"Tesis ini membahas mengenai kekuatan hukum dari penetapan hak asuh anak dan pemisahan harta bersama sebagai akibat dari putusnya perkawinan dengan menggunakan akta perdamaian yang dibuat dihadapan notaris. Dalam kasus Putusan No. 122/Pdt.G/2015/Pn.Sgr, para pihak adalah pasangan suami-isteri yang sepakat untuk bercerai, segala akibat perceraiannya diatur dalam akta perdamaian. Baik sebelum maupun sepanjang perkawinan berlangsung, para pihak tidak membuat dan mendaftarkan perjanjian kawin, namun dalam akta perdamaian para pihak saling menyepakati bahwa sepanjang perkawinan berlangsung diantara para pihak tidak terdapat percampuran harta, dan terdapat klausul mengenai pembayaran utang antara suami kepada isteri. Hal lain seperti pengasuhan anak pun diatur dalam akta perdamaian yang dibuat di hadapan notaris. Akta perdamaian ini menjadi dasar isteri sebagai penggugat untuk mengajukan gugatan perceraian ke Pengadilan Negeri Singaraja. Majelis Hakim dalam putusannya tidak menjadikan akta perdamaian sebagai dasar untuk memutus perceraian, namun akta perdamaian ini digunakan oleh Majelis Hakim untuk memutus mengenai penetapan hak asuh anak yang mana tidak sesuai dengan apa yang telah disepakati oleh para pihak sebelumnya. Metode penelitian yang dipakai dalam penulisan tesis ini adalah penelitian yuridis normatif, bersifat deskriptif analitis dengan pendekatan kualitatif. Hasil penelitian dari tesis ini adalah akibat hukum dari pembuatan akta yang tidak sesuai dengan ketentuan Pasal 1320 KUHPerdata mengakibatkan akta perdamaian yang dibuat oleh para pihak menjadi batal demi hukum.

This thesis discusses the legal force of the establishment of child custody and the separation of joint property as a result of divorce by using the settlement agreement made before the public notary. In Case No. 122 Pdt.G 2015 Pn.Sgr, the parties are spouses who both agreed to divorce, all the consequences of the divorce arranged in the settlement agreement. Before and during the marriage, the parties did not make and register any prenuptial or marriage agreement, but in the settlement agreement the parties mutually agreed that as long as the marriage took place, there was no joint treasure, and there was a clause concerning the payment of debt between husband and wife. Other things such as parenting are arranged in the settlement agreement made before a notary. This settlement agreement became the basis of the wife as a plaintiff to file a divorce suit to the Singaraja District Court. The Panel of Judges in its ruling did not make the settlement agreement the basis for the divorce, but it was used by the Panel of Judges to decide on the custody of the child which was not in accordance with what had been agreed by the previous parties. The research method used in writing this thesis is normative juridical research, analytical descriptive with qualitative approach. The result of this thesis is the legal result of the deed which is not in accordance with the provisions of Article 1320 of the Civil Code, resulting in the settlement agreement made by the parties to be null and void."
