"General election of Chiefs and Vice Chiefs of districts, directly made by citizens who had the right to elect, has been carried out n 2005, and 2010 is the period of the end of their commission. Because the services executed by those Chiefs and Vice Chiefs of districts elected in 2005 went on for five years, so now, it is time to make evaluation on that general election. This paper tries to analyze several aspects of general election of chiefs and vice chiefs of districts, specially the uncertainty of law and the problem of implementation of general election of chiefs and vice chiefs of districts which embrace: Contradiction between one stipulation with another stipulation, vacuum of law, i.e. some matters are not regulated, some stipulations have multi-interpretation, and various stipulations are hard to be implemented."

"Penelitian ini berangkat dari adanya perbedaan kebijakan yang diterapkan di dalam pelaksanaan pemerintahan daerah yang bersifat Istimewa. Keistimewaan DIY diamanatkan dalam UUD 1945 Pasal 18B. Kewenangan Daerah Istimewa Yogyakarta diatur dalam Undang-Undang No. 13 Tahun 2012 dan dalam bidang pertanahan secara lengkap diatur dalam Peraturan Daerah Istimewa Yogyakarta No. 1 Tahun 2017 Tentang Pengelolaan dan Pemanfaatan Tanah Kasultanan dan Tanah Kadipaten di Yogyakarta. Rumusan permasalahan penelitian ini, Bagaimana kewenangan DIY berdasarkan Undang-Undang No. 13 Tahun 2012 Tentang Keistimewaan DIY, bagaimana peran pemerintah dalam urusan pengelolaan dan pemanfaatan tanah dan bagaimana hubungan pengelolaan dan pemanfaatan tanah terhadap tanah yang memiliki sertifikat hak milik. Tujuannya adalah menganalisis bagaimana kewenangan, peran pemerintah dan hubungan pengelolaan dan pemanfaatan tanah dengan tanah yang memiliki sertifikat. Metodologi yang digunakan adalah studi normatif dengan model deskriptif analitis. Hasil yang diperoleh adalah bahwa terdapat pendelegasian peraturan yang berasal dari undang-undang kepada peraturan dibawahnya yang dalam pendelegasian peraturan tersebut melekat pula kewenangan pemerintah daerah yang bersifat atribusi untuk merumuskan peraturan-peraturan dibawahnya dengan mengacu pada peraturan perundang-undangan diatasnya. Peran pemerintah daerah telah diatur dalam Peraturan Gubernur No. 33 Tahun 2017 dan terdapat beberapa perbedaan dengan peran daerah lainnya. Terkait dengan tanah yang memiliki sertifikat, Peraturan Daerah Istimewa No. 1 Tahun 2017 tidak mengatur karena peraturan tersebut hanya mengatur mengenai pengelolaan dan pemanfaatan tanah saja.

This study departs from the existence of differences in policies that are applied in the implementation of special regional administrations. DIY features mandated in the 1945 Constitution Article 18B. The authority of the Special Region of Yogyakarta is regulated in Law No. 13 of 2012 and in the field of land completely regulated in the Special Region Regulation of Yogyakarta No. 1 of 2017 concerning Management and Utilization of the Sultanate and Duchy Land in Yogyakarta.

Formulation of the problem of this research, How is the authority of DIY based on Law No. 13 of 2012 concerning the Privileges of DIY, what is the role of the government in matters of management and utilization of land and how is the relationship between management and utilization of land to land that has a certificate of ownership. The aim is to analyze how the authority, the role of government and the relationship of management and use of land with land that has a certificate. The methodology used is normative study with analytical descriptive model.

The results obtained are that there is a delegation of regulations originating from the law to the rules below which in the delegation of these regulations also attaches the authority of the regional government that has the character of attribution to formulate the rules below by referring to the laws and regulations above. The role of the regional government has been regulated in Governor Regulation No. 33 of 2017 and there are some differences with other regional roles. Regarding land that has a certificate, Special District Regulation No. 1 of 2017 does not regulate because the regulation only regulates land management and utilization."

"Penelitian ini bertujuan untuk membangun model prediksi senjangan anggaran, mendapatkan bukti empiris mengenai faktor-faktor apa yang mempengaruhi probilitas terjadinya senjangan anggaran, dan menggunakan model prediksi senjangan anggaran tersebut untuk pengujian model hipotesis. Model hipotesis yang diuji dalam penelitian ini adalah determinan potensi senjangan anggaran dan pengaruh potensi senjangan anggara terhadap kinerja pemerintah baik secara langsung maupun melalui sistem akuntabilitas, serta apakah perubahan anggaran mempengaruhi kinerja pemerintah baik secara langsung maupun tidak langsung melalui potensi senjangan anggaran atau melalui potensi senjangan anggaran dan system akuntabilitas. Unit analisis penelitian ini adalah Pemerintah Kabupaten/Kota di Indonesia yang memiliki data lengkap dengan tahun pengamatan 2008-2012. Hasil penelitian menunjukkan bahwa model prediksi senjangan anggaran fit secara statistic dan dapat digunakan sebagai model untuk memprediksi senjangan anggaran pemerintah, meskipun variable asset quality tidak terbukti berpengaruh secara signifikan terhadap probabilitas terjadinya senjangan anggaran. Model prediksi senjangan anggaran digunakan sebagai ukuran senjangan anggaran di dalam model pengujian hipotesis, dimana ukuran tersebut menggambarkan besarnya potensi senjangan anggaran. Model prediksi tersebut juga digunakan untuk memilah pemda mana yang terdapat indikasi melakukan senjangan anggaran dan yang tidak. Di dalam model pengujian hipotesis, hanya pemda yang terindikasi melakukan senjangan anggaran yang diuji. Peran Kepala Daerah di Dalam Senjangan Anggaran, Kualitas Auditor Intern, dan Tekanan Akuntabilitas terbukti menjadi faktorfaktor yang mempengaruhi terjadinya senjangan anggaran. Senjangan anggaran terbukti berpengaruh negative terhadap kinerja penyelenggaraan pemerintah baik secara langsung maupun melalui sistem akuntabilitas. Perubahan anggaran terbukti berpengaruh positif terhadap kinerja pemerintah secara langsung. Pengaruh perubahan anggaran terhadap kinerja pemerintah melalui senjangan anggaran maupun melalui senjangan anggaran dan system akuntabilitas terbukti berpengaruh positif dan signifikan. Hasil ini menunjukkan pentingnya meminimalisir senjangan anggaran dengan mengimplementasikan anggaran berbasis kinerja (ABK) dengan benar sehingga akan meningkatkan keandalan sistem akuntabilitas pemda dan berdampak terhadap tingginya kinerja penyelenggaraan pemerintahnya. Perubahan anggaran yang lebih realistis dan didukung informasi kinerja dan keuangan terkini sangat penting untuk menekan senjangan anggaran dan meningkatkan kinerja pemerintah.

These research objectives are to build a predictive model of budgetary slack, obtain an empirical evidence of factors that affect the probability of budgetary slack occurence, and utilize the predictive model for hypothesis testing. Hypothesis that tested in this study are: potential budgetary slack determinants and the effect of potential budgetary slack to government performance, either directly or through accountability system, as well as to examine the effect of budget revisions to government performance, either directly or indirectly through potential budgetary slack or through potential budgetary slack and accountability system. Sample units of this study is the county/city governments in Indonesia, which has complete observed data for the period of 2008 to 2012.

The results showed that the model is statistically fit and can be used to predict government budgetary slack, though quality asset variable is not proven significantly affect probability of budgetary slack occurence. Predictive model of budgetary slack is used to measure budgetary slack in hypothesis testing model, which portray the magnitude of budgetary slack. The model is used to sort out local government which have a budgetary slack indication. In hypothesis testing, only local government that have budgetary slack that will be tested. Role of Regional Head in conducting budgetary slack, Internal Auditor Quality and Accountability Pressure are proved to be the factors that influence the occurrence of budgetary slack. Budgetary slack proved to have negative impact on government performance both partially and through accountability system. Budget revisions also proved to have positive impact on government performancedirectly. The effect of budget revisions to government performance through budgetary slack and through budgetary slack and accountability system is proved to be significantly positive.

This result shows the importance of minimizing the budgetary slack by implementing performancebased budgeting correctly so that it will enhance the reliability of local government accountability system and improve government performance. More realistic budget revisions which supported by an updated financial and performance information are very important to suppress the budgetary slack and improve government performance."
