"ABSTRAK
PT Rungkut Megah Sentosa mengadakan kerjasama pemanfaatan swasta yang
merupakan kerjasama pengelolaan barang milik daerah dengan Pemerintah Kota Surabaya atas tanah yang menjadi asetnya tersebut dalam bentuk Hak Guna Bangunan (HGB) di atas Hak Pengelolaan (HPL). Permasalahan terjadi ketika PT Rungkut Megah Sentosa memperpanjang HGB di atas HPL tersebut sedangkan Kementerian Dalam Negeri melarang perpanjangan tersebut karena tidak sesuai dengan kerjasama pemanfaatan swasta dimana kerjasama tersebut tidak dapat diperpanjang jika melihat bahwa tanah tersebut merupakan tanah aset daerah. Penelitian ini menggunakan metode penelitian yang bersifat yuridis normatif dengan pendekatan kualitatif. Pendekatan ini dilakukan karena digunakan penelitian kepustakaan yang menghasilkan data yang bersifat deskriptif analitis, sehingga menghasilkan gambaran secara umum mengenai materi yang menjadi pembahasan dalam penelitian ini. Menjawab permasalahan tersebut pengaturan pertanahan mengenai perpanjangan HGB di atas HPL tetap merujuk pada UUPA dan PP No. 40 Tahun 1996, meskipun tanah tersebut aset daerah yang pengaturannya diatur oleh UU No. 1 Tahun 2004 dan PP No. 27 Tahun 2014 Tentang Pengelolaan Barang Milik Negara/Daerah. Sedangkan kedudukan kemendagri hanyalah sebatas pembinaan dan pengawasan serta pengendalian barang milik daerah jika antara kerjasama dengan pihak ketiga tersebut memiliki indikasi menimbulkan kerugian daerah.

ABSTRACT
PT Rungkut Megah Sentosa has made a private utilization cooperation agreement, pertaining to cooperation on sectoral asset management with Surabaya Government City over its land, in the form of The Right To Build on the Management Rights Over Land. Problem has been arised when PT Rungkut
Megah Sentosa had intended to extend of the right to build on the management rights over land, but the Ministry of Internal Affair issued a letter of warning about that extension because it did not comply with the agreement which was prohibit the extension because the land was an asset of Surabaya City Government. The methode of this thesis was normative juridical with qualitative approach which produce an analitical descriptive which obtain general description about the responses of the problem. The answers was using the regulation of land law, on the subject of the extension of the right to build on the management rights over land and government regulation number 40 of 1996, although the asset of government was using constitution of local asset management and government regulation number 27 of 2014. Meanwhile the ministry of internal affair can only developed, supervised, and controlled the local asset to prevent the loss of the region's asset."

Tesis ini membahas mengenai Putusan Pengadilan Negeri Jakarta Utara No.
71/PDT/G/2007 juncto No. 418/PDT/2007/PT.DKI tentang sengketa tanah antara PT. Roda Kencana Mendiri melawan Perusahaan Umum Pelabuhan II Tanjung Priok (sekarang PT. (Persero) Pelabuhan Indonesia II Cabang Tanjung Priok) dan PT. Maju Terus Jaya yang bermula dari permintaan Perum Pelabuhan Indonesia II Tanjung Priok kepada PT. Roda Kencana Mandiri untuk melakukan pembayaran kembali atau pembayaran ulang atas tanah dengan Sertifikat Hak Guna Bangunan No.105/Kalibaru yang dikuasainya dengan alasan tanah tersebut merupakan tanah Hak Guna Bangunan (HGB) diatas tanah Hak Pengelolaan (HPL) dimana pihak Perum Pelabuhan Indonesia II Tanjung Priok sebagai Pemegang HPL atas tanah objek sengketa tersebut. Penulisan tesis ini dengan metode penelitian yuridis normatif untuk
mengetahui dan menganalisis norma-norma/asas-asas hukum dalam Putusan
Pengadilan dan bahan hukum pustaka atau data sekunder (berupa peraturan
perundang-undangan di bidang pertanahan, khususnya mengenai pemberian Hak Guna Bangunan di atas tanah Hak Pengelolaan). Putusan Pengadilan Negeri Jakarta Utara No. 71/Pdt/G/2007 jo. No. 418/PDT/2007/PT.DKI. menyatakan bahwa Akta Jual Beli No. 454/Cilincing/1998 adalah sah dan berharga dan PT. Roda Kencana Mandiri dinyatakan sebagai pemilik yang sah atas tanah objek sengketa dengan Sertifikat Hak Guna Bangunan No. 105/Kalibaru tersebut. Pertimbangan hukum yang diberikan oleh Majelis Hakim dalam Putusan Pengadilan Negeri Jakarta Utara No. 71/Pdt/G/2007 jo. No. 418/PDT/2007/PT.DKI. tidak sesuai dengan ketentuan perundangan yang berlaku mengenai pemberian HGB di atas tanah HPL

ABSTRACT
This thesis is to analyze the Verdict of North Jakarta District Court Number
71/PDT/G/2007 jo. Number 418/PDT/2007/PT.DKI concerning land dispute between PT. Roda Kencana Mandiri versus Perusahaan Umum Pelabuhan II Tanjung Priok (now PT. (Persero) Pelabuhan Indonesia II Cabang Tanjung Priok) and PT. Maju Terus Jaya which was caused by the petition of Pelabuhan Indonesia II Tanjung Priok towards PT. Roda Kencana Mandiri to perform re-payment or recompense onto land under Building Utilization Title Number 105/Kalibaru occupied by PT. Roda Kencana Mandiri by reason that the land under the Certificate of Right of Building (HGB) located within the area of Right of Management (HPL) whereas Pelabuhan Indonesia II Tanjung Priok as the holder of the Certificate of HPL to such disputed land. This thesis writ with normative juridical research method to study and analyze the norms / principles of law on the Verdict and legal material libraries or secondary
data (in form of legislations on the land sector, particularly regarding the provision of Right of Building upon Land under Right of Management). The Verdict of North Jakarta District Court Number 71/PDT/G/2007 jo. Number 418/PDT/2007/PT.DKI stated that the Sales and Purchase Deed Number 454/Cilincing/1998 is lawfully valid and recognized hence PT. Roda Kencana Mandiri declared as a rightful owner upon disputed land under the Certificate of Right of Building Number 105/Kalibaru. Juristical judgment provided by the Panel of Judges in the Verdict of North Jakarta District Court Number 71/PDT/G/2007 jo. Number 418/PDT/2007/PT.DKI is not in according with the prevailing laws and regulations regarding the issuance of HGB upon the HPL."

"[ABSTRAK
Risalah Lelang merupakan akta otentik yang membuktikan telah terjadinya lelang
dan berfungsi sebagai alas hak untuk melakukan balik nama, khususnya dalam hal
objek lelang berupa tanah dan bangunan. Seperti halnya akta notaris, Risalah
Lelang dapat dibuat dalam bentuk minuta, salinan dan grosse. Minuta Risalah
Lelang merupakan arsip negara yang wajib disimpan dan dipelihara secara baik
oleh Juru Lelang/Kantor Lelang. Dalam penelitian ini, permasalahan muncul
sebagai dampak dari diterbitkannya surat keterangan sebagai pengganti salinan
Risalah Lelang oleh Kepala Kantor Lelang Negara, yang tidak memiliki minuta.
Mengenai bidang tanah/bangunan yang telah dijual lelang oleh Kantor Lelang
Negara tersebut, bagaimanapun, telah diterbitkan sertipikat Hak Guna Bangunan
atas nama pihak lain oleh Kantor Pertanahan sebagai tindak lanjut dari adanya
ketentuan konversi tanah berdasarkan UUPA. Selain itu, sertipikat Hak Guna
Bangunan tersebut telah pula ditingkatkan menjadi Hak Milik. Penelitian ini
bertujuan untuk mengetahui kesesuaian antara prosedur lelang dan proses
konversi tanah yang telah dilakukan dengan peraturan-peraturan yang berlaku di
bidang hukum lelang dan pertanahan. Penelitian ini menggunakan bentuk yuridis
normatif dengan tipe diagnostik fact-finding. Jenis data yang digunakan adalah
data sekunder yang dianalis secara kualitatif sehingga menghasilkan laporan yang
bersifat diagnostik analisis. Penulis menyimpulkan bahwa lelang yang telah
dilakukan mengandung beberapa cacat prosedur dan surat keterangan sebagai
pengganti salinan Risalah Lelang tersebut tidak dapat diterima sebagai alat bukti
yang sah dan sempurna, namun hanya sebagai bukti permulaan.

becomes the legal basis the transfer of title from a vendor to a purchaser,
particularly in relation to land and builidng. Similiar to a notary deed, The
Auction Deed may be drawn as a minute, an exemplified copy, and an
engrossment. As state archives, the minute of Auction Deeds must be kept and
maintained well by auctioneers. In this research, problems arise as a result of the
issuance of letters of evidence by the Head of State Auction Office as a substitute
for an exemplified copy of an auction deed, that do not has the minute. With
regard to the property sold by the aforementioned State Auction Office, however,
the Land Office has granted Building Rights Certificate under the name of other
people based on the conversion policy of land titles in conformity with the Basic
Agrarian Law (UUPA). Besides, The Building Rights has been increased into the
Ownership (Freehold) Rights. This study aims to examine the suitability of the
auction procedure, conversion of land rights procedure with the auction and land
regulations. The research uses normative juridical with fact-finding diagnostic.

Hak atas tanah merupakan hak yang melekat, dan tidak dapat dihilangkan begitu saja. Hak atas tanah, antara lain adalah Hak Milik. Pengaturan pertanahan di Indonesia tegas menjelaskan bahwa Hak Milik atas tanah hanya diperuntukkan bagi warga negara indonesia dan badan hukum dengan
syarat. Oleh karena itu hak milik kepada orang asing dilarang, dan pelanggaran terhadap hal ini mengandung sanksi batal demi hukum dan hak atas tanahnya jatuh pada negara. Tulisan ini membahas sebuah kasus sengketa tanah antara WNA dan WNI, yang memperlihatkan telah terjadi peralihan hak melalui jual-beli dengan pinjam nama, serta pertimbangan hakim yang diklasifikasikan dalam dua tema oleh penulis yaitu mengenai kepemilikan tanah oleh WNA dan
harta bersama dalam perkawinan campuran.Tulisan ini menggunakan metode kualiatatif dengan penelusuran data sekunder berupa bahan hukum primer dan sekunder, yang dibahas dengan metode analisis yuridis. Hasilnya bahwa perjanjian nominee dalam jual beli mengakibatkan jual beli tidak memiliki kekuatan hukum, warga negara asing dapat mempunyai hak atas tanah namun
terbatas, yakni hanya diperbolehkan dengan status hak pakai dan hak sewa sebagaimana dijelaskan didalam pasal 42 dan 45 UUPA, tidak boleh hak jenis lain. Dan perkawinan campuran tanpa perjanjian kawin tidak bisa memiliki tanah dengan hak milik di Indonesia

ABSTRACT
The right to land is an inherent right, and can not be eliminated just like that. Land rights, among others, is Hak. Administration of land in Indonesia firmly explained that the Property Rights of land reserved for Indonesian citizens and legal entities on the condition. Therefore the property to foreigners is prohibited, and a violation of the sanctions it contains a null and void and the land rights fall on the state. This paper discusses a land dispute between the foreigners and the citizen, which shows there has been a transfer of rights through the sale by borrowing the name, as well as consideration of the judge who is classified into two themes by the author of the ownership of
land by foreign and joint property in marriage campuran.Tulisan the use of qualitative methods to search secondary data from primary and secondary legal materials, which are discussed with juridical analysis methods. The result is that the agreement nominee in buying and selling lead selling does not have the force of law, foreign citizens can have land rights but limited, which is
only allowed with the status of the right to life and the right to lease as described in Article 42 and 45 of the BAL, may not be the right kind of other , And intermarriage without mating agreement could not have freehold land in Indonesia"

Propinsi Bali merupakan wilayah Indonesia yang jumlah wisatawan yang datang
ke kian mengingkat setiap tahunnya. Hal ini menyebabkan banyak orang baik warga
negara Indonesia dan orang asing tertarik untuk tinggal atau membuka usaha di Bali.
Undang-Undang Pokok Agraria menyatakan bahwa hanya warga negara Indonesia yang
berhak untuk memiliki tanah. Sementara itu, orang asing diberi hak untuk menempati
lahan di Indonesia dengan hak pakai dan hak sewa atas bangunan. Tetapi pada
kenyataannya banyak orang asing menggunakan perjanjian pinjam nama untuk
menempati lahan di Bali dalam jangka waktu yang mereka inginkan. Perjanjian sewa
menyewa digunakan sebagai upaya untuk menutupi keberadaan perjanjian dapat dianggap
sebagai perjanjian pinjam nama sehingga perjanjian sewa menyewa merupakan suatu
upaya penyelundupan hukum. Penelitian ini menggunakan metode yuridis normatif,
untuk memperoleh data yang dikehendaki penelitian ini dengan melakukan telaah bahan
pustaka atau data sekunder. Hasil analisis menunjukkan bahwa rangkaian perjanjian
pinjam nama antara lain surat pernyataan, perjanjian sewa menyewa, surat kuasa
mengelola, surat kuasa menjual dan perjanjian perpanjangan sewa. Pada saat orang asing
datang kepada notaris untuk dibuatkan akta otentik sebaiknya notaris lebih teliti dan
seksama sehingga apabila terdapat indikasi pembuatan akta otentik dapat menyalahi
aturan hukum maka notaris dapat memberi penyuluhan hukum. Dalam menjalankannya
jabatannya seorang notaris itu harus bertindak amanah, jujur dan seksama karena notaris
wajib menjaga kepercayaan masyarakat dan negara dengan baik.

ABSTRACT
Bali Province is a major area of Indonesia tourism so that the number of tourists
who come to Bali is increasingly every year. This leads to a lot of people both Indonesian
citizens and foreigners keen to stay or open a business in Bali. Basic Agrarian Law states
that only Indonesian citizens who have the right to own land. Meanwhile, foreigners were
given the right to occupy land in Indonesia with the right to use and leases on buildings.
But in fact many foreigners use nominee agreement and loan agreement to occupy land in
Bali in the time period they want. The content of Indonesian citizen who appointed to be
a nominee states that the true owner of the land is the foreigner because the money she
used for the purchase of land was belongs to the foreigner. Lease agreement is used as an
attempt to cover up the existence of the agreement can be considered as a loan agreement
so that the name of the lease agreement is a legal smuggling attempt. This study uses
normative juridical, to obtain the desired data of this study by conducting research library
materials or secondary data. The analysis showed that a series of loan agreements include
a statement of the name, lease agreement, power of attorney to manage, power of attorney
to sell and lease extension agreement. By the time a foreigner came to the notary for the
notary should be made authentic act more carefully and thoroughly so that if there are
indications of an authentic deed may violate the rule of law, the notary can provide legal
counseling. A notary should act trustworthy, honest and thorough, as notaries are required

"[ABSTRAK
Saat ini masih banyak terjadi praktek jual beli yang dilakukan dibawah tangan atau tanpa dengan akta jual beli yang dilakukan dihadapan PPAT (Pejabat Pembuat Akta Tanah), yang tentunya tanpa akta tersebut masyarakat tidak dapat melakukan pendaftaran tanah atas peralihan hak tersebut pada Kantor Badan Pertanahan Nasional. Terdapat juga penerbitan Sertifikat Hak Milik oleh Kantor Badan Pertanahan Kota Medan tanpa disertai data yuridis maupun fisik yang benar. Penelitian ini menggunakan metode analisis kualitatif, yaitu data diperoleh, dibaca serta ditafsirkan sendiri oleh peneliti berdasarkan peraturan perundang-undangan yang berlaku di Indonesia. Tujuan dari penelitian ini adalah untuk mengetahui keabsahan jual beli tanah yang dilakukan di bawah tangan dan perkara proses penerbitan sertipikat hak milik, khususnya dalam Perkara Nomor 305K/Pdt/1995 dan Perkara Nomor 23/K/TUN/2005. Hasil kajian ini menunjukan bahwa jual beli tanah yang dilakukan tanpa akta jual beli PPAT adalah sah menurut hukum, namun untuk melakukan pendaftaran peralihan hak pada Kantor Badan Pertanahan Nasional. Penerbitan sertifikat sebagai bukti hak oleh Kantor Badan Pertanahan Nasional juga harus didasari dengan data yuridis dan data fisik yang benar.

Currently, there is still a lot of buying and selling underhanded or without the deed of
sale is done before PPAT (Pejabat Pembuat Akta Tanah), which of course without the deed, the
people cannot do the transfer of rights over the registration as meant in office of National Land
Agency. There is also the issuance of Certificate in office of Medan National Land Agency
unaccompanied by judicial and physical right. This research used a qualitative analysis method,
namely based on the data obtained, read and interpreted by the researchers based on the laws and
regulations in force in Indonesia. The purpose of this study was to determine the validity of the
sale and purchase of land made underhanded and cause the issuance of certificates of property
rights, particularly in case number 305K / Pdt / 1995 and case number 23 / C / TUN / 2005. The
results of the review showed that the sale and purchase of land is done without a deed of sale
PPAT is lawful, but to register the transfer of the National Land Agency. The issuance of a
certificate as proof of rights by the National Land Agency should also be based on the juridical

Peningkatan pemanfaatan tanah berpotensi menimbulkan sengketa diantara para
pihak yang hendak menguasai tanah. Untuk memberi jaminan kepastian hukum dan
kepastian akan hak-hak atas tanah, maka diperlukan perangkat hukum yang tertulis,
lengkap, dan jelas. Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar
Pokok-Pokok Agraria (UUPA) telah meletakkan kewajiban kepada Pemerintah untuk
melaksanakan pendaftaran tanah, disamping kewajiban para pemegang hak untuk
mendaftarkan hak atas tanah yang ada padanya. Sistem pendaftaran tanah yang
berlaku di Indonesia adalah sistem pendaftaran hak. Hal ini tampak dengan adanya
buku tanah sebagai dokumen yang memuat data fisik dan data yuridis yang dihimpun
dan disajikan, serta diterbitkannya sertipikat sebagai surat tanda bukti hak yang
didaftar. Sertipikat hak atas tanah merupakan alat pembuktian yang kuat. Namun
dalam prakteknya, pemegang sertipikat hak atas tanah masih rentan terhadap gugatan.
Penulis dalam penelitian ini menemukan kasus pembatalan 111 (seratus sebelas)
Sertipikat Hak Milik melalui sebuah Surat Keputusan Kepala Kantor Wilayah Badan
Pertanahan Nasional. Pembatalan Sertipikat tentu menimbulkan banyak
permasalahan. Untuk menjawab permasalahan yang telah dirumuskan, Penulis
menggunakan metode penelitian hukum normatif atau penelitian hukum kepustakaan,
yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data
sekunder. Berdasarkan penelitian ini, Penulis menyimpulkan bahwa pemegang Hak
Milik dalam seratus sebelas sertipikat yang dibatalkan oleh Badan Pertanahan
Nasional tidak memperoleh perlindungan hukum sebagaimana mestinya karena
memperoleh tanah tidak dengan itikad baik. Mereka telah membeli tanah redistribusi
dari pihak yang tidak berhak mengalihkan hak atas tanah tersebut dan tidak dapat
membantu pihak Kantor Pertanahan untuk membuktikan adanya proses pengajuan
permohonan hak sesuai ketentuan pendaftaran tanah yang berlaku di Indonesia.

ABSTRACT
The increasing need of land resource utilization potentially leads to the rising number
of disputes over the land property control between the parties who have vested
interest on it. In order to guarantee legal security over the property of the land, the
law that is comprehensive and clear is indeed required. Act No. 5 of 1960 Concerning
Basic Regulations on Agrarian Principles has laid an obligation to the government to
implement land registration, in addition to the obligation of the landowners to register
property rights. The system of land registration in Indonesia is a system of
registration of tittles. The landowners receive a certificate as evidence of ownership.
The certificate of land right is a powerful evidence. However, in practice, the holder
of the certificate of the land right is still vulnerable to a lawsuit. The author of this
study has found the case of cancellation of 111 (one hundred and eleven) certificates
by means of the Decree of the Head of the National Land Agency. The cancellation
of certificate raises many problems. To find out and learn about the problem, the
author has used the method of normative legal research or legal research literature,
namely the legal research done by examining library materials or secondary data.
Based on the study, the author has concluded that the holders of property rights in the
one hundred and eleven certificates have not obtained legal protection as they should
be because they have acquired the property by illegal procedure. Not only they have
purchased redistributed land property from unauthorized entity, but they also fail to
provide evidence to the Land Officer to prove the existence of the process of
registration of land property in accordance with the law of land registration in
Indonesia."

"ABSTRAK
Kota depok khususnya Kecamatan Beji adalah daerah yang mengalami perkembangan pesat dan sebagian besar tanahnya adalah tanah permukiman. Secara teori terdapat beberapa faktor yang mempengaruhi nilai tanah permukiman dimana dalam penelitian ini faktor yang digunakan sebagai varabel bebas adalah jarak ke pusat pemerintahan, jarak ke stasiun, jarak ke jalan arteri, jarak ke sekolah, jarak UI, jarak ke pusat perbelanjaan, dan ketersediaan fasilitas kesehatan. Untuk mengetahui pengaruh variabel bebas terhadap nilai tanah permukiman digunakan analisis statistik dan analisis Sistem Informasi Geografis. Variabel yang secara individu mempengaruhi nilai tanah adalah jarak ke stasiun, jarak ke arteri, jarak ke pusat pemerintahan, jarak ke pusat perbelanjaan dan fasilitas kesehatan. Sedangkan variabel yang tidak signifikan pengaruhnya adalah jarak ke UI dan jarak ke sekolah. Selain itu juga dapat dipetakan daerah mana yang mengalami kenaikan nilai tanah paling besar.

ABSTRACT
Depok city especially Beji district is a rapid developed area and most of the territory are land for residential. Teoritically, there are some faktor that determine settlement land value. Independent variables that used in this study are distance to central of government, distance to station, distance to artery road, distance to publik school, distance to University of Indonesia, distance to shopping centre, and health facilities. To determine relationship between independent variabel with settlement land value, researcher uses statistic analysis and Geographic Information Sistem GIS . The result, distance to central of government, distance to station, distance to artery road, distance to shopping centre, and healt facilities are significant variables that determine settlement land value. This research also provide land value mapping to analyze which the most increasing settlement land value area in Beji District. "

Tanah merupakan sumber kehidupan bangsa. Hakekat tanah adalah menyangkut hajat hidup orang banyak maka penguasaannya dilakukan oleh pemerintah dengan tujuan untuk mensejahterakan rakyat. Tesis ini membahas mengenai Hak Pengelolaan yang bagian-bagian tanahnya diberikan hak atas tanah lainnya, misalnya Hak Guna Bangunan. Pemberian Hak Guna Bangunan diatas tanah Hak Pengelolaan adalah legal dan berdasarkan perjanjian kerja sama antara pemegang Hak Pengelolaan dengan pihak ketiga. Namun, pemberian Hak Guna Bangunan diatas tanah Hak Pengelolaan harus dicabut, apabila tanah tersebut ditelantarkan dan tidak dimanfaatkan sebagaimana mestinya. Pencabutan Hak Guna Bangunan diatas tanah Hak Pengelolaan harus berdasarkan peraturan perundang-undangan yang berlaku. Studi kasus dalam tesis ini adalah Pencabutan Hak Guna Bangunan PT. Griya Tritunggal Eka Paksi diatas tanah Hak Pengelolaan Situ Cipondoh. Dalam tesis ini akan terlihat bagaimana peran Kantor Pertanahan setempat dalam mengawal proses pencabutan Pencabutan Hak Guna Bangunan diatas tanah Hak Pengelolaan tersebut dan melihat bagaimana bentuk pertanggungjawaban PT. Griya Tritunggal Eka Paksi selaku pemegang Hak Guna Bangunan diatas tanah Hak Pengelolaan Situ Cipondoh.

ABSTRACT
Soil is the life of the nation. The essence of the soil is related to public needs then for the purpose of welfare of the people the control of itself by the government. This thesis discusses the Right of Management which parts of the land has the other land right, e.g Right to Build. The act of distributing Right to Build on the Right of Management land is legal and based on the cooperation agreement between the holder and the third parties. However, the act of distributing Right to Build on the Right of Management land should be repealed, when the land has been abondoned and not utilized as it should be. The revocation of Right to Build on the Right of Management land should be based on the state laws. Case study in this thesis is the revocation of Right to Build PT. Griya Tritunggal Eka Paksi on the Right of Management land of Situ Cipondoh. This thesis explain how land office role the revocation of Right to Build on the Right of Management land and how the commitment of PT. Griya Tritunggal Eka Paksi as the holder of Right to Build on the Right of Management land Situ Cipondoh."
