"Summary:
Drawing on the expertise and experience of contributors from a wide range of academic, professional and judicial backgrounds, the Research Handbook on the International Penal System critically analyses the laws, policies and practices that govern detention, punishment and the enforcement of sentences in the international criminal justice context. Comprehensive and innovative, it examines the operation of the international penal system, covering pertinent issues such as non-custodial sanctions, monitoring of conditions of detention, the protection of prisoners under international law and the transfer of prisoners. These aspects are presented in a logical order, linking up with the chronological sequence of the international criminal justice process. Far-reaching, this Handbook also explores broader normative questions related to contemporary human rights law, transitional and restorative justice and victim redress, before exploring contemporary and alternative mechanisms for punishing and overseeing punishment, and possible avenues for development. This up-to-date assessment will provide valuable insights for researchers and students of international criminal law and justice, comparative penal law, penology, prisoners' rights and transitional and restorative justice. Its recommendations for development will also interest international and national officials working in criminal law and justice"

"Presently, many of the greatest debates and controversies in international criminal law concern modes of liability for international crimes. The state of the law is unclear, to the detriment of accountability for major crimes and of the uniformity of international criminal law. The present book aims at clarifying the state of the law and provides a thorough analysis of the jurisprudence of international courts and tribunals, as well as of the debates and the questions these debates have left open. Renowned international criminal law scholars analyze, in discrete chapters, the modes of liability one by one; for each mode they identify the main trends in the jurisprudence and the main points of controversy. An introduction addresses the cross-cutting issues, and a conclusion anticipates possible evolutions that we may see in the future. The research on which this book is based was undertaken with the Geneva Academy."

internasional. Konsep ini selanjutnya diterapkan di berbagai peradilan
pidana internasional. dan mengalami perkembangan dengan munculnya
konsep pertanggungjawaban pimpinan dalam Peradilan Tokyo dan
konsep Joint Criminal Enterprise dalam International Court for Former
Yugoslavia (ICTY). Konsep pertanggungjawaban individual mengalami
perubahan ketika diterapkan dalam International Criminal Court (ICC)
yang terlihat didalam putusan Prosecutor v. Thomas Lubanga Dyilo.
(co-perpetration).

ABSTRACT
This thesis analyzes the concept of criminal responsibility under
international criminal law, specifically discusses the individual criminal responsibility under Rome Statute. Individual criminal responsibility was first applied during the Second World War, which was in the Nuremberg Trials. The concept punishes individual for International crimes. The concept of individual criminal responsibility was then applied in various international criminal tribunals, and has developed with the introduction of the concept of superior responsibility in International Military Tribunal for The Far East and the concept of joint criminal enterprise in International Criminal Tribunal for Former
Yugoslavia. The concept of criminal responsibility has evolved in the
International Criminal Court, as it can be seen in Prosecutor v. Thomas
Lubanga Dyilo Case. The trial chamber punished Thomas Lubanga
Dyilo for the warcrime of recruiting child soldier under co-perpetration."

"This book investigates when 'mistake of law' should be a reason to exculpate the perpetrator of an international crime. It demonstrates that the issue of 'mistake of law' goes to the heart of individual criminal responsibility and therewith contributes to the development of a more systematic approach toward the structure of international offences. "The functionalist perspective on the law relating to international organizations is being replaced by a constitutionalist perspective in light of the need to control international bureaucracies engaging in quasi-sovereign activities or violating rules of international law. For this book, editors Klabbers and Wallendahl (Center of Excellence in Global Governance Research, U. of Helsinki, Finland) bring together contributors from European countries to explore this paradigm shift and how it affects the various doctrinal issues that make up the law of international organizations. A section on general issues addresses topics such as membership and financing in international organizations, dispute settlement, and the role of the International Law Commission. A section on special issues examines areas such as ultra vires doctrine and deformalization of international organization law. Chapters on the EU and the United Nations examine the facets of constitutionalism in international organizations"
