ABSTRAKPengelolaan dana haji melalui investasi pada sektor infrastruktur merupakan solusi Pemerintah untuk mengembangkan dana haji yang terkumpul. Keseriusan Pemerintah saat ini telah terlihat dengan dibentuknya Badan Pengelola Keuangan Haji BPKH yang bertugas untuk mengelola dana haji. Permasalahan yang menjadi bahasan utama dalam penelitian ini adalah bagaimana pengelolaan dana haji melalui investasi pada sektor infrastruktur menurut UU No. 34 Tahun 2014 UUPKH dan hukum Islam. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dengan objek penelitian utama pada data sekunder. UUPKH melalui Pasal 48 membuka kemungkinan untuk mengelola dana haji melalui investasi pada sektor infrastruktur. Berdasarkan hukum Islam, kebolehan investasi dana haji pada sektor infrastruktur, dimungkinkan berdasarkan metode ijtihad maslahah mursalah. Alasannya, melalui investasi tersebut dapat meningkatkan kualitas penyelenggaraan ibadah haji, rasionalitas dan efisiensi biaya penyelenggaraan ibadah haji, dan manfaat bagi kemaslahatan umat Islam. Saran dalam penelitian ini, yaitu kepada Pemerintah, secepatnya menerbitkan peraturan pelaksana dari UU No. 34 Tahun 2014, seperti Peraturan Pemerintah yang belum juga selesai dibuat, sedangkan kepada BPKH, harus ada informasi yang transparan mengenai penyaluran dana yang dilakukan oleh BPKH.
ABSTRACTManagement of haj funds through investments in the infrastructure sector is a solution from the Government to develop the haj fund collected. The seriousness of the Government is now visible with the establishment of the haj Financial Management Board tasked with managing the haj funds. The main problem in this research is how the management of haj funds through investment in infrastructure sector when viewed from Law No. 34 of 2014 and Islamic law. Research method used in this research is normative juridical with the main research object on secondary data. UUPKH through Article 48 opens the possibility to manage the haj funds through investments in the infrastructure sector. Under Islamic law, the permissibility of investing Haj funds in the infrastructure sector, is possible based on the method of ijtihad maslahah mursalah. The reason, through these investments can improve the quality of hajj pilgrimage, rationality and cost efficiency of Hajj pilgrimage, and benefits for the benefit of Muslims. Suggestions in this research, namely to the Government, immediately issue the implementing regulations of Law No. 34 Year 2014, such as Government Regulations that have not yet been made, whereas to the BPKH, there should be transparent information about the channeling of funds made by BPKH. "
