"Tesis ini membahas mengenai permasalahan perjanjian kawin yang tidak didaftarkan. Perkawinan merupakan ikatan lahir batin antara seorang pria dengan seorang wanita, sebagai suami istri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Perkawinan merupakan salah satu bentuk "perikatan" antara seorang pria dengan seorang wanita. Perikatan tersebut diatur dalam suatu hukum yang berlaku dalam masyarakat, yang dikenal dengan istilah "hukum perkawinan" yakni sebuah himpunan dari peraturan-peraturan yang mengatur dan memberi sanksi terhadap tingkah laku manusia dalam perkawinan. Pokok permasalahan dalam tesis ini adalah mengenai implikasi perjanjian kawin yang tidak didaftarkan terhadap pihak ketiga dan status kepemilikan properti milik WNI setelah perkawinan dilangsungkan menurut hukum yang berlaku di Indonesia. Penulis menggunakan metode penelitian yuridis normatif, jenis data yang digunakan adalah data sekunder yang dikumpulkan melalui studi dokumen. Ketidaktahuan hukum dalam pembuatan perjanjian kawin setelah perkawinan berlangsung dan keterlambatan pendaftaran perjanjian kawin, akan menjadi pemicu masalah hukum bagi suami istri maupun pihak ketiga karena merasa dirugikan, dan dapat berakibat pada pembatalan perjanjian kawin. Pihak ketiga akan dirugikan apabila tidak dilakukan pendaftaran, karena perjanjian kawin tersebut dianggap hanya berlaku pada pihak suami dan istri saja, tidak berlaku terhadap pihak ketiga apabila tidak didaftarkan. Bagi calon pasangan perkawinan campuran yang akan mengadakan perjanjian kawin dalam perkawinannya, sudah sebaiknya mencari informasi baik melalui instansi pemerintah yakni pada Kantor Catatan Sipil maupun profesi hukum yang memiliki kompetensi atau pengetahuan berkaitan dengan pembuatan perjanjian kawin, seperti Notaris atau pengacara.

This thesis discusses the issue of marriage agreements that are not registered. Marriage is an inner and outer bond between a man and a woman, as a husband and wife with the aim of forming a happy and eternal family based on the One Godhead. Marriage is one form of "engagement" between a man and a woman. The engagement is regulated in a law that applies in society, known as "marriage law" which is a set of rules that regulate and sanction human behavior in marriage. The main problem in this thesis is about the implications of the marriage agreement that is not registered with the third party and the property ownership status of the Indonesian citizen after the marriage is held according to the applicable law in Indonesia. The author uses a normative juridical research method, the type of data used is secondary data collected through document studies. The ignorance of the law in making marriage agreements after marriage and the delay in the registration of marriage agreements, will be a trigger for legal problems for husband and wife and third parties because they feel disadvantaged, and can result in the cancellation of the marriage agreement. Third parties will be disadvantaged if registration is not carried out, because the marriage agreement is considered only valid on the part of husband and wife only, does not apply to third parties if not registered. For prospective mixed marriages who will enter into marriage agreements in their marriages, it is better to seek information through government agencies, namely the Civil Registry Office and the legal profession that has the competence or knowledge related to making marriage agreements, such as Notaries or lawyers."

"Perjanjian perkawinan dibuat untuk mengatur harta benda milik suami istri. Perjanjian perkawinan yang telah dibuat harus didaftarkan di Dinas Kependudukan dan Catatan Sipil bersamaan dengan pendaftaran akta nikah. Namun dalam praktiknya para pihak yang membuat akad nikah tidak melampirkan akad nikah pada saat pencatatan nikah. Pentingnya pencatatan berdampak pada status aset dan hutang pihak ketiga. Berdasarkan aturan, akad nikah yang tidak tercatat membuat akad nikah tidak sah, karena tidak memenuhi asas publisitas. Dengan menggunakan metode penulisan normatif, makalah ini akan membahas tentang perjanjian nikah yang tidak tercatat dalam akta nikah dengan menganalisis Putusan Nomor 25 / Pdt.G / 2013 / PN.Tbn. Dapat disimpulkan bahwa akad nikah siri akan membatalkan akad nikah yang tidak mengikat pihak ketiga. Namun keberadaan akad nikah tetap berlaku bagi pihak yang membuatnya. Penulis menyarankan kepada hakim untuk memberikan sosialisasi kepada masyarakat mengenai tata cara pembuatan dan pencatatan akad nikah serta mempertimbangkan pula untuk menentukan perpanjangan atau pembaharuan akad nikah.

The marriage agreement is made to regulate the property belonging to the husband and wife. Marriage agreements that have been made must be registered at the Population and Civil Registry Service together with the registration of a marriage certificate. However, in practice, the parties making the marriage contract do not attach the marriage contract at the time of registration of marriage. The importance of record-keeping has an impact on the asset and debt status of third parties. Based on the regulations, an unregistered marriage contract invalidates the marriage contract, because it does not fulfill the principle of publicity. By using the normative writing method, this paper will discuss about marriage agreements that are not recorded in the marriage certificate by analyzing Decision Number 25 / Pdt.G / 2013 / PN.Tbn. It can be concluded that the siri nikah contract will cancel the marriage contract that is not binding on a third party. However, the existence of the marriage contract still applies to the party who made it. The author suggests the judge to provide socialization to the public regarding the procedures for making and recording marriage contracts and also considering determining the extension or renewal of the marriage contract."

"[Perkawinan campuran sebagaimana diatur dalam Undang-Undang Nomor 1 Tahun 1974 adalah perkawinan antara dua orang yang di Indonesia tunduk pada hukum yang berlainan, karena perbedaan kewarganegaraan dan salah satu pihak berkewarganegaraan Indonesia. Perkawinan campuran dapat dilaksanakan di Indonesia maupun di luar Indonesia. Dalam hal perkawinan campuran dilaksanakan di luar Indonesia adalah sah bilamana dilakukan menurut hukum yang berlaku di Negara di mana perkawinan itu dilangsungkan dan bagi Warga Negara Indonesia tidak melanggar ketentuan-ketentuan Undang-Undang Perkawinan. Dalam jangka waktu 1 (satu) tahun sejak sekembalinya mereka ke Indonesia, bukti perkawinan mereka harus didaftarkan di Kantor Pencatatan perkawinan tempat tinggal mereka. Pasangan perkawinan campuran yang hendak melangsungkan perkawinan campuran di luar negeri juga dapat membuat perjanjian perkawinan. Perjanjian perkawinan adalah perjanjian tertulis yang dibuat oleh calon suami isteri sebelum atau pada saat perkawinan dilangsungkan untuk mengatur akibat-akibat perkawinan terhadap harta kekayaan mereka. Pentingnya pembuatan perjanjian perkawinan bagi pasangan yang hendak melangsungkan perkawinan campuran adalah terkait dengan perlindungan hukum terhadap hak milik atas tanah di Indonesia yang hanya dapat dimiliki oleh Warga Negara Indonesia, sebagaimana diatur dalam Undang-Undang Pokok Agraria. Penulisan tesis ini menggunakan metode yuridis normatif, yaitu dilakukan dengan menelusuri bahan hukum sekunder berupa norma-norma dari peraturan perundang-undangan yang berkaitan dengan permasalahan. Prosedur pembuatan perjanjian perkawinan dalam perkawinan campuran yang dilangsungkan di luar negeri, tetap mengacu pada ketentuan Undang-Undang Perkawinan yaitu dibuat sebelum atau pada saat perkawinan dilangsungkan dan berdasarkan pada hukum yang berlaku di Indonesia. Dalam hal setelah perkawinan dilangsungkan di luar negeri dan mereka kembali ke Indonesia namun tidak mendaftarkan perkawinannya tersebut dan kemudian mereka membuat perjanjian perkawinan, maka perjanjian perkawinan tersebut menjadi batal demi hukum karena melanggar ketentuan Undang-undang yaitu dibuat setelah perkawinan berlangsung.

"ABSTRACT
Pada praktiknya, perjanjian perkawinan mengatur mengenai harta dalam perkawinan, yakni mengenai pemisahan harta. Persyaratan perjanjian perkawinan diatur dalam Pasal 29 UU No. 1 Tahun 1974, yakni perjanjian perkawinan harus didaftarkan ke Dinas Kependudukan dan Pencatatan Sipil atau Kantor Urusan Agama. Namun pada kenyataannya, masih banyak para pihak suami isteri yang membuat perjanjian perkawinan tetapi tidak didaftarkan. Hal ini mengakibatkan perjanjian perkawinan tersebut hanya berlaku bagi kedua belah pihak yang membuat perjanjian, tidak berlaku bagi pihak ketiga. Penulis tertarik meneliti masalah perjanjian perkawinan yang tidak didaftarkan ini apabila harta dalam perkawinan dipindahtangankan secara sepihak (oleh salah satu pihak suami atau isteri saja) kepada pihak ketiga melalui jual beli. Untuk mencari solusi dari masalah ini penulis melakukan penelitian dengan pendekatan kualitatif, perundang-undangan, dan analitis. Karya ilmiah ini menggunakan kajian ilmu hukum normatif dan tipe berdasarkan sifatnya merupakan penelitian deskriptif. Hasil penelitian menunjukkan bahwa akibat hukum terhadap perjanjian perkawinan yang tidak didaftarkan ialah tidak berlakunya atau mengikatnya perjanjian perkawinan tersebut terhadap pihak ketiga, sehingga harta yang diperjualbelikan bagi pihak ketiga masih merupakan harta bersama. Oleh karena itu, maka dalam proses jual beli harta bersama tersebut pihak ketiga harus mendapat persetujuan kedua belah pihak suami isteri. Apabila dilakukan dengan tanpa persetujuan salah satu pihak suami isteri, maka pihak tersebut dapat mengajukan pembatalan jual beli harta bersama tersebut. Mengenai perlindungan terhadap pihak ketiga, perlindungan hanya dapat dilakukan apabila pihak ketiga beritikad baik pada saat proses jual beli harta bersama tersebut.

ABSTRACT
In practice, marriage agreements usually regulate property in marriage, namely regarding the separation of assets. The requirements of the marriage agreement are regulated in Article 29 of Law No. 1 of 1974, as the marriage agreement must be registered with the Department of Population and Civil Registration or the Office of Religious Affairs. But in the reality, there are still many spouses that make marriage agreements but not registered. That caused the marriage agreements are only valid for both parties who making the agreement, but not for third parties. The author is interested in examining the issue of marriage agreements that are not registered if the assets in marriage are unilaterally transferred (by one of the husband or wife) to a third party through buying and selling. To find a solution to this problem, the author conducted there search with a qualitative, legislatif, and analytical approach. This scientific work uses the study of legal science and type based on its nature which is descriptive research. The results of the study indicate that the legal consequences of the marriage agreement that is not registered are the non-valid or attachement of the marriage agreement to a third party, so that the traded asset by the third party is still considered as a joint asset. Therefore, in the process of buying and selling shared assets, the third party must obtain the approval of both husband and wife parties. If it is carried out without the consent of one of the husband and wife parties, then the party may submit a cancellation of the sale of the joint assets. Regarding the protection of third parties, protection can only be done if the third party has good intentions during the process of  buying and selling of the joint assets."

"Ketidakjelasan muncul terkait keabsahan perjanjian kawin pasangan suami istri pemeluk agama Katolik yang perceraiannya tidak didaftarkan pada Dinas Kependudukan dan Pencatatan Sipil. Dapat dikatakan, bahwa pasangan suami istri yang tidak mendaftarkan perceraiannya pada Dinas Kependudukan dan Pencatatan Sipil masih terikat perkawinan yang sah, walaupun telah mendapatkan putusan pengadilan. Permasalahan menjadi semakin kompleks, manakala pasangan suami istri tersebut ingin melakukan perkawinan kembali dengan pasangannya terdahulu. Penelitian menggunakan bahan hukum primer berupa perundang-undangan yang berkaitan dengan perkawinan menurut hukum negara dan agama Katolik serta mengenai perjanjian kawin. Bahan hukum sekunder berupa buku-buku dan wawancara dengan romo dan hakim. Bahan-bahan hukum tersebut kemudian dianalis secara kualitatif. Perjanjian kawin pasangan suami istri pemeluk agama Katolik pada perceraian yang tidak didaftarkan dalam hal terjadi perkawinan kembali tetap sah, kecuali pasangan suami istri tersebut telah membatalkan terlebih dahulu. Notaris selaku pembuat perjanjian kawin juga hendaknya memberikan penyuluhan hukum terkait pentingnya pendaftaran perceraian, dimana dalam perkawinan tersebut diikuti dengan perjanjian kawin.

Unclear status prenuptial agreement arise in catholic marriage if the divorce is not registered in civil registrar. In Indonesia, divorce will be legalized if the couple register their divorce in the civil registrar after the judge grant their request on court proceeding. However, complex situation arise whenever the couple want to do remarriage since catholic does not allow divorce. Furthermore, the notary as the one who create the prenuptial agreement should give clear understanding on legal consequences after creating prenuptial agreement in relation to catholic and Indonesian marriage.A critical question posed in this scene is, does the remarriage process legal under Indonesian law? Does the prenuptial agreement still valid? To answer those questions The research will based on primer sources of law which are indonesia marriage law and catholic marriage law; and secondary sources of law which are books & interview with Churchmans and judges. In addition to that. The research method will based on qualitative approach."

"Perkawinan campuran adalah suatu perkawinan antara dua warganegara yang berbeda, dimana satu pihak warga negara Indonesia dan pihak lain warga negara asing. Calon suami istri sebelum atau pada waktu perkawinan atau suami istri setelah perkawinan, dapat membuat perjanjian kawin mengenai harta benda dalam perkawinan. Perjanjian kawin dalam perkawinan campuran, yang dibuat setelah berlangsungnya perkawinan mengenai harta kawin berupa hak atas tanah, tidak dapat berlaku surut terhadap hak atas tanah yang diperoleh sebelum adanya perjanjian kawin. Status hak atas tanah berupa hak milik, hak guna bangunan dan hak guna, usaha, tidak dapat dipunyai atau dimiliki oleh warga negara asing baik secara langsung maupun tidak langsung. Bagaimana jika hak atas tanah berupa hak guna bangunan yang diperoleh selama perkawinan campuran, dilakukan pemisahan harta berdasarkan penetapan pengadilan. Dalam menjawab masalah tersebut, dipergunakan metode penelitian normatif, dengan mengkaji keabsahan perkawinan campuran,  subjek dan objek hak atas tanah dan waktu  hak atas tanah diperoleh, yaitu sejak atau sebelum  perkawinan campuran sah secara hukum. Harta kawin berupa hak atas tanah yang diperoleh sebelum perkawinan campuran sah, tetap merupakan milik pribadi masing masing suami istri, yang tidak dapat dijadikan objek pemisahan harta  Harta kawin berupa hak atas tanah yang diperoleh setelah perkawinan campuran sah, yang oleh undang-undang pokok agraria, dilarang dipunyai oleh warga negara asing melalui perkawinan campuran, tidak dapat dilakukan melalui pemisahan harta.

Mixed marriage is a marriage between two different citizens, where one party is an Indonesian citizen and the other is a foreign citizen. Prospective husband and wife before or at the time of marriage or husband and wife after marriage, can make a marriage agreement regarding property in marriage. Agreements for marriage in mixed marriages, which are made after the marriage takes place regarding the property of marriage in the form of land rights, cannot apply retroactively to the rights to land acquired prior to the marriage agreement. The status of land rights in the form of property rights, building use rights and usufructuary rights, business, cannot be owned or owned by foreign citizens either directly or indirectly. What if the land rights in the form of building usufructuary rights obtained during mixed marriages are carried out by the separation of assets based on court decisions. In answering the problem, normative research methods are used, by examining the validity of mixed marriages, the subject and object of land rights and when land rights are obtained, ie from or before a mixed marriage is legally legal. Marital assets in the form of land rights acquired before a mixed marriage are legal, still private property of each husband and wife, which cannot be the object of the separation of assets of married property in the form of land rights obtained after a legal mixed marriage, which is based on agrarian law, prohibited from being owned by foreign nationals through mixed marriages, cannot be done through the separation of property."

"Putusnya perkawinan karena perceraian dapat dianggap tidak pernah terjadi apabila salinan putusan perceraian yang telah berkekuatan hukum tetap tetapi tidak dicatatkan pada Kantor Catatan Sipil. Pentingnya pencatatan ini adalah untuk memenuhi ketentuan pasal 34 ayat 2 Peraturan Pemerintah Nomor 9 Tahun 1975. Dari putusan Mahkamah Agung No. 2307 K/Pdt/2007 timbul masalah yang perlu dikaji yaitu mengenai akibat hukum yang ditimbulkan dari putusan tersebut dan upaya hukum apa yang dapat dilakukannya.
Metode pendekatan penelitian yang digunakan dalam mengkaji permasalahan diatas adalah yuridis normatif yang bersifat deskriptif yang mengolah data primer maupun sekunder dengan mempergunakan analisis data kualitatif dan akhirnya dapat diambil kesimpulan.
Hasil penelitian menunjukan bahwa adanya salinan putusan perceraian yang telah berkekuatan hukum tetap tetapi tidak dicatatkan yang mengakibatkan perkawinan tetap berlangsung sehingga tuntutan terhadap pemberian nafkah istri tidak dapat dipenuhi. Diperlukan upaya hukum memohon putusan perceraian yang telah berkekuatan hukum tetap untuk dicatatkan kembali di Kantor Catatan Sipil.
Disarankan para pihak sudah seharusnya di informasikan oleh pihak yang terkait mengenai tata cara perceraian di Pengadilan sehingga memberikan kepastian hukum bagi pihak-pihak yang berkepentingan.

The marriage divorce may be considered never occurred if the copy of divorce decision which has a permanent legal powered decision but not registered at the Department of Population. The importance of this registration is to fulfill the provision of Article 34 paragraph 2 of Government Regulation Number 9 Year 1975. Based on the decision of Supreme Court Number 2307 K/Pdt/2007, there is a problem should be analyzed related to the legal consequence and legal effort to overcome the decision.
The method of the research approach used in analyzing the above problem is descriptive, normative jurisdiction which processes primary and secondary data using qualitative data analysis so that can be drawn a conclusion.
The result of the research shows that the copy of divorce decision which has a permanent legal powered decision but not registered is the reason that the marriage considered still occurred legally, so that the prosecution of alimony for the wife can not be undertaken. It is needed to take a legal effort to propose a divorce decision which has a permanent legal powered decision to be re-registered at the Department of Population.
It is suggested that all parties should be informed and socialized by the related parties concerning the divorce procedures at the Court so it will give a legal security to the related parties.

"Hak milik atas tanah merupakan hak terkuat dan terpenuh atas tanah yang hanya dapat dimiliki oleh Warga Negara Indonesia. Namun akibat percampuran dalam perkawinan campuran, warga negara asing dapat memiliki hak milik atas tanah. Untuk itu Pasal 21 ayat (3) UUPA mengamanatkan bahwa bagi warga negara asing yang memiliki hak milik atas tanah akibat percampuran harta dalam perkawinan campuran diwajibkan untuk melepaskan hak tersebut dalam jangka waktu 1 (satu) tahun. Kewajiban pelepasan hak milik atas tanah tersebut kemudian menjadi suatu permasalahan bagi warga negara Indonesia sebagai pihak yang juga berhak atas hak milik atas tanah tersebut. Hal ini kemudian yang menjadi pokok permasalahan dalam tesis saya yakni bagaimanakah peraturan perundang-undangan mengatur mengenai kepemilikan tanah oleh warga negara asing dalam kaitannya dengan kepemilikan harta bersama dalam perkawinan campuran serta bagaimanakah analisis mengenai Putusan Penetapan Pengadilan Negeri Nomor 207/Pdt/P/2005/PN.Jkt.Tmr tentang penetapan perjanjian kawin setelah perkawinan dalam perkawinan campuran. Penulis kemudian meneliti permasalahan ini dengan metode penelitian yuridis normatif, dimana penulis dalam meneliti mengacu pada aturan-aturan hukum yang ada untuk kemudian dapat menjawab permasalahan bahwa, hal tersebut dimungkinkan dengan sebelumnya mengajukan permohonan terlebih dahulu dan ijin untuk membuatnya baru muncul ketika Pengadilan melalui Hakim mengabulkan permohonan tersebut. Dalam kesimpulannya, hak yang dapat dimilki oleh warga negara asing, termasuk dalam hal ini mereka yang menikah dengan warga negara Indonesia dan tidak melakukan pemisahan harta, adalah hanya hak pakai.

Rights to land an exclusive right that can only be owned by Indonesian citizens to own land in the strongest and fullest. However, due to mixing in mixed marriages, foreigners can own landed property. For that article 21 Paragraph (3) The Law Number 5 Year 1960 Regarding The Regulation Of The Basic Agrarian Principles mandates that foreign citizens who have the right to land due to mixing in the mixing property must waive the right for a period of 1 (one) year. Liability waiver to land then becomes an issue of Indonesians citizens as well as the party entitled to the possession of the land. It then becomes the identification of the problem in my thesis how the legislation rules of law arrange foreigners can own landed property from their marital property in mixed marriages and then how to analyze verdict of the sentence of east state court number 207/Pdt/P/2005/PN.Jkt.Tmr regarding covenant agreement after marriages in mixed marriages. The author then examines these issues with the method of juridicial normative research, which examined in reference to the existing rules of law to then be able to answer this problem in a descriptive analytic. Through the study authors found the answer that, it is possible to do by previously apply for permission in advance and if the Court of Justice granted the request. In conclusion, the rights to land in Indonesia that can be owned by mixed marriage couple who did not have a covenant agreement is only The Right to Use."

"Perjanjian perkawinan itu sama dengan perjanjian pada umumnya, yaitu perjanjian antara dua orang calon suami dan istri untuk mengatur harta kekayaan pribadi masing-masing yang dibuat menjelang perkawinan, serta disahkan oleh pegawai pencatat nikah. Perjanjian kawin pada dasarnya berlaku dan mengikat suami dan istri sejak perkawinan berlangsung, sedangkan bagi pihak ketiga berlaku sejak perjanjian kawin tersebut didaftarkan. Daya laku dari akta perjanjian kawin yang didaftarkan setelah terjadinya perkawinan, adalah sah secara hukum, sepanjang perjanjian tersebut tidak bertentangan dengan ketentuan yang berlaku, perjanjian tersebut dibuat dalam bentuk akta notaris yang memenuhi 4 syarat sah perjanjian sebagaimana diatur dalam Pasal 1320 KUHPerdata dan perjanjian kawin tersebut akan mengikat pihak ketiga apabila telah memenuhi unsur publisitas.

Marriage agreements are basically are the same as agreements in general, agreements between two prospective husbands and wives to regulate their personal assets made before marriage, and legalized by a marriage registrar employee. The marriage agreement basically applies and binds husband and wife since the marriage takes place, while for the third party is valid since the marriage agreement is registered. The power of the marriage agreement deed registered after the marriage is legal, as long as the agreement does not conflict with the applicable provisions, the agreement is made in the form of a notary deed that fulfills the 4 legal terms of the agreement as stipulated in Article 1320 of the Civil Code and the marriage agreement will bind a third party if it fulfil the publicity element."

"Seorang pria dan seorang wanita yang hendak melangsungkan perkawinan dapat membuat perjanjian perkawinan. Perjanjian perkawinan harus dibuat dalam bentuk tertulis dan selanjutnya disahkan pada pegawai pencatat perkawinan. Akan tetapi dapat terjadi perjanjian perkawinan yamg dibuat oleh suami isteri tidak didaftarkan pada pegawai pencatat perkawinan. Permasalahan yang dikemukakan pada tesis ini adalah apakah dimungkinkan pengesahan perjanjian perkawinan setelah perkawinan berlangsung serta apakah konsekuensi dari perjanjian perkawinan yang tidak didaftarkan pada pencatat perkawinan. Penelitian yang digunakan dalam tesis ini adalah tipe penelitian normatif, yaitu penelitian yang dilakukan terhadap bahan hukum primer dan bahan hukum sekunder.
Pokok hasil dari penelitian dalam tesis ini adalah bahwa perjanjian perkawinan antara suami isteri dimaksudkan untuk menentukan bagian harta kekayaan masing-masing yang dibuat dalam klausula perjanjian dengan tujuan untuk menyelamatkan harta salah satu pihak apabila pihak yang lain dinyatakan pailit. sedangkan akibat hukum perjanjian perkawinan yang tidak dimintakan pengesahan pada pegawai pencatat perkawinan bagi suami isteri dan pihak ketiga, adalah perjanjian perkawinan tersebut tetap sah tetapi tidak berlaku bagi pihak ketiga, sehingga pihak ketiga dapat menganggap dalam perkawinan tersebut tidak terjadi pisah harta.

Man and a woman who wanted to establish a marriage can make a marriage aggrement. Marriage aggrement must be made in writing and subsequently passed in marriage registrar officer. But can occur marriage aggrement made by the husband and wife are not registered with the civil registrar of marriage. Issues raised in this thesis is whether the possible ratification of a treaty of marriage after the marriage took place and whether the consequences of the marriage aggrement is not registered with the registrar of marriage. Research used in this thesis are the type of normative research, namely a study of primary legal materials and secondary legal materials.
Principal results of the research in this thesis is that the marriage aggrement between husband and wife are meant to determine the assets of each clause in the agreement made with the goal to save one party property if the other party is declared bankrupt. while the legal consequences of marriage aggrement don't have approval from the marriage registrar officer the marriage aggrement is still valid but it does not apply to any third party, that third parties can assume the marriage aggrement is doesn't exist.
