"Perkawinan akan menimbulkan hak dan kewajiban bagi suami dan juga akan punya akibat penting bagi harta benda perkawinan suami istri. Terhadap harta benda perkawinan tersebut, ketentuan pasal 119, 139 KUHPerdata dan pasal 29 Undang- undang Perkawinan, memberikan kesempatan bagi calon suami istri untuk mengadakan penyimpangan terhadap harta benda perkawinan mereka. Dengan demikian bagi perkawinan pada umumnya dan perkawinan campuran, yang lebih rentan punya masalah hukum pada khususnya, penting untuk mengadakan perjanjian perkawinan sebelum perkawinan dilangsungkan. Kegunaannya tidak lain memberikan perlindungan bagi suami istri dan pihak ketiga lainnya. Perkawinan campuran, yang mengadakan perjanjian perkawinan, sering mendapatkan masalah pada saat pelaksanaannya karena terkendala dalam masalah waktu perkawinan dan/ atau pendaftarannya di Indonesia, serta pembuatan perjanjian perkawinan dan pendaftaran dari perjanjian perkawinan, sebagai salah satu syarat keberlakuan perjanjian perkawinan sah mengikat bagi pihak ketiga. Penelitian ini dimaksudkan untuk mengetahui penentuan waktu pembuatan dan keabsahan perjanjian perkawinan pada perkawinan campuran, akibat hukum dari perjanjian perkawinan yang dibatalkan, terhadap harta benda perkawinan pada perkawinan campuran, serta untuk mengetahui akibat bagi akta perjanjian perkawinan yang dibatalkan dan pertanggungjawaban notaris yang membuat perjanjian perkawinan yang telah dibatalkan oleh pengadilan dalam kasus perjanjian perkawinan perkawinan campuran sebagaimana kasus dalam putusan Nomor: 526/ Pdt/G/2012/PN. Jkt. Sel. Penelitian yang dilakukan ini adalah penelitian yuridis normatif dengan menggunakan metode penelusuran kepustakaan dalam mengumpulkan datanya. Ketidaktahuan hukum diantaranya pembuatan perjanjian perkawinan setelah perkawinan berlangsung dan keterlambatan pendaftaran perkawinan maupun perjanjian perkawinan, akan menjadi pemicu masalah hukum bagi suami istri maupun pihak ketiga, yang berakibat pada pembatalan perjanjian perkawinan. Dengan demikian dengan tetap berpegang pada ketentuan hukum di Indonesia, bagi perkawinan campuran tidak ada pengecualian, bahwa perjanjian perkawinan harus tetap dibuat sebelum perkawinan berlangsung, yang dengan demikian akan memisahkan harta benda perkawinan suami istri sejak saat perkawinan berlangsung. Terhadap hal tersebut Notaris punya kewajiban untuk memberikan penyuluhan hukum langsung terhadap mereka yang berkehendak untuk membuat perjanjian perkawinan dan punya hak untuk menolak pembuatan perjanjian perkawinan yang tidak sesuai dengan ketentuan hukum positif Indonesia. Bagi calon pasangan perkawinan campuran yang akan mengadakan perjanjian perkawinan dalam perkawinannya, sudah sebaiknya mencari informasi baik melalui instansi pemerintah yakni pada Kantor Catatan Sipil maupun profesi hukum yang memiliki kompetensi atau pengetahuan berkaitan dengan pembuatan perjanjian perkawinan, seperti Notaris atau pengacara.

"ABSTRAK
Tesis ini membahas mengenai bagaimana akibat hukum dari pembatalan suatu perjanjian kawin dalam perkawinan antara warga negara Indonesia dengan warga negara asing yang menyebabkan munculnya harta bersama diantara mereka. Bentuk penelitian ini adalah penelitian yuridis normatif dan tipe penelitian adalah eksplanatoris. Hasil penelitian menyatakan bahwa pembatalan perjanjian perkawinan dalam perkawinan antara warga negara Indonesia dengan warga negara asing mengakibatkan munculnya harta bersama dalam perkawinan tersebut dan mengingat adanya batasan kepemilikan tanah oleh warga negara asing maka harta bersama yang berupa tanah harus dilepas dengan jangka waktu satu tahun dan pembatalan perjanjian kawin harus diumumkan agar pihak-pihak yang berkepentingan langsung maupun tidak langsung terutama mengenai harta dalam perkawinan, mengetahuinya.

ABSTRACT
This thesis describes how the legal consequences of pre-nuptial agreement?s annulment on marriage between Indonesian and foreigner which leads to the emergence of joint property between them. The form of this research is a normative juridical research and the type this research is explanatory. This thesis states that the legal consequences of pre-nuptial agreement?s annulment on marriage between Indonesian and foreigner have result in the emergence of joint property in the marriage. Given the limitation of land?s ownership by foreigner in the regulation of Indonesian land law, the joint property which is land must be hand over with a period of one year and the pre-nuptial agreement?s annulment should be announced to the parties that concerned directly or indirectly regarding marital property.

"Hak milik atas tanah merupakan hak terkuat dan terpenuh atas tanah yang hanya dapat dimiliki oleh Warga Negara Indonesia. Namun akibat percampuran dalam perkawinan campuran, warga negara asing dapat memiliki hak milik atas tanah. Untuk itu Pasal 21 ayat (3) UUPA mengamanatkan bahwa bagi warga negara asing yang memiliki hak milik atas tanah akibat percampuran harta dalam perkawinan campuran diwajibkan untuk melepaskan hak tersebut dalam jangka waktu 1 (satu) tahun. Kewajiban pelepasan hak milik atas tanah tersebut kemudian menjadi suatu permasalahan bagi warga negara Indonesia sebagai pihak yang juga berhak atas hak milik atas tanah tersebut. Hal ini kemudian yang menjadi pokok permasalahan dalam tesis saya yakni bagaimanakah peraturan perundang-undangan mengatur mengenai kepemilikan tanah oleh warga negara asing dalam kaitannya dengan kepemilikan harta bersama dalam perkawinan campuran serta bagaimanakah analisis mengenai Putusan Penetapan Pengadilan Negeri Nomor 207/Pdt/P/2005/PN.Jkt.Tmr tentang penetapan perjanjian kawin setelah perkawinan dalam perkawinan campuran. Penulis kemudian meneliti permasalahan ini dengan metode penelitian yuridis normatif, dimana penulis dalam meneliti mengacu pada aturan-aturan hukum yang ada untuk kemudian dapat menjawab permasalahan bahwa, hal tersebut dimungkinkan dengan sebelumnya mengajukan permohonan terlebih dahulu dan ijin untuk membuatnya baru muncul ketika Pengadilan melalui Hakim mengabulkan permohonan tersebut. Dalam kesimpulannya, hak yang dapat dimilki oleh warga negara asing, termasuk dalam hal ini mereka yang menikah dengan warga negara Indonesia dan tidak melakukan pemisahan harta, adalah hanya hak pakai.

Rights to land an exclusive right that can only be owned by Indonesian citizens to own land in the strongest and fullest. However, due to mixing in mixed marriages, foreigners can own landed property. For that article 21 Paragraph (3) The Law Number 5 Year 1960 Regarding The Regulation Of The Basic Agrarian Principles mandates that foreign citizens who have the right to land due to mixing in the mixing property must waive the right for a period of 1 (one) year. Liability waiver to land then becomes an issue of Indonesians citizens as well as the party entitled to the possession of the land. It then becomes the identification of the problem in my thesis how the legislation rules of law arrange foreigners can own landed property from their marital property in mixed marriages and then how to analyze verdict of the sentence of east state court number 207/Pdt/P/2005/PN.Jkt.Tmr regarding covenant agreement after marriages in mixed marriages. The author then examines these issues with the method of juridicial normative research, which examined in reference to the existing rules of law to then be able to answer this problem in a descriptive analytic. Through the study authors found the answer that, it is possible to do by previously apply for permission in advance and if the Court of Justice granted the request. In conclusion, the rights to land in Indonesia that can be owned by mixed marriage couple who did not have a covenant agreement is only The Right to Use."

"[Perkawinan campuran sebagaimana diatur dalam Undang-Undang Nomor 1 Tahun 1974 adalah perkawinan antara dua orang yang di Indonesia tunduk pada hukum yang berlainan, karena perbedaan kewarganegaraan dan salah satu pihak berkewarganegaraan Indonesia. Perkawinan campuran dapat dilaksanakan di Indonesia maupun di luar Indonesia. Dalam hal perkawinan campuran dilaksanakan di luar Indonesia adalah sah bilamana dilakukan menurut hukum yang berlaku di Negara di mana perkawinan itu dilangsungkan dan bagi Warga Negara Indonesia tidak melanggar ketentuan-ketentuan Undang-Undang Perkawinan. Dalam jangka waktu 1 (satu) tahun sejak sekembalinya mereka ke Indonesia, bukti perkawinan mereka harus didaftarkan di Kantor Pencatatan perkawinan tempat tinggal mereka. Pasangan perkawinan campuran yang hendak melangsungkan perkawinan campuran di luar negeri juga dapat membuat perjanjian perkawinan. Perjanjian perkawinan adalah perjanjian tertulis yang dibuat oleh calon suami isteri sebelum atau pada saat perkawinan dilangsungkan untuk mengatur akibat-akibat perkawinan terhadap harta kekayaan mereka. Pentingnya pembuatan perjanjian perkawinan bagi pasangan yang hendak melangsungkan perkawinan campuran adalah terkait dengan perlindungan hukum terhadap hak milik atas tanah di Indonesia yang hanya dapat dimiliki oleh Warga Negara Indonesia, sebagaimana diatur dalam Undang-Undang Pokok Agraria. Penulisan tesis ini menggunakan metode yuridis normatif, yaitu dilakukan dengan menelusuri bahan hukum sekunder berupa norma-norma dari peraturan perundang-undangan yang berkaitan dengan permasalahan. Prosedur pembuatan perjanjian perkawinan dalam perkawinan campuran yang dilangsungkan di luar negeri, tetap mengacu pada ketentuan Undang-Undang Perkawinan yaitu dibuat sebelum atau pada saat perkawinan dilangsungkan dan berdasarkan pada hukum yang berlaku di Indonesia. Dalam hal setelah perkawinan dilangsungkan di luar negeri dan mereka kembali ke Indonesia namun tidak mendaftarkan perkawinannya tersebut dan kemudian mereka membuat perjanjian perkawinan, maka perjanjian perkawinan tersebut menjadi batal demi hukum karena melanggar ketentuan Undang-undang yaitu dibuat setelah perkawinan berlangsung.

"Pada umumnya masyarakat yang melakukan perkawinan campuran tidak memperhatikan dan mengetahui hal-hal yang harus dilakukan sebelum mereka melakukan perkawinan campuran terutama hal-hal yang menyangkut mengenai harta bersama yang diperoleh sepanjang perkawinan mereka. Pada dasarnya seseorang yang melakukan perkawinan campuran tidaklah dapat secara bebas untuk membeli hak-hak atas tanah di Indonesia dikarenakan pasangannya yang berkewarganegaraan asing tetap mempunyai hak tersebut karena adanya harta bersama. Hal ini karena adanya pembatasan hak kepemilikan tanah yang diatur dalam hukum pertanahan Indonesia pasal 1 jo pasal 21 Undang-undang Nomor 5 Tahun 1960 yang berazaskan kebangsaan.
Penelitian kali ini berjudul "Tinjauan Yuridis Perjanjian Kawin Dalam Perkawinan Campuran Terhadap Harta Bersama" dengan menggunakan metode kepustakaan yang bersifat normatif dengan jenis penelitian menarik asas hukum untuk mendapatkan gambaran menyeluruh terhadap permasalahan yang diteliti serta wawancara kepada narasumber atau informan untuk menambah informasi atas penelitian. Juga menganalisa putusan Pengadilan Agama Bandung nomor 495/Pdt.G/2005/PA.Bdg sebagai salah satu contoh perkawinan campuran. Seseorang yang melakukan perkawinan campuran harus membuat perjanjian kawin diluar persekutuan harta dan benda sebelum melakukan perkawinan serta didaftarkan agar dapat mengikat pihak ketiga serta adanya kepastian hukum.
Hal ini agar tidak terdapat persatuan harta dan benda dalam bentuk apapun antara suami dan istri tersebut sesuai yang diatur dalam pasal 29 Undang-undang Nomor 1 Tahun 1974 jo pasal 139 Kitab Undang-undang Hukum Perdata. Pada kenyataannya, masih banyak masyarakat yang melakukan perkawinan campuran dengan tidak membuat perjanjian kawin diluar persekutan harta dan benda karena unsur ketidaktahuan atau tidak adanya budaya membuat perjanjian kawin dalam perkawinan di Indonesia. Sehingga ketika terjadi perceraian dan pewarisan menimbulkan permasalahan dan dalam pelaksanaannya sering terjadi penyelundupan hukum. Ini dapat menyebabkan seseorang kehilangan atas hak atas tanah tersebut.

In General, Couples of mixed marriage do not care and know what they should do before they enter married life, especially about their marital property. Principally, a person who did this marriage has limitation to posses land, because based on Article 1 jo article 21 Law Number 5 Year 1960 every possession that is purchased by a mixed couple after they are married is considered a collective possession. The couple would lose the right to own land because one of the parties was an expatriate.
The research is entitled "Judicial Review Of Prenuptial Agreement In Mixed Marriage On Marital Property". The normative library method is used in this research for getting full description about the problem. Interview with the informant is used to add information for the research. I also analyze verdict of religious court of Bandung Number 495/Pdt.G/2005/PA.Bdg as an example of mixed marriage case. An Indonesian (man or woman) in a mixed marriage has to make prenuptial agreement for separation property before they married to protect their assets and limit parties? right. After that the prenuptial agreement has to be registered to bind third party and legal certainty.
The prenuptial agreement to avoid joint marital property which is in line with article 29 Law Number 1 Year 1974 jo article 139 The Burgerlijk Wetboek.However, many mixed married couples who do not make prenuptial agreement in Indonesian marriage, since they are not familiar with making prenuptial agreement. Consequently, they find many problems when they divorce or one of them dies. Sometimes there is smuggling law which prohibit in our country and they can lose the right to own land."

"Membina sebuah rumah tangga memang tidak semudah membalikkan tangan, pasti selalu ada konflik yang timbul terutama masalah harta kekayaan dalam perkawinan. Apabila sebelum melangsungkan perkawinan suami isteri tidak membuat perjanjian kawin, maka harta bawaan dan harta yang diperoleh selama perkawinan menjadi harta persatuan bulat. Kemudian selama perkawinan berlangsung, terjadi sesuatu hal misal suami boros dan berkelakukan tidak baik yang mengakibatkan harta bersama akan habis, maka isteri dapat mengajukan tuntutan pemisahan harta kekayaan ke Pengadilan Negeri, karena perjanjian kawin sudah tidak dapat lagi dibuat setelah perkawinan berlangsung. Dari keadaan tersebut di atas, maka yang jadi permasalahan penelitian ini yaitu bagaimanakah akibat hukum dari pemisahan harta kekayaan yang dilakukan berdasarkan perjanjian kawin yang dibuat setelah perkawinan dan bagaimana secara yuridis pertimbangan Hakim mengenai pemisahan harta kekayaan dalam perkawinan sebagaimana ternyata dalam Putusan Mahkamah Agung Nomor 2901 K/Pdt/2012 tanggal 9 Desember 2013. Dengan menggunakan metode penelitian yuridis normatif, dimana penulis dalam meneliti mengacu pada aturanaturan hukum yang ada. Maka ditemukan jawabannya bahwa akibat hukum yang timbul sebagaimana ternyata dalam kasus yang diteliti yaitu tidak dapat diadakan pemisahan karena isteri tidak memenuhi Pasal 186 BW, sehingga objek sengketa tetap menjadi harta bersama suami dan isteri. Untuk perjanjian pisah harta yang telah dibuat dihadapan Notaris menjadi batal demi hukum karena mengandung cacat yuridis dan bertentangan dengan undang-undang. Dan Putusan Mahkamah Agung sudah tepat dan telah sesuai dengan Pasal 119 BW, karena antara suami dan isteri tersebut tetap terjadi persatuan harta bulat. Sedangkan penerapan Pasal 29 ayat (4) Undang-undang Perkawinan dalam pertimbangan Hakim dianggap kurang tepat karena tidak terjadi perubahan perjanjian kawin.

Fostering a household is not as easy as turning the hand, there is always a conflict triggered by wealth in marriage. If spouse did not make a prenuptial agreement, separation asset and any asset they acquire during the course of their marriage would be community asset. Furthermore, during the marriage takes place, if there is something happen e.g. the husband is extravagant and does not have good manner which is caused community asset would be lost, the wife could propose a claim for asset separation to District Court, because prenuptial agreement could no longer be made after marriage took place. According to that circumstances, the consent of this research is how the legal consequences of the assets separation that is performed by prenuptial agreement made after marriage and how the juridical considerations of the Judge regarding separation assets in marriage, as it turns out in the Supreme Court Verdict No. 2901 K / Pdt / 2012 dated December 9, 2013. By using a normative juridical research method, the author in researching refers to rules of existing law. Then found the answer that the legal consequences arising in this case study that the separation cannot be held because the wife does not comply with Article 186 BW, then the object of dispute remain the property of the husband and wife. And the prenuptial agreement that has been made before a Notary cancelled and void because of flawed juridical and contrary to law. And Supreme Court decisions were appropriate and in accordance with Article 119 of the BW, as between husband and wife are still having community assets. While the application of Article 29 paragraph (4) of the Law of Marriage in consideration of Judges considered less appropriate because there is no change in prenuptial agreement."

Dengan menggunakan metode penelitian hukum normatif, tulisan ini menjelaskan peranan HPI dalam pengaturan dan keberlakuan perjanjian perkawinan dalam perkawinan campuran oleh karena adanya interaksi antara dua atau lebih stelsel hukum. Berdasarkan pembahasan perjanjian-perjanjian perkawinan tersebut, dapat disimpulkan bahwa masing-masing negara memiliki pengaturan perjanjian perkawinan dalam perkawinan campuran yang berbeda dan para pihak diharapkan memperhatikan hal tersebut sebelum menyusun perjanjian.

Prenuptial agreement in mixed marriage is a worldwide phenomenon. With the research methodology of normative law, this writing explains the role of Private International Law/PIL in regulation and enforcement of prenuptial agreement because of the interaction between two or more laws. Based on the discussion of the prenuptial agreements, it can be concluded that each country has different regulation on prenuptial agreement in mixed marriage and it is best for the parties to pay attention on this matter before getting into agreement.

"Perjanjian perkawinan belum diketahui secara luas oleh masyarakat Indonesia. Meskipun demikian, perjanjian perkawinan dapat dianggap penting terutama dalam perkawinan campuran mengingat dampak yang dihasilkan dari perkawinan itu sendiri cukup besar. Skripsi ini membahas mengenai pengaturan perjanjian perkawinan dalam perkawinan campuran di Indonesia yakni dalam Kitab Undang-Undang Hukum Perdata dan Undang-Undang No. 1 Tahun 1974 tentang Perkawinan dan membandingkan pengaturan di Texas, Amerika Serikat yakni Texas Family Code dan Uniform Premarital Agreement Act. Penelitian yang digunakan dalam skripsi ini adalah penelitian doktrinal untuk melakukan perbandingan pengaturan antara Indonesia dan Texas, Amerika Serikat. Adapun hasil dari penelitian ini adalah pengaturan mengenai perjanjian perkawinan dalam perkawinan campuran di Indonesia diperlukan adanya kepastian hukum karena dalam prakteknya masih terdapat ketidaksesuaian berkaitan dengan pengaturan perjanjian perkawinan dalam perkawinan campuran. Hal ini dapat dilakukan dengan pemerintah sebagai lembaga yang berwenang untuk lebih memperhatikan pengaturan mengenai perjanjian perkawinan dalam perkawinan campuran agar prosedur, akibat hukum, serta legalitas dari perjanjian perkawinan itu sendiri memiliki kepastian.

Prenuptial agreement is still not widely known by the Indonesian people. However, marriage agreements can be considered important, especially in mixed marriages, considering the significant impact of the marriage itself. This thesis discusses the regulation of prenuptial agreement in mixed marriages in Indonesia namely in the Indonesian Civil Code and the Marriage Law No. 1 of 1974 and compares the with those in Texas, United States namely Texas Family Code and Uniform Premarital Agreement Act. The research used in this thesis is doctrinal research to compare the regulations between Indonesia and Texas, United States. The results of this study are that the regulation of prenuptial agreement in mixed marriages in Indonesia requires legal certainty because in practice there are still inconsistencies related to the regulation of prenuptial agreement in mixed marriages. This can be done by the government as the authorized institution to pay more attention to the regulation of prenuptial agreement in mixed marriages so that the procedures, legal consequences, and legality of the prenuptial agreement themselves have certainty."

"Tesis ini membahas mengenai permasalahan perjanjian kawin yang tidak didaftarkan. Perkawinan merupakan ikatan lahir batin antara seorang pria dengan seorang wanita, sebagai suami istri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Perkawinan merupakan salah satu bentuk "perikatan" antara seorang pria dengan seorang wanita. Perikatan tersebut diatur dalam suatu hukum yang berlaku dalam masyarakat, yang dikenal dengan istilah "hukum perkawinan" yakni sebuah himpunan dari peraturan-peraturan yang mengatur dan memberi sanksi terhadap tingkah laku manusia dalam perkawinan. Pokok permasalahan dalam tesis ini adalah mengenai implikasi perjanjian kawin yang tidak didaftarkan terhadap pihak ketiga dan status kepemilikan properti milik WNI setelah perkawinan dilangsungkan menurut hukum yang berlaku di Indonesia. Penulis menggunakan metode penelitian yuridis normatif, jenis data yang digunakan adalah data sekunder yang dikumpulkan melalui studi dokumen. Ketidaktahuan hukum dalam pembuatan perjanjian kawin setelah perkawinan berlangsung dan keterlambatan pendaftaran perjanjian kawin, akan menjadi pemicu masalah hukum bagi suami istri maupun pihak ketiga karena merasa dirugikan, dan dapat berakibat pada pembatalan perjanjian kawin. Pihak ketiga akan dirugikan apabila tidak dilakukan pendaftaran, karena perjanjian kawin tersebut dianggap hanya berlaku pada pihak suami dan istri saja, tidak berlaku terhadap pihak ketiga apabila tidak didaftarkan. Bagi calon pasangan perkawinan campuran yang akan mengadakan perjanjian kawin dalam perkawinannya, sudah sebaiknya mencari informasi baik melalui instansi pemerintah yakni pada Kantor Catatan Sipil maupun profesi hukum yang memiliki kompetensi atau pengetahuan berkaitan dengan pembuatan perjanjian kawin, seperti Notaris atau pengacara.

This thesis discusses the issue of marriage agreements that are not registered. Marriage is an inner and outer bond between a man and a woman, as a husband and wife with the aim of forming a happy and eternal family based on the One Godhead. Marriage is one form of "engagement" between a man and a woman. The engagement is regulated in a law that applies in society, known as "marriage law" which is a set of rules that regulate and sanction human behavior in marriage. The main problem in this thesis is about the implications of the marriage agreement that is not registered with the third party and the property ownership status of the Indonesian citizen after the marriage is held according to the applicable law in Indonesia. The author uses a normative juridical research method, the type of data used is secondary data collected through document studies. The ignorance of the law in making marriage agreements after marriage and the delay in the registration of marriage agreements, will be a trigger for legal problems for husband and wife and third parties because they feel disadvantaged, and can result in the cancellation of the marriage agreement. Third parties will be disadvantaged if registration is not carried out, because the marriage agreement is considered only valid on the part of husband and wife only, does not apply to third parties if not registered. For prospective mixed marriages who will enter into marriage agreements in their marriages, it is better to seek information through government agencies, namely the Civil Registry Office and the legal profession that has the competence or knowledge related to making marriage agreements, such as Notaries or lawyers."

Tesis ini membahas mengenai perkawinan campuran diantara Warga Negara Indonesia dengan Warga Negara Irlandia yang dilangsungkan di Hong Kong. Perjanjian kawin yang dibuat pasca perkawinan. Pokok permasalahan dalam tesis ini adalah akta perjanjian kawin yang dibuat oleh Notaris terhadap perkawinan campuran, serta peran notaris selaku pejabat umum yang berwenang untuk membuat perjanjian kawin pada pernikahan yang berbeda warga negara dan akibatnya apabila terjadi perceraian. Metode penelitian yang digunakan yuridis normatif, dengan tipologi penelitian deskriptif analitis, dengan pendekatan kualitatif. Hasil penelitian: Notaris sebelum membuat akta perjanjian perkawinan wajib melihat apakah sudah ada penetapan pengadilan terhadap permohonan para pihak atau suami istri yang hendak membuat perjanjian perkawinan di dalam masa perkawinan. Setelah adanya penetapan maka dalam membuat akta perjanjian kawin Notaris tunduk kepada ketentuan Pasal 15 dan Pasal 16 Undang-undang Jabatan Notaris. Peran Notaris adalah membuat dan memastikan perjanjian perkawinan mengikuti ketentuan perundang-undangan, dalam melaksanakan peran tersebut Notaris wajib bertanggung jawab secara Pidana, Perdata, dan Administratif.

ABSTRACT
The main topic of this Thesis is to discuss about an intermarriage between a Indonesian citizen and a Ireland citizen, that takes place in Hong Kong. The prenuptial agreement is made after they were married. The main problems in this thesis is the prenuptial agreement deed that rsquo s been made by the Notary about this intermarriage, and also the role of a Notary as a public attendant that have the rights to make a prenuptial agreement on a intermarriage, and the consequences if the marriage end in a Divorce. The Research Method used in writing this thesis is Juridical Normative, with Descriptive Analysis, with a qualitative approach. The result of this research before making a prenuptial agreement deed a Notary must check if there is already a court arrangement towards the applicant that wants to make the Prenuptial Agreement while in the marriage period. After the assignation when making of a Prenuptial Agreement a Notary must obey the clause 15 and 16 section in the Notary Billet Act. The role of a Notary is to make a deed and to make sure the Prenuptial Agreement follows the rules of the Act, in managing that role a Notary is obligated take responsibility for Criminal Law, Civil Law, and Administratif Law."
