"Skripsi ini membahas mengenai legalitas penggunaan foto potret yang diunggah ke dalam layanan berbagi foto instagram oleh tiap subjek potret. Kepastian atas penggunaan potret ini perlu diketahui karena sering sekali terjadi penggunaan potret di instagram yang tidak sah. Hal demikian terjadi karena terdapat ketidakjelasan pengaturan mengenai penggunaan potret. Di Indonesia, ketentuan mengenai penggunaan potret seseorang oleh pencipta diatur berdasarkan Undang-Undang Nomor 19 Tahun 2002 tentang Hak Cipta. Undang–Undang Hak Cipta mengharuskan pencipta meminta persetujuan terlebih dahulu kepada orang yang dipotret. Sedangkan pengaturan penggunaan potret oleh pengguna potret diatur di dalam Undang-Undang Hak Cipta dan Undang-Undang Informasi dan Transaksi Elektronik yang mengharuskan pengguna potret untuk meminta lisensi dari pencipta dan penggunaan potret tersebut tidak boleh menimbulkan pencemaran nama baik dari orang yang dipotret.

This thesis discusses the legality of the use of portrait photos which uploaded to the photo sharing service instagram by each subject of the portrait. Legal certainty for the use of this portrait needed to be known because it often occurs the unauthorized use of portrait on instagram. It happens because there is a lack of regulation about the use of the portrait. In Indonesia, the regulation regarding the use of portrait by the author is ruled by The Law of Republic of Indonesia Number 19 Year 2002 Regarding Copyright. The act requires the creator to ask prior permission from the person portrayed. While the regulation the use of portraits by the user portrait, regulated in the Copyright Law and the Law on Information and Electronic Transactions that require users to ask a license from the author and the use of portrait may not cause defamation of the person portrayed."
