"Dalam perekonomian pasar yang terjadi saat ini, hukum persaingan usaha memiliki peran besar untuk melindungi usaha mikro dan usaha kecil karena hukum persaingan usaha berfungsi untuk menjaga iklim persaingan dengan mencegah monopoli dan terjadinya persaingan usaha tidak sehat yang mematikan bagi usaha mikro dan usaha kecil. Usaha mikro dan usaha kecil sendiri selain telah diberikan pemberdayaan, mereka diberikan pula pengecualian dari hukum persaingan usaha untuk memberikan mereka perlakuan khusus mengingat sistem ekonomi kita yang menganut demokrasi ekonomi dengan pertimbangan bahwa mereka tidak memiliki level of playing field yang sama untuk bersaing dengan usaha menengah dan usaha besar. Tujuan dari hukum persaingan di Indonesia adalah untuk mencapai kesejahteraan umum, bukan sekedar kompetisi dalam arti sempit, efisiensi, atau bahkan perlindungan konsumen belaka. Untuk mencapai hal tersebut, hukum persaingan usaha perlu memberikan perlakuan khusus untuk usaha mikro dan usaha kecil sehingga kesejahteraan umum dapat tercapai.

In the current status quo where market economy system happened, competition law has a really big function to keep the competition atmosphere being conducive while in the same time giving the protection to micro and small scales enterpreneurs because competition law prevent monopoly or unfair competition which usually did by big scales enterpreneurs and driving out micro and small scales enterpreneurs off from the market. Beside given empowerment, micro and small scales enterprenuers also given exemption in the competition law in order to give them special favour which adopted in our economic demoracy system, in the awareness that they have different level of playing field to compete with medium and big scale enterpreneurs. The competiton law purpose in Indonesia is to achieve general welfare, not only to achieve narrow competition minded, efficiency, or even only about consumer protection. To achieve that purpose, the compeititon law needs to give special favour to micro and small scales enterpreneurs in order to fulfil Indonesia’s goal which is actualizing the general welfare."
