"Skripsi ini membahas mengenai perlindungan bagi Tenaga Kerja Indonesia di luar negeri oleh Lembaga Swadaya Masyarakat (LSM) Migrant CARE. Rendahnya pendidikan dan kurangnya keterampilan menjadikan tenaga kerja Indonesia banyak bekerja di bidang informal di luar negeri. Banyaknya permasalahan yang dihadapi Tenaga Kerja Indonesia di luar negeri membutuhkan peran dari berbagai lapisan masyarakat. Dalam penulisan skripsi ini, penulis menggunakan metode yuridis normatif yang merupakan penelitian hukum yang mengacu pada norma hukum sebagaimana terdapat dalam peraturan perundangundangan. Didalam penelitian ini mengacu pada Undang-Undang No. 39 tahun 2004 tentang Penempatan dan Perlindungan Tenaga Kerja Indonesia Di Luar Negeri. Keberadaan LSM sebagai bagian dari civil society membuktikan adanya pihak lain yang turut serta dalam menyeimbangkan kekuatan negara. Disinilah peran Migrant CARE sebagai LSM yang menyatakan diri sebagai pembela buruh migran (TKI) dapat dibuktikan.

The following undergraduate thesis is to discuss the protection for Indonesian Migrant Workers by Non-Government Organization (NGO) Migrant CARE. Lack of education and lack of skills of Indonesian workers had contributed to the fact that many of these workers work in the field of informal overseas. The many problems faced by Migrant Workers needs the role of the various layers of society. In this undergraduate thesis, the author basically using normative methods, which is a normative legal research which refers to the rule of law as in this legislation system.

In this research, it refers to Act No. 39 of 2004 on Placement and Protection for Indonesian Migrant Workers. The existence of NGO as part of civil society proves the existence of others who participate in balancing the power of the State. This is where the role of the "Migrant CARE" as the NGO declared themselves as defenders of migrant workers can be proven."

"Skripsi ini membahas mengenai implementasi atas International Convention on the Protection of All Migrant Workers and Members of Their Families Tahun 1990 oleh Indonesia dalam rangka perlindungan Tenaga Kerja Indonesia di luar negeri. Indonesia sebagai salah satu negara yang memiliki jumlah pekerja migran membutuhkan suatu mekanisme perlindungan yang dapat menjamin nasib para pekerja migrannya di luar negeri yang rentan terhadap pelanggaran hak-hak dasar mereka. International Convention on the Protection of All Migrant Workers and Members of Their Families merupakan sebuah instrumen hukum internasional yang disahkan untuk menyediakan perlindungan atas hak-hak dasar seluruh pekerja migran di dunia. Komitmen Indonesia untuk terikat dengan perjanjian internasional ini diharapkan mampu mengatasi permasalahan yang terjadi terhadap pekerja migrannya di negara-negara tujuan pekerja migran untuk bekerja. Indonesia harus melakukan perubahan pada kerangka hukum perlindungan Tenaga Kerja Indonesia dan mereformasi praktik perlindungannya untuk memastikan agar hak-hak para Tenaga Kerja Indonesia dapat terjamin.

This final paper discusses about the implementation of 1990 International Convention on the Protection of All Migrant Workers and Members of Their Families by Indonesia regarding the protection of the Indonesian migrant workers overseas. Indonesia, as one of the countries who has the largest number of its migrant workers, needs a protection mechanism to ensure the life of its migrant workers’ who are highly susceptible to the violation of their rights. 1990 International Convention on the Protection of All Migrant Workers and Members of Their Families is one of the existing international law instrument which was formed to provide protection to the migrant workers’ rights. Indonesia’s commitment to be bound by the treaty is expected to overcome the problems that happened in their working destination states. Indonesia must conduct a change in its regulation concerning the protection of Indonesian migrant workers and reform the protection practice to ensure its migrant workers’ life."

"Skripsi ini merupakan hasil penelitian mengenai peran pendampingan yang dilakukan nongovernment organization NGO dalam advokasi di level individu pada permasalahan buruh migran Indonesia. Lokasi penelitian adalah Migrant CARE. Penelitian ini menggunakan pendekatan kualitatif dengan metode deskriptif. Pengumpulan data menggunakan wawancara mendalam dan studi literatur. Informan ditentukan melalui teknik purposive sampling.Hasil penelitian mengungkapkan bahwa peran pendampingan NGO dalam advokasi kasus BMI terbagi atas tiga fase yaitu pada prapendampingan, pendampingan, dan pasca pendampingan. Peran-peran yang dilakukan mencakup advokasi, konsultasi, enabling, pengelolaan kasus, edukasi, mediasi, negosiasi, konseling, menghubungkan klien dengan sumber kebutuhan, dan pemberdayaan.

This thesis is about assistance roles performed by NGO on the individual level of advocacy according to the Indonesian migrant worker rsquo s problem in Migrant CARE. This research used qualitative approach with descriptive method. The data were collected by in depth interviews and study literature. Informants are determined through purposive sampling technique.Results of this research revealed that the role of NGOs in their advocacy assistance is divided into three phases on pre assistance, assistance, and post assistance. The roles performed include advocacy, consultation, enabling, case management, education, mediation, negotiation, counseling, connecting clients with resources needs, and empowerment."

"Skripsi ini membahas mengenai penyelenggaraan program penempatan dan perlindungan TKI di luar negeri. Jumlah TKI di luar negeri yang tergolong tinggi, tidak membuat penyelenggaraan program penempatan dan perlindungan TKI lepas dari berbagai permasalahan. Hal ini dapat dilihat dari berbagai berita nasional yang masih memberitakan mengenai permasalahan-permasalahan yang dihadapi TKI tidak hanya ketika TKI berada di luar negeri, tetapi juga ketika TKI berada di dalam negeri dan kembali ke tanah air. Skripsi ini berbentuk penelitian yuridis normatif yang bersifat deskriptif analitis dilakukan dengan studi kepustakaan terhadap data sekunder baik menggunakan pendekatan kualitatif, disertai dengan wawancara kepada informan di Kementerian Ketenagakerjaan, Badan Nasional Penempatan dan Perlindungan Tenaga Kerja Indonesia, Kementerian Luar Negeri, dan Pelaksana Penempatan Tenaga Kerja Indonesia Swasta. Skripsi ini berkesimpulan bahwa Undang-Undang No. 39 Tahun 2004 tentang Penempatan dan Perlindungan Tenaga Kerja Indonesia di Luar Negeri tidak memadai dalam sisi perlindungan dan masih banyak ditemukan pelanggaran dalam implementasinya.

This thesis discusses about the program for placement and protection of Indonesian migrant workers. Despite the number of Indonesian migrant workers is high, doesn't make the program for placement and protection of Indonesian migrant workers out of problems. This can be seen from various national news that still preach about problems faced by Indonesian migrant workers not only when they were abroad, but also when they were still Indonesia and they came back to Indonesia.

The research is a normative juridical research, which has descriptive analytical. The research was conducted by literature research and document with interview to Ministry of Manpower, National Agency of Placement and Protection of Indonesian migrant workers, Ministry of Foreign Affairs, and company related. Documents that used in this research are secondary data in the form primary, secondary, and tertiary legal materials. The secondary will be further analyzed by qualitative approach.

This research conclude that law no. 39 2004 about Placement and Protection of Indonesian migrant workers are inadequate within the sides of protection and breach in its implementation."

"Fokus dari skripsi ini adalah pemenuhan perlindungan dalam prosedur perekrutan dan penempatan Tenaga Kerja Indonesia. Metode penelitian dari skripsi ini adalah penelitian hukum dengan metode deskriptif normatif. Tujuan dari skripsi ini adalah untuk menganalisis hukum dan peraturan perundang-undangan yang mengatur tentang perlindungan dan penempatan Tenaga Kerja Indonesia di luar negeri. The focus of this thesis is the fulfillment of protections in the procedure of recruitment and placement of Indonesian Migrant Workers. The research method of this thesis is research of law using the normative descriptive methods. The purpose of this paper is to analyze the legal and statutory regulations governing the placement and protection of Indonesian Workers in other Country.

This thesis shows that some things have to be improved in order to realize the maximum protection of Indonesian Migrant Workers. Harmonization towards the Laws and Regulations, as well as the participation of governments and society needed to realize the protection of Indonesian Labor in accordance with the rights of Indonesian Workers as workers and as people of Indonesia."

"Masalah penempatan dan perlindungan TKI di luar negeri masih kerap terjadi baik mulai dari tahap pra penempatan, masa penempatan, hingga purna penempatan. Pemerintah telah mengupayakan untuk meminimalisir dampak yang terjadi, salah satunya melalui pembentukan BNP2TKI. Meskipun demikian, peraturan yang disusun, kelembagaan, maupun standar prosedur yang ada masih belum optimal guna mengatasi permasalahan yang terjadi. Permasalahan yang akan dikaji meliputi peran BNP2TKI terkait penempatan dan perlindungan TKI di luar negeri berdasarkan peraturan perundang-undangan yang berlaku dan implementasi peran BNP2TKI terkait penempatan dan perlindungan TKI di luar negeri. Adapun metode penelitian yang digunakan meliputi bentuk penelitian yaitu yuridis normatif. Melalui penelitian ini diharapkan dapat mengidentifikasi peran BNP2TKI terkait penempatan dan perlindungan TKI di luar negeri.

Problems placement and protection of migrant workers abroad still frequently occur either from pre placement, the placement period, until after placement. The government has sought to minimize the impact that happened, one of them through the establishment of BNP2TKI. Nonetheless, the rules established, institutional, as well as the existing procedures that are still not optimal in order to overcome the problems occurred.

Issues to be examined include the role of BNP2TKI related to the placement and protection of migrant workers abroad based on the legislation in force and the implementation of related BNP2TKI role placement and protection of migrant workers abroad. "Strategi NGO Migrant Care dalam Advokasi Kasus Hukuman Mati Tenaga Kerja Indonesia Wilfrida Soik Pada Tahun 2012-2014 rdquo; Penelitian ini membahas Tenaga Kerja Indonesia Wilfrida Soik yang mendapatkan hukuman mati di Malaysia. Migrant Care merupakan NGO Non Governmental Organization yang mengadvokasi kasus Wilfrida Soik. Dalam investigasi oleh Migrant Care, terdapat bukti bahwa Wilfrida Soik merupakan seorang anak yang menjadi korban perdagangan manusia. Migrant Care membentuk jaringan advokasi transnasional yang kemudian berhasil membebaskan Wilfrida Soik dari hukuman mati. Rumusan pertanyaan yang hendak dijawab adalah ldquo;Bagaimana strategi NGO Migrant Care dalam advokasi kasus hukuman mati Tenaga Kerja Indonesia Wilfrida Soik pada tahun 2012-2014? rdquo; Menggunakan kerangka pemikiran konstruktivis, penelitian ini menyoroti peran NGO di dalam pendekatan HAM kritis.

NGO Migrant Care Strategy in Indonesian Migrant Worker Wilfrida SoikDeath Pinalty Case Advocacy on 2012 2014 rdquo This research explains Indonesian Migrant Worker Wilfrida Soik who wassentenced with death penalty in Malaysia. Migrant Care is a NGO NonGovernmental Organization that advocated Wilfrida Soik. In Migrant Care rsquo sinvestigation found that Wilfrida Soik is a child who became human traffickingvictim. Migrant Care established Transnational Advocacy Network which latersuccess to release Wilfrida Soik from death penalty. This research question is, ldquo How the strategy of NGO Migrant Care in advocating the death penalty case ofIndonesian Migrant Worker Wilfrida Soik on 2012 2014 Using constructivist asperspective, this research highlights NGO role in the critical human right approach."

"Skripsi ini membahas tentang pelaksanaan program pemberdayaan TKI pasca kepulangan dari luar negeri oleh BNP2TKI. Lapangan kerja yang terbatas dibandingkan dengan angkatan kerja menjadi salah satu alasan untuk tenaga kerja memilih pasar kerja di luar negeri sebagai tenaga kerja Indonesia selanjutnya disingkat TKI yang dapat disebut pekerja migran. Tenaga kerja Indonesia yang telah kembali ke daerah asalnya yang disebut TKI Purna belum mengoptimalkan penerimaan dari remitansi sehingga pemerintah melaksanakan program pemberdayaan sebagai salah satu tujuan program pemerintah untuk mendayagunakan dan membantu peningkatan kesejahteraan TKI. Tujuan dari penelitian ini adalah untuk mengetahui pemberdayaan kepada Tenaga Kerja Indonesia setelah kembali dari luar negeri agar tidak berangkat menjadi TKI kembali. Metode yang digunakan dalam penelitian ini adalah dengan melakukan wawancara mendalam dengan informan yang berhubungan dengan pelaksanaan program pemberdayaan TKI. Penelitian ini menggunakan pendekatan kualitatif dengan teknik analisis data kualitatif. Hasil penelitian ini adalah menunjukkan pelaksanaan program pemberdayaan TKI purna yang dilaksanakan berdasarkan peraturan yang dibuat oleh BNP2TKI. Pelaksanaan tersebut dibantu oleh unit pelaksana tugas BNP2TKI beserta stakeholder yang membantu pelaksanaan seperti Kementerian/dinas terkait, lembaga keuangan, fasilitator maupun profesional. Namun dalam pelaksanaannya terdapat hambatan yang terjadi selama proses pelaksanaan diantaranya kesulitan mengumpulkan peserta, informasi mengenai program pemberdayaan belum menyeluruh, target pencapaian peserta berkurang, kurangnya koordinasi diantara stakeholder.

This thesis discusses about the implementation of Indonesian Migrant Workers Empowerment Program after the return from abroad by the BNP2TKI. Limited employment compared to the labor force is one reason for the manpower to choose as Indonesian Migrant Workers. Indonesian migrant workers who have returned to Indonesia called Ex Indonesian Migrant Workers have not optimized the receipt of their remittance so that the government implements the empowerment program as one of the goals of the government program. The empowerment of ex Indonesian Migrant Workers is based on the government program to utilize and assist the improving of Indonesian Migrant Worker rsquo s welfare.

The aim of this research is to know the empowerment to the Indonesian Migrant Worker after returning from abroad in order not to go back to be the Indonesian Migrant Workers again. The method used in this research conduct the in depth interviews with informants related to the implementation of the Indonesian Migrant Workers Empowerment Program. This research uses the qualitative approach with the technical analysis of qualitative data.

The result of this research is showing that the implementation of empowerment of ex Indonesian Migrant Workers has been implemented in accordance with regulations made by BNP2TKI. The implementation is assisted by the implementing unit of BNP2TKI duties along with stakeholders that assist the implementation of such ministries agencies, financial institutions, facilitators and professionals.But in the implementation of the program, there are still shortcomings that could not reach the maximum target. The matter is due to constraints that occur during the process of the implementation including the difficulty of gathering the participants, the information about the empowerment program has not been comprehensive, lack of the target achievement of participant, the lack of coordination between stakeholders."

"Penelitian ini membahas mengenai peranan yang diselenggarakan oleh KBRI Singapura dalam upaya perlindungan buruh migran asal Indonesia di wilayah kerjanya, terkhusus yang bekerja pada sektor domestik. Penelitian ini merupakan penelitian kualitatif dengan desain deskriptif. Pengumpulan data dilakukan melalui wawancara mendalam, observasi, studi dokumen. Hasil penelitian ini menunjukkan bahwa KBRI Singapura telah merealisasi dan merancang upaya perlindungan sesuai dengan yang dibutuhkan & diharapkan oleh para stakeholders. Selain itu, hasil dari penelitian ini juga menunjukkan bahwa hambatan bagi KBRI Singapura untuk menjalankan perannya tersebut berasal dari rendahnya kompetensi buruh migran Indonesia, minimnya ketersediaan SDM, keterbatasan data BMI, dan pola komunikasi internal KBRI Singapura yang masih perlu dioptimalisasi.

This research discusses about the role of Indonesian Embassy in Singapore in an attempt to assist and protect migrant workers who are particularly vulnerable to abuse, such as domestic workers. This is a qualitative research with a descriptive design. The data were collected by means of in-depth interview, observation, and document studies.

The results show that Indonesian Embassy in Singapore plays a strong role and also has taken an active part in protecting migrant workers. However, there are still 4 major obstacles to deal with, such as, lack of awareness & knowledge of the migrant workers, limited Embassy?s human resources, unrecorded illegal entry, and ineffective internal communication."

"Migrasi tenaga kerja ke luar negeri, merupakan program pemerintah Indonesia untuk mengatasi kesenjangan dalam memperoleh pekerjaan di dalam negeri, masalah pengangguran dan juga keadaan ekonomi yang diperburuk dengan krisis global yang terjadi pada tahun 1997 lalu. Labor migration abroad, a government program for Indonesia to address the gap in gaining employment in the country, the problem of unemployment and the economic situation aggravated by the global crisis which occurred in 1997. The role of Government Indonesia as a shaper of policy provides three protection on TKW. The mechanism of handling cases with the enactment of the moratorium that has not been effective in dealing with the case. How Governments in providing education to the aspiring agent, family and TKW was done in gradations."
