"Tesis ini membahas mengenai bagaimana perlindungan terhadap hak-hak konsumen dalam perkembangan Financial Technology (Fintech), khsusnya dalam sektor pembayaran dan sektor pinjaman (P2P Lending) yang terjadi di Indonesia. Dalam Fintech, perlindungan terhadap hak-hak konsumen didasarkan pada 4 (empat) aspek utama perlindungan konsumen dalam sektor jasa keuangan yang meliputi, kelengkapan informasi dan transparansi atau layanan; pencegahan penipuan dan keandalan sistem layanan; perlindungan terhadap data pribadi (cybersecurity); dan penanganan pengaduan dan penyelesaian sengketa konsumen. Terkait dengan hal tersebut, maka BI dan OJK selaku otoritas di sektor keuangan beserta Kementerian Komunikasi dan Informatika selaku penyelenggara urusan pemerintah di bidang komunikasi dan informasi, telah mengatur upaya perlindungan konsumen pada Fintech menjadi suatu kewajiban dan tanggung jawab bagi penyelenggara Fintech menjadi suatu kewajiban dan tanggung jawab bagi penyelenggara Fintech selaku pelaku usaha.

This thesis discussed how to protect consumer rights in the development of Financial Technology (Fintech), especially in the payment sector and the lending sector (P2P Lending) that occurred in Indonesia.  In Fintech, the protection of consumer rights is based on 4 (four) main aspects of consumer protection in the financial services sector which includes, completeness of information and transparency or services;  The prevention of fraud and the reliability of the system of services;  protection against private data (cybersecurity);  and complaints and settlement of consumer disputes.  Related to this, BI and OJK as the authority in the financial sector along with the Ministry of Communications and Information Technology as the government authorized in the field of communication and information, have arranged efforts to protect consumers in Fintech as an obligation and responsibility for Fintech operators as business actors."

"This book describes two different museums using construction technology as the common language that brings architecture and engineering together. The first is the Museum of the Ibere Camargo Foundation at Porto Alegre, Rio Grande do Sul, Brazil, by Álvaro Siza and GOP, and the second is the Coach Museum at Lisbon in Portugal, by Paulo Mendes da Rocha and AFAconsult. Both projects put special emphasis on the design process as a construction language, achieved by a close collaboration promoted by the integrated design methodology that both teams follow. Besides its importance from an architectural and urban point of view, these two buildings suggest interesting topics that are present in current building research such as sustainability, the construction of façades with a heavy use of unrendered white concrete and the integration of all the technical infrastructure needed to build a successful high-tech museum. "

Pesatnya perkembangan teknologi informasi telah membawa perubahan yang signifikan dalam berbagai aspek kehidupan manusia. Aspek-aspek tersebut mencakup aspek finansial juga, sehingga melahirkan financial technology. Karena basis teknologi finansial adalah teknologi informasi, maka penggunaan data dan informasi menjadi elemen utama industri. Untuk memaksimalkan potensinya, praktik financial technology membutuhkan penggunaan data pribadi milik pengguna produk/jasa. Mengingat sifat khusus dari data pribadi, perlindungannya harus ditegakkan secara ketat. Tidak adanya regulasi yang seragam mengenai perlindungan data pribadi dapat menimbulkan kekacauan di industri, ditandai dengan maraknya pelanggaran yang dilakukan oleh pihak terkait. Berkaitan dengan hal tersebut, tesis ini membahas tentang konsep perlindungan data pribadi, privasi, serta tanggung jawab dan kewajiban masing-masing pihak dalam industri financial technology, khususnya mengenai layanan pinjam meminjam uang berbasis teknologi (peer-to-peer lending). Berdasarkan penelitian yang komprehensif, ditemukan bahwa pengaturan perlindungan data pribadi oleh produk legislatif sektoral masih sangat minim dibandingkan dengan yurisdiksi lain bahkan peraturan nasional. Akibat pengaturan perlindungan yang tidak memadai, masyarakat dirugikan. Oleh karena itu, Indonesia diharapkan meningkatkan pendekatan hukumnya untuk melindungi kepentingan publik.
ABSTRACT
The rapid development of information technology has brought significant changes in various aspects of human life. These aspects include financial aspects as well, thus giving birth to financial technology. Because the basis of financial technology is information technology, the use of data and information is the main element of the industry. To maximize its potential, the practice of financial technology requires the use of personal data belonging to product/service users. Given the special nature of personal data, its protection must be strictly enforced. The absence of uniform regulations regarding the protection of personal data can lead to chaos in the industry, marked by rampant violations committed by related parties. In this regard, this thesis discusses the concept of personal data protection, privacy, as well as the responsibilities and obligations of each party in the financial technology industry, especially regarding technology-based lending and borrowing services (peer-to-peer lending). Based on comprehensive research, it was found that the regulation of personal data protection by sectoral legislative products is still very minimal compared to other jurisdictions and even national regulations. As a result of inadequate protection arrangements, the community is harmed. Therefore, Indonesia is expected to improve its legal approach to protect the public interest."

Penggunaan layanan keuangan berbasis teknologi muncul atas dampak dari perkembangan teknologi. Layanan keuangan jenis baru ini bertujuan untuk meningkatkan inklusi keuangan masyarakat. Salah satu jenis layanan tersebut yang saat ini dikenal ialah aplikasi Go-Pay. Keberadaan Go-Pay sendiri bertujuan untuk memudahkan masyarakat menggunakan berbagai layanan jasa yang terdapat dalam aplikasi Go-Jek. Go-Pay memudahkan para konsumen melakukan transaksi karena menggunakan sistem digital. Karena itulah maka penulis hendak mengkaji bagaimana perlindungan hukum terhadap nasabah Go-Pay di Indonesia.

ABSTRACT
The use of technology based financial services arises from the impact of technological developments. This new type of financial service aims to improve the inclusion of public finances. One type of service that is currently known is the application Go Pay. The existence of Go Pay itself aims to facilitate the public using various services contained in the application of Go Jek. Go Pay makes it easy for consumers to make transactions because it uses a digital system. Therefore, the authors want to examine how the legal protection of Go Pay customers in Indonesia.
