"Undang-Undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara menyatakan bahwa dalam rangka mencapai tujuan nasional, diperlukan Aparatur Sipil Negara yang memiliki integritas, profesional, netral, bebas dari intervensi politik, bersih dari praktik korupsi, kolusi, dan nepotisme, serta mampu menyelenggarakan pelayanan publik bagi masyarakat dan mampu menjalankan peran sebagai unsur perekat persatuan dan kesatuan bangsa berdasarkan Pancasila dan Undang- Undang Dasar Negara Republik Indonesia Tahun 1945. Untuk itu, diperlukan aktivitas manajemen kepegawaian yang baik. Salah satu aktivitas manajemen kepegawaian yang berkontribusi besar adalah aktivitas rekrutmen dan seleksi.
Penelitian ini bertujuan mendeskripsikan pola rekrutmen dan seleksi menurut peraturan perundang-undangan yang selama ini berlaku serta menganalisa proses rekrutmen dan seleksi pegawai Aparatur Sipil Negara baik jenis kepegawaian Pegawai Negeri Sipil maupun jenis kepegawaian Aparatur Sipil Negara Pegawai Pemerintah dengan Perjanjian Kerja. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan perbandingan (comparative approach). Berdasarkan hasil penelitian, dapat disimpulkan, rekrutmen dan seleksi Aparatur Sipil Negara terus mengalami perubahan baik pola maupun sistem yang digunakan dalam proses rekrutmen dan seleksi dan dengan diundangkannya Undang-Undang Nomor 5 Tahun 2014 tentang Aparatur Sipil Negara maka pola dan sistem rekrutmen akan bertambah untuk jenis Pegawai Pemerintah dengan Perjanjian Kerja.

Act No. 5 of 2014 concerning State Civil Apparatus stated that in order to achieve national objectives, as stated in paragraph 4 of the Preamble of the Constitution of the Republic of Indonesia Year 1945, required Apparatus State Civil which have integrity, professional, neutral, and free from political interference, free from corruption, collusion, and nepotism, as well as capable of organizing public services for the society and able to perform a role as an adhesive element of national unity based on Pancasila and the Constitution of the Republic of Indonesia Year 1945. Therefore, it is required good personnel management activities. One of the personnel management activity that contributes more is the activity of recruitment and selection process.
This study aimed to describe the pattern of recruitment and selection according to the legislation in effect until now and analyze the process of recruitment and selection of employees of the State Civil Apparatus both types of employment of Civil Servants and type of personnel Civil Apparatus of the new Government Employees with Work Agreements. This research form is normative juridical (statute approach) with comparison (comparative approach). Based on the results, it can be concluded, recruitment and selection process of the State Civil Apparatus continues to change both on patterns and systems used in the recruitment and on selection process and with the enactment of Act No. 5 of 2014 concerning the State Civil Apparatus then recruitment system will accrue to the type of Government Employees with Work Agreements."

"Larangan mempekerjakan pegawai non Pegawai Negeri Sipil (non PNS) dan non Pegawai Pemerintah dengan Perjanjian Kerja (non PPPK) sebagaimana diatur dalam Peraturan Pemerintah Nomor 49 Tahun 2018 tentang Manajemen PPPK tidak serta merta membuat Pemerintah Provinsi DKI Jakarta, berhenti melakukan rekrutmen atau mengadakan hubungan kerja dengan pegawai non PNS dan non PPPK. Berdasarkan data Badan Kepegawaian Daerah, hingga tahun 2019, Pemerintah Provinsi DKI Jakarta mempekerjakan sekitar ±81.096 orang pegawai non PNS dan non PPPK yang mengisi jabatan fungsional dan jabatan pelaksana. Tulisan ini mengangkat permasalahan status dan hubungan hukum pegawai non PNS dan non PPPK setelah diundangkannya PP Manajemen PPPK dan hubungan hukum PPPK menurut konsep hubungan dinas publik. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis-normatif melalui pendekatan peraturan perundang-undangan (statue approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian disajikan dalam bentuk preskriptif-analitis. Hasil penelitian menunjukkan bahwa dengan diundangkannya PP Manajemen PPPK, pegawai non PNS dan non PPPK pada Pemerintah Provinsi DKI Jakarta kehilangan legalitas status dan hubungan hukumnya. Tindakan Pejabat Pembina Kepegawaian Pemerintah Provinsi DKI Jakarta tetap/masih mempekerjakan pegawai non PNS dan non PPPK untuk mengisi jabatan ASN merupakan suatu tindakan yang melanggar asas legalitas dan asas yuridiktas. Namun demikian, tujuan dipekerjakannya pegawai non PNS dan non PPPK mengandung unsur kemanfaatan yang jauh lebih besar daripada pemenuhan unsur kepastian hukum. Oleh karena itu, Pemerintah Provinsi DKI Jakarta masih dapat mempekerjakan pegawai non PNS dan non PPPK guna menyelenggarakan tugas pemerintahan dalam mewujudkan kesejahteraan bagi masyarakat khususnya masyarakat Provinsi DKI Jakarta. Selain permasalahan praktis, PP Manajemen PPPK juga mengandung permasalahan konseptual terkait dengan hubungan kerja PPPK yaitu dengan digunakan dua jenis perbuatan hukum yang saling bertolak belakang dan mengaburkan sistem hubungan kerja yang selama ini dikenal dan berjalan sesuai dengan asas dan kaidah hukum. Dengan demikian, PP Manajemen PPPK harus direformulasi sesuai dengan kebutuhan faktual dengan tetap berpedoman pada asas dan kaidah hukum yang berlaku.

Prohibition of hiring non-Civil Servants (non-PNS) and non-Government Employees with Work Agreements (non-PPPK) as stipulated in Government Regulation Number 49 of 2018 concerning PPPK Management does not necessarily make the Provincial Government of DKI Jakarta, stop recruiting or entering into work relationships with non-PNS and non-PPPK. Based on data from the Regional Personnel Agency, until 2019, the Provincial Government of DKI Jakarta employs approximately ± 81,096 non-PNS and non-PPPK who fill functional and executive positions. This paper raises the issue of the status and legal relationship of non-PNS and non-PPPK after the promulgation of the Government Regulation concerning Management PPPK and the PPPK legal relationship according to the concept of public service relations. The research method used in this study is juridical-normative research through the statue approach and conceptual approach. The research results are presented in a prescriptive-analytical form. The results showed that with the enactment of the Government Regulation concerning Management PPPK, non-PNS and non-PPPK employees in the DKI Jakarta Provincial Government lost their legality and legal relationship. The Acting of the Civil Service Officers of the DKI Jakarta Provincial Government that still employs non-PNS and non-PPPK to fill ASN positions is an act that violates the legality and juridical principles. However, the purpose of hiring non-PNS and non-PPPK employees contains greater benefit than the fulfillment of the element of legal certainty. Therefore, the DKI Jakarta Provincial Government can still employ non-PNS and non-PPPK staff to carry out governmental tasks in realizing prosperity for the community, especially the people of DKI Jakarta Province. In addition to practical issues, Government Regulation concerning Management PPPK also contains conceptual problems related to the PPPK work relationship, by using two types of legal actions that contradict each other and obscure the working relationship system that has been known and runs according to legal principles and rules. Thus, Government Regulation concerning Management PPPK must be formulated in accordance with factual needs while still referring to the principles and applicable legal rules."

"Skripsi ini membahas implementasi merit system pada proses rekrutmen dan seleksi CPNS tahun 2013 di Kementerian Keuangan dan Kabupaten Kepulauan Meranti serta faktor-faktor yang mempengaruhinya. Dalam pelaksanaannya di lapangan proses rekrutmen dan seleksi CPNS tahun 2013 masih diwarnai dengan kepentingan politik, dugaan KKN dan tidak sesuai dengan prinsip knowledge of results dan equal oportunity pada merit system. Penelitian ini dilakukan secara Post Positivis dengan desain deskriptif melalui pengumpulan data primer dan sekunder.
Hasil penelitian menunjukkan bahwa implementasi merit system pada proses rekrutmen dan seleksi CPNS tahun 2013 di Kementerian Keuangan telah berjalan dengan baik sesuai dengan prinsip equal opportunity, open competition and fairness, serta pengambilan keputusan yang diterima berdasarkan passing grade. Di sisi lain, implementasi merit system pada proses rekrutmen dan seleksi CPNS tahun 2013 di Kabupaten Kepulauan Meranti belum berjalan dengan baik karena kurang memenuhi dengan prinsip equal opportunity, open competition and fairness, serta pengambilan keputusan yang diterima berdasarkan passing grade. Proses rekrutmen dan seleksi CPNS tahun 2013 masih dipengaruhi oleh faktor administratif, politik dan budaya, serta teknis.

This thesis discussed about the implementation of the merit system in recruitment and selection process of civil servants candidates in 2013 in the Ministry of Finance and the Meranti Islands Regency, and the factors that influence it. The implementation of process of recruitment and selection CPNS 2013 still affected by political interests, allegations of corruption and not in accordance with the principle of knowledge of results and equal oportunity of the merit system. Research is done in Post Positivist with a descriptive design through primary and secondary data collection.
The results showed that the implementation of the merit system in recruitment and selection process of civil servants candidates in 2013 in the Ministry of Finance has gone well in accordance with the principle of equal opportunity, open competition and fairness, and the decision is received by passing grade. On the other hand, implementation of the merit system in recruitment and selection process of civil servants candidates in 2013 in Meranti Islands District has not gone well because of lack of accordance with the principle of equal opportunity, open competition and fairness, as well as the decision is received by passing grade. The recruitment and selection process of candidates for civil servants in 2013 still influenced by the following factors, they are administrative, political and cultural, and technical.

"Tesis ini bertujuan untuk menganalisis pelaksanaan rekrutmen dan seleksi calon pegawai negeri sipil di Kementerian Sekretariat Negara selama masa moratorium Tahun 2012 dan menganalisis kendala-kendala yang dihadapi sehingga Kementerian Sekretariat Negara belum sepenuhnya melakukan 4 (empat) hal yang diwajibkan selama masa moratorium. Penelitian ini merupakan penelitian deskriptif dengan pendekatan pospositivis. Analisis evaluasi pelaksanaan rekrutmen dan seleksi calon pegawai negeri sipil dilakukan menggunakan model Context Evaluation, Input Evaluation, Process Evaluation, dan Product Evaluation. Hasil evaluasi menunjukkan bahwa evaluasi terhadap konteks dan proses menunjukkan hasil baik dan memadai. Namun, evaluasi terhadap input dan produk menunjukkan hasil kurang baik.

This thesis is aimed to analyze the recruitment and the selection of new civil servants by the Ministry of State Secretariat in the period of the 2012 moratorium and to analyze the obstacles which hinder the Ministry of State Secretariat from performing the four actions completely as required in the moratorium period. This research is a descriptive one using post-positivism approach. The analysis of the evaluation of the recruitment and the selection of new civil servants is conducted using models named Context Evaluation, Input Evaluation, Process Evaluation, and Product Evaluation. The results of those evaluations show that context and process evaluations yield good and sufficient results, while input and product evaluations yield unsatisfactory results."

"Penelitian ini bertujuan untuk mengevaluasi program kesehatan dan olahraga pada Pegawai Negeri Sipil (PNS) di lingkup kerja Pemerintah Kota Depok tahun 2015 dengan melakukan analisis pada penggunaan input dan proses sehinggadapat mempengaruhi pencapaian target program kesehatan dan olahraga. Desain penelitian ini menggunakan metode kualitatif Penelitian dilakukan dengan melihat komponen input (peraturan, sumber daya manusia, sumber daya keuangan, danfasilitas) dan proses manajerial (perencanaan, pengorganisasian pelaksanaan, pengendalian, dan evaluasi) dalam pelaksaan program. Data dikumpulkan melalui wawancara mendalam kepada stakeholder, pelaksana, dan peserta. Selain itu, data juga dikumpulkan melalui telaah dokumen terhadap dokumen-dokumen program Temuan dari penelitian ini adalah dari sisi input belum ada peraturan daerah yang menjadi dasar pelaksanaan program dan belum tersedia anggaran untuk media promosi program.

This study aims to evaluate health and sports programs for Civil Servants (PNS) in the Depok City Government's work area in 2015 by conducting an analysis of the use of inputs and processes so that they can affect the achievement of health and sports program targets. The design of this study uses qualitative methods The research was conducted by looking at the input components (regulations, human resources, financial resources, and facilities) and managerial processes (planning, organizing implementation, control, and evaluation) in implementing the program. Data is collected through in-depth interviews with stakeholders, implementers, and participants. In addition, data is also collected through document review of program documents. The findings of this study are that from the input side there are no regional regulations that are the basis for implementing the program and there is no available budget for media promotion programs.

"Kompetensi Pegawai Negeri Sipil (PNS) Indonesia yang belum sesuai dengan bidangnya, menjadi latar belakang hadirnya pengaturan Pegawai Pemerintah dengan Perjanjian Kerja (PPPK) dalam Undang-Undang Nomor 5 Tahun 2014 Tentang Aparatur Sipil Negara (UU ASN). PPPK diharapkan mampu mengatasi kebutuhan pegawai yang profesional dan kompeten dalam birokrasi. Beberapa permasalahan muncul dalam peraturan perundang-undangan Aparatur Sipil Negara (ASN), antara lain PPPK memiliki permasalahan terkait konsep pengadaan PPPK khususnya manajemen kepegawaian dan implikasi penerapan PPPK terhadap eksistensi dan kedudukan pegawai non-PNS. Melalui metode penelitian yuridis normatif data dikumpulkan dalam bentuk studi kepustakaan dan diolah serta dianalisis secara kualitatif yang kemudian disajikan secara deksriptif.
Berdasarkan hasil analisis yang dilakukan, konsep PPPK dalam manajemen kepegawaian adalah untuk memperoleh ASN yang memiliki kompetensi dan profesionalitas, serta kedudukan dan tugas yang jelas dalam melakukan pelayanan publik, melalui penataan manajemen PPPK. Pembentukan PPPK sebagai bagian dari ASN, berimplikasi pada hak dan kewajiban PPPK yang dijamin dalam UU ASN. Secara umum PPPK memiliki hak yang hampir sama dengan PNS, dengan perbedaan terletak pada hak keuangan, yaitu PPPK tidak memiliki hak pensiun. Sedangkan mengenai kewajiban, UU ASN memberlakukan kewajiban yang sama antara PPPK dengan PNS. Guna mengisi kekurangan pengaturan PPPK dalam UU ASN pemerintah perlu membuat pengaturan mengenai identifikasi yang jelas mengenai kriteria, prosedur rekrutmen, pemetaan kebutuhan, dan periodisasi masa kerja, dan pengawasan mengenai efektivitas kinerja PPPK. Pemerintah pusat juga perlu melakukan intervensi guna menjamin terlaksananya hak-hak keuangan PPPK, khususnya untuk daerah yang membutuhkan PPPK, namun memiliki anggaran terbatas.

The competence of Indonesian Civil Servants (PNS) that is not in accordance with their fields, is the background of the presence of the regulation of Government Employees with Work Agreements (PPPK) in Law Number 5 of 2014 concerning State Civil Apparatus (ASN Law). PPPK is expected to be able to address the needs of professional and competent employees in the bureaucracy. Some problems arise in the legislation of the State Civil Apparatus (ASN), among others, PPPK has problems related to the concept of PPPK procurement, especially management of personnel and the implications of the application of PPPK to the existence and position of non-PNS employees. Through normative juridical research methods data is collected in the form of literature review and processed and analyzed qualitatively which is then presented descriptively.
Based on the results of the analysis, the concept of PPPK in staffing management is to obtain ASN that has competence and professionalism, as well as a clear position and duty in conducting public services, through the management of PPPK. The establishment of PPPK as part of the ASN has implications for the rights and obligations of PPPK guaranteed under the ASN Law. In general, PPPK has almost the same rights as civil servants, with the difference in financial rights, namely PPPK does not have pension rights. As for obligations, the ASN Law imposes the same obligations between PPPK and PNS. To fill in the shortcomings of the PPPK regulation in the ASN Law, the government needs to make arrangements regarding clear identification of criteria, recruitment procedures, needs mapping, and periodization of tenure, and supervision on the effectiveness of PPPK performance. The central government also needs to intervene to ensure the implementation of PPPK's financial rights, especially for regions that need PPPK, but have a limited budget.

"Penelitian ini bertujuan untuk menguji seberapa besar pengaruh budaya komunikasi terhadap motivasi kerja dan produktivitas kerja pegawai dalam sebuah instansi pemerintah. Disamping itu, penelitian ini juga bertujuan untuk menguji pengaruh secara tidak langsung budaya komunikasi terhadap motivasi kerja dan produktivitas kerja jika dikaitkan dengan faktor usia.
Hasil yang diperoleh dari penelitian ini menujukkan bahwa secara langsung budaya komunikasi dalam sebuah instansi pemerintah memberikan pengaruh yang signifikan terhadap motivasi kerja dan produktivitas kerja pegawai. Sementara itu, secara tidak langsung, budaya komunikasi berpengaruh signifikan terhadap motivasi kerja pegawai dengan usia sebagai variabel interverning. Sama halnya dengan pengaruh budaya komunikasi terhadap produktivitas kerja pegawai dengan usia sebagai variabel interverning.

This study aims to examine how much influence the communication culture on work motivation and productivity of employees working in a government agency. In addition, this study also aims to examine the effect of indirect culture communication on work motivation and productivity in relation to the age factor.
The results obtained from this study showed that direct communication culture within a government agency have a significant influence on work motivation and employee productivity. Meanwhile, indirectly, the communication culture significantly influence employee motivation with age as a variable interverning. Similarly, the influence of communication culture on employee productivity with age as a variable interverning."

Untuk itu, Badan Kepegawaian Negara BKN mengembangkan metode seleksi dengan menggunakan alat utama yaitu Computer Asissted Test CAT.
Penelitian ini bertujuan untuk menggambarkan pelaksanaan seleksi Calon Pegawai Negeri Sipil CPNS di Badan Kepegawaian Negara BKN dalam mewujudkan sistem merit di Indonesia. Penelitian ini menggunakan teori utama standar seleksi yang dikemukakan oleh Noe dkk 2008 yang terdiri dari lima dimensi yaitu realibility, validity, generalizability, utility dan legality dan sistem merit.
Penelitian ini menggunakan pendekatan post-positivist di mana teori standar seleksi dan sistem merit menjadi dasar analisis temuan penelitian. Data diperoleh dari wawancara, dan studi kepustakaan.
Hasil penelitian menunjukkan bahwa seleksi CPNS yang dilaksanakan pada tahun 2017 sudah menunjukkan arah perwujudan sistem merit dimana seleksi dilakukan berlandaskan kepada kualifikasi dan kompetensi peserta tanpa membedakan asal usul, ras dan golongan serta kekurangan fisik dari peserta. Hal tersebut terlihat dari indikator-indikator yang terpenuhi dan keseluruhan pelaksanaan seleksi telah berlandaskan peraturan perundangan yang berlaku. Namun, perwujudan ini dirasa masih kurang sempurna karena belum menggunakan hasil final seleksi sebagai bahan acuan dalam mengevaluasi dan memetakan kinerja CPNS.

Human resource is one of the factor that play a big role in an organization or Government in providing services to the public. Therefore, a recruitment and selection system that is appropriate to the merit system is required to produce civilian state apparatus who are qualified and competent in their field. All this time, the implementation for recruitment and selection indicates that there 39 s still fraud and CCN Corruption, Collution, Nepotism. Badan Kepegawaian Negara BKN developing the method with the use of primary tools which is computer asissted test CAT.
This study aims to describe the implementation is a candidate for civil servants in BKN in the realization of the merit system in Indonesia. This research will use the primary theory which is standard selection by Noe et al 2008 . It consists of five dimensions which is reliability, validity, generalizability, utilities and merit system.
This research use post positivist approaches where standard theory is the base of the merit system and the analysis of the research findings. The data is obtained from the interviews, and the study of literature.
The results showed that the selection of CPNS conducted in 2017 has shown the direction of the merit system where the selection is based on the qualification and competence of participants without distinguishing the origin, race and class and physical deficiencies of the participants. This can be shown from the indicators that are met and the overall implementation of the selection has been based on the applicable legislation. However, this manifestation is still not perfect yet because the final result of selection has not been used as a reference in evaluating and mapping the performance of CPNS.

"ABSTRAK

Penelitian ini membahas tentang kegiatan rekrutmen dan seleksi pegawai di Rumah Sakit Islam Jakarta Pondok Kopi yang bertujuan untuk memenuhi kebutuhan tenaga di Rumah Sakit tersebut. Desain penelitian dimulai dengan kuantitatif berupa kuesioner kepada pegawai SDI dan dilanjutkan dengan wawancara mendalam kepada pimpinan. Temuannya adalah: pelaksanaan rekrutmen dan seleksi sudah sesuai dengan kebijakan RS Nomor: 037/KEP/1.6.AU/D/2014 mengenai penerimaan dan pengangkatan pegawai. Sumber rekrutmen adalah internal dan eksternal. Pengumuman rekrutmen dilakukan secara terbuka dengan menginformasikan lowongan pekerjaan melalui web, koran dan memasang di papan pengumuman Rumah Sakit. Proses seleksi yang dilakukan yaitu seleksi administrasi, tes Al Islam, tes profesi, psikotes dan tes kesehatan. Sumber Daya Insani RS Jakarta Pondok Kopi sejauh ini belum dapat mencukupi semua kebutuhan tenaga melalui rekrutmen dan seleksi disebabkan karena kendala data pelamar yang tidak lengkap, sedikitnya pelamar, tidak adanya tempat yang cukup besar dan waktu yang terlalu pendek dari pengumuman tes ke tes berikutnya. Sarannya adalah pelamar mempelajari persyaratan, memberikan pengumuman lowongan melalui media social dan memperpanjang waktu pengumuman


ABSTRACT

This study analyzed the implementation of the recruitment and selection of employees in Jakarta Islamic Hospital Pondok Kopi to fulfill the employees needs at the hospital. The quantitative design study began with a questionnaire to employees in Human Resources unit and followed by in-depth interviews to the management. The findings were: The implementation of the recruitment and selection has been based on policy No. 037/KEP/1.6.AU/D/2014 on the acceptance and appointment of employees. The sources used for recruitment are internal and external sources. Announcement of recruitment is carried out openly by informing jobs via the web, newspapers and on the hospital bulletin board. The process of selection is by administration selection, Al Islam test, proper test, psycho test and health test. Human Resources unit in Jakarta Islamic Pondok Kopi Hospital so far not been able to meet all the workers needs through recruitment and selection due to incomplete data of the applicants, less applicants than expected, the place is not enough and time too short from the announcement of the test to the next test. Applicants should study the requirements thoroughly and vacancy announcement through social media and lastly to extend the time of announcemen
