"Mahkamah Konstitusi membatalkan UU nomor 9 Tahun 2009 tentang Badan Hukum Pendidikan (BHP) karena dinilai melanggar UUD NRI Tahun 1945. Negara bertanggungjawab atas pengaturan pengelolaan Perguruan Tinggi dalam menyelenggarakan pendidikan tinggi untuk mencerdaskan kehidupan bangsa, sedangkan warganegara dapat berpartisipasi dalam penyelenggaraan pendidikan tinggi. Perguruan Tinggi sebagai lembaga yang menyelenggarakan Pendidikan Tinggi Penelitian dan Pengabdian kepada Masyarakat, harus memiliki otonomi dalam mengelola sendiri lembaganya. Mengenai konstitusionalitas bentuk badan hukum pendidikan, Mahkamah mempertimbangkan bahwa tidak ada yang menunjukkan hilangnya kewajiban negara terhadap warga negara di bidang pendidikan, Akan tetapi Mahkamah berpendapat, istilah "badan hukum pendidikan" sebagaimana dimaksud dalam Pasal 53 ayat (1) UU Sisdiknas bukanlah nama dan bentuk badan hukum tertentu, melainkan sebutan dari fungsi penyelenggara pendidikan yang berarti bahwa suatu lembaga pendidikan harus dikelola oleh suatu badan hukum. Selain PTN Badan Hukum, juga ada PTN Badan Layanan Umum (BLU). PTN dengan Pengelolaan Keuangan BLU bertujuan untuk meningkatkan pelayanan kepada masyarakat (public services) dalam rangka memajukan kesejahteraan umum dan mencerdaskan kehidupan bangsa dengan memberikan fleksibilitas dalam pengelolaan keuangan berdasarkan prinsip ekonomi dan produktivitas, dan penerapan praktek bisnis yang sehat yaitu penyelenggaraan fungsi organisasi berdasarkan kaidah-kaidah manajemen yang baik dalam rangka pemberian layanan yang bermutu dan berkesinambungan.

Constitutional Court revoked the Act No. 9 of 2009 on Educational Legal Entities (BHP) due to violate the NRI Constitution of 1945. State is responsible for regulating the management in organizing undergraduate study to educate life of the nation; meanwhile the citizens are able to participate in undergraduate study. University as an institution that organizes the Research undergraduate study and Community Service should have an autonomy in managing their own institution. Regarding the constitutionality of the legal entity level, the Court considers that there is nothing to indicate the loss of the state's obligation to the citizens in the field of education, however the Court argued, the term "Educational Legal Entities" as referred to Article 53 paragraph (1) of the Law on National Education System is not the name and certain forms of legal entities, but the designation of the function of education administrator which means that an educational institution should be managed by a legal entity. Besides Legal Entity of State Universities, there is a Public Service Agencies of State Universities (BLU). State Universities with BLU Financial Management aims to improve services to public in order to promote the general prosperity and educating the nation by providing flexibility in financial management based on the principles of economics and productivity, and the application of healthy business practice which is providing organizational functions based on the principles of good management in quality service delivery and continuously.

"Penelitian ini didasarkan pada bentuk badan penyelenggaraan pendidikan tinggi di Indonesia terlebih khusus Badan Hukum Pendidikan yang diatur dalam UU No.9 Tahun 2009 dan Putusan Mahkamah Konstitusi Nomor 11-14-21-126- 136/PUU-VII/2009 tentang Pengujian Undang-Undang Badan Hukum Pendidikan (UU BHP) yang membatalkan UU tersebut beserta implikasinya terhadap status hukum Universitas Indonesia.
Penelitian ini membahas dua permasalahan utama. Pertama, status perguruan Tinggi di Indonesia setelah lahirnya UU BHP. Kedua, implikasi dari keluarnya putusan Mahkamah Konstitusi Nomor 11-14-21-126- 136/PUU-VII/2009 yang memutus tentang pembatalan UU BHP terhadap status hukum Universitas Indonesia (UI).
Metode yang digunakan dalam penelitian ini adalah yuridis normatif yang menggunakan data sekunder dan pendekatan perbandingan. Hasil penelitian menunjukkan bahwa status perguruan tinggi di Indonesia setelah lahirnya UU BHP terhadap perguruan tinggi berbadan hukum milik negara (PT BHMN) siap bertransformasi menjadi perguruan tinggi berbadan hukum pendidikan (PT BHP), sedangkan perguruan tinggi bersistem pengelolaan keuangan badan layanan umum (PT PK-BLU) tidak terpengaruh dengan adanya UU BHP ini. UU BHP telah diajukan kepada Mahkamah Konstitusi untuk dilakukan pengujian.
Hasil dari pengujian tersebut adalah pembatalan UU BHP yang kemudian berimplikasi terhadap status hukum UI. Status UI pasca pembatalan UU BHP tetap PT BHMN namun bersistem pengelolaan keuangan badan layanan umum (PK-BLU) sebagaimana diamanatkan PP No.66 Tahun 2010 tentang Perubahan Atas PP No. 17 Tahun 2010 tentang Pengelolaan dan Penyelenggaraan Pendidikan.

This study is based on the implementation of higher education entity in Indonesia; especially Law for Educational Entity (BHP) regulated by Law Number 9 year 2009 and the Constitutional Court decision Number 11-14-21-126- 136/PUU-VII/2009 on judicial review which invalidated the Law for Educational Legal Entity (UU BHP) as well as its implication on the legal status of University of Indonesia.
This study discusses two main problems; first, the legal status of Higher Educations in Indonesia after the issuance of the Law for Educational Legal Entity; second, the implications of the Constitutional Court decision Number 11-14-21-126-136/PUU-VII/2009 on the invalidation of the law for Educational Legal Entity on the legal status of University of Indonesia (UI).
The method of this study is normative legal research using two secondary data and comparative approach. The findings show that the status of higher education in Indonesia after the issuance of the Law for Educational Legal Entity for the State Owned Legal Enterprises (PT BHMN) university is the transformation of the university into Educational Legal Entity (PT BHP) University. Meanwhile, the university with the system of Financial Management of General Service Agency (PT PK-BLU) is not influenced by the Law for Educational Legal Entity. This law has been proposed to the Constitutional Court to conduct judicial review.
The result of the judicial review is the invalidation of the Law for Educational Entity which gives impact on the legal status of UI. The status of UI after the invalidation is PT BHMN with the system of Financial Management of General Service Agency (PK-BLU) as mandated by PP Number 66 year 20120 on the amendment of PP Number 17 year 20120 on the Management and Education Implementation.

"[Skripsi ini membahas tentang pengaturan daluwarsa pembayaran pesangon bagi
pekerja dengan perubahan status sebagai akibat dari pemutusan hubungan kerja.
Dengan menggunakan metode penelitian deskriptif analitis terhadap putusan yang
dikeluarkan oleh mahkamah konstitusi, yang telah berkekuatan hukum tetap serta
telah menghapus isi pasal 96 Undang-Undang Ketenagakerjaan, diperoleh
simpulan bahwa, daluwarsa penuntutan pembayaran upah dan segala yang timbul
dari hubungan kerja memberikan manfaat bagi para pekerja, khusunya bagi pekerja
yang terkena dampak PHK akibat adanya perubahan status. Upah merupakan hak
setiap pekerja yang tidak mempunyai jangka waktu dalam hal penuntutan haknya.
Upah adalah hak dan sampai kapanpun tidak pernah hapus dengan adanya
daluwarsa. Pengaturan mengenai pemutusan hubungan kerja, penghitungan uang
pesangon, serta perubahan status pekerja dari PKWT menjadi PKWTT sudah diatur
secara rinci di dalam Undang-Undang Ketenagakerjaan dan peraturan lain yang
berkaitan dengan ketenagakerjaan. Namun, daluwarsa tetap diperlukan dalam
pengaturan hak pesangon pekerja, hal ini untuk memberikan jaminan kepastian
hukum, baik bagi yang menuntut haknya, maupun pihak yang akan dituntut
memenuhi kewajibannya., This thesis discusses about the regulation of the expiry severance payment for
workers with changed status as a result of termination of employment. Using the
descriptive analytical on the verdict issued by Constitutional Court that has legally
binding that has erased article 96 of The Employment Act, resulted in a conclusion
that the expiry of salary payment prosecution and all the things that arise from
working relation give benefit to workers, especially for the ones who get the impact
from termination of employment caused by the status changes. Salary is the right
for every worker and will never be erased with expiry. The regulation about
termination of employment, severance calculation, and changed worker’s status
from PKWT to PKWTT has been adjusted in details on the Employment Act and
other regulation that related with employment. However, the expiry will still be
needed in the regulation of worker’s severance payment right. The regulation is
purposed to guarantee the legal certainty, either for the one who demands his right
or the one who will be accused to fulfill his responsibility.]"

"ABSTRAK
Penelitian dalam Tesis ini mengkaji pengisian jabatan Anggota BPK dalam artian luas. Di Indonesia pengaturan tentang pengisian Anggota BPK ini tercantum dalam Ketentuan Pasal 23F UUD NRI 1945 dan UU No. 15 Tahun 2006 Tentang Badan Pemeriksa Keuangan. Tesis ini menganalisis 3 permasalahan utama yakni menganalisis perkembangan pengaturan pengisian jabatan anggota BPK, menganalisis dan mengkaji pengisian jabatan lembaga audit di negara-negara anggota ASEANSAI dan terakhir menemukan implikasi putusan MK No. 13/PUU-XII/2013 terhadap pengisian jabatan anggota BPK.
Penelitian dalam Tesis ini diklasifikasikan sebagai penelitian dengan tipe decriptive explanatory. Tesis ini menganalisis 9 (sembilan) negara yang merupakan negara anggota ASEANSAI.
Setelah melakukan analisis maka dapat disimpulkan bahwa pengisian jabatan anggota BPK dari masa kemasa mengalami perkembangan yang sangat pesat baik dalam hal mekanisme dan masa.

ABSTRACT
There are three main problems to be analysed in this thesis. That are analysis of the amendement of regulation of the position fulfillment of BPK?s Member, analysis and review of the positions fulfillment of the Auditor General in ASEANSAI?s members, and ultimately analysis of The implication of the Constitutional Court Decision 13/PUU-XII/2013 in Judicial Review of the BPK?s Law Related to Term of Office.
This research is classified as the descriptive explanatory, which is collecting and concluding the information about the observed problems. This approach is a qualitative research. As the matter of comparison, this thesis analysed nine countries as the country ASEANSAI member organization.
The analysis results conclusion that the charging of office of the BPK over time, has developed very rapidly both in terms of mechanisms and future. After conducting the analysis, it can be concluded that positions fulfillment of BPK?s members from time to time undergoes a rapid development."

"Tesis ini membahas tentang penemuan hukum (rechtsvinding) dalam judicial review putusan Mahkamah Konstitusi terhadap Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan, khususnya hak serikat pekerja dalam satu perusahaan dalam merundingkan perjanjian kerja bersama (PKB). Penelitian ini adalah penelitian hukum normatif dengan menggunakan 2 metode pendekatan yaitu pendekatan perundang-undangan (statuta approach) dan pendekatan konseptual (conseptual approach) dengan desain deskriptif analitis dan analisa kualitatif serta menggunakan teknik pengumpulan data sekunder yang meliputi bahan hukum primer antara lain putusan Mahkamah Konstitusi Nomor 115/PUU-VII/2009 dan peraturan perundangan-undangan yang relevan dengan penelitian; bahan hukum sekunder yang terdiri dari tulisan atau pendapat para ahli yang termuat di dalam buku-buku, atau hasil penelitian sebelumnya yang terkait penelitian ini; bahan hukum tersier seperti kamus, ensiklopedia dan indeks kumulatif.
Hasil penelitian menghasilkan 3 kesimpulan. Pertama, bahwa hak berunding PKB sebelum putusan Mahkamah Konstitusi Nomor 115/PUU-VII/2009 terdapat pengaturan hak berunding serikat pekerja yang menerapkan asas tunggal atau proporsional tidak terbatas (UU No.21/1954) dan opsi asas mayoritas atau proporsional tidak terbatas (UU No.13/2003) Kedua, Putusan Mahkamah Konstitusi Nomor 115/PUU-VII/2009 menyatakan UU No.13/2003 Pasal 120 ayat (1) dan (2) bertentangan dengan UUD 1945, dan menyatakan Pasal 120 ayat (3) sebagai konstitusional bersyarat (conditionally constitutional), yang merupakan penemuan hukum dalam pengaturan hak berunding serikat pekerja yang menerapkan asas proporsional terbatas. Ketiga, dampak dari putusan a quo antara lain bahwa sebagai pasal konstitusional bersyarat (conditionally constitutional) maka putusan ini mengandung sifat ultra petita, negative legislature, dan inkonsistensi dalam sinkronisasi horizontal dengan undang-undang yang lain yaitu UU No. 42 Tahun 2008 Tentang Pemilihan Umum Presiden dan Wakil Presiden, sehingga penemuan hukum ini perlu segera ditindaklanjuti oleh fungsi legislative review berupa revisi UU a quo dengan memperhatikan jiwa putusan Mahkamah Konstitusi No. 115/PUU-VII/2009.

This thesis discusses the rechtsvinding in a judicial review against the decision of the Constitutional Court Act No. 13/2003 on Employment, in particular the right of trade unions in the company in negotiating a collective bargaining agreement (CBA). This study is a normative legal research by using two methods of statutory approach and the conceptual approach with analytical and descriptive design and qualitative analysis using secondary data collection techniques that include primary legal materials, among others, the decision of the Constitutional Court number 115/PUUVII/ 2009 and legislation regulations relevant to the study; secondary legal material consisting of paper or expert opinions contained in the books, or the results of previous studies related to this research; tertiary legal materials such as dictionaries, encyclopedias and a cumulative index.
The results of the study resulted in three conclusions. First, that the collective bargaining rights before the Constitutional Court decision No. 115/PUU-VII/2009 are setting the union bargaining rights which apply the single principle or proportional unlimited (Law No.21/1954) and the options of principle of majority or proportional unlimited (Law no. 13/2003) Secondly, the Constitutional Court Decision No. 115/PUU-VII/2009 declare Law No.13/2003 Article 120 paragraph (1) and (2) contrary to the 1945 Constitution, and declared Article 120 paragraph (3) as a conditionally constitutional which is the rechtsvinding in the regulation of union bargaining rights which apply the principle of proportional limited. Third, the impact of the decision a quo among others, that the conditionally constitutional then this decision contains the ultra petita, negative legislature, and inconsistencies in horizontal synchronization with other legislation, namely Law no. 42/2008 on General Election of President and Vice President, so this rechtsvinding needs to be followed up by legislative function in the form of a revised Act a quo with regarding the decision of the Constitutional Court No. 115/PUU-VII/2009.

"[ABSTRAK
Anak yang dilahirkan dari perkawinan tidak sah akan menciptakan pada status anak luar kawin bagi anak bersangkutan. Konsekuensi normatif dari status anak luar kawin membawa pada tidak adanya hubungan keperdataan antara anak luar kawin dengan ayah biologisnya. Keadaan tersebut tentu menghilangkan hak-hak konstitusional anak. Putusan Mahkamah Konstitusional Nomor 46/PUU-VIII/2010, menjadi jawaban bagi anak luar kawin untuk memperoleh kembali hak tersebut. Putusan Mahkamah Konstitusi memfokuskan pada dua hal, yaitu perlindungan anak dan pertanggungjawaban ayah biologis melalui pembuktian. Putusan Mahkamah Konstitusi menjadi acuan oleh Pengadilan Negeri dalam menghadapi permasalahan anak luar kawin. Hasil penelitian menyimpulkan bahwa, oleh beberapa Pengadilan Negeri yang dibahas dalam penulisan ini terlihat ketidakkonsistenan hakim dalam memberikan pertimbangan hukum berkaitan dengan status keperdataan anak luar kawin. Sehingga, perlu adanya kejelasan tentang aturan dan prosedur yang mengatur tentang penetapan ayah biologis dari anak luar kawin tersebut dari pihak pihak pengadilan pasca adanya Putusan Mahkamah Konstitusi tersebut.

The normative consequence from that matter is there is no legal relationship between a child and his biological father. This condition surely remove the constitutional rights of child. The existence of Constitutional Court of Decision Number 46/PUU-VIII/2010 become the answer for the child who born out of wedlock to reclaim their rights. The constitutional court decision focus on two things: child protection and the responsibility of the biological father through evidence. This constitutional court decision become a reference by district court in dealing with the problem of a child born out of wedlock. The result of this research concluded, by some district cout decision that analys in this reseach, that there is an incinsistencies judges decision in giving judicial consideration in concerned with the legal status of a child born out of wedlock. So, there should be a clarification on rules and procedures which regulates the biological father of the external marriage child from the court after the constitutional court decision.

"Pada tanggal 27 Oktober 2016, MK RI telah mengeluarkan putusan nomor 69/PUU-XIII/2015 yang merubah bunyi Pasal 29 ayat (1), (3), dan (4) UU Perkawinan. Namun, sampai saat ini belum ada ketentuan yang mengatur tentang pelaksanaan perjanjian perkawinan pasca Putusan MK tersebut sehingga menimbulkan permasalahan. Salah satu permasalahan yang muncul ke permukaan adalah tentang penerapan asas publisitas terhadap perubahan perjanjian perkawinan pasca Putusan MK. Penelitian skripsi ini mengungkap tentang bagaimana pengaturan perubahan perjanjian perkawinan dan bagaimana penerapan asas publisitas terhadap perubahan perjanjian perkawinan pasca putusan MK tersebut. Untuk itu, digunakan metode penelitian hukum yuridis normatif dengan fokus kajian pada bahan hukum primer, sekunder, dan tersier. Untuk memperkuat bahan hukum tersebut dilakukan wawancara dengan beberapa narasumber terkait. Berdasarkan hasil kajian yang dilakukan, perubahan pasal 29 ayat (1) UU Perkawinan pasca Putusan MK ini membawa pengaruh kepada pengaturan perubahan perjanjian perkawinan, sedangkan prosedur dan tata cara pelaksanaannya belum diatur sehingga dapat menimbulkan kerugian terhadap pihak ketiga. Selain itu, mengenai penerapan asas publisitas terhadap perubahan perjanjian perkawinan di dalam pasal 29 ayat (1) pasca Putusan MK hanya ditentukan untuk disahkan oleh pegawai pencatat perkawinan atau notaris sebelum berlaku kepada pihak ketiga sehingga asas publisitasnya belum terpenuhi karena dengan pengesahan tidak berarti telah diumumkan, sehingga pihak ketiga dapat dirugikan. Atas dasar itu, penulis merekomendasikan agar segera dilakukan revisi khususnya pasal 29 ayat (1), (3), dan (4) UU Perkawinan diikuti dengan penambahan penjelasan dalam PP terkait prosedur dan tata cara perubahan perjanjian perkawinan supaya memberikan dasar hukum yang kuat bagi notaris dalam melaksanakan Putusan MK tersebut.

On October 27, 2016, the Constitutional Court of the Republic of Indonesia issued a decision number 69 / PUU-XIII / 2015 which changed the sound of article 29 paragraph (1), (3), and (4) of Marriage Law. However, until now there is no provision that regulates the implementation of marriage after the Constitutional Court's decision so that cause problems. One of the problems that arise is about the application of the principle of publicity to the change of marriage agreement after the Constitutional Court Decision. This thesis research reveals how the arrangement of change of marriage agreement and how the application of publicity principle to change of marriage agreement after the Constitutional Court decision. For that, the researcher use the juridical normative methods focusing the analysis on the the primary, secondary, and tertiary legal materials. To strengthen the legal material is done with several relevant sources. Based on the results of the review, the amendment of Article 29 paragraph (1) of the Marriage Law after the Constitutional Court's Decision has had an effect on the arrangement of amendments to the marriage agreement, while the procedures and procedures for implementation are not yet reliable for third parties. In addition, concerning the application of the principle of publicity to the amendment of the marriage agreement in article 29 paragraph (1) after the Constitutional Court Decision is only determined to be approved by the marriage or notary before applying to a third party so that the publicity principle has not been fulfilled because with no validation has been announced, third parties can be harmed. On that basis, the author suggest to promptly revise in particular Article 29 paragraphs (1), (3), and (4) of the Marriage Law with additional explanation in the Implementing regulation relating to the procedures and procedures for amending the marriage agreement which provide a firm legal basis for the notary in carry out the Constitutional Court Decision."

"Skripsi ini didasarkan pada Putusan Mahkamah Konstitusi Nomor 62/PUU-XI/2013 yang mengukuhkan status kekayaan negara yang bersumber dari keuangan negara dan dipisahkan dari APBN untuk disertakan menjadi penyertaan modal BUMN tetap menjadi bagian dari rezim keuangan negara. Penelitian ini membahas dua permasalahan utama. Pertama, implikasi yuridis Putusan Mahkamah Konstitusi Nomor 62/PUU-XI/2013 terhadap status hukum piutang kredit bermasalah bank BUMN. Kedua, mekanisme penyelesaian kredit bermasalah pada Bank BUMN pasca Putusan Mahkamah Konstitusi Nomor 62/PUU-XI/2013. Skripsi ini menggunakan metode penelitian yuridis normatif, yaitu dengan tipe penelitian deskriptif analitis.
Hasil penelitian menunjukkan bahwa Putusan Mahkamah Konstitusi Nomor 62/PUU-XI/2013 membuat adanya perbedaan penafsiran akan status hukum kredit bermasalah bank BUMN. Dengan demikian, Putusan Mahkamah Konstitusi Nomor 62/PUU-XI/2013 membuat terciptanya ketidakpastian akan status hukum kredit bermasalah bank BUMN serta membuat kewenangan pengurusan dalam penyelesaian kredit bermasalah tidak sepenuhnya menjadi kewenangan Bank BUMN terutama dalam hal mekanisme penyelesaian kredit bermasalah melalui hapus tagih. Untuk itu, diperlukan sinkronisasi dan harmonisasi pemikiran, penafsiran serta pengaturan akan pengertian serta ruang lingkup keuangan negara dalam peraturan perundang-undangan agar dapat menciptakan kepastian hukum bagi status serta mekanisme penyelesaian kredit bermasalah pada Bank BUMN. Selain itu, diperlukan pula peraturan perundang-undangan yang secara khusus mengatur tentang kewenangan bagi bank BUMN dalam penyelesaian dan penghapusan kredit bermasalah sehingga nantinya bank BUMN dapat melaksanakan mekanisme penyelesaian kredit bermasalah dengan mekanisme korporasi yang dapat meningkatkan kinerja bank BUMN agar dapat berada di level of playing field yang sama dengan bank-bank swasta.

This thesis is based on the Decision of the Constitutional Court Number 62 / PUU-XI / 2013 which confirms the status of state assets originating from state finances and separated from the state budget to be included in the equity participation of state-owned enterprises which remain part of the state financial regime. This study addresses two main problems. First, the juridical implications of the Decision of the Constitutional Court Number 62 / PUU-XI / 2013 on the legal status of accounts receivable (non-performing loans) of state-owned banks. Second, the mechanism for resolving non-performing loans at State-Owned Banks after the Decision of the Constitutional Court Number 62 / PUU-XI / 2013. This thesis uses a normative juridical research method, ie the research refers to positive law or written legal norms.
The results of the study indicate that the Decision of the Constitutional Court Number 62 / PUU-XI / 2013 made a difference in the interpretation of the legal status of non-performing loans of state-owned banks. Thus, the Constitutional Court Decision Number 62 / PUU-XI / 2013 made uncertainty about the legal status of non-performing loans of state-owned banks and made the authority to manage non-performing loans not entirely under the authority of state-owned banks, especially in the mechanism of resolving non-performing loans through hair cut. For this reason, synchronization and harmonization of thought, interpretation and regulation of the understanding and scope of state finances are needed in legislation so that legal certainty can be created for the status and mechanism for resolving non-performing loans at state-owned banks. In addition, legislation is needed which specifically regulates the authority of state-owned banks in the settlement and elimination of non-performing loans so that later state-owned banks can implement the mechanism for solving non-performing loans with a corporate mechanism that can improve the performance of state-owned banks to be at the level of playing the same field as private banks.

"Penelitian ini membahas 3 masalah yaitu mengenai keistimewaan Daerah Istimewa Yogyakarta,  hak politik perempuan dan suksesi kepemimpinan di provinsi DIY pasca putusan Mahkamah Konstitusi tentang uji materi terhadap Undang-Undang Keistimewaan Daerah Istimewa Yogyakarta. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Penelitian ini menyimpulkan bahwa salah satu keistimewaan Daerah Istimewa Yogyakarta adalah tentang pengisian jabatan Gubenur dan Wakil Gubenur. Sultan Keraton Yogyakarta akan secara otomatis menjadi Gubernur dan Adipati Paku Alam akan menjadi Wakil Gubernur. Penghapusan frasa istri dalam Pasal 18 ayat (1) huruf m UUKDIY memberikan peluang bagi perempuan untuk menjadi Gubernur di provinsi DIY. Walaupun kepemimpinan perempuan masih mendapatkan pertentangan dari banyak pihak dikarenakan nilai-nilai yang hidup dalam Keraton. Sultan sebagai pemimpin Keraton memiliki wewenang penuh untuk menunjuk penerus tahtanya. Sebagai daerah istimewa, Keraton memiliki hak untuk mengajukan siapa saja menjadi Gubernur sepanjang ia adalah pemimpin Keraton yang sah. Negara akan menetapkan Gubernur yang diajukan oleh Keraton.

This study discusses 3 problems, namely about the privileges of the Special Region of Yogyakarta, women's political rights and leadership succession in DIY Province after the verdict of the Constitutional Court regarding the judicial review on the Privileges of the Special Region of Yogyakarta. "Tesis ini membahas tentang penyelesaian sengketa perbankan syariah pasca dikeluarkannya Putusan Mahkamah Konstitusi Republik Indonesia Nomor 93/PUU-X/2012 dengan melakukan studi pada perkara antara Bank Syariah X dengan Nasabahnya. Terhadap perkara antara Bank Syariah X dengan nasabahnya ini sendiri telah diputus melalui Putusan Sela Pengadilan Negeri Jakarta Pusat Nomor 42/PDT.G 2013/PN.JKT.PST tanggal 28 Agustus 2013 ('Putusan Sela'). Metode penelitian yang digunakan adalah metode penelitian hukum normatif dengan tipe penelitian evaluatif untuk melakukan analisis terhadap Putusan Sela, sehingga melalui penelitian ini diharapkan mampu memberikan rekomendasi dan menjadi rujukan bagi hakim yang tengah memeriksa, memutus dan menyelesaikan perkara terkait pnyelesaian sengketa perbankan syariah, khususnya hakim di Pengadilan Tinggi Jakarta yang saat ini tengah memeriksa perkara di tingkat banding yang diajukan oleh Nasabah Bank Syariah X.

This thesis discusses the Islamic Banking’s dispute resolution after the issuance of the Decision of the Constitutional Court of the Republic of Indonesia Number 93/PUU-X/2012 by conducting a case study on the dispute between Islamic Bank 'X' with its Customers. This dispute between the Islamic Bank 'X' with its Customers has already enacted by the Decision of Central Jakarta District Court No. 42/PDT.G/2013/PN.JKT.PST dated August 28, 2013.
