"[Tesis ini membahas mengenai peranan hukum pidana dalam melindungi konsumen atas iklan dan pelayanan yang menyesatkan di bidang pengobatan non-medis (pengobatan alternative dan sejenisnya). Penelitian ini adalah penelitian deskriptif analitis. Penelitian ini meneliti mengenai pengaturan pengobatan non-medis, peran undang-undang perlindungan konsumen, dan kebijakan perlindungan di bidang hukum pidana. Peraturan-peraturan yang ada hanya mengatur sedikit mengenai pengobatan non-medis. Perlindungan konsumen belum dapat menjangkau secara menyeluruh di bidang ini. Sanksi yang ada dalam peraturan di bidang pidana belum memberikan perlindungan yang cukup bagi pengguna jasa pengobatan non-medis;This dissertation researches about the role of criminal law in protecting the consumers from fraud advertisements and services in non-medical treatment (alternative treatments and similar services). "Skripsi ini dilatarbelakangi oleh fenomena yang semakin berkembang dalam periklanan digital yang melibatkan influencer sebagai pengiklan di platform media sosial. Di Indonesia, ketiadaan regulasi yang jelas terkait pemasaran melalui influencer menimbulkan risiko signifikan bagi konsumen, yang dapat menjadi korban informasi palsu atau menyesatkan tentang produk atau layanan yang dipromosikan. Banyak kasus yang muncul di mana influencer gagal mematuhi etika periklanan yang semestinya, terutama dengan menggunakan iklan berbasis testimoni untuk mendorong calon konsumen membeli produk berdasarkan pengalaman positif yang diklaim. Berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen dan Etika Pariwara Indonesia, praktik periklanan semacam itu dianggap tidak etis jika terbukti bahwa influencer tidak benar-benar menggunakan produk yang mereka dukung, sehingga menyesatkan konsumen. Lebih lanjut, influencer sering kali lalai mengungkapkan bahwa mereka sedang beriklan, baik dengan tidak menggunakan hashtag iklan yang sesuai maupun tidak menjelaskan bahwa unggahan mereka bersifat promosi. Kurangnya transparansi ini dapat merugikan konsumen ketika produk yang dipromosikan tidak memenuhi ekspektasi yang telah dibangun oleh dukungan influencer. Bentuk penelitian yang akan digunakan oleh penulis adalah doktrinal. Metodologi penelitian tersebut meneliti data sekunder, yaitu menganalisis bagaimana norma hukum tertulis mengatur perlindungan konsumen terkait misinformasi dalam periklanan di media sosial di Indonesia dan Australia. Dengan membandingkan kerangka regulasi pemasaran melalui influencer di kedua negara, tesis ini bertujuan untuk mengidentifikasi area yang perlu diperbaiki dalam regulasi perlindungan konsumen di Indonesia, dengan menyoroti perlunya pengakuan terhadap influencer sebagai pihak yang bertanggung jawab dalam menjunjung hak-hak konsumen di industri periklanan.

This thesis is motivated by the growing phenomenon of digital advertising that involves influencers as advertisers on social media platforms. In Indonesia, the absence of clear regulations governing influencer marketing poses significant risks for consumers, who may become victims of false or misleading information about the products or services being promoted. Numerous cases have surfaced where influencers fail to uphold proper advertising ethics, primarily using testimonial advertising to encourage potential consumers to purchase products based on purported positive experiences. According to Law No. 8/1999 on Consumer Protection and the Indonesian Ethics of Advertising, such advertising practices are deemed unethical if it is proven that the influencer has not genuinely used the product they endorse, thereby misleading consumers. Furthermore, influencers often neglect to disclose that they are advertising, either by failing to use appropriate advertising hashtags or by not clarifying that their posts are promotional. This lack of transparency can lead to consumer harm when the products do not meet the expectations set by influencer endorsements. The research methodology is doctrinal by examining secondary data, by analyzing how written legal norms regulate consumer protection regarding misinformation in social media advertising in Indonesia and Australia. Through comparing the regulator frameworks for influencer marketing in both countries, this thesis aims to identify areas for improvement in Indonesia’s consumer protection regulations, highlighting the need to recognize influencers as responsible parties in upholding consumer rights within the advertising industry. "

"ABSTRACT
Penggunaan ganja untuk pengobatan telah dikriminalisasi di Indonesia sejak tahun 1997. Dua puluh tahun kemudian, Fidelis Arie Sudewarto melanggar aturan tersebut dengan memberikan ganja sebagai alternatif pengobatan untuk istrinya, Yeni Riawati. Beragamnya reaksi publik atas kasus tersebut menunjukkan adanya perubahan paradigma masyarakat akan penggunaan ganja untuk pengobatan, dan hal ini berpengaruh pada pemenuhan ldquo;sifat melawan hukum rdquo; yang secara tegas dicantumkan sebagai salah satu unsur dalam rumusan delik sebagaimana diatur dalam Pasal 116 ayat 2 Undang-Undang Nomor 35 Tahun 2009, khususnya dalam menilai sifat melawan hukum materiil. Penelitian ini membahas kasus Fidelis dari perspektif hukum pidana, yakni bagaimana pemenuhan unsur sifat melawan hukum dan apakah ada dasar yang kemudian menghapuskan sifat melawan hukum dalam perbuatan yang dilakukan oleh Fidelis Arie Sudewarto.

ABSTRACT
The use of marijuana in medication has been criminalized in Indonesia since 1997. 20 years after, Fidelis Arie Sudewarto violated the rule by administering marijuana as an alternative means of medication for his spouse, Yeni Riawati. Various public opinions emerged, indicating a shift of paradigm on the use of marijuana for medication, and this affects the fulfillment of unlawful nature which is expressly stated as one of the elements in the formulation of offense as stipulated in Article 116 paragraph 2 Law Number 35 of 2009, especially in assessing the material unlawfulness nature materieele wederrechtelijkheid of the act. This study discusses the case of Fidelis from the perspective of criminal law, namely how the fulfillment of the element of unlawful nature wederrechtelijk and whether there is a basis which then abolish the unlawful nature in the acts committed by Fidelis Arie Sudewarto."

"Iklan merupakan salah satu strategi pemasaran guna menyampaikan informasi kepada konsumen. Namun sayangnya informasi yang disampaikan oleh pelaku usaha belum tentu sepenuhnya benar. Akibat yang timbul dari iklan yang menyesatkan tidak hanya merugikan konsumen tetapi juga pelaku usaha lainnya. Penelitian ini melihat peranan Pemerintah dan PPPI terkait permasalahan iklan yang menyesatkan. Metode penelitian yang dipergunakan bersifat yuridis normatif dengan menitikberatkan penelitian terhadap data sekunder. Dari hasil penelitian diharapkan Pemerintah dapat lebih berperan dalam menerapkan ketentuan hukum dalam bidang periklanan.

Advertisement is one of the marketing strategies with the aim to deliver the information to consumers. Unfortunately not all the information is true. The impact of misleading advertisement is not only causing loss to consumers but also to other business entity. This research will focus on government and PPPI's roles in relation to misleading advertisement. This research is based on juridicalnormative research, emphasizing on secondary data. From this research it is expected that the Government can have more role in implementing the regulation on advertisement."
