"ABSTRAKTesis ini membahas mengenai tindakan penegakan hukum yang dilakukan oleh Pemerintah Republik Indonesia guna memberantas Illegal, Unreported, and Unregulated (IUU) Fishing yaitu penenggelaman kapal penangkap ikan berbendera asing pelaku IUU Fishing di Wilayah Pengelolaan Perikanan Negara Republik Indonesia. Oleh sebab itu penelitian ini akan menguraikan ketentuanketentuan yang terkait penenggelaman kapal penangkap ikan berbendera asing pelaku IUU Fishing baik berdasarkan ketentuan hukum internasional dan hukum nasional.Hasil penelitian ini menunjukkan bahwa Indonesia telah memiliki peraturan perundang-undangan yang mengacu pada Konvensi Hukum Laut 1982. Salah satu tujuan dilaksanakannya tindakan penenggelaman kapal adalah untuk memberikan efek jera, namun demikian tindakan ini perlu memperhatikan aspek hukum, politis, dan lingkungan. Disarankan penenggelaman kapal merupakan upaya terakhir dalam rangka pencegahan dan penanggulangan IUU Fishing. Aspek penting yang perlu diperkuat adalah dari segi pengawasan.

ABSTRACT

This thesis reviews the law enforcement undertaken by the Government of the Republic of Indonesia to combat Illegal, Unreported, and Unregulated (IUU)Fishing, namely the sinking of the foreign fishing vessels the actors of IUU Fishing in regional fisheries management of the Republic of Indonesia. Therefore, this research will outline the relevant provisions of the sinking of foreign fishing vessels both under the provisions of the international law as well as the national law.

The outcome of this research shows that Indonesia has legislation that refers to the Convention on the Law of the Sea 1982.One of the purposes of implementing the sinking action is to provide a deterrent effect, however, these measures need to pay careful attention to legal, political, and environmental aspects. The sinking of the fishing vessel is suggested to be the last option to prevent and overcome IUU Fishing. The important aspect that need to be strengthened is surveillance."
