"ABSTRAK
Tujuan penulisan penelitian ini secara garis besar adalah, pertama, untuk mengetahui permasalahan-permasalahan yang dihadapi oleh peritel tradisional Indonesia berdasarkan ratio decidendi putusan-putusan KPPU. Kedua, tulisan ini ingin mengetahui bagaimana pengaturan hukum ritel tradisional Indonesia, dan ketiga, penulis ingin melihat bagaimana prospek perlindungan hukum ritel indonesia dalam menghadapi Masyarakat Ekonomi ASEAN setelah sebelumnya dibandingkan dengan kondisi perlindungan hukum ritel tradisional di Thailand secara singkat. Metode penelitian yang penulis gunakan adalah normatif dengan kajian literatur yang didukung dengan pendekatan perundang-undangan, konseptual, putusan, serta perbandingan.
Penulis mengidentifikasikan bahwa pada dasarnya isu perlindungan hukum bagi ritel tradisional Indonesia memiliki kesamaan dengan ritel tradisional di Thailand yaitu persaingan secara langsung dengan ritel besar modern. Respon pemerintah Thailand adalah dengan menerbitkan undang-undang khusus di bidang ritel serta adanya Code of Ethic. Persaingan secara lansung antara ritel tradisional dan besar modern di Indonesia terjadi karena berkaitan dengan regulasi dan efektivitas zonasi, aturan jam buka layanan, rendahnya kompetensi pedagang serta pengelolaan pasar, dan juga berkaitan dengan lemahnya ruang lingkup kewenangan KPPU serta kurang efektifnya penegakan perlindungan hukum.
Berdasarkan masalah yang telah diidentifikasikan sebelumnya, untuk menghadapi Masyarakat Ekonomi ASEAN diperlukan penguatan kewenangan KPPU dan revisi Undang-Undang Nomor 5 Tahun 1999. Selain itu, untuk meningkatkan posisi tawar peritel tradisional Indonesia sebaiknya memiliki asosiasi atau perkumpulan yang dapat merespon permasalahan ?permasalahan yang dihadapi.

ABSTRACT
The purpose of writing this paper are, first, to find out the problems faced by Indonesian traditional retailers based on ratio decidendi in Commission's decisions. Secondly, this paper wants to know how the law regulate Indonesian traditional retail industry, and third, the authors wanted to see how the prospects for legal protection of Indonesian traditional retail industry in the ASEAN Economic Community as compared to the previous condition of the legal protection of traditional retailing in Thailand. The research method that I use is normative literature review supported with the statute approach, and conceptual, decision, as well as a comparison approach.
The authors identified that basically the issue of legal protection for traditional retail Indonesia has in common with traditional retail in Thailand namely direct competition with large retail modern. Thai government's response is to publish specific legislation in the field of retail as well as the Code of Ethics. Direct competition between traditional retail and modern large in Indonesia occurred as it relates to the effectiveness of regulation and zoning, rules of opening hours, lack of competence and management of market traders, and also relates to the weakness of the Commission's scope of authority and a lack of effective enforcement of legal protection.
Based on the problems identified previously, for the ASEAN Economic Community is necessary to strengthen the authority of the Commission and revision of Law No. 5 of 1999. In addition, to improve the bargaining position of Indonesian traditional retailers should have an association or associations that can respond to the problems faced.

"Indonesia will be welcoming the ASEAN Economic Community in 2015 as a multilateral agreement
to create integrated regions such as: (a) a single market and production base, (b) a highly
competitive economic region, (c) a region of equitable economic development, and (d) a region
fully integrated into the global economy. These characteristics are interrelated and mutually
reinforcing in a sense that overall development would not be complete without total completion
of the previous sector. This article discusses the participation of Indonesia as part of ASEAN as a
single market and production base, through free flow of services which targets higher education
in law. The author researched that Indonesian higher education system still faces issues, especially
in legal education. As a result, the quality of Indonesian law graduate still varies. Indonesian legal
education is special in nature since it is considered profession and regulated by code of ethic.
According to the author, legal education should be integrated with profession organization so
that upon graduation, law graduates can directly conduct internship according to their desired
profession and compete against ASEAN law graduates.
Indonesia akan menghadapi ASEAN Economic Commmunity pada tahun 2015 sebagai realisasi
perjanjian multilateral untuk menciptakan wilayah terintegrasi seperti: (a) pusat produksi dan
pasar tunggal, (b) wilayah ekonomi yang kompetitif, (c) wilayah yang memiliki perkembangan
ekonomi yang memadai, dan (d) wilayah yang terintegrasi dengan ekonomi global. Karakteristik
ini saling berhubungan dan mendukung dalam arti semua perkembangan ini tidak akan lengkap
tanpa terpenuhinya semua persyaratan tersebut. Artikel ini membahas partisipasi Indonesia
sebagai anggota ASEAN mengenai potensi pendidikan tinggi dalam bidang hukum sebagai sektor
jasa. Akibatnya kualitas lulusan hukum di Indonesia masih beraneka ragam secara nasional.
Pendidikan hukum itu sifatnya khusus karena berupa profesi dan diatur oleh kode etik. Menurut
hemat penulis, seharusnya pendidikan hukum terintegrasi dengan lembaga profesi, sehingga
lulusan sarjana hukum sudah memiliki sertifikasi untuk langsung magang menurut profesinya
masing-masing dan bersaing dengan lulusan hukum dari ASEAN."
