"ABSTRACT
Saat ini telah lahir sistem alternatif penyelesaian sengketa investasi yaitu Investment Court System yang unggul dalam beberapa aspek seperti kepastian hukum, konsistensi, transparansi dan lain sebagainya. Skripsi ini mengambil tiga rumusan masalah yaitu untuk mengetahui apa itu Investment Court System, apa keunggulan dan kelemahan dari gagasan Investment Court System, dan untuk mengkaji penerapan gagasan Investment Court System ini pada hukum Indonesia.Metode penelitian skripsi ini adalah yuridis-normatif mengacu kepada norma hukum yang terdapat dalam peraturan perundang-undangan dan norma-norma lain yang berlaku dan mengikat di masyarakat. Perolehan data dilakukan melalui penelitian kepustakaan yakni melalui pengumpulan data sekunder. Kesimpulan dari skripsi ini adalah bahwa Investment Court System memiliki beberapa keunggulan dibandingkan dengan sistem arbitrase dan mampu melengkapi mekanisme arbitrase. Kesiapan hukum Indonesia dalam penerapan gagasanini dapat dikatakan belum siap karena belum memiliki infrastruktur hukum untuk menerapkannya secara paripurna. Diperlukan penyesuaian UU Penanaman Modal, khususnya dalam ketentuan penyelesaian sengketa penanaman modal. Saran Penulis untuk Pemerintah Indonesia adalah perlu kembali mengkaji mengenai sistem penyelesaian sengketa investasi asing yang selama ini diterapkan dalam UU Penanaman Modal dan mempertimbangkan alternatif baru, yaitu Investment Court System. Saran Penulis bagi kalangan akademisi Indonesia adalah untuk mengkaji lebih lanjut mengenai gagasan Investment Court System ini dan bagaimana penerapannya.

ABSTRACT
An alternative system of investment dispute resolution has been born, namely Investment Court System that excels in several aspects such as legal-certainty, consistency, transparency and so on. This thesis takes three problems, namely to find out what Investment Court System is, what are the advantages and disadvantages of the Investment Court System, and the application of Investment Court System to Indonesian law. This thesis research method is juridical-normative refers to legal norms and other norms that bind in the community. Data acquisition is done through library research which is through secondary data collection. The thesis conclusion is that the Investment Court System has several advantages and able to complete the arbitration mechanism. It can be said that Indonesia is not ready to implement the idea because it does not yet have a legal infrastructure for it. Adjustments of law are needed, especially in terms of investment dispute resolution provisions. The authors suggestion for the Indonesian Government is to review the system of investment disputes that have been implemented in the Investment Law and consider an alternative, Investment Court System. The authors suggestion for Indonesian academics is to study more about this Investment Court System idea and how it is implemented."

"Penelitian ini membahas tentang kepastian hukum penanaman modal asing dalam hukum penanaman modal di Indonesia yaitu dengan membandingkan peraturan penanaman modal asing di Indonesia dan Thailand, yaitu Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal dan The Investment Promotion Act. B.E. 2560, serta melihat juga kepastian hukum terhadap Penanaman Modal Asing di bidang Pertambangan Mineral dan Batubara menurut Undang-Undang Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan perbandingan hukum dan pendekatan perundang-undangan, sehingga diketahui bahwa terdapat ketidakjelasan mengenai pengaturan penanaman modal asing di Indonesia, yang menimbulkan tumpang tindih antara peraturan pemerintah pusat dan pemerintah daerah, serta menimbulkan ketidakjelasan birokrasi. Kemudian dalam penanaman modal asing di bidang pertambangan mineral dan batubara, pemerintah seharusnya dapat mengontrol dalam pengelolaannya karena mineral dan batubara berperan penting dalam kemakmuran dan kesejahteraan rakyat. Kemudian terdapat perbedaan dan persamaan antara Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal dan The Investment Promotion Act. B.E. 2560 di Thailand. Persamaannya terdapat pada pemberlakuan undang-undang, adanya lembaga khusus, dan pemberian fasilitas serta insentif dalam kegiatan penanaman modal. Perbedaanya, terdapat pada substansi undang-undang, bentuk badan usaha, koordinasi dan pengawasan serta evaluasi terhadap kegiatan penanaman modal asing. Dengan demikian, diperlukan ketentuan yang ada harus jelas dan detail, dari peraturan tertinggi hingga peraturan pelaksananya harus sesuai dan dapat direalisasikan, khususnya ketentuan mengenai perizinan dan koordinasi antara pemerintah pusat dan daerah, serta pengawasan terhadap penegakan hukum juga harus tetap dilaksanakan dan berkelanjutan.

This research discusses the legal certainty of foreign investment in investment law in Indonesia by comparing the regulations of foreign investment in Indonesia and Thailand, under The Act Number 25 of 2007 on Investment and The Investment Promotion Act. B.E. 2560, and also see legal certainty to Foreign Capital Investment in Mineral and Coal Mining according to The Act Number 4 of 2009 about Mineral and Coal Mining. This research uses normative juridical research method with comparative law approach and statutory approach, there is unclear about foreign investment arrangement in Indonesia, causing overlap between central and local government regulations, and causing bureaucratic uncertainty. Then in foreign investment of mineral and coal mining, the government should be able to control in its management because mineral and coal have an important role in prosperity. There are differences and similarities between The Act Number 25 of 2007 on Investment and The Investment Promotion Act. B.E. 2560 in Thailand. The similarities are in the enactment of the law, the existence of special institutions, and the provision of facilities and incentives in investment activities. The difference is in the substance of the law, the form of business entity, coordination and supervision and evaluation of foreign investment activities. Therefore, the necessary provisions must be clear and detailed, from the highest regulation to the implementing regulations to be appropriate and realizable, in particular provisions on licensing and coordination between central and local government, and supervision of law enforcement must also be implemented and sustained.

Tesis ini mengkaji putusan ICSID dalam sengketa antara Rafat Ali Rizvi melawan Republik Indonesia yang diputus berdasarkan Bilateral Investment Treaty (?BIT?) antara negara Indonesia dan negara Inggris, Agreement between the Government of United Kingdom and Northern Ireland and the Government of the Republic of Indonesia for the Promotion and Protection of Investments, yang ditandatangani pada tanggal 27 April 1976 dan mulai berlaku tanggal 24 Maret 1977. Permasalahan utama yang menjadi fokus penelitian ini adalah (i) apakah yang menjadi pokok sengketa antara Rafat Ali Rizvi melawan Republik Indonesia dan (ii) bagaimana pendapat majelis arbitrase ICSID yang memeriksa dan mengadili perkara tersebut dikaitkan dengan penafsiran atas ketentuan BIT dalam sengketa penanaman modal. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif. Hasil penelitian menunjukkan bahwa pokok sengketa yang terjadi adalah masalah proses dan prosedur masuknya penanaman modal asing (admission process) yang harus dilalui investor berdasarkan BIT. Proses tersebut menentukan legalitas penanaman modal yang dilakukan. Tidak terpenuhinya admission process tersebut menjadikan Majelis Arbitrase ICSID tidak memiliki yurisdiksi untuk memeriksa dan mengadili sengketa tersebut sehingga pokok perkara tidak dapat diperiksa. Penafsiran atas ketentuan-ketentuan dalam BIT utamanya menggunakan Pasal 31 ayat (1) Konvensi Wina 1969 tentang Hukum Perjanjian, khususnya penafsiran berdasarkan makna biasa dari rumusan ketentuan BIT. Kajian tesis ini menyimpulkan bahwa penanaman modal yang dilakukan Penggugat tidak memenuhi ketentuan Pasal 2 ayat (1) BIT mengenai admission process sehingga Majelis Arbitrase menyatakan tidak memiliki yurisdiksi untuk memeriksa perkara tersebut. Majelis Arbitrase menafsirkan frasa ?granted admission in accordance with? dalam ketentuan Pasal 2 ayat (1) BIT antara Indonesia dan Inggris berdasarkan Konvensi Wina 1969 tentang hukum perjanjian khususnya Pasal 31 ayat (1). Penggunaan aturan penafsiran tersebut juga ditemukan dalam putusan-putusan ICSID lainnya yang menafsrikan ketentuan BIT yang serupa dengan ketentuan BIT antara Indonesia dan Inggris.

This thesis analyzes the decision of ICSID tribunal in the case between Rafat Ali Rizvi v. Republic of Indonesia based on Bilateral Investment Treaty (?BIT?) between Indonesia and United Kingdom, Agreement between the Government of United Kingdom and Northern Ireland and the Government of the Republic of Indonesia for the Promotion and Protection of Investments, signed on 27 April 1976 and entered into force on 24 March 1977. The research questions of this thesis are (i) what is the subject matter of the case between Rafat Ali Rizvi v. Republic of Indonesia; (ii) how is the opinion of the Tribunal in examining and adjudicating the case related to the interpretation of BIT provisions in investment disputes. The method used in analyzing the problems is normative legal research method. Research result shows that the subject matter of the case is the admission process of foreign investment. There is admission process that should be followed based on BIT in that process which determines the legality of the investment. This legality requirement is related to ICSID jurisdiction. If these processes are unfulfilled, the ICSID tribunal will not have jurisdiction on the case. Thus, the merit of the case will not be examined. The rule of interpretation used is mainly the provision of Article 31 (1) of the 1969 Vienna Covention on the Law of Treaty especially interpretation based on the ordinary meaning of the BIT provision. This study concludes that the Claimant?s investment does not fulfil the provision of Article 2 (1) of BIT between Indonesia and United Kingdom concerning the admission process that the Tribunal does not have jurisdiction on the case. The Tribunal inbterprets the phrase ?granted admission in accordance with? in the provision of Article 2 (1) of the BIT based on the 1969 Vienna Convension on the Law of Treaty especially Article 31 (1) concerning interpretation based on the ordinary meaning of the BIT provision. "Penelitian ini membahas tentang perlindungan investor asing dalam hukum penanaman modal di Indonesia dengan perbandingan hukum penanaman modal asing Indonesia dan Korea Selatan. Pokok permasalahan dalam penelitian ini adalah bagaimana perlindungan investor asing dalam hukum penanaman Modal di Indonesia dan bagaimana perbandingan hukum penanaman modal asing di Indonesia dan Korea Selatan. Tujuannya ialah untuk mengetahui tentang bagaimana perlindungan investor asing dalam hukum penanaman Modal di Indonesia dan bagaimana perbandingan hukum penanaman modal asing di Indonesia dan Korea Selatan. Metode penelitian yang digunakan adalah metode penelitian yuridis normatif dengan menggunakan pendekatan penelitian kualitatif.
Penelitian ini menemukan bahwa Undang-Undang Penanaman Modal No. 25 Tahun 2007 (UUPM) dan Undang-Undang Promosi Penanaman Modal Asing Korea Selatan (UUPPMA) mempunyai persamaan sebagai peraturan perundangundangan yang dibuat oleh pemerintah untuk memberikan perlindungan hukum terhadap investor asing serta untuk memberikan manfaat sebesar-besarnya terhadap kemakmuran rakyat. Yang membedakan diantara keduanya adalah bahwa UUPPMA mengatur mengenai ketentuan pidana sementara UUPM tidak mengaturnya. Selain pelayanan dan proses pendaftaran yang berbeda. Pada akhirnya semua menuju kepada satu tujuan untuk kemakmuran bersama rakyatnya.

This research examined about foreign investment in Indonesia and comparative study of foreign investment law of Indonesia and South Korea. The main issues in this research is how the protection of foreign investors in the investment law of Indonesia and South Korea. The main purpose of this research is to find out the protection of foreign investors in the investment law of Indonesia and South Korea. The research method used in this research is normative law research.
This research found that the investment law in Indonesia and South Korea has the equation as the legislation made by the government to provide legal protection for foreign investors as well as to provide maximum benefit to the public welfare. The differences between Investment Law in Indonesia and South Korea are criminal provisions, the services and the registration process. In South Korea criminal provisions governing by the Investment Law while in Indonesia not set it.

"Sebagai salah satu bentuk ekspropriasi tidak langsung, creeping expropriation kerap menimbulkan permasalahan dalam penyelesaian sengketa antara negara dan penanam modal. Creeping expropriation sering digunakan negara dalam mengambil alih penanaman modal asing. Empat putusan ICSID yang dibahas dalam skripsi ini telah mempertimbangkan mengenai konsep creeping expropriation. Meskipun demikian, tidak terdapat suatu konsep yang jelas dan konsisten mengenai creeping expropriation. Untuk menganalisis permasalahan ini, digunakan penelitian hukum normatif yang dilakukan secara deskriptif analisis. Hasil dari penelitian menunjukkan terdapat perbedaan pemahaman dan penerapan konsep creeping expropriation dalam sengketa penanaman modal asing di ICSID.

As one form of indirect expropriation, creeping expropriation often rises problems in investor-state investment dispute. Creeping expropriation is often used by a state to undertake foreign investment. Four ICSID awards used in this thesis have acknowledged and put creeping expropriation into consideration. However, there is no clear and consistent understanding regarding creeping expropriation concept. This research is analyzed through normative legal research done through descriptive-analytic method. The research shows the different implementation of creeping expropriation concept in foreign investment dispute in ICSID."

"ABSTRAK
Thesis ini membahas pembentukan, kedudukan, dan fungsi Badan Koordinasi Penanaman Modal (BKPM) sebagai Lembaga Pemerintah Nonkementerian dalam sistem hukum administrasi Negara Indonesia serta praktik koordinasi penanaman modal yang dilakukan oleh BKPM, khususnya di bidang kegiatan usaha industri. Metode penelitian yang digunakan adalah metode kualitatif dengan desain preskriptif. Hasil penelitian menyarankan pembentukan BKPM sebagai LPNK dilakukan melalui Peraturan Presiden, Secara fungsi kelembagaan BKPM cukup menjadi LPNK yang hanya berfungsi kantor pengelola PTSP di tingkat pemerintah pusat dan lembaga yang mengkaji kebijakan penanaman modal di seluruh sektor kementerian/lembaga. Sistem OSS yang diterapkan BKPM untuk koordinasi penerbitan Izin Usaha Industri (IUI) juga harus diperkuat. Sistem OSS harus terintegrasi dengan pelayanan perizinan elektronik yang dimiliki kementerian dan pemerintah daerah sehingga tidak perlu lagi pelimpahan kewenangan dari pemerintah daerah kepada Kepala BKPM dalam menerbitkan IUI.

ABSTRACT
This thesis discusses about formation, status, and function of Investment Coordinating Board  as as Non-Ministry Government Agency in The Indonesia Administrative Law System. It also discusses Investment Coordinating Boards business practice in coordinating investation, particularly in industrial sector. This research suggests that Investment Coordinating Board as as Non-Ministry Government Agency should be formed through Presidential Regulation. As Non-Ministry Government Agency, Investment Coordinating Boards should be focussed on one stop service management in national level and investment policy research in all sectors. OSS system that has been implemented by Investment Coordinating Boards to coordinate in issuing industry activity permit should be strengthened even more. The  OSS System should be integrated with information system owneg by othe government agencies and local governments, so there is no need of delegation of authority from ministry and local governments to Investment Coordinating Board in issuing business permit in all sectors.

"International Centre for Settlement of Investment Disputes (ICSID) adalah forum penyelesaian sengketa penanaman modal asing yang memiliki yurisdiksi berdasarkan Pasal 25 Konvensi ICSID. Dalam menentukan yurisdiksi, Majelis Arbiter ICSID mengualifikasi penanaman modal untuk memeriksa syarat ratione materiae. Majelis Arbiter ICSID menggunakan metode Piecemeal Test atau Dual-Test untuk mengualifikasi penanaman modal.
Penelitian ini bertujuan untuk menganalisis kualifikasi penanaman modal oleh Majelis Arbiter ICSID pada sengketa antara Rafat Ali Rizvi melawan Republik Indonesia dengan menggunakan penelitian hukum normatif yang dilakukan secara deskriptif analitis. Penelitian ini menemukan bahwa penggunaan metode kualifikasi penanaman modal yang berbeda memengaruhi hasil kualifikasi.

International Centre for Settlement of Investment Disputes (ICSID) is foreign investment dispute settlement forum which has jurisdiction according to Article 25 of ICSID Convention. In determining its jurisdiction, ICSID?s Arbitral Tribunal qualify investment to examine the requirement of ratione materiae. ICSID?s Arbitral Tribunal uses the method of Piecemeal Test or Dual-Test to qualify investment.
This research is aimed to analyse the qualification of investment by ICSID's Arbitral Tribunal in the matter between Rafat Ali Rizvi v. the Republic of Indonesia using normative juridical approach conducted through descriptive-analytic method. This research finds that using different methods of investment qualification influence the result of such qualification.

"Penelitian ini membahas mengenai kepastian hukum penanaman modal asing di Indonesia kemudian membandingkan Undang-Undang Penanaman Modal di Indonesia dan Vietnam. Pokok permasalahan yang diangkat dalam penelitian ini adalah bagaimana kepastian hukum penanaman modal asing di Indonesia serta bagaimana perbandingan undang-undang penanaman modal di Indonesia dan Vietnam. Tujuan penelitian ini adalah untuk mengetahui, memahami dan menganalisi masalah kepastian hukum Penanaman Modal Asing di Indonesia, dan perbandingan Undang-Undang Penanaman Modal antara Indonesia dan Vietnam. Penelitian ini merupakan penelitian hukum yang bersifat yuridis normatif dengan menggunakan data sekunder diantaranya peraturan perundang-undangan dan buku-buku.
Penanaman Modal Asing memberi manfaat dan dampak yang positif untuk pertumbuhan ekonomi suatu negara, begitu juga untuk Indonesia dan Vietnam yang masih dianggap sebagai destinasi investasi Asia dan dunia. Banyak faktor yang menjadi bahan pertimbangan bagi penanam modal untuk menanamkan modalnya pada suatu negara, salah satunya adalah jaminan kepastian hukum. Masalah kepastian hukum seringkali menjadi penghambat masuknya investasi, khususnya di Indonesia karena ketidakpastian hukum menyebabkan iklim investasi menjadi tidak kondusif. Penelitian ini membandingkan Undang-Undang Penanaman Modal antara Indonesia dan Vietnam, kemudian menemukan beberapa persamaan dan perbedaan didalamnya. Undang-Undang Penanaman Modal harus bisa mengakomodir kepentingan penanam modal asing dengan memberi kepastian hukum, diikuti dengan penegakan hukum, tanpa mengurangi kepentingan nasion.

This research examines the legal certainty of foreign investment in Indonesia and subsequently compares the investment laws between Indonesia and Vietnam. The principal issue raised in this research is about the legal certainty of foreign investment in Indonesia as well as how the Indonesian laws of investment are compared to the laws of investment in Vietnam. As for the purpose of this research is to discover, comprehend and analyze the legal certainty problem of Foreign Investment in Indonesia, and the comparison of Investment Laws between Indonesia and Vietnam. This research is a legal research which is juridical normative using secondary data such as legislation and books.
Foreign investment gives benefits and impact which are positive for economic growth of a country, as well as to Indonesia and Vietnam which are still regarded as the investment destination in Asia and in the world. There are many factors taken into consideration for investors to invest in a country, one of them is legal certainty assurance. Legal certainty problem often obstructs the entry of investment, especially in Indonesia because the legal uncertainty made it inconducive for investment. This research attempts to compare the laws of investment between Indonesia and Vietnam, and subsequently locate the similarities and differences between them. Investment laws should be able to accommodate the interests of foreign investors by providing legal certainty, followed by law enforcement, without jeopardizing national interest.

"ABSTRAK
Adanya penanaman modal asing (PMA) tidak hanya memberikan dampak positif terhadap perekonomian tapi juga dampak negatif. Salah satu dampak negatif dari PMA adalah meningkatnya ketimpangan. Ketimpangan pendapatan merupakan salah satu permasalah yang dihadapi oleh Indonesia. Selama periode tahun 2010 sampai dengan 2014, terjadi tren kenaikan ketimpangan yang ditandai dengan naiknya indeks gini dan turunnya kontribusi pengeluaran kelompok masyarakat berpengeluaran rendah. Penelitian ini menggunakan data dari 33 provinsi di Indonesia selama periode waktu tahun 2010 sampai dengan 2015 untuk mengukur dampak dari PMA terhadap ketimpangan yang diproksi dengan indeks gini dan kriteria Bank Dunia. Hasil dari penelitian ini menunjukkan bahwa PMA memiliki hubungan dengan ketimpangan. Masuknya PMA yang diikuti dengan adanya transfer teknologi membuat produktivitas tenaga kerja meningkat yanag kemudian akan menaikkan pendapatan tenaga kerja. Hal tersebut kemudian akan meningkatkan ketimpangan pendapatan.

ABSTRACT
Not only bring a positive impact to the economy of a country, foreign direct investment (FDI) also bring a negative impact. One of the negative impact of globalization is inequality. Inequality is one of many problem in Indonesia. From 2010 to 2014 there is a rise in inequality with the rise of gini index and the decrease in the contribution of low income groups. Using the data from 33 provinces in Indonesia from 2010 to 2015 to determine the impact of FDI towards inequality. The result show FDI have impact toward inequality. FDI inflow will be followed by transfer of technology which will increase the workers productivity. That increase in productivity will lead to higher income that will result in increase in inequality."
