""This book explores contemporary maritime piracy in Southeast Asia, demonstrating the utility of using historical context in developing policy approaches that will address the roots of this resurgent phenomenon. The depth and breadth of historical piracy help highlight causative factors of contemporary piracy, which are immersed in the socio-cultural matrix of maritime-oriented peoples to whom piracy is still a thinkable option. The threats to life and property posed by piracy are relatively low, but significant given the strategic nature of these waterways that link the Pacific and Indian Oceans, and because piracy is emblematic of broader issues of weak state control in the littoral states of the region. "ABSTRAK
Tesis ini membahas mengenai peranan instrumen ASEAN berupa forum-forum yang berfokus pada keamanan maritim seperti ASEAN Maritime Forum AMF , Extended ASEAN Maritime Forum EAMF , dan ASEAN Defense Minister Meeting ADMM Plus Experts rsquo; Maritime Group on Maritime Security yang belum berperan secara efektif dalam upaya menurunkan tingkat kejahatan di perairan Asia Tenggara, khususnya pembajakan dan perompakan. Penelitian ini adalah penelitian kualitatif deduktif. Hasil penelitian berkesimpulan bahwa kerjasama yang sudah disepakati dalam kerangka ASEAN tidak terlalu berjalan efektif karena adanya relative gain dan self-interest yang berbeda dari setiap anggota ASEAN, sehingga forum kerjasama maritim di bawah ASEAN hanya menjadi forum trust building tanpa ada tindak lanjut berupa operasi bersama atau patroli bersama di dalam kerangka ASEAN. Penelitan ini menyarankan agar Indonesia sebagai pemimpin tradisional ASEAN dapat memimpin kerja sama regional dalam menangani pembajakan dan perompakan di wilayah Asia Tenggara.

ABSTRACT
This thesis discusses the role of ASEAN instruments in the form of forums focusing on maritime security such as the ASEAN Maritime Forum AMF , the Extended ASEAN Maritime Forum EAMF , and the ASEAN Defense Minister Meeting ADMM Plus Experts rsquo Maritime Group on Maritime Security have not functioned effectively in the efforts to reduce crime rates in Southeast Asian waters, especially sea piracy and armed robbery at sea. This research is a deductive qualitative research. The research concludes that the agreed cooperation within the framework of ASEAN are not very effective because of the relative gain and different self interest of each ASEAN member, so that the maritime cooperation forums under ASEAN merely becomes forums of trust building without any follow up in the form of joint operation or joint patrol within the framework of ASEAN. This research suggests that Indonesia, as a traditional ASEAN leader, can lead regional cooperation in dealing with sea piracy and armed robbery at sea in the Southeast Asian region."

"[;Skripsi ini menggambarkan bajak laut sebagai isu keamanan dalam hukum internasional. Fokus pembahasan adalah terhadap rezim hukum internasional tentang bajak laut dari berbagai sumber hukum internasional. Salahs satunya adalah Konvensi Perserikatan Bangsa Bangsa tentang Hukum Laut yang mengandung peraturan dan definisi bajak laut dan juga rangka untuk pembrantasanya dengan kerjamasa antar-negara. Dengan menggunakan metode analisa-deskriptif, skripsi ini mengalisa dan menguji efektifitas hukum internasional sebagai alat untuk membrantas bajak laut. Contoh yang digunakan dalam skripsi ini adalah situasi di Teluk Aden dan di Selat Malaka, yang keduanya terkenal rawan bajak laut. Skripsi ini menyatakan bahwa tindakan PBB di Teluk Aden terhadap ancaman bajak laut melalui kontingen militer mancanegara telah membuktikan bahwa hukum internasional efektif dalam membrantas bajak laut berdasarkan statistika yang menunjukan turun dan jatuhnya kejadian-kejadian perompakan. Namun, tindakan tersebut hanya dapat menghasilkan keamanan sementara. Di lain kata di Selat Malaka, hukum internasional telah terbukti tidak terlalu efektif dalam pembrantasan bajak laut. Yang lebih efektif dalam pembrantasan bajak laut dan menghasilkan keamanan jangka panjang adalah rangka-rangka kerjasama regional dan multilateral seperti ReCAAP.

This thesis explores the concept of maritime piracy as security issue in international law. The discussion explores the existing regime of international laws governing maritime piracy from various sources of international law. Most prominent is the United Nations Convention on the Law of the Sea, which contains provisions regarding the definition of piracy and its repression through international cooperation. Through the descriptive-analysis method, this thesis analyzes and evaluates the effectiveness of international law as a tool to combat piracy. The example used in this thesis is the situation in the Gulf of Aden and the Strait of Malacca, both of which are prominent hotspots for pirate activities in recent years and are very different from one another in terms of geographical and political aspects. This thesis stipulates that the international response to the problem of piracy in the Gulf of Aden has been effective as can be seen in the decline and collapse of pirate activities in the Gulf of Aden, brought about by the counter-piracy operations of the multinational combined maritime forces task forces. However its long-term sustainability remains questionable. Whereas in the Strait of Malacca, the stipulations of UNCLOS 1982 are too narrow and undermine its effectiveness as a tool to combat piracy. Instead, in the Strait of Malacca, regional and multilateral cooperation avenues have been very effective in combating piracy and ensuring long-term security., Skripsi ini menggambarkan bajak laut sebagai isu keamanan dalam hukum internasional.
