 135/PDT/2006/PT.DKI dan Akta Perdamaian Nomor 14 Tanggal 12 Juli 2007 khususnya terkait permasalahan dalam hal salah satu pihak tidak melaksanakan isi dari akta perdamaian yang telah dibuat di hadapan Notaris setelah adanya putusan pengadilan tinggi yang berkekuatan hukum tetap (inkracht). Pada kasus ini, akta perdamaian sebagaimana dimaksud dikesampingkan dan para pihak berkewajiban untuk kembali tunduk pada putusan pengadilan tinggi yang telah berkekuatan hukum tetap (inkracht).

This Thesis is discussing about the reconciliation of the parties in an authentic Deed which made before the Notary after the High Court Verdict which is a final and binding by the law (inkracht). In this research, the Writer also doing a review on Court's Verdict No. 135/PDT/2006/PT.DKI and Deed of Reconciliation No. 14 Dated 12 July 2007, particularly for the problems which related with one of the parties did not implement the content(s) of the Deed of Reconciliation after the High Court Verdict. In this case, Deed of Reconciliation has been ruled out and the parties must obey the High Court Verdict."

"The scheme of checks and balances in the process of legislation in various countries, experienced a shift after judical review accommodated. Legislation does not only involve exeecutive institutions and the parliament bbut also the judiciary. Judicial review is a channel for the expression of public dissent against the decision taken by the legislators. Through the authority of judical review, the Constitutional Court may overturn legislation. This is not because the Constutional Court is in a superior position but becausae judical review is an instrument of the checks and balances mechanism among institutions in the legislative process. Therefore, the presence of the Constitutional Court with powers of judical review should be understood in order to contribute to the democratization in the legislation process."

"Skripsi ini membahas mengenai perbuatan melawan hukum dalam bidang keperdataan karena pencemaran nama baik. Penelitian ini merupakan penelitian yuridis-normatif normative legal research dengan studi kepustakaan. Metode penelitian tersebut digunakan untuk menjawab permasalahan: pertama, teori dan pengaturan perbuatan melawan hukum dalam bidang keperdataan serta teori dan pengaturan tentang pencemaran nama baik. Perbuatan melawan hukum diatur di dalam Pasal 1365 sampai 1380 KUH Perdata, sedangkan pencemaran nama baik diatur di dalam Pasal 1372 sampai 1380 KUH Perdata dan Pasal 27 ayat 3 UU ITE jo Pasal 310 sampai 320 KUH Pidana. Kedua, perlu atau tidaknya putusan pidana untuk mengajukan gugatan perdata karena pencemaran nama baik. Tidak adanya pengaturan mengenai kewajiban tersebut menimbulkan perbedaan pendapat di putusan Hakim. Ketiga, analisis terhadap pertimbangan hakim di dalam Putusan No. 134/Pdt. G/2010/PN.Jkt.Ut.
Hasil penelitian ini menyarankan bahwa: i Definisi “penghinaan” dalam bidang Hukum Perdata perlu dibuat, sehingga tidak menimbulkan ambiguitas dengan menggunakan terminologi Hukum Pidana; ii Pengaturan mengenai tidak perlunya putusan pidana dalam mengajukan gugatan pencemaran nama baik perlu diatur sehingga menimbulkan kepastian hukum dan tidak terjadi perbedaan pendapat diantara hakim; iii Penggugat seharusnya meminta kepada hakim untuk rehabilitasi nama baik dan kehormatan dengan cara penempelan putusan di muka umum dan agar Tergugat membuat pernyataan bahwa perbuatan yang dilakukannya adalah fitnah.

This thesis discusses the unlawful act in the field of civil cases for defamation. This research is a juridical-normative legal normative research with a literature study. The research methods used to answer the problems: first, the theory of unlawful act and its regulation as well as the theory and the regularion of defamation. Unlawful act is regulated in Article 1365 until 1380 Civil Code, while defamation is regulated in Article 1372 to the 1380 Civil Code and Article 27 paragraph 3 ITE Law in conjunction with Article 310 to 320 of Penal Code. Second, is criminal verdict necessary or not to file a civil lawsuit for defamation. This lack of regulation caused diifferent opinion in the Judge's decision. Third, analysis of the judges' considerations in the Verdict No. 134/Pdt. G/2010/PN.Jkt.Ut.
The result of this study suggest that: i Definition of "defamation" in the field of civil law needs to be made, because to avoid ambiguity by using the terminology of the Penal Code, ii There is need the regulation that criminal verdict is not necessary to file a civil lawsuit for defamation, in order to certainty of law and no different of opinion among the judges; iii Plaintiff's should request for rehabilitation of the reputation and honor by way of settlement decisions in public and that defendant made a statement that his act of doing is defamation.

"Skripsi ini membahas self-determination sebagai dasar pelaksanaan referendum Falkland Islands 2013. Penelitian ini mengangkat isu self-determination, termasuk definisi referendum secara umum. Skripsi ini menjelaskan status hukum Falkland Islands dan menganalisis legalitas referendum itu sendiri dalam hukum internasional. Sifat penelitian ini berfokus pada keabsahan pelaksanaan referendum Falkland Islands, melalui hak self-determination yang tercantum dalam instrumen hukum internasional, termasuk juga batasan-batasannya. Hasilnya, skripsi ini menyimpulkan bahwa beberapa aspek dari referendum Falkland Islands 2013 tidak sesuai dengan hukum internasional.

This research discusses self-determination as an underlying cause of the Falkland Islands’ referendum in 2013. This research raises the issue of self-determination, including its broad definition, then explains the legal status of Falkland Islands in international law. Lastly, this research analyzes the legality of the referendum itself in regards to international law. The nature of this research focuses on the legality of the Falkland Islands’ referendum, through the exercise of the right to self-determination enshrined in international law instruments, including its limitations. As a result, this research concludes that some aspects of the Falkland Islands’ referendum is not in accordance with international law.

"Wewenang Komisi Pengawas Persaingan Usaha (KPPU) untuk melakukan pengawasan dalam perkara kemitraan terdapat dalam Pasal 36 UU No. 20 Tahun 2008 (UU UMKM). Lebih lanjut dalam peraturan pelaksana UU UMKM, yaitu dalam PP No. 7 Tahun 2021 (PP 7/2021) disebutkan pula dalam Pasal 123 bahwa tata cara pengawasan perkara kemitraan akan adanya indikasi pelanggaran persaingan usaha diatur dengan Peraturan Komisi Pengawas Persaingan Usaha (Peraturan Komisi). Peraturan Komisi yang berlaku saat ini adalah Peraturan Komisi No. 4 Tahun 2019 (Perkom 4/2019). Menariknya dalam Perkom 4/2019 ini disebutkan dalam Pasal 66 ayat (4) bahwa putusan KPPU bersifat final. Lebih lanjut dalam Perkom 4/2019 ini juga tidak lagi diatur mengenai upaya hukum yang dapat diajukan oleh Terlapor terhadap putusan yang dijatuhkan oleh KPPU. Padahal dalam PP 7/2021 tidak disebutkan bahwa putusan yang dijatuhkan oleh KPPU bersifat final. Dengan adanya ketentuan dalam pasal 66 ayat (4) Perkom 4/2019 tentunya bisa sangat merugikan Terlapor yang dirugikan akibat putusan KPPU yang dijatuhkan kepadanya, sebab mekanisme untuk mengajukan upaya hukum tidak diatur dalam Perkom 4/2019. Adapun dalam menjawab permasalahan pada penelitian ini dilakukan analisis menggunakan metode kepustakaan sehingga menghasilkan penelitian yang deskriptif. Sementara dari hasil Penelitian skripsi ini didapati bahwa Putusan KPPU dalam perkara kemitraan yang tidak menyediakan mekanisme pengajuan upaya hukum kepada Terlapor tidak tepat ditinjau berdasarkan ketentuan hukum acara yang berlaku. Serta tidak ada perlindungan hukum yang diberikan kepada terlapor setelah adanya Perkom 4/2019. Sehingga diperlukan adanya peninjauan ulang atas ketentuan dalam Pasal 66 ayat (4) Perkom 4/2019 yang menyebutkan bahwa Putusan Komisi bersifat final serta perlu disebutkan secara tegas pula mengenai alternatif perlindungan hukum yang dapat ditempuh oleh Terlapor atas Putusan KPPU dalam perkara kemitraan yang dijatuhkan kepadanya, yang dapat dilakukan melalui alternatif yang diberikan kepada Terlapor untuk dapat mengajukan permohonan pembatalan Putusan Komisi ke Pengadilan Niaga.

The authority of the Indonesia Competition Commission (KPPU) to supervise partnership agreements is contained in Article 36 of Law No. 20 of 2008 (UU UMKM). Further in the implementing regulations of the UMKM Law, namely in government regulations No. 7 of 2021 (PP 7/2021) It is also stated that in Article 123 PP, the procedures for supervising partnership agreements for indications of business competition violations are regulated by the Regulations of the Indonesia Competition Commission (“Peraturan Komisi"). The Commission Regulation currently in effect is Commission Regulation No. 4 of 2019 (Perkom 4/2019). Interestingly, in Perkom 4/2019 it is stated in Article 66 paragraph (4) that the KPPU's decision is final. Furthermore, Perkom 4/2019 also no longer stipulates legal remedies that can be submitted by the Reported Party against decisions handed down by the KPPU. Even though PP 7/2021 does not state that the decisions handed down by the KPPU are final. With the provisions in Article 66 paragraph (4) Perkom 4/2019, of course, it can be very detrimental to the Reported Party who is harmed by the KPPU's decision handed down to him, because the mechanism for filing legal remedies is not regulated in Perkom 4/2019. As for answering the problems in this study, analysis was carried out using the library method so as to produce descriptive research in the form of a description of the existing facts. Meanwhile, from the results of this thesis research it was found that The KPPU's decision in a partnership agreement that does not provide a mechanism for filing legal action against the Reported Party is inappropriately reviewed based on the provisions of the applicable procedural law. As well as no legal protection was given to the reported party after Perkom 4/2019. So it is necessary to review the provisions in Article 66 paragraph (4) Perkom 4/2019 which states that the Commission's Decision is final and it is also necessary to state explicitly regarding alternative legal protections that can be taken by the Reported Party for the KPPU's Decision in the partnership case handed down to him, which can be done through an alternative provided to the Reported Party to be able to submit a request for cancellation of the Commission Decision to the Commercial Court.

"ABSTRAK
Skripsi ini membahas tentang tanggung jawab atas benda sitaan oleh instansi Kepolisian dan Kejaksaan ketika telah tersedia Rumah penyimpanan benda sitaan negara (Rupbasan) di suatu wilayah. Menurut undang-undang, benda sitaan dapat disimpan dan berada di bawah tanggung jawab instansi Kepolisian maupun Kejaksaan, hanya apabila belum tersedia Rupbasan di wilayah bersangkutan. Dewasa ini, instansi Kepolisian dan Kejaksaan tetap menempatkan penanganan fisik benda sitaan di bawah tanggung jawabnya, walaupun telah tersedia Rupbasan di wilayahnya. Penyimpanan demikian dipandang sah karena dilakukan berdasarkan peraturan internal masing-masing instansi. Penelitian ini adalah penelitian hukum normatif-empiris, dimana data yang digunakan merupakan data sekunder dari bebarapa literatur dan data primer dari hasil wawancara, yang kemudian dianalisis dengan pendekatan kualitatif. Hasil penelitian ini menunjukkan bahwa apabila dalam suatu wilayah telah tersedia Rupbasan, maka peraturan internal di instansi Kepolisian dan Kejaksaan tidak dapat secara otomatis berlaku terhadap penyimpanan benda sitaan. Dalam hal telah tersedia Rupbasan di wilayah bersangkutan, benda sitaan yang disimpan di instansi Kepolisian dan Kejaksaan tetap berada dalam tanggung jawab Rupbasan, jika penyimpanan pada masing-masing instansi tersebut secara konsisten dilaksanakan menurut peraturan perundang-undangan yang berlaku.

ABSTRACT
This thesis studies about the execution of physical responsibility for confiscated goods by Police Department and Office of a Public Prosecutor institutions when the house for keeping the state confiscated goods (Rupbasan) have been made available in a region. According to the Law, confiscated goods can be kept and under the responsibility of Police Department or Office of a Public Prosecutor institution, only if Rupbasan has not yet been made available in related area. But it is different from what happened these days, where Police and Office of a Public Prosecutor institutions remain to place handling of physical of confiscated goods under their responsibility, even though Rupbasan have been made available in a region. The storage is viewed as validated since it was conducted pursuant to internal regulation of each institution. This research is a normative-empirical law research, where the data used are secondary from several literature and primary data from the result of interview which later analyzed by qualitative approach. This research result shows that if in region a Rupbasan has been available, the internal regulations in Police Department and Office of a Public Prosecutor institutions can not be automatically applied for the storage of a confiscated good and physical responsibility for confiscated goods is remain at Rupbasan even though the confiscated goods are kept outside Rupbasan. "

"Penelitian ini didasarkan pada Politik Hukum Pengelolaan Migas di Indonesia sesuai dengan amanat Pasal 33 Undang Undang Dasar 1945 Penelitian ini membahas tiga permasalahan utama Pertama kaitan mengenai Politik Hukum Pengelolaan Migas dengan teori kedaulatan Migas dalam mewujudkan Negara Kesejahteraan Kedua Perkembangan Politik Hukum Pengelolaan Migas di Indonesia dari Massa Hindia sampai dengan Massa Reformasi Ketiga Politik Hukum Pengelolaan Migas sesudah Putusan Mahkamah Konstitusi mengenai Pengujian Undang undang Migas Metode yang digunakan dalam penelitian ini adalah yuridis normatif yang menggunakan data sekunder Hasil penelitian menunjukkan bahwa hak menguasai negara atas sumber daya Migas merupakan landasan kokoh sebelum menetapkan langkah kebijakan politik hukum pengelolaan Migas Negara harus mampu mengelola kekayaan alam untuk sebesar besarnya kemakmuran rakyat Politik hukum pengelolaan Migas di Indonesia merupakan sikap dan atau perhatian Pemerintah terhadap pengelolaan Migas berupa kebijakan kebijakan yang dituangkan ke dalam Undang Undang dan Peraturan Pemerintah Pengelolaan dan Pengusahaan Minyak dan Gas Bumi Politik hukum pengelolaan migas di Indonesia selalu mengalami gejolak dan perubahan baik Setiap terjadinya perubahan Orde politik pemerintahan ataupun beberapa faktor yang mendasarinya seperti halnya tuntutan masyarakat sampai dengan permohonan Judicial review Undang undang Migas di Mahkamah Konstitusi Atas dasar itulah perubahan politik Hukum pengelolaan Migas harus segera dilaksanakan sesuai dengan Pancasila Undang undang Dasar Politik keberpihakan Pemerintah serta penguataan kelembagaan negara dalam pengelolaan Hulu Migas Disamping itu penulis menyampaikan bahwa Rancangan perubahan Undang Undang Migas diharapkan dapat mengakomodir segala masalah yang selalu terjadi yang dikeluhkan oleh berbagai pihak baik dalam hal hak menguasai negara dan maupun kebijakan teknis guna mendukung berkembangnya industri Migas Nasional sebagai wujud kemandirian dan ketahanan energi.
