"ABSTRAKStreaming internet telah berkembang menjadi hambatan yang besar untuk televisi kabel dalam mendapatkan kesuksesan yang lebih di Amerika Serikat. Terlepas dari segalanya, hak kekayaan intelektual memainkan peran penting dalam isu tersebut. Maka, maksud dari tulisan ini adalah untuk menginvestigasi korelasi antara televisi kabel dan streaming internet dari perspektif hak kekayaan intelektual di Amerika Serikat. Tulisan ini memakai tinjauan pustaka untuk membantu tulisan ini meraih tujuannya. Kesimpulannya, streaming internet memberikan dampak yang sangat besar untuk televisi kabel dalam segi konsumer, perkembangan, dan popularitas di Amerika Serikat. Hak kekayaan intelektual di Amerika Serikat mempunyai otoritas untuk memberikan hak dan untuk itu, melindungi pemilik hak, yang masih memiliki beberapa kelemahan untuk siapa hak itu dimiliki. Ini menandakan bahwa hak kekayaan intelektual mengenai industry televisi, terutama hak cipta, di Amerika Serikat perlu untuk lebih spesifik dalam regulasinya dan menyesuaikan isinya agar lebih pas untuk situasi yang berbeda.

ABSTRACTInternet streaming has turned into a major obstacle for cable television to reach a greater success in the United States. In spite of all that, intellectual property rights play a key role in the issue. Consequently, the purpose of this study is to investigate the correlation of cable television and internet streaming from a perspective of intellectual property rights in the United States. This study uses literature review to help achieve the purpose of this study. In conclusion, internet streaming made a huge impact on cable television in terms of consumers, growth, and popularity in the United States. The intellectual property rights in the United States have the authority to give rights and thus, protect the right owners, which still has some weaknesses on whom do the rights belong to. This indicates that the intellectual property rights regarding the television industry, especially the copyright, in the United States have to be more specific on the regulation and adjust the content to be more fitting to the different situation. "

"Persaingan berbasis inovasi menciptakan tantangan baru bagi hukum persaingan usaha. Di tengah era teknologi saat ini, penggabungan badan usaha kerap didorong oleh motivasi untuk mengambil alih hak kekayaan intelektual atas suatu teknologi milik badan usaha lainnya. Namun, hasil penelitian ini membuktikan bahwa bentuk penggabungan badan usaha yang demikian akan mengakibatkan terjadinya konsentrasi hak kekayaan intelektual yang memiliki dampak anti persaingan mengingat sifat eksklusivitas dan monopolistik dari hak kekayaan intelektual. Sayangnya, masih terdapat celah hukum bagi terjadinya praktik konsentrasi hak kekayaan intelektual di Indonesia. Karenanya, KPPU perlu menerapkan konsep analisis terhadap penggabungan yang serupa dengan konsep analisis Innovation Market di Amerika Serikat.

Innovation-based competition creates new challenges for antitrust law. In the idst of current era of technology, the merger of a business entity is often driven by the motivation to acquire the intellectual property rights over a technology owned by other business entities. However, the results of this study prove that the form of such business entity merger would lead to a concentration of intellectual property rights that has anti-competitive effects due to the exclusivity and monopolistic nature of intellectual property rights. Unfortunately, there is still loopholes for the practice of concentration of intellectual property rights in Indonesia. Therefore, KPPU should apply the concept of merger analysis that is similar to the concept of Innovation Market in the United States."

"Ekonomi kreatif ditetapkan pemerintah sebagai tulang punggung perekonomian Indonesia di masa mendatang. Berdasarkan Undang-undang Nomor 24 Tahun 2019 Tentang Ekonomi Kreatif, perlindungan hak kekayaan intelektual memiliki peran penting di dalamnya. Penelitian ini mencoba untuk melihat bagaimana pengaruh hak kekayaan intelektual terhadap kinerja ekonomi kreatif yang diukur dengan total pendapatan dan keputusan ekspor pelaku ekonomi kreatif. Penelitian ini menggunakan metode analisis Ordinary Least Square OLS. Data yang digunakan adalah data cross section yang bersumber dari Badan Pusat Statistik BPS tahun 2016. Temuan dari penelitian ini adalah kepemilikan HKI oleh pelaku ekonomi kreatif berdampak positif secara signifikan terhadap pendapatan dan keputusan ekspor pelaku ekonomi kreatif.

Creative economy has been assigned as the backbone of Indonesian economy in the future. Based on Article 24 of the 2019 Law of Creative Economy, the protection of Intellectual Property Rights upholds an important role in creative economy. This research aims to observe the impact of intellectual property rights to the performance of creative economy as measured by the total income and export decision of creative economy actors, using the Ordinary Least Square OLS analytical method. It uses the cross-section data sourced from Badan Pusat Statistik BPS Central Bureau of Statistics in 2016. This research concludes that the ownership of Intellectual Property Rights by economy actors has yielded significantly positive impact to the total income and export decision of creative economy actors."
