Temuan Pemeriksaan Inspektorat Jenderal Kementerian Energi dan Sumber Daya
Mineral merupakan temuan yang harus ditindaklanjuti berdasarkan Peraturan
Inspektur Jenderal Kementerian Energi dan Sumber Daya Mineral Nomor 1 Tahun
2014 dan Pasal 3 Peraturan Badan Pemeriksa Keuangan Nomor 2 Tahun 2010.
Namun dalam kondisi tertentu menyebabkan temuan pemeriksaan Inspektorat
Jenderal tersebut menjadi tidak dapat ditindaklanjuti, di mana kriteria dan
kewenangan untuk menetapkan temuan yang tidak dapat ditindaklanjuti adalah Unit
Pemeriksa yang bersangkutan, dalam hal ini adalah Inspektorat Jenderal Kementerian
Energi dan Sumber Daya Mineral.
Permasalahan yang dapat diungkap adalah Bagaimana suatu temuan pemeriksaan
pada Kementerian Energi dan Sumber Daya Mineral diklasifikasikan sebagai temuan
yang tidak dapat ditindaklanjuti berdasarkan Keputusan Kepala BPKP Nomor KEP-
830/K/IP/2004 dan bagaimana upaya reformasi yang dapat dilakukan agar internal
control mempunyai administrative efficacy dan penerapannya di Inspektorat Jenderal
Kementerian Energi dan Sumber Daya Mineral.
Metode Penelitian yang digunakan adalah metode penelitian yuridis normatif yang
meninjau mengenai temuan pemeriksaan yang tidak dapat ditindaklanjuti berdasarkan
Keputusan Kepala BPKP Nomor KEP-830/K/IP/2004 tentang Prosedur Baku
Pengelolaan Database Hasil Pengawasan pada BPKP. Data dalam penelitian ini akan
diolah dan dianalisa secara kualitatif dan menghasilkan data preskriptif-analisis yang
merumuskan saran bagi penyelesaian permasalahan dalam penelitian. Dalam hal ini
merumuskan saran bagaimana upaya reformasi yang dapat dilakukan agar internal
control memiliki administrative efficacy.
Lokasi penelitian di Jakarta berkedudukan di Inspektorat Jenderal Kementerian
Energi dan Sumber Daya Mineral, sebagai salah satu aparat pengawasan intern
pemerintah yang berfungsi melaksanakan pengawasan intern di lingkungan
Kementerian Energi dan Sumber Daya Mineral. Pengumpulan data yang digunakan
pada penelitian ini adalah studi dokumen dan melakukan wawancara dengan
narasumber atau informan yaitu orang yang memberikan informasi karena jabatannya
atau keahliannya.
Hasil penelitian membuktikan bahwa dalam menentukan kualitas temuan
pemeriksaan beserta tindak lanjutnya harus didasarkan pada suatu standar agar
menjadi temuan yang bermutu dan juga menghasilkan suatu tindak lanjut yang relevan agar menyelesaikan temuan pemeriksaan karena efektivitas suatu tindak
lanjut ditentukan oleh mekanisme akuntabilitas. Penetapan temuan menjadi temuan
yang tidak dapat ditindaklanjuti pun harus melalui mekanisme tertentu agar kualitas
temuan dan rekomendasi tidak menyimpang dari standar kendali mutu internal audit.
Penguatan institusi BPKP sebagai perangkat pengendalian internal akan memberikan
nilai tambah dan berguna bagi efektivitas aparat pengawasan intern pemerintah di
Indonesia. Dalam hal ini restrukturisasi dan refungsionalisasi BPKP menjadi
Kementerian merupakan salah satu upaya melaksanakan fungsi manajemen yang
akan mencapai administrative efficacy

ABSTRACT
Examination findings of the Inspectorate General of Ministry of Energy and Mineral
Resources are findings that should be actionable under the Regulation of the
Inspector General of Ministry of Energy and Mineral Resources No. 1 Year 2014 and
Article 3 of Regulation of State Audit Board (BPK) No. 2 Year 2010.
However, under certain circumstances, examination findings of the Inspectorate
General cannot be followed, because the authority and criteria to determine whether a
finding can be followed or not are in the hand of concerned Investigations Unit, in
this case is the Inspectorate General of the Ministry of Energy and Mineral
Resources.
Problems that can be revealed is how examination findings of the Ministry of Energy
and Mineral Resources are classified as non-actionable under the Decree of the Head
of Financial and Development Supervisory Agency (BPKP) No. KEP-830/K/IP/2004
and what kinds of reform efforts can be done in order to obtain administrative
efficacy of internal control and to apply them in the Inspectorate General of the
Ministry of Energy and Mineral Resources.
The research method used is the normative juridical, which reviews examination
findings that cannot be followed under the Decree of the Head of Financial and
Development Supervisory Agency (BPKP) No. KEP-830/K/IP/2004 on Standard
Procedures of Database Management of Monitoring Results on BPKP. The data in
this research will be processed and analyzed qualitatively, and will generate
prescriptive-analytic data to formulate solutions. In this case, the research will
formulate suggestions on what reform efforts can be done in order to obtain
administrative efficacy of internal control.
Research site in Jakarta located at the Inspectorate General of the Ministry of Energy
and Mineral Resources, as one of the government's internal control instruments
whose function is to implement internal control within the scope of Ministry of
Energy and Mineral Resources. Data collection conducted in the research is the
review of documents and interviews with speakers or informants ? ones who can
provide information regarding their roles or skills. The research proves that the determination of the quality of examination findings and
the proceeding actions should be based upon certain standards in order to obtain
qualified findings and to produce relevant solutions - which effectiveness is measured
by accountability mechanisms. The determination of a finding as non-actionable
should also go through certain mechanisms, so that the quality of the findings and
recommendations will not deviate from the standards of internal audits? quality
control.
The institutional strengthening of BPKP as an internal control instrument will provide
an added value and be useful to the effectiveness of the government?s internal control
instruments in Indonesia. In this case, the restructuring and refunctionalization of
BPKP into Ministry is one way to carry out the management functions that will
achieve administrative efficacy"

"Notaris merupakan pejabat umum yang diakui oleh negara Republik Indonesia sebagai pejabat satu-satunya yang berwenang untuk membuat akta otentik mengenai suatu penetapan maupun perjanjian-perjanjian. Notaris memiliki peranan yang sangat besar dalam mewujudkan adanya kepastian hukum sehingga notaris dalam menjalankan jabatannya mempunyai berbagai kewenangan khusus yang diamanatkan kepadanya, Pengaturan mengenai profesi notaris diatur dalam Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris. Salah satu kewenangan Notaris adalah membuat akta otentik yang berkaitan dengan pertanahan sebagaimana yang tercantum dalam Pasal 15 Ayat (2) huruf f. Kewenangan notaris pada pasal ini tentunya sudah diemban oleh Pejabat Pembuat Akta Tanah (PPAT). PPAT pada dasarnya merupakan pejabat yang diangkat oleh Badan Pertanahan Nasional yang bertugas khusus membantu tertib administrasi pertanahan. Pada kalangan praktisi awalnya mengharapkan adanya satu profesi saja yang berwenang untuk membuat suatu akta otentik tanpa terkecuali supaya tidak menimbulkan kerancuan hukum seperti ini sehingga ada pembahasan untuk mencabut pasal 15 Ayat (2) Huruf f. Kemudian pada awal Januari 2014, diundangkanlah perubahan atas Undang-Undang Jabatan Notaris baru Nomor 2 Tahun 2014 yang kembali memuat ketentuan Pasal ini.
Metode penulisan yang dipergunakan dalam penulisan ini adalah yuridis normatif, data yang dipergunakan adalah data sekunder, alat pengumpulan data dilakukan dengan studi kepustakaan, data yang diperoleh dianalisis dengan pendekatan kualitatif, sedangkan tipologi penelitian ini adalah deskriptif, sehingga hasil penelitian adalah deskriptif analitis. Dari hasil penelitian dapat diketahui pertimbangan hukum atas dimuatnya kembali pasal 15 ayat (2) huruf f pada perubahan undang-undang jabatan notaris, yakni pada Undang-Undang Nomor 2 Tahun 2014.

Notary is a public official who is recognized by the state of Indonesia as the only officer authorized official who can issuing an authentic deeds about stipulation and agreements. A Notary has various special powers mandated to her or him, setting the notary profession regulated in Law Number 30 Year 2004 concerning Notary. Notary is one of the authorities to make an authentic deed relating to land as stated in Article 15 Paragraph ( 2 ) f. The authority of the notary on this article must have been carried out by a Land Deed Official ( PPAT ). PPAT is basically an official appointed by the National Land Agency (BPN) in charge of special help orderly land administration. In the early practitioners of the profession expects only authorized to make an authentic act without exception so as not to cause confusion of the law so that there is discussion to repeal Article 15, Paragraph ( 2 ) Letter f. Then in early January 2014, recompile again the same article in new regulation which is refer to Law Notary No. 2 of 2014 which re-load the provisions of Article ini.
The writing method of this thesis was normative, the data which has been used are secondary data , tools of data collection done by the study literature, the data were analyzed with a qualitative approach, while the typology of this research is descriptive, so the result is a descriptive analytical study. From the results of this research is the legal considerations for publishing back Article 15 paragraph ( 2 ) f of the change in the law office of notary public, namely the Law No. 2 of 2014.

"SKK MIGAS yang merupakan perubahan dari organisasi BPMigas setelah diputus oleh Mahkamah Konstitusi dengan Putusan Nomor 36/PUU-X/2012 dan melalui Peraturan Presiden Nomor 9 Tahun 2013 lahirlah organisasi SKK Migas. SKK Migas sebagai penyelenggara pengelolaan Kegiatan Usaha Hulu Migas mempunyai peran yang sangat penting. Salah satu peran tersebut adalah dalam hal kaitannya dengan pengawasan / pemeriksaan pengajuan biaya operasi yang dapat dikembalikan (cost recovery) yang diajukan oleh Kontraktor Kerja Sama (KKKS) Migas. Yang menjadi permasalahan adalah bagaimana konsep kewenangan dalam penghitungan cost recovery Migas? Serta bagaimana mekanisme pengawasan tentang Besaran cost recovery yang diajukan KKKS. Bentuk penelitian ini adalah yuridis normatif dengan jenis data yang digunakan adalah data sekunder. Kesimpulannya adalah penghitungan cost recovery yang diajukan oleh KKKS harus mendapat persetujuan dari Kepala SKK Migas yang sebelumnya dilakukan analisa dan evaluasi oleh Divisi Pemeriksaan Biaya Operasi Deputi Pengendalian Keuangan. Mekanisme pengawasannya dengan dilakukan Audit pada tahap perencanaan, pelaksanaan dan pada tahap akhir.

SKK MIGAS Organization which is a change from BP Migas organization after being shutdown by the Constitutional Court Decision No. 36/PUU-X/2012 and through Presidential Decree No. 9 of 2013 was born SKK MIGAS organization. SKK MIGAS was organize Oil and Gas Upstream management has a very important role. One such role is to supervision / examination / audit operating costs can be refunded ( cost recovery ) to the government filed by the Cooperation Contract ( PSC ) of oil and gas. The problem is how the concept of authority in the calculation of the cost recovery? And how the monitoring mechanism of the magnitude of the proposed PSC cost recovery. This research is used normative juridical with the type of data used is secondary data. The conclusion is counting the cost recovery filed by the PSC to approval of the Head of SKK MIGAS previously performed analysis and evaluated by Operation Cost Audit Division Deputy of Financial Management. Audit mechanism to be done at the planning (preaudit), implementation (current audit) and at the final stage (post audit).

Tesis ini membahas mengenai perlindungan terhadap pembayaran upah buruh dan pemenuhan hak-hak buruh yang timbul akibat PHK pada perusahaan yang dinyatakan pailit berdasarkan undang-undang kepailitan dan ketenagakerjaan, dengan studi kasus kepailitan PT Fit U Garment Industry. Penelitian ini menguraikan mengenai buruh sebagai salah satu kreditor dari debitor pailit yang harus bersanding dengan kreditor-kreditor lainnya dalam mendapatkan pembayaran upah buruh dan hak-hak buruh lainnya dari harta pailit. Penelitian ini bertujuan untuk menjawab permasalahan sebagai berikut; pertama, Bagaimana kedudukan tagihan upah buruh dan hak-hak buruh lainnya dalam urutan prioritas pembayaran utang. Kedua, Bagaimana upaya yang dapat dilakukan oleh buruh terhadap putusan kepailitan untuk mendapatkan hak-hak buruh yang diatur dalam peraturan perundang-undangan yang berlaku. Dan terakhir, bagaimana pembayaran upah buruh dan pemenuhan hak-hak yang timbul akibat PHK pada kasus kepailitan PT Fit-U Garment Industry.

ABSTRACT
This thesis discusses the protection of workers' wage payment and fulfillment of labor rights arising from layoffs at the company declared bankrupt under the laws of bankruptcy and employment, with the bankruptcy case studies PT Fit U Garment Industry. This study describes about the workers as one of the creditors of the bankruptcy debtor must be coupled with other creditors in obtaining payment of wages and other labor rights of the bankruptcy estate. This study aims to answer the question as follows; first, how the position of wage bills and other labor rights in order of priority debt payments. Second, how efforts to be made by the workers against the decision of the bankruptcy to obtain labor rights set out in the legislation in force. And lastly, how payment of wages and fulfillment of the rights arising from layoffs in the case of bankruptcy PT Fit-U Garment Industry."

Permasalahan yang akan diteliti mengenai prosedur dan tanggung jawab dokter dalam melaksanakan cito seksio sesarea dan menganalisis putusan No.90/PID.B/2011/PN.MDO, putusan No.365 K/Pid/2012 dan Putusan 79PK/PID/2013.
Tujuan dari penelitian ialah memahami prosedur dan tanggung jawab dokter dalam melaksanakan tindakan cito seksio sesarea, dan menganilisis putusan. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus.
Berdasarkan hasil penelitian, dapat disimpulkan bahwa dokter yang sesuai dengan Standard Operating Procedure, dalam melaksanakan profesinya maka berhak memperoleh perlindungan hukum berdasarkan UU No. 36 Tahun 2009 Tentang Kesehatan dan UU No. 29 Tahun 2004 Tentang Praktik Kedokteran.

This thesis discusses the legal protection for doctors in performing cito Seksio Caesarea. Issues that will be examined on the procedure and the doctor's responsibility in implementing cito cesarean section and analyze the decision 90/Pid.B/2011/PN.MDO, 365 K/Pid/2012 and 79PK/PID/2013.
The purpose of the research is to understand the procedure and the doctor's responsibility in implementing the action cito cesarean section, and analyze the decision. This research is a normative juridical approach to legislation and case approach.
Based on the results, it can be concluded that the doctor is in accordance with Standard Operating Procedure, in carrying out his profession, the right to obtain legal protection under Law No. 36 of 2009 on Health and Law No. 29 of 2004 on Medical Practices.

"Tesis ini membahas mengenai konsep dan kedudukan Trust dalam sistem hukum Common Law dan Civil Law, serta kedudukan Trustee sebagai Pihak yang Mengajukan Permohonan Penundaan Kewajiban Pembayaran Utang (PKPU). Penelitian ini merupakan suatu penelitian yang berbentuk yuridis normatif yang bersifat deskriptif analisis. Hasil penelitian dalam penulisan ini yaitu konsep Trust adalah pranata yang unik dalam sistem hukum Common Law karena keberadaannya yang mengenal kepemilikan ganda (dual ownership) yaitu legal ownership dan beneficiary ownership, dimana pranata tersebut tumbuh dan berkembang di Inggris dan negara Commonwealth lainnya. Meskipun awalnya konsepTrust dan equity merupakan kebiasaan yang berlaku di masyarakat, saat ini telah ada undang-undang yang secara khusus mengatur mengenai Trust yaitu: Trustee Act 1925, Trustee Investments Act 1961, Recognition of Trusts Act 1987, Financial Services and Markets Act 2000, Trustee Act 2000. Lain halnya dengan di negara Civil Law yang tidak mengenal sistema kepemilikan ganda. Seperti di Indonesia, meskipun pranata mirip Trust telah dikenal dalam bidang hukum bisnis, seperti likuidator dalam kepailitan, wali amant dalam pasar modal, dan direksi perseroan dalam hukum perusahaan, akan tetapi belum ada undang-undang yang khusus mengatur mengenai Trust. Kedudukan Bank Trustee dalam mengajukan Permohonan Penundaan kewajiban Pembayaran Utang (PKPU) adalah sama dengan pemohon lainnya yaitu orang atau badan hukum, sepanjang syarat pendirian kegiatan usahanya sesuai dengan Peraturan Bank Indonesia No. 14/17/PBI/2012, tentang kegiatan usaha bank berupa penitipan dengan pengelolaan (Trust). Hasil penelitan menyarankan perlunya pemerintah membuat regulasi yang dapat menjamin kepastian dan kemudahan berinvestasi, termasuk membuat Undang-undang yang secara khusus mengatur tentang Trust, bukan hanya di bidang perbankan, tetapi juga di bidang lainnya.

This thesis focuses on discussing the concept and the position of Trust in the legal system of Common Law and Civil Law, and also the position of the Trustee as the parties applying for Suspension of Payment (PKPU). This research is a study in the normative form of juridical normative with descriptive analysis. The results of this research shows that the concept of the Trust is a unique institution in the legal system of Common Law because of its existence which can acknowledge about dual ownership, which are legal ownership and beneficiary ownership, where such institutions grow and thrive in England and other Commonwealth countries. Although the concept of trust and equity was initially the habit of society, there have been legislations specifically governing the Trust today, namely: Trustee Act 1925, the Trustee Investments Act 1961, Recognition of Trusts Act 1987, the Financial Services and Markets Act 2000, Trustee Act 2000. It is different from the Civil Law country which does not acknowledge the dual ownership system. As in Indonesia, although institutions similar to Trust have been known in the area of business law, liquidator in bankruptcy, trustee in the capital markets, and the directors of the company in corporate law, but there is no specific legislation which govern about the Trust. The position of the Bank Trustee in applying for Suspension of Payment (PKPU) is the same as the other applicants which are the person or legal entities, as long as the requirement of the establishment of business activities based on regulation Bank Indonesia Number 14/17/PBI/2012, about the bank's business activities in the form of deposit with certain management (Trust). The researcher suggests that government needs to make regulations to ensure the certainty and the ease of investing, including making regulations specifically regulating the Trust, not only in banking, but also in other sectors.

"Irtidad seringkali dipandang sebagai masalah yang sensitif yang tabu untuk dibicarakan. Pasalnya, berbicara tentang irtidad berarti mengkaji satu permasalahan dari dua sisi kacamata yang berbeda. Bagi kaum sekular, irtidad merupakan HAM dan kebebasan beragama, sedangkan dalam hukum Islam irtidad merupakan sebuah kejahatan. Hal ini dikarenakan adanya perbedaan prinsip antara keduanya. Sekuiarisme memisahkan kehidupan temporal dengan kehidupan spiritual yang mengsekte-sektekan berbagai bidang kehidupan dan berorientasi hanya pada dunia semata, sedangkan Islam merupakan a way of life yang komprehensif dan berorientasi tidak hanya pada dunia tetapi juga akhirat. Untuk mengkaji hukum dan implementasi sanksi terhadap pelaku irtidad, dilakukan analisis dengan metode yuridis formal dengan faktor-faktor penelitian yang meliputi ayat-ayat Qur'an, Hadits, pendapat para ulama dan sarjana Islam, peraturan perundang-undangan, dan kondisi pemurtadan dalam masyarakat. Dari hasil analisis tersebut, diperoleh hasil bahwa tidak ada kontradiksi antara ayat-ayat Qur'an, Hadits, dan pendapat para ulama dan sarjana Islam tentang hukum irtidad, dan bahwa implementasi sanksi terhadap pelaku irtidad dan pelaku pemurtadan diterapkan dengan mempertimbangkan ancaman bahaya yang ditimbulkan."

"[ABSTRAK
Penulisan skripsi ini dilatarbelakangi oleh belum adanya payung hukum terhadap protokol manajemen krisis untuk mencegah dan menangani krisis perbankan yang terjadi di Indonesia. Krisis perbankan tersebut berdampak bukan hanya bagi kegiatan perekonomian negara, melainkan bagi keadaan politik yang begitu luas. Dalam penulisannya, metode yang digunakan adalah yuridis normatif, yaitu metode yang dilakukan dengan meneliti bahan pustaka atau data sekunder.
Tesis ini menyoroti sejarah krisis perbankan yang melanda Indonesia dan Inggris dan bagaimana mekanisme dan aplikasi Jaring Pengaman Sistem Keuangan yang ada pada masing-masing negara tersebut. Adapun pertimbangan yang melatarbelakangi penulis untuk mengakat tema ini adalah, kedua negara tersebut sama-sama terkena imbas krisis subprime mortgage dari US pada tahun 2008 dan keduanya sama-sama mengalami krisis perbankan akibat satu bank kecil yang berdampak sistemik. ABSTRACT
The writing of this thesis motivated by the absence of legal protection against the crisis management protocol to prevent and deal with the banking crisis that occurred in Indonesia. The banking crisis has an impact not only for the economic activities of the country, but also for a broad political circumstances. Method used in this writing is juridical-normative writing, which is done by examining material library or a mere secondary data.
This thesis highlights the history of banking crisis that hit Indonesia and the UK and how the mechanism and application of the Financial System Safety Net that exist in each of these countries. As for the considerations underlying the author, to the theme of this is that these two countries are equally affected by the subprime mortgage crisis on the US in 2008 and both are experiencing a banking crisis as a result of a small bank with systemic impact. However, this time the UK already has a law that regulates the coordination between agencies / authorities in preventing crises and maintaining financial system stability country
