"Skripsi ini akan membahas mengenai prinsip check and balances dalam penerbitan Surat Pemberitahuan Dimulainya Penyidikan (SPDP) dengan mengaitkan kepada Sistem Peradilan Pidana Terpadu. Skripsi ini akan menjawab dua pertanyaan penelitian mengenai bagaimana peran penuntut umum dalam penyidikan setelah diberikannya Surat Pemberitahuan Dimulainya Penyidikan (SPDP) bila ditinjau dengan prinsip check and balances, sehingga dapat menjawab pertanyaan mengenai apakah dibutuhkan keterlibatan aktif penuntut umum pada penyidikan. Skripsi ini disusun dengan metode penelitian doktrinal. Skripsi ini akan menganalisis kasus yang timbul akibat kesalahan penerapan hukum oleh penyidik pada tahap penyidikan yang seharusnya dapat diatasi apabila terdapat penerapan prinsip check and balances yang baik antara penuntut umum dan penyidik. Penuntut umum sebagai pihak yang berwenang untuk melakukan penuntutan, memiliki kewajiban untuk berkoordinasi dengan penyidik dengan tujuan untuk menyiapkan seluruh data dan fakta yang diperlukan untuk kepentingan penuntutan. Koordinasi tersebut direalisasikan dengan peran penuntut umum untuk melakukan prapenuntutan setelah diterimanya Surat Pemberitahuan Dimulainya Penyidikan dari penyidik. Setelah dilakukan analisis, diketahui bahwa keterlibatan aktif penuntut umum dapat mencegah adanya kesalahan penerapan hukum dalam tahap penyidikan. Seringkali penyidik tidak memberikan Surat Pemberitahuan Dimulainya Penyidikan (SPDP) sehingga menyulitkan penuntut umum untuk memulai proses penuntutan. Dengan terdapat kekurangan maupun permasalahan dalam penerapan check and balances antara penuntut umum dan penyidik dapat berakibat pada tahapan penyidikan yang tidak sempurna sehingga dapat merugikan hak seseorang yang tidak bersalah.

This thesis will discuss the principles of checks and balances in the issuance of Surat Pemberitahuan Dimulainya Penyidikan (SPDP) by linking it to the Integrated Criminal Justice System. The thesis will address two research questions regarding the role of public prosecutors in the investigation after the issuance of Surat Pemberitahuan Dimulainya Penyidikan (SPDP) when viewed through the principles of checks and balances. This aims to answer the question of whether active involvement of public prosecutors in the investigation is necessary. The thesis is conducted using a doctrinal research method. It will analyze cases that arise due to legal application errors by investigators during the investigative stage, which should be overcome if there is a good application of the principles of checks and balances between public prosecutors and investigators. Public prosecutors, as the authorized party for prosecution, have the obligation to coordinate with investigators to prepare all necessary data and facts for the purpose of prosecution. This coordination is realized through the role of public prosecutors in conducting pre-prosecution after receiving Surat Pemberitahuan Dimulainya Penyidikan from the investigators. After the analysis, it is found that active involvement of public prosecutors can prevent legal application errors during the investigative stage. Often, investigators do not provide Surat Pemberitahuan Dimulainya Penyidikan (SPDP), making it difficult for public prosecutors to initiate the prosecution process. The deficiencies and issues in the application of checks and balances between public prosecutors and investigators can result in an imperfect investigative stage, thus harming the rights of innocent individuals."
