"Metode persidangan pidana dengan menggunakan alat elektronik baru digunakan luas setelah terjadinya pandemi Covid-19 yang berdampak pada sistem peradilan pidana berbagai negara di dunia. Perubahan ini berdampak pada hak terdakwa untuk hadir di muka pengadilan yang diatur dalam KUHAP. Hak kehadiran terdakwa di muka pengadilan merupakan salah satu hak dasar bagi terdakwa dan sebagai jaminan dalam pelaksanaan peradilan yang adil (fair trial) karena berkaitan dengan proses pembuktian. Dalam pembahasan ini metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perbandingan hukum Indonesia, Belanda, dan Amerika Serikat. Penelitian ini menunjukkan, sidang pidana elektronik di Indonesia hanya diatur dalam peraturan Mahkamah Agung dan ini berbenturan dengan KUHAP; sedangkan di Belanda, sekalipun telah dituangkan dalam KUHAP, penggunaan videoconference dianggap melanggar ketentuan dalam European Convention on Human Rights; di Amerika Serikat penggunaan videoconference diatur dengan cukup ketat dalam CARES Act. Penelitian ini berpendapat, persetujuan terdakwa dalam persidangan pidana online diperlukan karena hal ini sebagai persetujuan mengenyampingkan hak untuk hadir di muka sidang. Oleh karena itu, penggunaan videoconferece tidak melanggar fair trial dan tetap dapat imparsial sepanjang terdapat persetujuan dari terdakwa atau ketentuan yang mengatur tersebut menjamin bahwa seluruh hak-hak terdakwa dapat dipenuhi.

The criminal trial method using electronic devices has only been widely used after the Covid-19 pandemic which has impacted the criminal justice system of various countries in the world. This change has an impact on the right of the accused to presence before the court as regulated in the Indonesia Criminal Procedure Code. The right of the accused's presence before the court is one of the basic rights for the accused and as a guarantee in the implementation of a fair trial because it is related to the evidentiary process. In this thesis the research method used is normative juridical with a comparative approach to the laws of Indonesia, the Netherlands, and the United States. This thesis shows that electronic criminal courts in Indonesia are only regulated in the Supreme Court regulations and this is in conflict with the Indonesia Criminal Procedure Code; whereas in the Netherlands, even though it has been stated in the Dutch Criminal Procedure Code, the use of videoconferencing is considered a violation of the provisions of the European Convention on Human Rights; in the United States the use of videoconference is regulated quite strictly in the CARES Act. This thesis argues that the accused’s approval to conduct a criminal trial via videoconferencing is necessary because this is an agreement that overrides the right to presence before the court. Therefore, the use of videoconferencing does not violate the fair trial and can still be impartial as long as there is agreement from the accused or the stipulations that regulate it ensure that all the rights of the accused can be fulfilled."
