"This paper is the result of research that discusses the conception of paramilitary policing and investigating their implementation within the body of the POLRI. Including identify the elements of paramilitary policing in a variety of functional unit (satfung) in departement of police in resort level.
The results of this study indicate the necessity of paramilitary policing control in the execution of duty serving the interests of the general public, but still needed internally in order to improve discipline and unity of police personnel in facing the instability and uncertainty of duties in the field."

"The thesis discusses the topic of Paramilitary Policing that occurs at the Sabhara Function of the Metro Police Resort, South Jakarta and Bogor City Police Resort. The study refers to the former study on Paramilitary Policing in the implementation of tasks at the Police Functional Units (The study at the Metro Police Resort, South Jakarta and Bogor City Police Resort) where paramilitary policing is still dominant and inherent at the National Police, in particular related to the sabhara function. This study applies primary data through in-depth interviews and observation. It clarifies and illustrates why the element of paramilitary policing at the Metro Police Resort of South Jakarta and Bogor City Police Resort is similar whereas these two regions differ in characteristics and culture. "Perkap Nomor 16 tahun 2011 tentang Sistem penilaian kinerja pegawai negeri pada Polri dengan Sistem Manajemen Kinerja Polri, merupakan upaya Polri untuk senantiasa menjaga dan meningkatkan kinerja para personel Polri. Dalam penelitian ini, membahas tentang penerapan penilaian kinerja personel dengan Sistem Manajemen Kinerja Polri pada Polres Cilegon sebagai upaya peningkatan kinerja personel Polres Cilegon.
Dalam penelitian ini, permasalahan yang diteliti oleh peneliti adalah meliputi bagaimana pelaksanaan penerapan Sistem Manajemen Kinerja Polri sebagai sistem penilaian kinerja personel pada Polres Cilegon, apakah penerapan Sistem Manajemen Kinerja Polri tersebut berdampak pada peningkatan kinerja personel Polres Cilegon, serta apa saja evaluasi terhadap penerapan sistem penilaian kinerja personel Polres Cilegon dengan metode Sistem Manajemen Kinerja Polri.
Penelitian tentang penilaian kinerja personel pada Polres Cilegon ini menggunakan pendekatan kualitatif yang bersifat deskriptif. Kemudian untuk sumber data dipilih dengan metode purposive dan snowball sampling yang disesuaikan dengan perkembangan kebutuhan informasi di lapangan. Pengumpulan data dalam penelitian ini digunakan tiga metode yaitu : observasi terlibat, wawancara mendalam dan studi dokumen. Adapun untuk metode analisis data, peneliti menggunakan 3 tahap yaitu : reduksi data, penyajian data dan verifikasi data.
Dalam akhir penelitian, disimpulkan bahwa penerapan Perkap Nomor 16 tahun 2011 tentang sistem penilaian kinerja personel dengan Sistem Manajemen Kinerja Polri pada Polres Cilegon dan Jajarannya, belum dilaksanakan sesuai ketentuan yang berlaku. Tahapan - tahapan pelaksanaan tidak dijalankan sebagaimana seharusnya. Pelaksanaan penilaian kinerja masih bersifat hanya mengejar formalitas dan menggugurkan kewajiban saja. Kemudian kurangnya pengetahuan dan kesadaran dari personel terhadap Perkap Nomor 16 tahun 2011 membuat pelaksanaan penilaian kinerja menjadi tidak maksimal. Belum berpengaruhnya penilaian kinerja dengan Sistem Manajemen Kinerja terhadap gaji dan tunjangan kinerja turut memperngaruhi pelaksanaan penilaian kinerja. Dan kesimpulan akhirnya adalah penerapan penilaian kinerja dengan Sistem Manajemen Kinerja Polri belum berpengaruh terhadap kinerja personel pada Polres Cilegon.

INP Regulation (Perkap) number 16 year 2011 concerning INP's government officer performance assessment system using INP Performance Management System, is an effort to manage and increase INP personal performance. This research studies the implementation of performance personal assessment using INP Performance Management System in Resort Police of Cilegon as an effort to incease personal performance in Cilegon Resort Police.
The issues of the research are including how the implementation of INP Performance Management System as a personal performance assessment system in Cilegon Resort Police, does it effect the personal performance improvement, and what are the evaluations due to personal performance assessment application in Cilegon Resort Police using INP Performance Management System.
This research uses descriptive qualitative approach. Data source is selected by using purposive method and snowball sampling which adjusting based on information necessity trend in field. Data collecting uses three methods including observation, interview and document study. Data analysis uses three steps method including data reduction, data presentation dan data verification.
The conclusion of the research is that the implementation of Perkap number 16 year 2011 concerning personal performance assessment system in Cilegon Resort Police using INP Performance Management System, has not been applied based on holding regulation. Each stage of application has not been performed as it should be. The implementation of performance assesment is only a formality. The lack of personal knowledgement and consciousness against Perkap number 16 year 2011 causes the lack of performance assessment implementation. Final conclusion of the research is that the performance assessment implementation using INP Performance Management System has not influence personal performance in Cilegon Resort Police.

"Penerapan bernegara di masa otoritarianisme di masa lalu menempatkan Polri untuk tunduk pada kontrol militer dan mengadopsi cara-cara militeristik dalam menegakkan hukum dan melayani masyarakat. Akibatnya lahirlah berbagai bentuk penyimpangan mandat tugas seperti pelanggaran HAM, penggunaan kekerasan secara berlebihan (excessive use of force), dan penyalahgunaan kekuasaan serta korupsi. Sebagai upaya menjaga keseimbangan dalam kepolisian demokratis (democratic policing) membutuhkan sumber daya dari kapasitas negara (state capacity) dan keinginan dari pemerintah untuk melaksanakan kekuasaan negara. Suatu
pemerintahan yang demokratis harus bersedia untuk mengembangkan lembaga-lembaga negara seperti kepolisian yang memungkinkan secara efektif memerangi kejahatan dan gangguan sosial, sementara pada saat yang bersamaan membatasi kemampuan polisi untuk melakukan kekuatan
fisik yang dapat melanggar HAM.
Terdapat tiga dimensi kapasitas negara dalam kepolisian demokratis (Fichtelberg, 2013) yaitu organisasi, profesionalisme dan legalitas. Ketiga dimensi dari kapasitas negara tersebut belumlah cukup untuk dapat membangun kepolisian demokratis di suatu negara, terdapat
beberapa dimensi lain yang perlu ditelaah untuk memperkuat kapasitas negara dalam kepolisian demokratis seperti dimensi institusi (Klockars, 1993), politik (Berkley, 1970), budaya (Bayley, 2006, & Dixon, 1999).
Dalam upaya memperkuat kapasitas negara (state capacity) dalam kepolisian demokratis Reserse Polri, digunakan soft system methodology berbasis riset tindakan di mana alat bantu intelektual berupa human activity systems dalam bentuk root definition, yang kemudian dibuat model konseptualnya untuk research interest dan problem solving interest. Sesuai dengan kaidah dalam soft system methodology berbasis riset tindakan, proses pembandingan dan debating ini untuk tujuan penelitian teoretik yang melibatkan peneliti, promotor dan ko promotor serta para
penguji lainnya sebagai academic reviewers. Sedangkan untuk problem solving interest melibatkan para pemangku kepentingan dari transformasi kepolisian konvensional kepada kepolisian demokratis Reserse Polri dan praktisioner SSM.
Hasil penelitian ditemukan bahwa konstruksi teoritis untuk research interest yaitu perlunya penguatan melalui pengembangan tiga dimensi kapasitas negara dalam kepolisian demokratis yaitu organisasi, profesionalisme dan legalitas (Fichtelberg, 2013) yang dapat diperkuat dan
dikembangkan dengan dimensi institusi (Klockars, 1993), politik (Berkley, 1970), budaya (Bayley, 2006, Dixon, 1999). Pengembangan dari tiga dimensi menjadi enam dimensi dari kapasitas negara dalam membangun kepolisian demokratis merupakan novelty dari penelitian yang bersifat research interest. Dimensi institusi, politik dan budaya juga merupakan dimensi yang penting dan harus ada dalam kapasitas negara dalam membentuk institusi kepolisian
demokratis. Bareskrim Polri memiliki peluang untuk dapat melakukan transformasi kepolisian melalui kepolisian demokratis (democratic policing) melakukan inovasi tata kelola kepolisian sebagai pelayan publik, menjunjung tinggi supremasi hukum, etika kepolisian, dan hak asasi
manusia, menjaga akuntabilitas dan transparansi, struktur dan manajerial yang efektif dan efisien dalam rangka mewujudkan perlindungan dan pelayanan terhadap masyarakat demokratis.

The implementation of the life of state during the past authoritarian era has put the Indonesian National Police under the military control and that the Indonesian Police had to adopt militaristic methods in enforcing the law and in serving the people. This has caused many forms
of dereliction of duty such as violation of human rights, excessive use of force, abuse of power and corruption. The effort to maintain the balance in democratic policing requires resources from the state capacity and political will of the government to implement the power of the state. A democratic government must be willing to develop state institutions such as police institution which will fight against crime and social problems, and at the same time restrict police capability that may violate against human rights.
There three dimensions of the state capacity in democratic policing (Fichtelberg, 2013), namely organization, professionalism and legality. These three dimensions of the state capacity, however, are not yet enough to develop democratic policing in a nation. There are still other dimensions to be explored in order to strengthen the state capacity in democratic policing, such as institutions
(Klockars, 1993), politics (Berkley, 1970), and culture (Bayley, 2006, & Dixon, 1999).
In the effort of strengthening the state capacity in democratic policing in the Criminal Investigation Division, the Indonesian Police uses an action research based soft system methodology whereby intellectual device of human activity systems in the forms of root definition, which then becomes the conceptual model for research interest and problem solving interest. In accordance with the principle in the action research based soft system methodology, the process of comparing and debating is for theoretical research purpose which involves researchers, promotors and co-promotors as well as other examiners being the academic reviewers. On the other hand, problem solving interest involves the stakeholders of the
transformation from conventional police to democratic police in the Criminal Investigation Division, the Indonesian Police and SSM practitioners.
The research results show that the theoretical construction for research interest is the need of
empowerment through the development of three dimensions of state capacity in democratic policing, namely organization, professionalism and legality (Fichtelberg, 2013), which can be strengthened and developed with such other dimensions as institutions (Klockars, 1993), politics (Berkley, 1970), and culture (Bayley, 2006, & Dixon, 1999).The development from three dimensions to six dimensions of the state capacity in establishing democratic police constitutes novelty of research having the nature of research interest. Institution, politics and cultures are three important dimensions and they should exist in the state capacity in establishing democratic
policing. The Criminal Investigation Division of the Indonesian National Police has the chance to implement police transformation through democratic policing and to make innovation in good governance of the police as public servant, to uphold the supremacy of law, police ethics, human rights, to keep accountability and transparency, effective and efficient structure and management in the framework of providing protection and services to a democratic society.

"Tesis ini merupakan hasil penelitian menggunakan metoda kualitatif dalam bentuk studi kasus, dengan pendekatan manajemen, yuridis dan psikologis dalam membahas proses pengambilan keputusan para agen yaitu Pimpinan dan para Penyidik Bareskrim Polri, yang memiliki kapasitas bertindak kreatif, sebagai respon terhadap aturan dan sumber daya organisasi (struktur) dalam penyidikan terhadap para Tersangka Perwira Tinggi Polri.
Permasalahan pokok dan tesis ini adalah mempertanyakan apakah para agen mampu menerapkan kapasitas bertindak kreatif yang mereka miliki sehingga dapat mempertahankan jati diri sebagai penegak hukum yang jujur, adil dan tidak diskriminatif, sertal tidak menyalah gunakan wewenangnya ketika menyidik sesama anggota Polri.
Tujuan penelitian ini adalah untuk mengetahui, memahami proses, bentuk, pola, kemungkinan penyebab dan pengaruh dari keputusan para agen khususnya para Penyidik dalam mengunakan kapasitas bertindak kreatif ketika menyidik sesama anggota Polri, dalam hal ini para Perwira Tinggi Polri.
Secara umum penelitian menunjukan bahwa, kapasitas bertindak kreatif yang mendasari keputusan penyidik untuk memberiakukan atau tidak memberiakukan ketentuan-ketentuan yang ditetapkan undangundang atau ketentuan lainnya yang berlaku dalam organisasi kepolisian, terhadap tersangka yang adalah atasan atau senior mereka, dipengaruhi oleh persepsi Penyidik yang lahir dari budaya kepolisian yang mereka anut. Kadar rasa hormat dan loyalitas kepada atasan maupun senior memegang peranan dominan terhadap penilaian subyektif penyidik dalam bertindak sehingga aspek etika dalam bentuk sikap yang penuh sopan santun, manusiawi, dan empati sangat ditonjolkan, Iebih-lebih kepada para Tersangka yang dinilai sebagai senior yang memiliki kepribadian yang balk oleh para penyidik.
Meskipun demikian, prinsip-prinsip dan kebijaksanaan yang telah digariskan pimpinan untuk menuntaskan kasusnya, sebagai wujud tanggung jawab terhadap tugas dan byalitas kepada institusi tetap dipertahankan, sehingga seluruh prosedur dan tahapan penyidikan sesuai ketentuan dapat dipenuhi dan kasusnya dapat diteruskan sampai pada tingkat peradilan dan penjatuhan hukuman.
Kesimpulan dan hasil penelitian memperlihatkan, pertama, para agen sesuai dengan tingkat kekuasaan dan wewenang mereka di dalam organisasi dengan kreasi dan kapasitas bertindak atas penilaian sendiri itu memberi kontribusi pencapaian tujuan penyidikan tanpa menimbulkan konflik yang berarti. Kedua, pada level pengambil keputusan, melalui tindakan kreatifnya mampu mengeliminir tekanan struktur yang lebih tinggi dan berskala strategis, bahkan berhasil mereproduksi struktur Baru dalam bentuk Keputusan Menkumham RI yang menetapkan rumah tahanan Polri sebagai Lapas bagi Terpidana Polri. Dan ketiga, hasii dari tindakan-tindakan kreatif pada level pelaksana, temyata memperlihatkan diskriminasi perlakuan yang dapat dikiasifrkasikan sebagai penyimpangan ringan namun dapat memberi implikasi yuridis bila terekspos ke depan publik hukum.
Wujud dari tindakan kreatif para agen yang diskriminatif menunjukan pola sebagai berikut :Terdapat perlakuan yang berbeda yang ditampilkan Penyidik (agen) dalam penyidikan terhadap Tersangka sipil dan tersangka anggota Polri. Perlakuan terhadap Tersangka Pain umumnya lebih longgar dan semakin tinggi tingkat kepangkatan Tersangka Polri yang disidik, semakin tinggi pula tingkat kelonggaran yang diberikan. Perlakuan yang sangat khusus diberikan pada Tersangka berpangkat Perwira Tinggi Polri.
Sesuai dengan tujuan tesis, rekomendasi yang diajukan adalah perlunya menetapkan dan merumuskan secara lebih jelas dan tepat konsep diskresi untuk Polri agar keragaman pemahaman dapat dicegah; penyusunan petunjuk yang jelas tentang prosedur pemenksaan pelanggaran disiplin, kode etik Polri dan pelanggaran pidana oleh anggota Polri berikut sistem pengawasannya; Berta penyusunan prosedur tetap penyidikan terhadap anggota Polri yang diproses karena pelanggaran pidana.

The thesis is a result of a research employing qualitative method in a form of a case study. The thesis also employs management, juridical and physiological approach in discussing the process of making decision made by some agents; that is, the administrators and investigators of Criminal Investigation Department (CID) of Indonesian National Police (INP) who have the capability to act creatively as a response to regulations and the organization's human resources in investigating high-rank police officers.
The capability to act creatively as the base of the investigators' decision as the agents of enforcing or not enforcing regulations stated in laws or other rules that prevail in police organization to the suspects who are actually the investigators' superiors or seniors, is influenced by the investigators' perception which comes from the police culture. The degree of respect and loyalty of the investigators to their superiors or seniors plays dominant roles in their subjective assessment so that ethical aspects in the forms of respect, humanity, and empathy strongly dominate such assessment. This is especially true in investigating suspects who are their senior that are regarded by the investigators to have good personality. Nevertheless, principles and policies that are underscored by their chief as a form of responsibility to the duties and loyalty to the institution are still maintained so that all procedures and steps of investigation can be fulfilled. In addition, the case can be forwarded to the level of trial and punishment.
The result of the research reveal some points: First, the agents, in accordance with their level of authority in their organizations and with their capability and creativity have given contribution in order to achieve the goals of investigation without causing significant conflict; Second, at the level of decision maker the investigators, using their creative action, are able to eliminate higher structural pressure as well as strategic pressure and they even succeeded to struggle for a new structure in a form of a decree of the Minister of Law and Human Rights which determines the prison of INP members as the penitentiary for convicted from INP members; and Third, the results of creative action at the level of implementation, in fact, show that discriminative treatment that can be classified as minor deviances but such deviances can give juridical implication if they are exposed to the public.
The shape of creative action of the discriminative agents shows the following patterns: there are different treatments done by the agents (investigators) in investigating civilian suspects and suspects belong to INP. Treatments to suspects belong to INP are generally laxer and the higher of the rank of the suspect the laxer of the treatment given. There are even extremely specific treatments given to suspects who are high-rank police officers.
In accordance with the aim of the thesis, the author recommends that it is necessary to determine and to formula a clearer and more precise concept of police discretion so that various and ambiguous understanding can be avoided. In addition, the author suggests formulating a clearer direction on the procedure of investigating discipline violation, Polri code of ethic and criminal act as well as the supervision of the implementation. Finally, the author also suggests formulating a fixed procedure about the investigation of Polri members who are processed because of criminal violation."

Pengelolaan sumber daya manusia Polri pada jabatan Atase Kepolisian di Divisi Hubungan Internasional Polri belum memiliki aturan yang mendukung tugas-tugas operasional dan pembinaan personel yang efektif. Penelitian ini menganalisa gambaran umum penugasan Atase Kepolisian serta pengelolaan sumber daya manusia Atase Kepolisian saat ini. Selain itu, penelitian ini juga memberikan penjelasan pengelolaan sumber daya manusia Atase Kepolisian yang efektif ssuai dengan kebutuhan. Pendekatan penelitian ini menggunakan pendekatan kualitatif dan pengumpulan data melalui teknik wawancara, observasi serta studi literature. Teori yang digunakan adalah teori manajemen sumber daya manusia, dan teori sistem pengendalian manajemen. Konsep rekrutmen dan seleksi, pelatihan, dan penilaian kinerja digunakan dalam penelitian ini. Hasil penelitian ini menunjukkan bahwa penugasan Atase Kepolisian hanya merujuk pada 2 dua Peraturan Kapolri yang hanya menjelaskan pengertian dan tugas dari Atase Kepolisian. Pengelolaan SDM Atase Kepolisian saat ini meliputi aspek kompetensi, manajemen karir, pengawasan pengendalian yang didalamnya terdapat proses penilaian kinerjadan rentang kendali. Pengelolaan SDM Atase Kepolisian yang efektif memerlukan adanya integrasi dari 4 empat aspek pengelolaan sebelumnya yang didukung dengan adanya penetapan aturan dasar yang mengatur penetapan aturan karir bagi Atase Kepolisian serta terintegrasinya database sistem informasi manajemen Atase Kepolisian dan sistem pelaporan yang berada di Divhubinter Polri dan Kementrian Luar Negeri Republik Indonesia guna pengembangan karir Atase Kepolisian.

ABSTRACT
The management of Polri 39 s human resources in the position of Police Attache in the International Relations Division of the Police does not have rules that support operational tasks and effective personnel development. This study analyzes the general description of Police Attache assignment and human resources management of Police Attache at this time. In addition, this study also provides an explanation of human resource management of Police Attache which is effective with the needs. This research approach uses qualitative approach and data collection through interview technique, observation and literature study. The theory used is the theory of human resource management, and the theory of management control systems. The concept of recruitment and selection, training, and performance appraisal was used in this study. The results of this study indicate that the assignment of Police Attache only refers to 2 two Police Regulations which only explain the meaning and duty of Police Attache. Human Resource Management The Police Attache currently includes aspects of competence, career management, supervision of controls in which there is a process of performance assessment and control span. Effective human resource management An effective police Attach requires integration of the four prior management aspects supported by the establishment of the basic rules governing the setting of career rules for Police Attache and the integration of the Police Attache Management Information System database and the reporting system located in the Division of Relations International Police and the Ministry of Foreign Affairs of the Republic of Indonesia for the career development of Police Attache. "
