"Salah satu akta yang dibuat notaris yaitu Akta Kesepakatan Perdamaian melalui proses mediasi, yang dilakukan oleh notaris yang bersertifikat mediator. Jika kesepakatan perdamaian hanya dibuat di hadapan notaris yang bersertifikat mediator tanpa didaftarkan dan dikukuhkan ke pengadilan maka hanya mengikat bagi para pihak sepanjang para pihak mentaatinya dan tidak memiliki kekuatan eksekutorial. Pasal 6 ayat (7) Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa, menjelaskan bahwa kesepakatan penyelesaian sengketa wajib didaftarkan di Pengadilan Negeri. Untuk itulah Pasal 23 Peraturan Mahkamah Agung Nomor 1 Tahun 2008 mengatur prosedur mediasi di pengadilan. Pasal tersebut mengatur kesepakatan yang dibuat seorang mediator di luar pengadilan, untuk dapat mengukuhkan hasil kesepakatan perdamaian nya ke pengadilan, dimana nantinya akan dikeluarkan putusan pengadilan berupa akta kesepakatan perdamaian yang memiliki kekuatan hukum tetap, para pihak wajib mantaati perdamaian itu, yang mana terhadap putusan demikian tidak diperkenankan banding. Kewajiban seorang notaris pula dalam menjalankan fungsi sosialnya, sudah semestinya menjadi mediator sejati yang harus dapat menjamin kekuatan dari kesepakatan perdamaian yang telah dibuatnya. Maka penelitian ini dibuat untuk dapat menjawab pertanyaan tentang norma hukum tertulis dalam pengaturan dan penerapan hukum terhadap implementasi Pasal 23 PERMA Nomor 1 Tahun 2008 Tentang Prosedur Mediasi di Pengadilan dikaitkan dengan peran notaris sebagai mendiator, dengan menekankan pada penelitian yuridis-normatif.

Peace Agreement is one of the deeds made by notary through mediation, it was made by a notary who is certified as a mediator. If the peace agreement was made in the presence of a mediator-certified notary without being registered and confirmed to the court, then it will only bind the parties as long as they are obedient and do not have the executorial authority. Article 6 paragraph (7) Act No. 30 of 1999 on Arbitration and the Alternative Settlement of Disputes, explaining that the settlement dispute should be registered in the District Court. For this reason, the Supreme Court Regulation Article 23 No. 1 of 2008 regulates the procedure of mediation in court. The article regulates the agreements which were made by a mediator outside the court, in order to confirm the results of its peace agreement to the court, where there will be court verdict in the form of peace agreement which has the power of legal law, the parties shall obey the agreement, in such a decision appeal will not be allowed. Obligation of a notary in running its social functions has to be a true mediator that able to ensure the strength of a peace agreement that has been made. This research is made to answer the question about the written legal norms in regulation and application on implementation of Article 23 of the Supreme Court Regulation No. 1 Year 2008 on Mediation Procedure in Court that associated with notary role as mediator and emphasize on the judical-normative."

"Pada zaman dahulu suatu persengketaan selalu diselesaikan di depan hakim pada pengadilan formal. Namun harus diakui, kenyataannya proses litigasi tidak selamanya berjalan sesuai dengan koridor hukum yang digariskan oleh undangundang. Kondisi ini mengakibatkan jatuhnya pamor dan wibawa pengadilan. Untuk mengatasi situasi seperti ini, kehadiran pihak ketiga sangat diperlukan guna mengakhiri perselisihan yang terjadi. Pihak ketiga yang menengahi persengketaan disebut mediator, mediator dapat dilakukan oleh siapa saja dan dari kalangan mana saja, baik atas permintaan maupun tanpa permintaan dari pihak yang berselisih. Pada umumnya peran ini dimainkan oleh pengetua adat, kepala desa, pimpinan agama, ketua perkumpulan, tokoh masyarakat dan sebagainya termasuk notaris.
Pokok permasalahan yang akan dibahas dalam penulisan ini mengenai peranan notaris sebagai mediator dalam menjalankan jabatannya ditinjau dari Undang-undang Nomor 30 Tahun 2004 tentang Jabatan Notaris dan Kode Etik Notaris, apakah mediasi yang dilakukan notaris mempunyai kekuatan yang mengikat bagi kedua belah pihak dan faktor-faktor apakah yang mempengaruhi keberhasilan dan kegagalan notaris sebagai mediator dalam penyelesaian sengketa diluar pengadilan. Penulisan ini menggunakan metode hukum normatif yaitu menitikberatkan pada peraturan yang berlaku, referensi dan literatur-literatur serta pelaksanaan peraturan dalam prakteknya.
Dari hasil penelitian ini, peranan notaris sebagai mediator dalam menjalankan jabatannya tidak bertentangan dan tidak melanggar Undang-undang Nomor 30 Tahun 2004 tentang Jabatan Notaris dan Kode Etik Notaris Ikatan Notaris Indonesia, dan mediasi yang dilakukan notaris mempunyai kekuatan yang mengikat bagi kedua belah pihak, serta faktor yang mempengaruhi keberhasilan dan kegagalan notaris sebagai mediator dalam penyelesaian sengketa diluar pengadilan adalah kharisma, kejujuran, pendidikan, memahami/menguasai permasalahan terhadap akta yang dibuatnya.

In the past times, the disputes are always settled by judge in a formal court. But it should be admitted, that in fact the litigation process does not always go according to the legal frame of law. This condition resulted in the fall of prestige and authority of the court. To handle this situation, the presence of the third party is very required to end a dispute that occurred. The third party who mediates disputes is called mediator, mediators can be performed by whoever and from whatever background, either on the request or not of the disputing parties. In general, this role is played by the dean custom, village chiefs, religious leaders, chairman of the association, social figures and the others include notary.
Main issues to be discussed in this paper regarding the role of notaries as mediators in the perform position in terms of the Law Number 30 Year 2004 concerning Notary office and Notary Code, whether the mediation is conducted notary has the power of binding for both parties and the factors that affect the success and failure of a notary as a mediator to settle disputes outside courts. This writing method that focuses on the normative legal regulations, references and literature as well as the implementation of regulations in practice.
From these results, the role of notaries as mediators in the running position is not contradictory and do not violate the Act No. 30 year 2004 concerning Notary office and Notary Association Notary Code of Indonesia, and mediation by a notary has the power of binding for both parties, as well as factors that influence success and failure of a notary as a mediator in the settlement of disputes outside the courts is charisma, honesty, education, understand / master the problems of the notarial deed they made."

Abstrak

Penelitian ini membahas mengenai penyelesaian konflik norma peraturan perundang-undangan memlalui jalur mediasi yang dilakukan oleh lembaga Kementerian Hukum dan Hak Asasi Manusia berdasarkan Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 2 Tahun 2019 tentang Penyelesaian Disharmoni Peraturan Perundang-Undangan Melalui Mediasi. Berlakunya Permenkumham No. 2 Tahun 2019 ini kemudian memunculkan permasalahan, yang itu berkaitan degan kewenangan Kementerian Hukum dan Hak Asasi Manusia dalam menyelesaikan konflik norma peraturan perundang-undangan melalui mediasi dan mengenai mekanisme mediasi itu sendiri dan akibat hukum yang ditimbulkan. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, sejarah, dan konseptual. Hasil penelitian ini menyatakan bahwa Kemenkumham tidak memiliki kewenangan dalam menyelesaikan konflik norma peraturan perundang-undangan melalui mediasi  dan penyelesaian konflik norma peraturan perundang-undangan melalui mediasi tidak termasuk dalam tugas dan fungsi Kemenkumham maupun Direktorat Jenderal Peraturan Perundang-Undangan. Kemudian dalam hal mekanisme mediasi yang digunakan merupakan suatu kekeliruan, karena mediasi merupakan mekanisme yang biasa diterapkan dalam perkara yang bersifat privat, dimana para pihak bertindak untuk dan atas namanya sendiri. sehingga menjadi aneh apabila mediasi digunakan dalam penyelesaian konflik norma peraturan perundang-undangan yang normanya mengatur secara umum. Adapun hasil dari mediasi tersebut tidak memiliki kekuatan hukum mengikat dan tidak memiberikan dampak hukum terhadap keberlakuan dari norma peraturan perundang-undangan yang telah disepakati.


ABSTRACT


Abstract

This research discusses the conflict completion of legislative norm through mediation path which is held by Ministry of Justice and Human Rights based on Justice and Human Rights Ministry Regulation No. 2/2019 about Completion Disharmony of Regulation by Mediation. The validity of Justice and Human Rights Ministry Regulation No. 2/2019 brings some problems up which related to authority of Ministry of Justice and Human Right on completing conflict of legislative norm by mediation, the mediation mechanism, and legal consequences. This study is normative which used statute, historical, and conceptual approach. The result showed Ministry of Justice and Human Rights did not has any authority for completing legislative norm by mediation and conflict compelation of legislative norm through mediation is not include in duties and function of the Ministry of Justice and Human Rights or Directorate General of Legislation. Moreover, mediation mechanism used by Justice and Human Rights Ministry is a mistake. Mediation is a mechanism which is used on private cases, in which the parties act and to their name self. As a result, mediation is a weird feature if it used for completing legislative norm conflict which was created for general norm. Its outcomes have no binding legal force and no legal consequence on the validity of legislative norm which was agreed.

"ABSTRACT
Integrating mediation into the process of civil procedure in court can be one of effective instruments to overcome cases backlog problems in the court and to strengthen and maximise the function of the court in setting disputes in addition to the court process which is of adjudicatory nature. However, the implementation of the Supreme Court Regulation Number 02 of the year 2003 and also under the Supreme Court Regulation Number 01 of the year 2008 is still far behind expectation. The percentage of success mediate cases on this regulation in district court pilot project of the Supreme Court of Republic of Indonesia is below 2,5 %, in spite of the contradiction between the amicable tradition of Indonesian people. The constraints which have been hampering the implementation of court-annexed mediation in district court pilot project are categorized into three factor, such as structure, substance and legal culture. Although court-annexed mediation is still far behind expectation, there are still so many things to be optimal in the effort to make court-annexed mediation success in Indonesia. There is a need to improve the procedures of court-annexed mediation by involving all stakeholders. The big hope comes from judges, mediator, advocates and the nature of Indonesian people?s way resolving conflict or disputes through amicable settlemen."

"[Dalam skenario keuangan ekonomi dan non-keuangan dimana kelangsungan hidup organisasi dari usaha mikro, kecil dan menengah (UMKM) yang lebih dikondisikan dari sebelumnya oleh kinerja kompetitif. Karya tulis ini bertujuan untuk menunjukkan bahwa penggabungan strategis dari tindakan yang bertanggung jawab secara sosial, lebih peduli, keterlibatan usaha dengan para stakeholder, serta memberikan kontribusi untuk meningkatkan competitive performance organisasi. Dengan demikian, keberadaan hubungan langsung atau peran mediasi antara pengembangan praktik Corporate Social Responsibility (CSR) dan competitive performance dianalisis dari perspektif stakeholder. Data dikumpulkan dari sampel 150 UMKM di Jabodetabek. Hasil menunjukkan bahwa perkembangan praktik CSR kontribusi untuk meningkatkan kinerja kompetitif baik secara langsung maupun tidak langsung, melalui kemampuan organisasi-organisasi ini untuk mengelola peningkatan hubungan dengan stakeholder;In a financial economic and non financial scenario in which the organization survival of micro, small and medium enterprises (SME) are more conditioned than ever by competitive performance. To accomplish this task, data were collected from a sample of 150 Jabodetabek SME?s. Results showed that the development of CSR practices are not significantly influential in enhance the competitive performance, both directly and indirectly, through the ability of these organizations to manage the relational improvement their stakeholders.;In a financial economic and non financial scenario in which the organization survival of micro, small and medium enterprises (SME) are more conditioned than ever by competitive performance. "Rancangan tugas akhir ini bertujuan untuk meningkatkan kemampuan petugas pengamanan di Lembaga Pemasyarakatan (Lapas) dalam menangani konflik antar narapidana dengan menggunakan teknik mediasi. Teknik mediasi memposisikan petugas sebagai orang yang netral dalam mendamaikan pihak yang berkonflik. Konflik antar narapidana yang sering terjadi di Lembaga Pemasyarakatan berakibat langsung terhadap terciptanya stabilitas keamanan sehingga setiap permasalahan harus cepat diselesaikan. Kondisi keamanan yang kondusif menjadi salah satu tolok ukur keberhasilan Lapas karena hal tersebut dapat mendukung terselenggaranya proses pembinaan narapidana.
Kenyataan dilapangan menunjukkan bahwa kemampuan petugas saat ini dalam menangani masalah antar narapidana belum maksimal Pendekatan keamanan masih menjadi prioritas dalam mengambil tindakan. Data dilapangan juga menunjukkan sering terjadinya masalah-masalah pemerasan, perkelahian, dan penyalahgunaan obat terlarang.
Program ini berbentuk pelatihan yang akan diselenggarakan selama 6 hari dengan beberapa materi ketrampilan dasar yang harus dikuasai petugas pengamanan sebagai mediator. Dengan kegiatan tersebut diharapkan petugas pengamanan mampu untuk menangani konflik antar narapidana dan menyelesaikan secara damai tanpa ada pihak yang dirugikan. Hasil dari pelatihan dapat dilihat dari efektifitas petugas pengamanan yang telah mengikuti pelatihan ketika mengaplikasikan kemampuannya dalam menangani permasalahan di lapangan."

"Tesis ini membahas tentang bagaimana peran dan tanggung jawab Notaris dalam pembuatan akta partij dan bagaimana tanggung jawab Notaris dalam hal terdapat perubahan dalam akta partij, yaitu analisis putusan Majelis Pemeriksa Wilayah Notaris Provinsi Riau Nomor 02/PTS/MJ/PWN.PROV.RIAU/XI/2012 jo. Putusan Pengadilan Negeri Pekanbaru Nomor 906/PID.B/2014/PN.PBR jo. Putusan Mahkamah Agung Republik Indonesia Nomor 1003 K/PID/2015. Penelitian ini menggunakan metode penelitian yuridis normatif. Hasil penelitian ini menunjukkan bahwa dalam membuat akta partij, Notaris hanya mengkonstantir kepentingan para penghadap yang datang kepadanya, tanpa ada kewenangan untuk melakukan pengubahan dengan inisiatifnya sendiri. Apabila Notaris hendak melakukan perubahan terhadap isi akta, maka Notaris harus mengikuti prosedur yang terdapat pada ketentuan Undang-undang tentang Jabatan Notaris. Notaris yang tidak mengikuti prosedur tersebut dapat dikatakan melakukan perbuatan melawan hukum, yaitu bertentangan dengan kewajibannya. Selanjutnya putusan Majelis Pemeriksa Notaris Provinsi Riau yang menjatuhkan teguran lisan kepada Notaris X tidak tepat jika didasarkan pada pelanggaran atas Pasal 48 ayat 1 Undang-undang tentang Jabatan Notaris karena undang-undang tidak menyatakan bahwa atas pelanggaran tersebut dapat dikenakan sanksi administratif. Putusan Pengadilan Negeri Pekanbaru yang melepaskan Notaris X dari segala tuntutan hukum juga tidak tepat karena perbuatan Notaris X memiliki sifat melawan hukum dan telah memenuhi semua unsur dalam Pasal 264 ayat 1 KUHP. Putusan Mahkamah Agung yang menjatuhkan pidana penjara 1 satu tahun pada Notaris X telah tepat karena memperbaiki putusan Pengadilan Negeri Pekanbaru dengan alasan utama bahwa judex facti telah salah menerapkan hukum. Notaris harus mengubah di depan kedua pihak sesuai persetujuan keduanya, atau sebagaimana prosedur yang seharusnya.

This thesis discusses on how is the role and liability of Notary in the revision of partij deed and how is the liability of Notary in the revision of partij deed by analysing the Notary rsquo s Assembly Supervisor of Riau Province Decision Number 02 PTS MJ PWN.PROV.RIAU XI 2012 jo. District Court of Pekanbaru Decision Number 906 Pid.B 2014 PN.Pbr jo. Supreme Court of Indonesia Number 1003 K PID 2015. This research is conducted by literature approaches. The result of the thesis shows that in revising the content of partij deed, Notary should only write down the will of both parties who come to him. Whether there should be any revision of the content in the deed, Notary should obey the rules which contained in Law of Notary. If the Notary doesn rsquo t obey those rules, the tort should occured. Furthermore, the Notary rsquo s Assembly Supervisor or Riau Province decision which sentenced verbal warning to Notary X was not appropriate as it used Article 48 1 as the legal base for the decision while the stated article does not subject to any administrative sanction. The District Court of Pekanbaru decision which acquit Notary X from any legal claim also improper as Notary X had commited the act which fulfil the element of unlawful and fulfil all the elements of Article 264 1 KUHP. The Supreme Court of Indonesia decision which pronounce sentence to one year imprisonment to Notary X was appropriate which the main premiss was that judex facti had applied the law improperly. Notary had to revise the content of the deed with the presence of and agreed by the parties or as legally ordered."
